Conditional Sale Contract and Security Agreement with
DriveTime when she purchased a Ford FocusAt the time of sale, our
customer agreed to make monthly payments of $and one final payment of
$298.12, beginning on May 4, Attached you will find the Conditional Sale
Contract and Security Agreement for your reference.That same day, our
customer enrolled in DriveTime’s automatic payment withdrawal service (Auto
Pay) and arranged for her monthly payments to be automatically drafted from her
bank accountAuto Pay is available to all DriveTime customers as a convenient
way for them to make payments at no cost to themOn December 3,
2015, a regularly scheduled payment of $was posted to our customer’s
account via her enrollment in Auto Pay.On December 8,
2015, a payment of $was made to our customer’s account via her
enrollment in Bill Pay with her third party bank.On December 9,
2015, our customer contacted DriveTime and stated that her third party bank had
submitted a payment to DriveTime in errorOur customer requested to be
refunded the amount of $DriveTime advised her to submit bank statements
and we would process her request to be reimbursed for the payment.On December 11,
2015, our customer’s third party bank contacted DriveTime and requested that we
refund our customer the payment made on December 8, We advised her third
party bank that we were unable to disclose information to them and we would
need the customer’s bank statements to process that type of requestOn December 14,
2015, DriveTime contacted our customer in an attempt to address her concerns
and reach an amicable resolutionOur customer stated that her bank had already
submitted the information requested to DriveTime and advised her that she would
be receiving a refundDriveTime advised our customer we would research the
situation in an attempt to reach an amicable resolution.On December 15,
2015, DriveTime contacted our customer and advised her that we had not received
the documentation needed to process her requestOur customer advised DriveTime
that she would she would contact her bank to obtain the documents requested.On that same day,
DriveTime received a letter and bank statement from our customer’s third party
bankThe letter requested that we refund our customer the amount of $as
the payment was made via certified funds and they were unable to stop payment
to DriveTimeWe have attached the letter and bank statement for your reviewAt this time, DriveTime
has taken the appropriate steps to remove the $payment posted to our
customer’s account on December 8, A refund has been processed with our
customer’s third party bank and she will be refunded in full. We apologize for
any confusion or inconvenience this matter may have causedAs a goodwill

year/50,mile Vehicle Service Contract, administered by AeverexAttached you will find the Simple Interest Retail Installment Contract and Vehicle Service Contract for your referenceAt the time of sale, our customer agreed to make bi-weekly payments of $and final payment of $196.78, beginning November 21, DriveTime does not compete on price, nor do we hide itWe encourage our customers to research all aspects of their purchaseOur customer had the opportunity to sign and review the following documents: - Buyer’s Guide - DriveTime’s DriveCare Limited Warranty - What You Need To Know About Financing a Vehicle with DriveTime - Simple Interest Retail Installment Contract Included, you will find copies of the above referenced documents for your reviewDriveTime offers a Vehicle Return Program, which gives our customers the ability to return their vehicles to DriveTime and terminate their Simple Interest Retail Installment ContractsTo participate in the vehicle return program, our customers must return their vehicles to the dealership within five calendar daysAll DriveTime vehicles are thoroughly inspected at our DriveTime inspection centers prior to saleParts that fail inspection are replacedHowever, if a part is functioning at the time of inspection, it is not replacedA timeline of our customer’s repair history follows: - On November 25, 2014, a repair facility contacted Aeverex and recommended a catalytic converter, heat shield, exhaust manifold gasket, and tire repairsAeverex approved all recommended repairs and the diagnostic fee, but denied the tire repairs- On February 25, 2015, a repair facility contacted Aeverex and recommended rack/gear box and MacPherson strut repairsAeverex denied these repairs, as they are non-covered components under the Vehicle Service ContractWe are unable to accommodate our customer’s request at this timeWe have made several unsuccessful attempts to contact our customer to discuss her concernsOn March 3, 2015, we sent a letter via certified mail to our customer’s address on fileThe purpose of this letter is to inform our customer of our attempts to reach out to herWe encourage our customer to contact our Customer Relations Department at ###-###-#### to discuss her concernsAs a goodwill gesture, DriveTime has applied a $credit to our customer’s principal balanceDriveTime thanks the Revdex.com for their ongoing supportShould you have any questions or concerns, please contact us by calling us at ###-###-####Sincerely, DriveTime Customer Relations

For your reference, details of the offer I reviewed appear below.Its a shame that this business would rather not work with someone who had experienced hard times which brought this about, the payment method that was offered by a third party was *** ***, which they do not accept , however ironically they send them out as a gesture of good will,really, also the second method of payment was a *** card, both of which were submitted by my girl friend who just wanted to help, *** got rejected because it was submitted as an unauthorized CASH ADVANCE, which was not disclosed till after it was rejected when *** called her!! legal not sure but very shady indeed also payment could not be in one sum had to be in not sure what that was about told it was policy , yeah policy to collect another transaction fee...whatever happens I am done with theses people, this whole thing is paramount to extortion, perhaps legal means are next,possibly states attorney thank you for time

DriveTime temporarily ceased credit reporting to all three major credit bureau
agenciesThis cease was due to required system enhancements taking place in
the manner DriveTime reports to the credit bureausWe have completed the necessary
updates with Experian, Equifax, and TransUnion, and they have uploaded our
customers’ account information for public viewingWe understand the
importance of building and maintaining a credit scoreWe also understand the
importance of accurately reporting credit activity, and that is why DriveTime
has made the effort to complete these system enhancementsOn June 15, 2015, our
customer filed for Chapter bankruptcyThis bankruptcy was discharged on September
24, 2015.When one, or both,
parties on the loan file for bankruptcy, DriveTime ceases reporting the trade
line to all three (3) major credit bureausOn November 11, 2015,
our customer contacted DriveTime and stated he wanted to voluntary surrender
the vehicle back to DriveTimeDriveTime advised our customer to take the
vehicle to the neared DriveTime sales lotOur customer understood and possession
of the vehicle was released to DriveTimeWe have made several
attempts to contact our customer and address his concernsAttempts to reach
him have been unsuccessful but will continue in an attempt to reach an amicable
resolutionAt this time, we are
unable to accommodate our customer’s request to refund him the payments made towards
his loan with DriveTimeWe apologize for any

Revdex.com:I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below.I HAVE NOT resolved my complaint with Drive TimeMy car was in the shop for almost a week while I waited for Drive Time and the warranty office to contact me or my mechanicI missed several days of work and had to pay out of pocket for the needed repairs $I returned the car several days later to my mechanic because of continued problems with the suspensionFinally I called the warranty office and they refused to take care of any suspension issues EVEN though I had these issues when I drove the car off the lotAt the time I drove the car off the lot they had me sign a waiver for cosmetic damage onlyThey also noted on that report that I was hearing odd sounds coming from the front endI was told if I continued to hear that sound I could bring the car to certified mechanic and have it taken care of for FREE because I had days of complete coverage on the carI have a copy of the problems that were taken care of by my mechanicDrive Time and the warranty office continuously dodge my calls or do not return calls and this is frustrating because if I don't pay my car note on time days later they repossessThey don't give reminder calls or final notification callsI am a single mom and had to borrow the money to fix the car and all of these issues were present at the time I drove the car off the lotI trusted them to keep their word to take care of these issues because the car was inspected by my mechanic before the day warranty was upI have all the paperwork from my mechanic and would be happen to fax them to you upon request.Regards,*** ***

For your reference, details of the offer I reviewed appear below.I filed a complaint against DriveTime around Nov and it was recently closed because you guys felt the situation was handled when in fact it wasn'tCamile reported to you guys that $was applied to my accountIn addition there was also a per diem being applied to my accountThe per diem was not applied to my account and because of that my car is repossession statusWhen I spoke to some one in the lease department she saw on the account where the per diem for $was supposed to be appliedShe then transfered me to customer relations where the guy I spoke to, who name I believe was Bennett, was very rude, then said he saw no such thingWhen I asked to speak with a supervisor, his response was that there is no supervisor and that there was no one higher then himI'm very frustrated with the run around I'm getting from DriveTime when I have done everything within their regulations to have been refunded my depositI'm trying to get things lowered at it's lowest levelMy next step is filing a lawsuitI would greatly appreciate if you could reopen the compliantAlso attached is a screenshot of the response that I received from DriveTime about the complaint because apparently no one else see that I was supposed to get the $233.47, a per diem, and $

This bankruptcy was discharged on September 13, 2011. On February 22, 2014, our customer entered into a Simple Interest Retail Installment Contract with DriveTime when she purchased a Ford EdgeAttached you will find the Simple Interest Retail Installment Contract for your reference. In October 2014, DriveTime temporarily ceased credit reporting to all three major credit bureau agencies. This cease was due to required system enhancements taking place in the manner DriveTime reports to the credit bureausWe have completed the necessary updates with *** and ***, and they have uploaded our customers’ account information for public viewing*** has recently completed these updates, as well. We understand the importance of building and maintaining a credit scoreWe also understand the importance of accurately reporting credit activity, and that is why DriveTime has made the effort to complete these system enhancements. After a recent extensive review, we determined that there were serious questions about the ability to report bankruptcy accounts accuratelyAs a result, we were temporarily unable to report accounts with previously filed bankruptcies, in order to ensure no inaccurate reporting occurredThis change was also required to ensure DriveTime was in compliance with the Fair Credit Reporting Act. At this time, DriveTime has found a resolution to report accurately for accounts that have had a previously dismissed bankruptcyThis update should reflect on our customer’s credit reporting within 30-daysWe will be reinstating these trade lines with *** *** and ***.
