any negative situations our customer has encountered throughout her interactions with DriveTime.On July 5, 2016, our customer entered into a Simple Interest Retail Installment Contract when she purchased a Ford Focus from DriveTimeThe vehicle came with a day/1,mile DriveTime Limited Warranty, administered by AeverexOur customer purchased an additional year/50,mile Vehicle Service Contract, also administered by AeverexAttached you will find the Contract, Limited Warranty, and Vehicle Service Contract for your reference.At the time of sale, our customer had the opportunity to review and sign a document entitled “What you need to know about financing a vehicle with DriveTime.” On page of this document, under “Recalls,” it is stated:“Used vehicles may be subject to manufacturer recalls to repair, at no cost to you, mechanical or operational problemsOnly new car dealers are allowed to do these repairsYou should confirm with a new car dealer that your vehicle does not require recall repairs.”The “What you need to know…” document has been attached for your reference.Our customer also had the opportunity to review and sign a Safercar.gov Recall ReportPer the report, there were no open recalls on the vehicle at time of purchaseWhile this vehicle currently has an open field service action (FSA) through Ford for a transmission clutch shudder and transmission input shaft seal warranty extension, there are no open recalls reflecting on the current Safercar.gov report or the Ford websiteAttached is an up-to-date Safercar.gov report for your reference

Although some of the statements are accurate, what they leave out is of great concern. I did receive a *** letter asking me to call them. I have not received any phone calls from them. I called DriveTime and they offered to put me in a new vehicle, and would NOT transfer any payments made on the truck I have driven about half the time I have owned it. I have paid $in payments they will not transfer to another vehicle. When holding on the phone with DriveTime Corporate office, their recording states that all vehicles are "rigorously" inspected. Also their written paperwork and commercials state their vehicles are "thoroughly" inspected. Those two words imply that they inspect all vehicles and make needed repairs before they sell the vehicles, and they state online, that they REJECT far more vehicles than they approved for sell on their lots. I find those statements misleading. I cannot lose the $I have paid on payments on a truck that has been in the shop more than it's been in my possession. Their deal was for a strict hours only. They would not give me any price guidelines as to which vehicles I could get without my down payment going up. I work days a week and would be glad to take my day off and get another truck, but I want a truck, not a car. In all of Tennessee they only have trucks, and three of them are older than my 2007. The other one is a which I am sure is more money down. When I commit to trade my vehicle in, I have hours to find a vehicle. If I find a truck at another lot, I can drive to that lot, or pay for it to be delivered to Antioch. It all involves me losing more money, or paying more money. I have lost enough already.I want a truck. I want all my monies to be transferred to my new contracted vehicle. I think after all I have gone through, and the run around I have gotten from the beginning, that is the least they should do.Thank you, Richard Smith

6, 2016, our customer entered into a Simple Interest Retail Installment Contract (the Contract) with DriveTime when she purchased a Ford FiestaAttached you will find a copy of the Contract for your reference On March 12, 2016, our customer contacted DriveTime Customer Service regarding her automatic payment scheduled for March 11, Our customer had received a $referral credit (which also posted on March 11, 2016) and wanted to know if her automatic payment would also be processed as scheduledOur customer had received an automatic text reminder that the payment would be withdrawn from her account Our representative advised our customer that she could disregard the text as we were having system issuesUnfortunately, this information was incorrectThe automatic payment system is designed to withdraw our customers’ payments on the scheduled dateIt does not have access to the status of the accounts, and as such does not know what other payments or credits have been applied to the account The automatic payments system requires that cancellations be performed hours prior to the scheduled payment dateWhen our customer spoke with Customer Service on March 12, 2016, the payment scheduled for March would already have been processed On March 14, 2016, our customer called in to discuss the situation and request a refund of the $March paymentA customer service agent asked our customer to provide a bank statement showing that the payment was not still pending so that we could review and process her refundA fax was received from our customer that same day FULL RESPONSE IN ATTACHMENT

entered into a Simple Interest Retail Installment Contract with DriveTime when she purchased a Pontiac Grand PrixAttached you will find the Simple Interest Retail Installment for your referenceOn November 30, 2015, our customer contacted DriveTime Customer Service to inquire as to when she would receive her permanent plates as her temporary plates were approaching expirationOn December 1, 2015, our customer spoke with DriveTime Customer RelationsOur customer was advised that we were informed that there had been delays resulting from the fact that the vehicle had been sold in *** but was being titled in ***aOn December 2, 2015, a Customer Relations agent called our customer to advise new temporary tags had been sent to her and that her permanent plates would be sent out by the end of that weekOn December 21, 2015, our customer called in to DriveTime to advise she had still not received her permanent platesA Customer Relations agent spoke with a dealership representative and was advised that the dealership would be reaching out to our customerOn January 27, 2016, our customer spoke with Customer Relations and advised that she still had not received her permanent plates and that the temporary tags she had would be expiring at the end of FebruaryOn February 1, 2016, we determined that an ***a title was issued for our customer on January 27, Our customer’s plates should arrive by the beginning of next week at her home address….CONTINUED IN RESPONSE SUBMISSION

with a Drivers Seat Limited Warranty, administered by AeverexIncluded you will find the Closed End Motor Vehicle Lease Contract and Drivers Seat Limited Warranty for your reference. Our customer spoke with DriveTime inquiring about reimbursement for the spark plug replacements she paid out of pocket forWe advised her we would not be able to provide reimbursement for maintenance items.At this time, DriveTime is unable to accommodate our customer’s request to waive the past due balance or any applicable deductibles for repairsWe have not been able to reach our customer to verify if the issues have been addressed on the vehicleIn the event she may be experiencing further mechanical issues, we encourage her to have a diagnosis completed at an in-network repair facilityOnce completed, we will review options of possible assistance. I reject the offer that drive time has made simply because I do not feel it is a sufficient accommodation considering I have been having this issue since week one of purchase all the while making my payment of monthly for the past months during this time there have been occasions I have been unable to drive the vehicleI have called in on several occasions with no resolution I have been told to bring the car to the lot and I do and in the end I get the same result NOTHING it was not until I reached out to the Revdex.com that drive time contacted me with an offer to reimburse for repairs that should have been done before I left the dealership I have followed every instruction as to where to take the car what parts to buy and I still continued to have the same issue even after taking this car to the manufacturer (***) and they are unable to determine the issue at this time I just want to be reimbursed my down payment repairs and a portion if not all my payments seeing now I'm being advised to turn the vehicle in and on the search for a new one but had this issue been addressed a corrected accordingly in the beginning this would have not been an issue

At the time of sale, our customer opted not to purchase the optional year/50,mile Vehicle Service Contract that DriveTime offers to all their finance customersOur customer signed an Optional Products Disclosure that showed she would not be purchasing this productThe Optional Products Disclosure has been included for your reference.On November 13, 2014, our customer contacted Aeverex with concerns about the seat belt and airbag light coming on, a grinding noise while driving, and transmission issuesAeverex referred our customer to an in-network repair facility to have the vehicle diagnosed.On November 15, 2014, an in-network repair facility called Aeverex and advised they were recommending our customer take the vehicle to the original equipment manufacturer (OEM) for further diagnosis, as they had been unable to diagnose the air bag issues.On November 19, 2014, an OEM filed a claim with Aeverex for an electrical diagnosisThis fee was approved in full under the terms of the DriveCare Limited Warranty.On November 20, 2014, the OEM filed an additional claim with Aeverex for the left-front seat position sensor, the shifter assembly, a filter housing coolant leak, the vacuum booster pump, and additional oil leak repairsThese repairs were approved in full under the terms of the DriveCare Limited Warranty.On November 25, 26, and 28, the OEM filed additional claims with Aeverex for an oil pan gasket, coolant, engine oil, sales tax, and the thermostatThese repairs and taxes were approved in full under the terms of the DriveCare Limited Warranty.On December and 2, 2014, our customer contacted Aeverex with concerns about a knocking noise while driving and air conditioner issuesAeverex referred our customer to an in-network repair facility to have the vehicle diagnosed.On December 3, 2014, an in-network repair facility called a claim into Aeverex for a suspension diagnosis, alignment, and HVAC diagnosisThe suspension diagnosis was approved in full under the terms of the DriveCare Limited Warranty; however, the alignment and HVAC diagnosis were not coveredAeverex made an exception to approve the alignment, but the HVAC diagnosis was not approved.On December 15, 2014, our customer contacted Aeverex and advised she was taking the vehicle back to a repair facility for the same issues as beforeAeverex advised our customer if there was an ongoing issue, it would be reviewed under the previous claim, but if there was a new issue, her warranty was now expired.On December 22, 2014, the OEM filed a claim with Aeverex for the front drive axle and stabilizer bushingsThese repairs were approved in full under the terms of the DriveCare Limited Warranty, despite our customer now being outside of the warranty period.On March 6, 2015, our customer contacted DriveTime with concerns that she needed a new batteryDriveTime made an exception to reimburse our customer for the battery as a one-time goodwill gesture.On April 29, 2015, our customer contacted Aeverex and advised she was still having the same issues with an odor coming from the air conditioner from the first days of the loanAeverex advised our customer that there was no coverage for odor in the vehicle under the terms of the DriveCare Limited Warranty.On May 1, 2015, our customer contacted DriveTime stating there was a ventilation issue with the vehicle that was making her sickOur customer stated she did not have the funds to get the vehicle fixed and was considering voluntarily surrendering the vehicle.On May 7, 2015, our customer contacted DriveTime and advised she would be voluntarily surrendering the vehicle the next day due to the ventilation issues with the vehicleWe advised our customer to send us the documentation of the issues with the vehicle so we could review options to assist.On May 11, 2015, our customer contacted DriveTime to request a copy of her contractWe mailed a copy of our customer’s contract to the address on file.On May 18, 2015, our customer contacted DriveTime and advised she would be returning the vehicle because it had no heat or air conditioning, and she no longer wanted itWe advised our customer of the process for voluntary surrender and the ramifications a voluntary repossession would have on her creditLater that day, our customer returned the vehicle to the DriveTime dealership where she purchased.All DriveTime vehicles are thoroughly inspected at our DriveTime inspection centers prior to saleParts that fail inspection are replacedHowever, if a part is functioning at the time of inspection, there is no need to replace it.On the Customer Delivery Checklist under “Important Reminder,” it is stated: “Our focus of the multi-point inspection is primarily the safety and reliability of your vehicle…Please insure you are comfortable with the condition of the vehicle prior to purchasing.” Additionally, on the Customer Delivery Checklist under “Maintenance Items,” it is stated: “…These maintenance items are subject to replacement only upon failure of the component...” Attached you will find the Customer Delivery Checklist for your reference. On June 1, 2015, we contacted our customer and attempted to address her concernsAt this time, we are unable to accommodate our customer’s request for DriveTime to reimburse all the funds she has paid into the loan. As an alternative form of assistance, should our customer be willing to enter into a Full Settlement and Release of Claims with DriveTime, DriveTime is willing to waive the deficiency balance on her account and delete her trade line from her credit reportingThis settlement offer will stand until July 5, 2015. purchased a Dodge JourneyOur customer also purchased a Vehicle Service Contract, administered through AeverexAttached you will find the Simple Interest Retail Installment Contract and the Vehicle Service Contract for your reference.On August 19, 2014, our customer contacted Aeverex advising that she needed to have the ball joints on the vehicle replacedAeverex referred our customer to an in-network repair facility to have the vehicle diagnosed. On August 23, 2014, our customer contacted DriveTime stating that the right front wheel had fallen off the vehicle while drivingWe advised our customer that she would need to take the vehicle to an in-network repair facility to be inspectedAs an exception, we provided our customer with a direct-bill rental until the vehicle could be inspected.On August 25, 2014, an in-network repair facility performed a diagnosis on the vehicle and found that there were issue with the wheel studs, lug nuts, the right front wheel, and cosmetic damage done to the body of the vehicleAeverex requested a third-party inspector go out to the repair facility to inspect the vehicle. On August 26, 2014, the third-party inspector completed his inspection of the vehicleThe inspector verified that the cause of failure was due to four stud bolts on the right front wheel had broken offThe pictures of the inspection show that the holes were not rounded on the wheel, which is an indication of improper fastening of the boltsWe have included a copy of the inspection report for your reference. On August 27, 2014, DriveTime approved the repairs of the wheel studs, lug nuts and wheel mount for a total of $as an exception through Aeverex. On August 28, 2014, DriveTime referred our customer to have the vehicle taken to a different in-network repair facility to have the bodywork inspected.On September 3, 2014, DriveTime contacted our customer to inform her that after reviewing the inspection report, we would not be assisting with the body damage repairsDriveTime advised that the type of damage reported through the inspection report is caused by impact, therefore is our customer’s responsibilityWe directed our customer to utilize her insurance provider for the cosmetic damage sustained by the incidentAt that time, we advised our customer that the direct bill rental would no longer be provided after days of use for a total of $306.60.We apologize for any inconvenience or confusion this matter may have causedIn order to reach an amicable resolution, DriveTime has agreed to refund the $500deductible to our customer. That is not adequate for a loss of 200+ points on my credit scoreFrom the way it was explained to me by the company the payments would be suspended - thus not late nor would it impact a credit scoreI have had this loan for two years and was never lateThis deferment the company offers forces the owners to have negative credit reportingI have made a future dated payment to DT for February 17th for two payments to have the review of my defermentThe way this program is offered is unfair and for someone to have asked months before the medical leave, it should have been handled better and how they offer deferments it forces their loan owners to have negative impact on their creditI lost my baby, the last thing I could afford at the time was a dollar a month car payment
