Thank you for the update on Ubrody’s situation.  We apologize for any inconveniences we may have caused.  Ubrody’s accepted the credit that was offered to him and also has used that credit and taken delivery of the new items.  Ubrody didn’t purchase his items online he made an in store purchase.  The terms he has quoted are for online in home delivery orders only, these terms do not apply to in store purchases. “In-Home Delivery For Items Ordered Online -- You have 72 hours after a Home Delivery of an online order to report if an item is delivered damaged, defective or if you are unhappy with it in any way. Call the phone number on your emailed order confirmation and we will work with you to repair, replace or pick up the item for a return. Items ordered online for In-Home Delivery with manufacturing defects discovered after the 72 hour return period may be covered by the manufacturer's warranty, if any; please contact the customer service number listed in your emailed order confirmation for assistance.” The terms for in store purchases are on the back of his original sales receipt. Below are the terms for in home delivery orders purchased in stores. “If merchandise is delivered in Damaged/Defective condition and you notify us of this condition within three (3) business days after delivery or pick-up (the “Notification Date”), we will either repair or replace the merchandise or provide you with an equivalent replacement acceptable to you within forty-five (45) days of the Notification Date. If we are unable to replace or repair the merchandise or provide you with an equivalent replacement acceptable to you within this 45 day period or within a mutually agreeable time period, we will offer you a refund of the purchase price paid by you or, where applicable, a reversal of the credit card or financing transaction.” We again apologize for any inconveniences caused. to the Ashley Furniture HomeStore where the customer had purchased their furniture. The HomeStore stated that they have already spoken to the customer today. The customer has a furniture technician scheduled to go to their home today and if the technician is unable to fix the furniture to the customer’s satisfaction they will be doing a full replacement for the items in question.
The customer was satisfied with this answer and would be waiting for the technician to arrive today.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.This rejection is to reject the same offer of reconciliation offered on 3/21/2017, which was also rejected. The attachments show my signature, but none of the initials are mine. Those belong to the salesman.I would not have known that you even had a facility in Mississippi, unless the salesman told me, which he did in front of my wife. Furthermore; the manager claimed the same thing when she denied my initial return request.In Florida, if there is a "No Refund Policy" it must be displayed on the front door and at point of sale. Neither was displayed. I had an independent witness go into the store to verify this fact. Attached is an exert from Florida State Statute 501.142. No Refunds and All Sales Final are generally terms used when a company is going out of business. That is the fair way to display a No Refund Policy.If Ashley was not trying to purposely mislead customers, why would a statement on their main website state: "Built Right Here" "All Ashley Furniture Industries products are designed and manufactured in facilities across America and around the globe." Where else would they be built? On the moon maybe???I also notice that the delivery receipt that I signed (where I noted the damage to the left side upon delivery) has not been included here. The wood on the left side was broken through on one piece and split apart on another. I see no mention of this, nor do I see a delivery receipt.Your statement of refusal to take back something that has been delivered is contradicted by your offer of store credit if I purchase something of equal or greater value.I have reached out to additional state and federal agencies and have presented my complaint to them as well. I also will begin reaching out through social media to various groups around the country to inform as many people as I can of your business practices. A $500M per year company should not treat customers this way.

Thank you for the update regarding [redacted]’s situation.   After further review of Mrs. [redacted]’s complaint, we have reached out to our management team with our online sales department. Mrs. [redacted] received an email at the time of purchase that does state which items would be home delivered and what items would be delivered via UPS. Set up on the UPS order was completed by our technician/delivery team on February 28th as a courtesy service only. We have authorized a replacement of the Alexee dining room table. Thank you for the update from Ms. [redacted].  After re-evaluating Ms. [redacted]’s concerns, we have resolved the issue of attaching the headboard to the adjustable base.  We do apologize however that we will not be able to fulfill her request to return the adjustable base for a refund.  Per the terms and conditions that Ms. [redacted] agreed to at the time of purchase, it states that we do not allow returns on items that have no damage or defects.  Our personnel have verified that the adjustable base is without damage and defects.    We feel we have made a good faith effort to resolve her issues all while working within the terms and conditions of the sale.    Regards, Ashley Furniture Industries, Inc.
