matter carefully and wish to apologize for any confusion that may have arisen as a result of your applicationWe pulled the call with out Customer Service dept and believethis to be a result of confusion between the terms "Pre-Qualified" and "Pre-Approved".As per the CFPB, "Pre-qualification" is a lender’s estimate of how much you could be eligible to borrow based on information you supplyPre-qualification does not mean you will get the loan as it is based on a very limited amount of information about the customer."Pre-approval" usually means that the lender is ready to make you a loan based on the information and documentation you provided at the time you requested a pre-approvalThe email sent by RateGenius only stated that you were Pre-Qualified for a possible lower interest rate on your car loanFrom there, we invite ourcustomers to apply online to see if they further qualify for a lower interest rate. Before a customer can submit an application the last page of the app states "I authorize rateGenius and/or its lenders to retrieve my credit report for the purpose of evaluating the credit worthiness of this loan request, and to service my loan if made, as outlined in rateGenius' Terms and Conditions." In order for the customer to finish submitting the refinance application, the customer must check the box to acknowledge they've read this statementBy checking his box, we pulled the customer's credit report and followed the Fair Credit Reporting ActOnce the application was taken and more information was gathered, however, it was determined by our lenders that due to issues with income, it would not allow the loan to be approved. I am rejecting this response because:I was misled on two separate occasions froma rate genius representative I know the difference between pre qualified and preapproved and however did not need anyone to explain that to me My concern is the fact on two separate occasions someone from rate genius gave me informationOne being the fact that if nothing had changed since the time I received the letter in which nothing had changed that I would be approvedI stated I did not want my credit pulled it there was a slim chance of refinancing for a lower interest rateSecond, being adding my husband and the extra income the representative then stated that it shouldn't be a problem at all with the added incomeI just want people to be aware that when talking to a customer representative from rate genius do you not take what they say to heart because they are not in a place to confirm whether or not a loan will be approvedThey should have stated they did not know whether adding my husband for the extra income would or would not make me qualified to lower my interest rateJust want consumers to be aware and hope this doesn't happened to other people that receive the letter to refinance for a lower interest rate and be misled by rate genius representativesNot to mention my credit was pulled again two days later when suggested by rate genius that added income would help.

July 21, 2017Mr***,I am responding to your complaint #*** submitted to the Revdex.com. In January 2017, RateGenius Loan Services, Inc(“RateGenius”) assisted you with a transaction relating to your vehicle. As part of the application, you provided information and
signed documentation stating the mileage on the vehicle. In May, during the process of securing the new title, the Illinois Department of Motor Vehicles (“ILDMV”) returned the original title as “not actual”, due to the fact that the original mileage on the title was higher than the signed odometer statement provided in your application. As a result, RateGenius contacted you to obtain the actual mileage and submitted a corrected application to the ILDMV. When the title was processed by the ILDMV, the actual mileage was corrected, but in error, the “not actual” status was not corrected on the title. On July 5th, RateGenius returned the title to the ILDMV to have the correction made. RateGenius spoke with the ILDMV on Wednesday, July 19th and was informed that the title is being processedThe processing time is 4-weeks. I am rejecting this response because:Because since I didn't give a Social Security number they should have not been able to through go with the procedure is pulling my creditI did not give approval at the end of the application because I did not complete the application they are saying that they got the information because of my name and address but he clearly is not correct because they should not have been able to pull my credit report without me agreeing to some terms and I didn'tI didn't even finish the application I stopped and since I stopped and they begin to send me emails asking me to completed that meant that the application was not complete and they should not have gone through with the procedure of checking my creditSo this is why I am rejecting what they're saying because they did something they would not give authority by me to doTo me that is a deceptive measure that they use to pull your credit report You say this is not wrong but this should be illegal because they're doing it under pretense is when ever you stop filling out an application that means you have changed your mind do not go through on thisthat you're doing saying I don't want to do it and you don't complete the information that means that you don't want to do itEspecially when they sing you emails asking you to come back and complete the application so they themselves are saying you did not complete the application please come back and completel so they can do what they need to do to check your credit since that being the case they should've stopped the application process at that pointThis means this this is being done to many people and no one is saying anything about it I am years old and I know when you are not wanting something done and you don't complete something that means stop do not go any further and, but this company continues on because they have your name and address? This is not rightNow there is a inquiry on your credit and they say they can't remove it something that never should've been put there in the first place this is wrongThis is my reason for rejecting what they sent to me

to purchase a GAP product. As stated in the documentation you received from RateGenius pertaining to that transaction, purchasing the GAP product was optional and not a requirement to fulfill the transaction. address your concerns properly and completelyWe have spoken to Allied who is one of our GAP Product providers regarding the matterThe reason the GAP Waiver contract that was signed by youdoes not mention the Allied name on the form is because it is a general Waiver between you, the customer, and the lender (in this case, Logix FCU)We have confirmed that Florida law does not require Allied's name to be on the Waiver.We have pulled all calls between you and RateGenius, and on different calls both on April 22, 2015, the GAP product is discussed with you and is mentioned by name by both you and the Loan Officer as being "Allied" GAP a total of distinct instancesWe're unsure where the mystery of the GAP provider comes from, but we are more than willing to have you listen to these calls should you so desire.As for your refund, we are more than happy and willing to issue a refund for the GAP product, as you are still within your legal Day cancellation period which ends on June 27th, We cannot issue the refund however until we have received a signed, unaltered cancellation form from youOur Product Manager that you have spoken with will be able to assist facilitate that.The refund amount will be issued to your lender, Logix FCU, because the cost of the product was rolled into your new auto loan with themSince you did not pay for the GAP product out of pocket (via Credit Card, Check, etc) we cannot issue the refund directly to youLogix FCU paid for the product by adding the cost of the GAP to your loan principal, ergo we will issue the refund (once we receive the cancellation form from you unaltered) to Logix FCU who will then reduce the loan principal by the amount of your GAP priceThis is beneficial to you because this also lowers the amount of interest you would have originally paid on that portion of principal over the term of your auto loan.We appreciate your patience and understanding in refinancing your auto loan with RateGenius and hope that this clears up and confusion or misunderstanding that may have taken place in communications with our staffThank you again for bringing this to our attention and please do not hesitate to contact us should you have any further questionsBest regards,Compliance Manager
