tickets—instead, we merely facilitate transactions between ticket buyers and ticket sellers. Mr. [redacted] has stated that he was not informed that his tickets were Standing Room Only until after he placed his order; this should be noted as inaccurate. When Mr. [redacted] viewed tickets for the Metropolitan Opera – La Traviata, he selected a listing in “Section: Orchestra Row: SRO Note: Standing Room Only.” After selecting this listing, Mr. [redacted] was directed to the Checkout page. This page provided an order summary which again disclosed “Section Orchestra Row: SRO Notes: Standing Room Only.” Once Mr. [redacted] selected a delivery method, his new order total was calculated and presented in this order summary. Mr. [redacted] was required to agree to our terms and conditions—visible in a text box—and presented with the message in bold “All sales are final.” At this point, Mr. [redacted] was also presented with the message “I agree to the sales terms and conditions listed above,” and a check box that needed to be selected in order to continue with checkout.As a secondary marketplace, Ticket Offices is not affiliated with any artist or venue and does not generate tickets as a primary box office; rather, we act as an intermediary between fans and ticket holders. Since customers are purchasing tickets owned and listed by individual resellers, we must ensure that our policies are fair to both parties. This means that we are unable to offer refunds or exchanges and must adhere to an “all sales are final” policy—a standard throughout the industry.Before receiving this claim, we were in contact with Mr. [redacted] to address these concerns and provide clarification. As we have thoroughly addressed his concerns and Mr. [redacted] tickets were clearly marked as standing room only prior to placing his order, we consider this matter closed. To this end, we are committed to providing the best possible customer service—and maintaining a simple purchase process.Ms. [redacted] has stated that she was unaware she was purchasing tickets through a secondary market, though we would like to clarify. It should be noted that our customer’s order was placed with a sales agent via telephone, and that all necessary event and pricing information was relayed to Ms. [redacted] at the time of purchase. All sales agents are required to list our terms and conditions, which clarify that we are not affiliated with any venue and that prices may be sold above face value.Ms. [redacted] has also expressed dissatisfaction with the seats she was provided for her event. It should be noted that within the duration of this phone call, the sales agent discussed several seating arrangements with the customer that were tailored to her preferences. Ms. [redacted] selected two seats in Section: Upper Level [redacted]. The sales agent repeated the seating selection to the customer and described in detail the seats’ location, to which Ms. [redacted] verbally stated her acceptance for. Additionally, the sales agent reiterated our “all sales are final” policy to the customer.Ms. [redacted] successfully placed her order on 4/24/2017 and received her valid tickets immediately the same day for her to print and bring to her event that is scheduled to take place on 5/19/2017. In addition to this current claim, Ms. [redacted] was in contact with two customer service agents and all of her concerns were adequately addressed at that time. As Ms. [redacted] received tickets for the exact section and row she placed her order for, we consider this matter closed. This page displays the listings which sellers have available on our site stating the location, quantity, and price per ticket. Once Ms. [redacted] selected the listing she was interested in, they are directed to the checkout page. Here customers are provided with an order summary that displays the event details, ticket location, and price per ticket. Our customer was prompted to provide an email address and select a delivery method. After a delivery method is selected, since methods vary in price, a new order total is calculated. A complete itemized breakdown of our customer’s order including the price per ticket, all fees, and the total price of $5,450.75 was displayed in bold text on the left-hand side of the page. This information was fully disclosed before Ms. [redacted] was asked to enter any payment information. Customers are then presented with our terms and conditions, including a bold message which clarifies, “All sales are final. All prices are listed in US Dollars (USD).” Ms. [redacted] was required to select a check box signifying their agreement to these terms. Customers are then prompted to select the "Review Order" button below these terms. Once selected, customers are taken to a review page which displayed their payment information, order summary and provided an additional itemized cost breakdown of their order. Our customer then proceeded to select "Confirm & Place Order" at which time their order was processed.Due to the nature of our business on the secondary marketplace, Ticket Offices is not affiliated with any artist or venue and do not own inventory; instead, we act as an intermediary between customers and sellers. As such, prior to receiving this claim, we reached out to Ms. [redacted] via email regarding the dispute which was filed against our company. Here, customers are provided with an order summary that displays the event details, ticket location, and price per ticket. Although our customer has indicated that they were not notified that the listing was Zone Seating until after purchase, this was initially disclosed on the ticket listing page and reiterated on the checkout page. This information clarifies that for Zone Seating listings, customers will receive tickets within the listed section. Our customer was prompted to provide an email address and select a delivery method. A complete itemized breakdown of our customer’s order including the price per ticket, all fees, and the total price of $424.91 was displayed in bold text. This information was fully disclosed before our customers are asked to enter any payment information. Below this order summary, our customers are presented with the message stating, “Please note: We are an independent resale marketplace. Ticket prices may exceed face value.” Customers are then presented with our terms and conditions, including a bold message which clarifies, “All sales are final. All prices are listed in US Dollars (USD).” Our customer was required to select a check box signifying their agreement to these terms stating, “I agree to the sales terms and conditions listed above and acknowledge that this site is a resale marketplace. I agree to and accept the refund policy.” Customers are then prompted to select the "Review Order" button below these terms. Once selected, customers are taken to a review page which displayed their payment information, order summary and provided an additional itemized cost breakdown of their order. Our customer then proceeded to select "Confirm & Place Order", at which time their order was processed.Due to the nature of our business on the secondary marketplace, Ticket Offices is not affiliated with any artist or venue and does not own inventory; instead, we act as an intermediary between customers and sellers. Directly below this selection, our customer was displayed the message, “The seller has provided an expected in-hand date of 12/01/2017 for these tickets,” with the date in red text to sufficiently notify our customer. A complete itemized breakdown of our customer’s order including the price per ticket, all fees, and the total price of $197.87 was displayed in bold text on the left-hand side of the page. This information was fully disclosed before our customers are asked to enter any payment information. Customers are then presented with our terms and conditions, including a bold message which clarifies, “All sales are final. All prices are listed in US Dollars (USD).” Our customer was required to select a check box signifying their agreement to these terms; no order can be placed without the customer having done this. Below this order summary, our customers are presented with the message stating, “Please note: We are an independent resale marketplace. Ticket prices may exceed face value.” Customers are then prompted to select the "Review Order" button below these terms. The date provided is the latest expected day a seller believes ticket will be available to deliver; nevertheless, the tickets are often available prior to the listed date.After placing this order, our customer contacted us via our Live Chat application and their concerns were thoroughly addressed. Additionally, we attempted to contact our customer via telephone to discuss their order but were unsuccessful in doing so. Since this initial interaction, our customer has filed a dispute with their PayPal account regarding this order. We are unable to provide a resolution to this matter while this dispute remains open due to the nature of the dispute process. Upon the dispute closure, contingent on the results of the dispute, our customer's valid tickets are ready to be delivered prior to the expected date. We encourage our customer to contact the institution with which the dispute was filed in relation to any questions they may have regarding its process or outcome. I am rejecting this response because: This is the same response given to the numerous people who have had complaints such as mine.  It is a cliche. You just reworded to suit my circumstances.   I was unknowingly redirected to your site from the venue's site.  You are aware this happens because of the trail of complaints about this exact same thing.  I was ordering two tickets before the tickets went on sale to the public because I was notified as a fan of the performer.  Why would I order tickets from a "business" that buys the tickets from somewhere else and resales with extravagant fees when there was a plethora of tickets available???  I thought I was ordering from the venue - and you know that many customers think that because of the complaints.  I would NEVER, EVER order tickets for almost a thousand dollars for any performer!!!!  I tried to contact you within minutes but was unable to talk to a real person.  I am sure that not being able to talk to a real person upon calling your number is intentional because of your dubious business.   It is so obvious that I made a mistake.  You are extremely unforgiving and have no ethics.  You have duped many people out of their hard earned money and keep getting away with it!

I am rejecting this response because: while the company is a resaler of tickets they have a responsibility to insure that the people holding the tickets for resale are legitimate. I am not questioning price or when tickets will be delivered. I am questioning their advertising legitimacy. They state up front on their site that the best seats available are provided. This not true. I purchased my tickets 4 months in advance and paid for tickets in a specific row for which I paid a higher price than I would in a less desirable row. They confirmed with the seller that he accepted my offer for tickets in that row in that section on that night. For an agreement between the two parties to exist the seller must in fact own the tickets and commit them to me. Yet this seller cannot provide me with a confirmed seating. If you check reviews of this company you will see many people have complained of what is essentially a bait and switch.by waiting to the last minute to supply both seat numbers and tickets the seller and this company can sell the same tickets closer to the date of the show at a higher price and provide the earlier buyer with less desirable tickets, their terms and conditions allow them to do this. Unfortunately there terms and conditions do not stand up to what is then false advertising. They state in their advertising that I am paying for best available. Therefore lacking any definition of what best available is in the terms and conditions, it is reasonable for any consumer to believe that best available is at the time of purchase and not 4 months later. Therefore they have false and misleading advertising. I believe they and the seller have a legal obligation to provide the seat numbers at the time of purchase to guarantee as also stated in their site that their service is guaranteed.The companies response also was incorrect in that I tried for two weeks to contact them by phone, chat line and email and they did not respond until after I filed the complaint with you. This is the most common thread of complaint online with this company. In response they responded as they did to you with an email. No return call.

I am rejecting this response because: I did email TicketOffices and their recommendation was to attempt to resale the tickets. I was going to but matters had changed to where I could the ticket dates. The problem here is that when I purchased the tickets, there was nothing during the transaction that stated all sales were final. I also have tried getting ahold of TicketOffices customer service via phone and email but phone won't let me get past the automatic system and hangs up on me. The emails kept being sent back as undeliverable email home address. I would have no problem talking to a customer service manager if I could get ahold of one. Especially considering the circumstances of my situation.

Our customer’s valid tickets were delivered on 10/7/2016 via UPS postal service. This event was later rescheduled for 10/16/2017 by the primary market, with which we have no affiliation, and our customer was notified of this information via email. Although our customer has stated that they were not informed their tickets would remain valid for the rescheduled date, this email states, “Your original tickets are still valid and will be honored at the rescheduled time listed.” Additionally, the terms which were agreed to at checkout clarify, “If an event is postponed or rescheduled, your order will not qualify for a refund and your tickets will be valid for the rescheduled date” and “Please keep your tickets in a safe place. We are not responsible for lost, stolen, damaged or destroyed tickets and are under no obligation, and, in many instances, are not able, to replace the tickets.” Prior to receiving this claim we thoroughly discussed this matter with our customer to address all of their concerns and provide clarification. As our customer’s valid tickets were delivered on 10/7/2016 and ticket reissues are not guaranteed as we have no affiliation with the venue, we consider this matter closed. The name on her tickets simply indicates that of the original purchaser from the primary market. The customer has no idea how much the ticket originally cost to compare it to how much they are actually charged when purchasing. There is no cross reference or comparison. The customer is lead to believe that they are receiving an equivalent item for an equivalent price.
