On July 14, 2015, DriveTime received an updated estimate from Aeverex with our customer’s brake concernsThe repair facility advised that the brake pads and rotors need to be replaced to address the noise concernAt this time, DriveTime will not be making an exception to cover these repairs since these items are considered maintenance items and our customer has driven the vehicle 9,miles since purchase. As a good will gesture, DriveTime has applied a $credit to our customer’s principal balance for the diagnostic cost of the above claimWe have offered our customer one payment deferment to be deferred to the back end of the loan provided receipts for the completed repairsSince these repairs are non-covered components, our customer can have this repair completed at a facility of their choice. If there are any additional concerns with the vehicle we encourage our customer to have the vehicle diagnosedWithout any new information, we are not able to offer any further assistance to our customer. 2015, our customer entered into a Simple Interest Retail Installment Contract with DriveTime when she purchased a BMW XOur customer’s vehicle came with a day/1,mile DriveCare Limited WarrantyOur customer also opted to purchase a year/50,mile Vehicle Service Contract, administered by AeverexAttached you will find the Simple Interest Retail Installment Contract, Limited Warranty Agreement, and Vehicle Service Contract for your reference. On March 25, 2015, our customer contacted *** regarding a check-engine light, heating issues, and a variety of other miscellaneous issues*** referred her to an in-network repair facility to have the vehicle diagnosed. On March 30, 2015, an in-network repair facility filed a claim with *** for a variety of repairs and diagnostic feesThe blue tooth module and electrical diagnosis were approved under the terms of the DriveCare Limited Warranty; however, the air filter, tuitems, vent valve, serpentine belts, engine and transmission mounts, and fuel system diagnosis were not covered under the DriveCare Limited Warranty, and therefore were not approved. On April 2, 2015, DriveTime made an exception to approve all of our customer’s non-covered repairs in full. On April 6, 2015, DriveTime advised *** to cover the diagnostic fee at an original equipment manufacturer (OEM) as exception, so our customer could have the vehicle further diagnosedThat day, an OEM filed a claim with *** for the key fobThese repairs were approved in full as part of the previous exception. On April 7, 2015, an in-network repair facility filed a claim with *** for the flywheel*** approved these repairs in full under the terms of the DriveCare Limited Warranty. On April 23, 2015, days into our customer’s loan, an in-network repair facility filed a claim with *** for strut mounts and a suspension diagnosisBecause strut mounts are not covered under the terms of the Vehicle Service Contract, *** did not approve these repairs and fees. On April 24, 2015, *** readdressed the claim for the struts and suspension diagnosis and determined that they would approve the repairs and fees in full under the terms of the day/1,mile DriveCare Limited Warranty. We have contacted our customer and have come to an amicable resolutionWe advised her of the above information and encouraged her to reach out to DriveTime Customer Relations at ###-###-#### with any additional questions or concernsAs a goodwill gesture, DriveTime has applied $to our customer’s principal balance. This company is nasty and unprofessional and I will not and would not refer anyone to them these people changed my contract without speaking to me after I have asked them many of times to change my payments to monthly and they refused and then all of a sudden they change my contract and payments to monthly and charge me a whole extra dollars then what my paym bra was and the recovery company is hired by them which they gave the job to someone else and that’s not right because if drive time hir d someone they should do the job not give the job to another nasty recovery company that steals out of people cars I had to replace a dollar gate card and many other things that was in the car along with my bank card that no one seem to know where It was drive time are nasty sells people they lie and change the prices and it’s not right at all they told me a day my car not was due and I was in process to pay and they came and took my car and informed me we can’t afford to allow you to get one day late on the payment that’s nuts that makes no sense at all and I’m not taking there response if I have to go to help me Howard I will and *** channel news because these people are crooks

the repairs to the purge valve solenoid under the terms of the DriveTime Limited Warranty and the water pump under the terms of the VSCOur customer was assessed a $deductible for these repairs per the terms of the VSCAlthough the following are non-covered components under the terms of the VSC, DriveTime covered the injector wire repair and steering angle sensor as customer service gesturesOur customer was responsible for the spark plugs and fuel tank cleaning as he had driven 12,miles since purchase, the repairs are maintenance, and they are non-covered under the terms of the VSC. On October 10, 2017, DriveTime reached out to our customer to discuss their concernsThe ATP advised the vehicle had been in the shop several times and not called into SilverRockWe reviewed the above information and explained we were unable to accommodate their request to exchange the vehicleWe requested all receipts for out-of-pocket repairs sent for review for possible assistanceThe ATP advised she would send them to us within the next few days and the call ended on amicable terms. We will continue to remain in contact with our customer to achieve an amicable resolution

At the time of purchase, our customer signed and reviewed the Vehicle Service Contract, which states, under subtitle Exclusion-What this Vehicle Service Contract Does not Cover: "All parts not specifically listed as Covered Parts are not covered under this contract…maintenance items/repairs such as engine tune-ups and front end alignments are not covered." All DriveTime vehicles are thoroughly inspected prior to sale at our DriveTime inspection centersParts that fail inspection are replacedHowever, if a part is functioning at the time of inspection, there is no need to replace it. Page one of the "Customer Delivery Checklist" under Important Reminder, states: "Our focus of the multi-point inspection is primarily the safety and reliability of your vehicle…Please insure you are comfortable with the condition of the vehicle prior to purchasing." Additionally, on page one of the "Customer Delivery Checklist" under Maintenance Items, states: "…Maintenance items are subject to replacement only upon failure of the componentAfter sale, these routine maintenance items are the responsibility of the vehicle owner..." On March 9, 2015, we attempted to contact our customer regarding her intention with the vehicle. On March 17, 2015, the repair facility contacted DriveTime and requested we pick up the vehicle since our customer has abandoned the vehicle. On March 23, 2015, DriveTime exercised their contractual right to secure the vehicle and assigned the vehicle to be recovered at days past due. To clarify our customer’s concern in regards to being in default, the payment our customer made on September 12, did not process until September At the time of payment, the account was behind (6) six days and then processed on day (7) sevenThere is no grace period for payments on leased vehicles we can repossess them at any time after the due date
Please refer to page of the Cancel Anytime Lease, section 11, "Default, Repossession, and Other Remedies":
"The following are events of default: (a) You fail to pay any periodic payment when due or any other amount you owe under this Lease when we ask you for it… If you are in default, after waiting any time the law requires, we may do any of the following:… (e)) Take (repossess) the Vehicle wherever we find it and enter any property where the Vehicle may be to do so…"
We have not been in possession of the vehicle since September and are unable to retrieve any belongings out of the vehicle because we sold it at auction on October Once again, we apologize for any inconvenience or confusion this might have caused

when she leased a *** ***The vehicle came with a life-of-lease Drivers Seat Limited Warranty, administered by *** Included you will find the Closed End Motor Vehicle Lease Contract and the Drivers Seat Limited Warranty Agreement for your reference.All DriveTime vehicles are thoroughly inspected at our DriveTime inspection centers prior to saleWe inspect every vehicle for signs of damageAt the time of sale, our customer signed and dated the attached Vehicle Delivery ChecklistUnder “Important Reminder,” the Vehicle Delivery Checklist states:“Our focus in the multi-point inspection is primarily the safety and reliability of your vehicleYou are leasing a pre-owned vehicleWhile the interior, exterior, and paint conditions of this vehicle meet DriveTime standards, any pre-owned vehicle may have minor cosmetic issuesWe do not make cosmetic repairsWe also do not repair after lease damage such as body, glass, or road hazard damagePlease ensure you are comfortable with the condition of the vehicle prior to leasing.”Under “Maintenance Items,” it is stated:“Items including, but not limited to, spark plugs/wires, routine fluid replacement flushes, accessory belts, hoses, struts/shocks, and filters are examined as part of the multi-point inspectionThese maintenance items are subject to replacement only upon failure of the componentDuring the lease these routine maintenance items are the responsibility of the vehicle lesseeDriveTime recommends following the manufacturer maintenance schedule for your specific vehicle.”On April 30, 2015, our customer contacted DriveTime and advised that the transmission fluid in the vehicle needed to be flushedDriveTime advised our customer to contact *** to start a claim for this issue and begin the process for diagnosis. On May 1, 2015, our customer contacted DriveTime and advised she wished for DriveTime to make an exception to cover a transmission flushWe advised our customer that in order to review her account for any exceptions, she must first have a claim filed with ***No claim was ever filed in regard to this matter. On July 13, 2015, our customer contacted DriveTime to discuss her mechanical concernsOur customer advised she was having additional issues with the vehicle and wanted DriveTime to exchange her into a new lease vehicleWe advised our customer that was not an option at the timeWe once again advised her we could not review options to assist without a claim on file. The same day, our customer contacted *** about a transmission flush and issues with the hubcaps and alarm on the vehicle; however, no claim was ever filed in regard to these concerns. On September 1, 2015, we contacted our customer and began working toward an amicable resolutionWe advised our customer we would make an exception to approve the diagnostic fee at an in-network repair facility once a claim was filed with ***We advised our customer once the estimate was complete, we would review her claim for possible further assistanceOur customer elected to accept our assistance and agreed to take the vehicle to an in-network repair facility. Revdex.com:I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below.I did contact Drive Time Customer Relations on 02/13/and was informed by the representative was not in and would need to call back I called back 02/18/and finally talked to *** and stated the credit bureaus will be notified the first week in March that reporting will resume I asked *** when did the issue occur to wipe out all reporting to credit bureaus? *** claims it was 10/that all reporting was taken off credit reports There was no type of notifications sent out by mail or email to inform of Drive Time updating enhancement system *** stated Drive Time was not aware would take so long to correct enhancement system and she does not know why notifications were not sent out to Drive Time customers about not being reported I did not find out until I went to a dealership 01/and only then I placed the call to Drive Time Drive Time can now afford commercials, but Drive Time cannot send out a simple notification to inform of nothing being reported to the credit bureaus As of today my FICA Score is the same as when my car was purchased and Drive Time failed to notify me as to why they experienced system malfunction We all know that when applying for credit it goes on your credit report and therefore when I applied at the Honda dealership 11/and the Kia dealership 01/I was told would need co-signer because FICA not in good standing and Drive Time not reporting Between 10/to present time no notifications were sent Drive Time failed to inform their customer's of any type of system issue and to offer a $credit is an insult to me This situation has not been resolved and I guess my next step is to obtain a lawyer due to Drive Time FAILURE to notify of credit reporting issue Regards,*** ***

"Your contract is a ‘simple interest’ contractThat means a "finance charge" (interest) is charged each day on the amount you financed with usWhen you make a payment, your payment pays interest and then it pays/reduce the amount financed
If you pay late, your contract continues to charge interestWhen you make your payment late more of your payment has to go to pay the extra interestThis means less of your payment goes to pay/reduce the amount financed and it can take longer to pay off your contract with usWe strongly encourage you to make your payments on time!"

At the time of lease our customer signed and reviewed "Motor Vehicle Periodic renewal Lease." Please review page two, section six titled "Types and amounts of require insurance coverage." DriveTime does not have the ability to change our customer’s insurance policy. We have confirmed our customer’s personal belongings are at the DriveTime dealership where she leased the vehicle fromOur customer has days from the date of recovery (January 16, 2015) to obtain her personal belongings. Due to the past due amount of $530.32, recovery fees for $330, and miles driven on the vehicle, we are unable to accommodate our customer’s request to refund half of the amount due at signing. Attached you will the Lease Vehicle Inspection Checklist for your review.On April 10, 2015, our customer contacted *** with concerns about the vehicle vibrating and hesitating*** referred our customer to an in-network repair facility to have the vehicle diagnosed.On April 13, 2015, a repair facility filed a claim with *** for the engine mounts, transmission mounts, and transmission diagnosisAll recommended repairs were approved under the terms of the Driver’s Seat Limited Warranty.On April 16, 2015, our customer took the vehicle to the same repair facility with concerns over the front speaker, steering wheel shaking, transmission jerking and brake noiseThe repair facility found no failure demonstrated with the brake noise, transmission jerking and steering wheel shaking*** did approve the electrical diagnosis, turning the front rotor and replacing the audio speaker under the terms of the Driver’s Seat Limited Warranty.On April 29, 2015, our customer brought the vehicle to a different repair facilityThe repair facility inspected the vehicle for a vibration in the engine mounts, noise in the brakes and a buzzing in the speakerThe repair facility found there was a separation in the engine mount, but no failure was demonstrated with the brakes and speaker*** approved the diagnosis fee on this claim.On April 30, 2015, our customer contacted *** in regards to the repair*** then advised the customer to have the vehicle returned to the original repair facility, ***, to have the repair facility warranty the part of the engine mount and referred our customer back to the previous repair facility.On May 1, 2015, the previous repair facility found no issue with the engine mountA third party independent inspector was to conduct an unbiased inspection for the on-going concerns of the engine mountsAt that time, the inspector concluded that the engine and transmission mounts were in new and good conditionThe inspector concluded that no repairs were needed.On May 26, 2015, our customer contacted *** in regards to concerns with the vehicle’s transmission and air conditioning*** referred the customer to take the vehicle to a repair facility to have the issues addressed.At this time, there are no new updated claims that have been called into ***We encourage our customer to take her vehicle to a repair facility for an updated diagnostic testOnce a claim is filed through ***, we may review for possible assistance on non-covered components under the Driver’s Seat Limited Warranty.On June 4, 2015, we sent a letter via certified mail to our customer’s address on fileThe purpose of this letter is to inform our customer of our attempts to reach out to herWe have made several unsuccessful attempts to contact our customer to discuss her concernsWe encourage our customer to contact our customer relations department at 800-965-8043.As a goodwill gesture, DriveTime has credited $to our customer’s account.DriveTime thanks the Revdex.com for their ongoing supportShould you have any questions or concerns, please contact us by calling us at ***Sincerely,*** **DriveTime

On July 18, 2014, DriveTime recovered the vehicle due to non-paymentAt the time of repossession, DriveTime was unable to verify proof of insurance for the vehicleTherefore, we were unable to immediately release the vehicle back into our customer’s possession
On July 21, 2014, DriveTime contacted our customer and credited her account $as a good will gesture for the overdraft fees she had incurredOur customer completed payment of the past due balance and provided DriveTime with current insurance informationLater that day, DriveTime sent release paperwork to the third party repossession agency and contacted them in an effort to waive any storage fees our customer may have acquired

order to qualifyThis would show that she is able to maintain the payments after the deferral periodAt that time, our customer only paid in $in the past days whereas three bi-weekly payments equated to $We advised her that if she were able to remit payment of $then we would be able to review for payment defermentsOur customer understood and advised she would make a payment later that monthThe next payment received from our customers was on September 1, for $180. On September 11, 2017, at days past due for $1,824.40, excluding late fees, Bridgecrest assigned the vehicle for recoveryWhile the recovery vendor was unable to locate the vehicle, Bridgecrest made attempts to reach our customers to discuss the status of the accountThese attempts continued through the month of September with no successWith no contact or any further payments made, the account entered into a Charge Off status on October 1, 2017. The co-buyer contacted Bridgecrest on October 4, to discuss the past due balanceWe explained to her that the vehicle was assigned for recoveryWe advised her that she was past due $2,on her payments and would need to remit payment of $2,to cease the recoveryThe co-buyer advised she would consider her options and contact usNo further communication was had between Bridgecrest and our customers At this time, Bridgecrest has made several unsuccessful attempts to reach our customersWe are unable to accommodate the desired resolution to clear the past due balanceBoth the buyer and co-buyer share equal responsibility for maintaining the payments on the account

Installment Contract with DriveTime when she purchased a Chevrolet Aveo
for a total sale price of $18,626.58. The “Simple Interest Retail Installment Contract” and “What
You Need to Know about Financing a Vehicle with DriveTime” was provided to
our customer at the time of sale to explain the finance charge and simple
interest and are attached for your review.On
page one of “What You Need to Know about Financing a Vehicle with DriveTime”,
simple interest is explained as follows: “Your contract is a ‘simple interest’ contractThat means a
“finance charge” (interest) is charged each day on the amount you financed with
usWhen you make a payment, your payment pays interest and then it
pays/reduces the amount financedIf you pay late, your contract continues to
accrue interestWhen you make your payment late, more of your payment has to
go to pay the extra interestThis means less of your payment goes to
pay/reduce the amount financed and it can take longer to pay off your contract
with usWe strongly encourage you to make your payments on time.” When
our customer’s account becomes delinquent, DriveTime makes regular attempts to
contact our customer to cure the delinquency balanceWhen our customer speaks
with a loan advisor, they are given the opportunity to set up payment
arrangements on the accountIf these payment arrangements are kept, our
customer will not be contacted in regard to the delinquent balanceAfter further
review of the account, it was found we made regular calls to cure the
delinquency balance, but did not exceed two calls in one calendar dayOn
July 31, 2015, our customer contacted DriveTime, advised she had transitioned
into a new job, and went without pay for a monthA payment arrangement was set
to cure the delinquency balance on August 10, This arrangement ceased
calls until that date, however, the arrangement was not kept and contact
efforts resumed.Since
that time, our customer has made multiple payment arrangements with DriveTime
loan advisorsWhen these arrangements were made and kept, contact to cure the
delinquency balance has ceasedOn
October 20, 2015, our customer contacted DriveTime to inform us that the
vehicle had been involved in an accident on October 15, We advised our
customer to have her insurance provider contact DriveTime in regard to a
settlement check.On
November 6, 2015, our customer’s insurance provider contacted DriveTime in
regard to settlement amount they will be providing due to the insurance claimOn
that same day, our customer contacted DriveTime in regard to the remaining
balance of her loanWe advised our customer we would need to receive the
insurance check before a remaining balance could be providedIn addition, we
explained the interest that has accrued on the loan and reason for the interest
as described aboveAt
this time, DriveTime has agreed to enter into a settlement with our customer,
