14, 2013, our customer entered into a Simple Interest Retail Installment Contract with DriveTime when she purchased a Jeep PatriotAttached you will find the Simple Interest Retail Installment Contract for your reference DriveTime offers eligible customers loan modifications to adjust their scheduled due dates and frequencyIn order to qualify for a due date or frequency change, DriveTime requires our customers’ account to be current On August 8, 2015, our customer contacted DriveTime and requested a loan modification to change the frequency and due dates of her loan paymentsOur customer advised DriveTime she had started a new job and wanted to change her payment to a monthly scheduleDriveTime advised our customer if the requested loan modification was approved, she would need to sign the documents and return them to DriveTime by the effective date of the document On September 3, 2015, our customer contacted DriveTime in regards to her loan modification requestDriveTime advised our customer in order to process a loan modification the account would have to be current and the documents would need to be signed and returned before the effective dateOur customer advised she understood and would processes a payment to bring the account currentDriveTime advised our customer once the payment processed, contact DriveTime and we would resubmit the request for the loan modification On September 4, 2015, our customer contacted DriveTime to re-request the loan modificationDriveTime verified the customer’s payment had processed in full and submitted the loan modification request for review On September 9, 2015, our customer contacted DriveTime to inquire about the loan modification requestDriveTime advised our customer the loan modification documents were completed and awaiting her signatureOur customer requested DriveTime send the documents to her email address on filedDriveTime send the documents as requested On September 10, 2015, DriveTime received the loan modification documents; however, the documents were signed electronically, rendering the documents invalid and not allowing DriveTime to process the loan modification requestDriveTime attempted to contact our customer to advise her of the error, however, we were unable to contact her On September 12, 2015, our customer contacted DriveTime regarding her loan modification requestDriveTime advised our customer the documents must be signed by hand and returned to DriveTimeOur customer advised she understood and informed DriveTime she would be sending the documents the following Monday On September 17, 2015, DriveTime received the signed loan modification documents; however, the effective date of the documents had passed, rendering the documents invalid and not allowing DriveTime to process the loan modification request. On September 23, 2015, our customer contacted DriveTime to inquire about her loan modification requestDriveTime advised our customer the request declined due to the documents being signed after the effective dateOur customer inquired about her current maturity date and how it had been effected by loan modificationsWe explained to our customer how loan modifications effect the maturity date of her loanDuring the conversation with our customer, the call was disconnected On September 30, 2015, our customer contacted DriveTime to discuss the status of her accountOur customer advised DriveTime her new job had already began and she would only be able to make payments on a monthly schedule as previously discussedDriveTime advised our customer once the account was paid current and remained current; we could submitted another loan modification to change the frequency of her scheduled payments On October 1, 2015, our customer contacted DriveTime after bringing her account current to request another loan modificationAlthough our customer’s account was current, she had another payment due October 3, which did not allow enough time to complete the loan modification requestDriveTime advised our customer to complete the scheduled payment, and then request the loan modification allowing the needed time to complete the request before the next payment came due. On October 2, 2015, our customer contacted DriveTime to complete her scheduled paymentDriveTime advised our customer to contact us the following business day and we would request the loan modification to complete the payment frequency changeHowever, DriveTime received no further communication from the customer regarding the loan modification On October 21, 2015, we contacted our customer to discuss her concernsWe advised our customer DriveTime would be willing to offer her an exception to process the loan modification without her account being currentOur customer advised she was satisfied with the resolution On October 22, 2015, DriveTime received the signed loan modification documents from our customerDriveTime contacted our customer and informed her the modification would be processed before her next due dayOur customer advised she was satisfied with this resolution and consider the matter resolved We apologize for any confusion or inconvenience this matter may have causedAs a goodwill gesture, DriveTime has applied a $credit to our customer principle balance DriveTime thanks the Revdex.com for their ongoing supportShould you have any questions or concerns, please contact us by calling us at 800-965- Sincerely, Josh SDriveTime Customer Relations
I have been working with DriveTime to see if I can get another vehicle, but the whole process has caused unwanted stress and going through the whole car buying process again is just going even more stressfulI do not like that they claim there was a secret lien the vehicle that they did not know about, meaning they do not do proper research and follow protocol when buying and selling their vehiclesThe problem with getting another car is that they base their finance approval rate on your current pay-stubI am a hourly paid worker, so my pay is often higher in seasonal times such as when I went to purchase the carWork is slow currently and I do not think it is fair for them to judge my finance amount on what I currently make, because I specifically went and bout the car at the end of November for a reasonIf I have to get another car, they need to deliver it to me and give me the same APR that I have now, if not better, I refuse to accept anything lessI am very very scared to go back into a dealership as I haven't received any respect from any of the sales members, let alone an apology for their negligence in their inability to register a car properlyI love my current car and I hate to lose it, but if I have to get another one, then I want to get a car with the same APR if not better and if the car is newer then my current one or more expensive, then I believe DriveTime needs to just eat thatI have suffered way to much in the first month of the new year from this unnecessary stress

In an attempt to assist our customer, we agreed to provide a two payment deferment that would bring his account current. Retail Installment Contract with DriveTime when she purchased a Honda CR-VThe vehicle came with a 30- day/1,mile DriveCare Limited Warranty, administered by AeverexOur customer purchased a year/50,000-mile Vehicle Service Contract, also administered by AeverexThe Contract was subsequently assigned to DT Acceptance Corporation, now known as Bridgecrest Acceptance CorporationAttached you will find a copy of the Simple Interest Retail Installment Contract, DriveCare Limited Warranty Agreement, and Vehicle Service Contract for your review.At the time of purchase, our customer signed a Safercar.gov Recall Report Acknowledgement stating:“I/we know that DriveTime did not create this report and there may be mistakes or missing informationDriveTime said we should contact a new auto dealer to ask them if there are any safety recalls related to the vehicle.”DriveTime cannot fix any recalls with the vehicles we sellWe encourage our customers to have any recall concerns brought to the attention of the original equipment manufacturer (OEM).On April 9, 2015, our customer contacted Aeverex to express concerns with the back door not working properly, a fluid leak, and AC not being coldAeverex encouraged her to have a diagnosis completed at an in-network repair facility.On April 11, 2015, an in-network repair facility initiated a claim with Aeverex for a pressure steering hose, steering fluid, and steering diagnosisAeverex approved these repairs under the DriveCare Limited WarrantyThe repair facility did not find any problems with the AC. On August 26, 2014, we reached out to our customer to address her concernsShe informed us she has not driven the vehicle since it broke down months ago, however she has not taken the vehicle in for a diagnosisShe also informed us she had difficulty obtaining insurance due to the vehicle being a flood vehicleShe also stated she wants all money put into the loan refunded to her and return the vehicle
We advised our customer we need to identify what needs to be repairedOnce we have that information, we can determine how we can assistThis step would go through the warranty, however we were willing to waive the diagnostic fee and deductible as a courtesyOur customer declined
To address flood claims, we pulled up the Experian AutoCheck Vehicle History Report from the time of saleThe Report can indicate the vehicle being registered in a storm area, and/or have a water damage recordIf any of the items were applicable, these items would be noted in the Vehicle Information section on the Experian AutoCheck History ReportOur customer signed and acknowledged the reporting of a clear history from water damageWe have attached the Experian AutoCheck Vehicle History for your referenceWe asked our customer to provide us with the documents the insurance company obtained the flood information from but she declined to send it because the insurance company told her to not to release it to DriveTime
To address the refund our customer was requesting, we advised a refund of all payments made into the loan is not a possibilityIf she decided to return the vehicle, the payments would stay with the vehicleIn addition, to consider the possibility of getting her out of the vehicle, we would need to know what repairs are needed on the vehicle, which our customer declined to do
At this time, our customer would like DriveTime to apprehend the vehicle as a repossession and not go through the process needed to see what resolution we can ultimately provide
As a goodwill gesture, DriveTime has sent our customer a $American Express gift card

July 14, 2015, our customer entered into a Simple Interest Retail Installment Contract with DriveTime when she purchased a Ford FiestaOur customer purchase a year/36,miles Drivers Seat Limited Warranty, administrated by AeverexAttached you will find the Simple Interest Retail Installment Contract and the DriveCare Limited Warranty for your reference At the time of sale, our customer singed an optional products disclosure stating she understood that the Drivers Seat Limited Warranty, GAP Coverage, and Skylink Service were optional products and that purchasing them was not a requirement to finance the vehicle with DriveTimeOur customer opted to purchase all three of these productsThe Optional Products Disclosure has been attached for you reference At the time of signing, DriveTime reviews each document with our customers and ensures they understand the information withinBy signing these documents, they are asserting that they have read and fully understand the terms enclosedWe encourage our customers to review all paperwork thoroughly before signing the contractIn addition, we record all of our closings, and a centralized group typically reviews in excess of 1,closings each month to ensure adherence to our standards, including the disclosure of all terms and interest rate. If our customers are dissatisfied with their purchase for any reason, DriveTime also offers a Vehicle Return Program that allows them to return the vehicle and terminate their Simple Interest Retail Installment Contract within the first five days of their loanPlease refer to page of the Retail Purchase Agreement: “You will give me the ability to return the Vehicle to DriveTime and rescind this Retail Purchase Agreement so long as I return the Vehicle: 1) To the DriveTime dealership where I purchased it within five calendar days…no later than the close of business on the fifth calendar day….” DriveTime customers have the ability to cancel their Optional Products for a full refund in the first sixty days after the contract purchase dateOn page two of the DriveCare Limited Warranty under “Cancellation including refunds and charges” it is stated: “ In the event this contract is cancelled y Your are described above, then; (a) You are entitled to a full refund less cancellation fee if: (1) You contact and provide the written notice of cancellation to the Administrator within the first days after the Contract Purchase Date…” On July 22, 2015, DriveTime received notification from Aeverex that our customer had elected to cancel her DriveCare Limited WarrantyDriveTime applied a refund of $2,to the customer’s principal balance On August 26, 2015, our customer contacted DriveTime to inquire how her monthly payments had changed since she canceled the DriveCare Limited WarrantyWe advised our customer the refund does not affect the interest rate or monthly payments for her loanWe advised our customer by applying the refund to the principal balance the customer would have less of a balance due, potentially allowing her to pay of the loan prior to the maturity date On September 8, 2015, our customer contacted DriveTime to obtain proof the DriveCare Limited Warranty had been canceled and the refund was appliedWe offered to email our customer her transaction history showing the principal refund adjustmentWe advised our customer the transaction history would show the refund applied to her account on July 22, On September 14, 2015, our customer contacted DriveTime and attempted to obtain a new Federal Truth in Lending Disclosure, and an updated payment scheduleWe advised our customer the Federal Truth and lending Disclosure would not changeWe advised our customer we would not be able to provide a new payment schedule as the payment schedule would stay the same however due to the principal refund adjustment, if she continued to make her payments as scheduled she would pay the loan offer prior to maturity On September 15, 2015, our customer contacted DriveTime to obtain a breakdown of her principal refund adjustmentWe advised our customer her original loan amount was for $11,We advised our customer when the principal adjustment refund of $2,had been applied; it lowered her loan balance to $8, At this time, we are unable to accommodate our customer request for an updated Federal Truth in Lending Disclosure, as the terms of the contract do not change with the cancelation of an Optional productWe have made several unsuccessful attempts to contact our customer to discuss her concernsOn September 23, 2015, we sent a letter via certified mail to our customer’s address on fileThe purpose of this letter is to inform our customer of our attempts to reach out to herWe encourage our customer to contact our Customer Relations Department at ***, to discuss her concerns We apologize for any confusion or inconvenience this matter may have causedAs a goodwill gesture, DriveTime has applied a $credit to our customer principal balance DriveTime thanks the Revdex.com for their ongoing supportShould you have any questions or concerns, please contact us by calling us ** *** *** Sincerely, Josh SDriveTime Customer Relations
