Dunne Wright Services settles class-action lawsuit with tenants over fees, evictions

A large residential property management company has settled a class-action lawsuit with 1,442 Baltimore tenants who accused the firm of charging improper fees and then threatening them with eviction to force payment, the parties announced Friday.

Dunne Wright Services, based in Baltimore, denied the allegations in the lawsuit but agreed to allocate nearly $663,000 to reduce the debts of past and current tenants, to credit their rents and reimburse some costs. The company also agreed to pay $61,500 in tenants' legal fees.

The company, which owns or manages 900 units throughout the region, also agreed to rewrite its standard lease, change its rent collection and property management practices and adjust disputed fees.Dunne Wright also agreed to define "rent" "to include only the fixed sum due from the tenant each month (not including repair charges or utilities, which will be classified as non-rent charges)," the company said in a joint statement issued Friday with Public Justice Center, the nonprofit that represented the former and current tenants.

The agreement on the definition comes as judges across Maryland grapple with the proper application of a ruling by the Court of Appeals. The court ruled in February that a property manager should not have claimed unpaid utility bills amounted to overdue rent for the purpose of filing eviction proceedings against a tenant.

In the settlement agreement, Dunne Wright agreed to abide by the same standard.

Philip Garboden, a researcher at The Poverty and Inequality Research Lab at the Johns Hopkins University who has interviewed hundreds of landlords, called the settlement "a big win" for tenants.

"They've established that you can evict only on rent, not on fees," he said.

Garboden said other landlords will take notice of the settlement and possibly adjust their practices "to avoid being the target of a class-action lawsuit."

Tenants accused Dunne Wright of filing hundreds of failure-to-pay-rent actions in District Court every year not just for rent but also for late payment of water bills, repair fees and maintenance charges. The tenants alleged it was the company's responsibility to cover these charges.

Dunne Wright charged tenants $50 for failure-to-pay-rent actions in District Court that actually cost $27; $70 for filing warrants of restitution that actually cost $50; and a $10 "eviction posting fee" that state law says cannot exceed $5.

In the settlement, the company agreed that it would stop billing tenants more than "the amount charged by the district court."

Tenants alleged that Dunne Wright would apply their rent checks to cover overdue utilities and other unpaid bills stemming from those excessive fees. That left the rent not fully paid, resulting in another court action and the assessment of a new set of those eviction-related fees.

"As a result of this misallocation, Dunne Wright unilaterally deems subsequent payment for rent insufficient, churning the cycle of litigation, late fee, and illegal fee accrual again," tenants said in the lawsuit.

The company then used the threat of eviction to collect, the tenants said.

Under the settlement, Dunne Wright agreed to allocate tenants' payments to outstanding rent charges before additional "non-rent charges," to bill tenants only for the actual costs of filing court actions, and to pay for repairs that are the company's responsibility.

I'm going thru something similar but in florida. These people are the worst. From not fixing things for over 4 months, not responding to emails, calls, texts. Not showing proof of utility charges, can't pay our rent u less we pay the charges, then charge us 125 late fee etc etc.

Progress Residential is an extremely greedy company. I gave the required 60 days notice of non- renewal of lease and now they are forcing me to pay their estimate of the utility bills for two months. They want over $650 when my monthly bills have never been over $167!

I have had issues with them since moving in on August 22, 2016. I have attempted to get out of this lease from the first week. My belongings didn't arrive for a month after moving in and I have only unpacked the necessities and haven't hung anything on the walls.

House was filthy on move in and Ricky Tingle would not put anything dirty, broken, or chipped on the move-in walk thru checklist. I have pictures and my Realtors signature on a paper walk thru form. I'm sure I'll have to hire a lawyer to get my deposit back and overpayment of utilities!

This Company is the worst rental company hire a lawyer, I empty the propety back in August, and they keep the deposit they charge 250 for landscapes, went my yard was one of the most clean in my street, and some crazy things, let everyone know how is this cpmpany

Where do I start...

The first month moving in the hot water was not turned on, the garage door would barley open, and the front door was warped shut do the foundation of the house shifting every week. After 3 months of going back and forth with a glorified secretary (answering service that doesn't serve a purpose), it was some what rectified.

The most immediate complaint is the extra charges that are put on my bill each month that are unjustified. The first month extra charge was because they claimed the rent was late, because the prior months rent was inaccurate and the would not fix it in order to pay. The next problem is I was charged for work orders that were never actually done at my house. They are charging me money every month for random things, and upon inquiring about them it takes 10 calls to the answering services (only because the corporate office and the Dallas office will not pick up my calls) for anyone to help me fix this.

I will never use this company again and I can't wait for this lease to be up...further more I am sure they will have the same standard response for all the other complaints for this one, which just shows they don't actually care about their residents.

I have been leasing a home in GA with Progress Residential for approximately three years (since Dec 31, 2013). During the time I have leased this property, I have found the response time to issues and work orders to be less than acceptable and bordering on POOR CUSTOMER SERVICE. This company is about "progress" but perhaps that is just progress at obtaining funds into their pockets rather than progress at maintaining satisfied customers. As a renter who pays rent timely and keeps the house in excellent condition, it is disheartening to know that companies such as this exist and do not read the numerous negative reviews and take comments into consideration.

As I review the Revdex.com complaints, I see absolutely zero positive comments and over 30 negative comments. That confirms my experience as well. Lack of follow-through without my consistent intervention. I had termites swarming in my house and on my patio and it took over 6 weeks to get the issue addressed. It took from December 31, 2013 until JULY 2016 to obtain a pool pass to the pool across the street from me. There was zero accommodations offered for the lack of follow-through and the inconvenience to me. They just continued to raise my rent yearly!

Now, I have a recurring brown spot (mold) and cracked paint from a leak in the Master Bathroom, on my ceiling in the dining room that I have been addressing since June. The issue was worked on in December 2015, but it was not resolved and now there is no action again... so I am done. I will no longer take days off to allow for the issue to be resolved. Two recommendations were made, and it is six weeks since the first work order was sent on this. They can just wait until I leave!

As a prior military family member, I have moved multiple times and leased several homes in multiple states. Never have I had to deal with this level of poor follow-through and apologies that are merely "words spoken" regarding any inconvenience that has been caused to me.

As a business person myself, I value constructive feedback and seek to improve my efforts to ensure quality service. That does not appear to be the goal of Progress Residential.

Why would anybody want to rent from a company that has NO positive feedback available to review?

This is one of the WORST property management companies that I have encountered. I have not been in my property for 6 months and they have yet to fix issues that were reported upon move-in. they do not believe in making the expensive repairs and at this point I am concerned for the safety of my family since there are electrical issues in the house. I have contacted them more than 10 times and have been promised that someone would be calling to schedule maintenance in 24-48 hours and I still have not heard from anyone. they don't even keep record of the maintenance requests that are called in, in their online portal. all phone calls and customer communication should be recorded to show a record of the performance of the company, and to top it all off they have removed my ability to pay my rent online with no cause. I am so frustrated and regret the day I signed a 2 year lease with them!!!

This company is fraudulent! Amazes me that I have called in several times to speak with the property manager to resolve an issue. People answer and claim that they will relax the message. The first lady who took my info wrote the message sloppy and didn't turn it in. We started that it was an emergency that they give us a call. Still hasn't heard from them. This is not the way you do business. I will be called 3 on your side to investigate cause they wanna try and keep my 1000 dollar deposit. I would say use another company. They try to make the issue everyone else fault.if I don't hear from them today I will be getting a lawyer.

This Company operates by harassment of tenants on a continuous basis and never attempts to resolve major issues. Company also refuses to accept checks and places in a hold in order to attempt to extort mor money and threaten to evict. Also, Company posts properties for rent on Zillow for lease that aren't available to further harass and intimidate for more money by raising current monthly rent. A Company to avoid at all costs.

THis is just crazy   I did not submit 2 payments on purpose    I am a single parent with a son to feed and bills to be paid  
neither if which can be done as Progress has refused to refund their over payment   I don't know any one who has 
an extra 1500 to pay out of one check  
  if they cares about anything other than money , they would refund the money   That's what an organization has an accounting department  
 OT os nothing but pure corporate greed and unethical business practice in my view

We apologize that Ms. [redacted] feels this way. The Progress Residential team has spoken with her on three separate occasions during the month of September to resolve the issue she experienced with the Rent Café system. We have also verified that she will not be late charged a late fee. At this point, we consider this matter to be closed.

My husband and I moved from Georgia to Arizona in 2013. We signed our lease contract, the company gave us the house keys but when we drove to the house the keys wouldn't work. We called the company and they refused to come to the house and open the door for us with the correct key, instead they gave us the lock box code to get the key out. This house was filthy, and I had called days before we arrived to confirm the house was cleaned and ready for move in, they said yes it was but instead we arrive to a home that was so dirty you couldn't even use the bathrooms or showers.

Since moving in we have had so many problems with this home, ceiling leaking when it rains, water bubbles in the ceiling, our furniture, floors are soaked when it rains. The entire garage gets flooded due to the leaking. After many work requests, took them year and half before they fixe the ceiling. As of today the leaking from the window seals have not been fixed yet! Even the inspector put it in his notes to have it fixed!

My sons room smelled like pigeon poop, where we couldn't even use his room. I contacted the company numerous times, it took them over a year to fix the problem.

Pool was cracking and falling apart when we moved in, my children cut themselves many times from the sharp rocks. This took them a year and 10 months before they fixed it. It cost $240 to refill the pool, but they would only pay $65 for this water bill. Countless times we wouldn't receive pool service, ( which pool services is included in our rent) the pool turned green, literally looked like a pond many times and my daughter and I were in and out of ER for infections due to the pool chemical balances were off and not cared for.

We sign out of this home this month in August but till this day there's so many things that need to be fixed in this home that they still haven't fixed or even bothered to respond, we just got tired of requesting and hitting a dead end!

Lastly they have this home advertised as a 4 bedroom 2 car garage but it's a 3 bedroom one car garage!

Whoever they decide to rent this home out to next, I hope they take better care of them because this is the worst experience we've encountered and I dealt with this mess on my own while my husband was deployed for a year! Their customers service is unacceptable!

This was a horrible experience for us leasing from Progress Residential. I wish we would have seen all the NEGATIVE reviews on here as well as all 40 plus NEGATIVE reviews on [redacted]. Not one person has had anything positive to say about Progress Residential and all the complaints and reviews are similar in nature. That alone is very alarming to know that this company is still operating and still out to get money and money only from its consumers. It is also ironic that their responses to complaints on here are the exact same. We paid an $1,100 deposit when we moved into our home. Now, I have heard of people not getting their deposit back for various reasons, but being sent a bill a in the mail stating you owe them $1,700 is absurd. First of all, they said that we did not pay them the last months rent. We sent them our bank statements and the confirmations we got on their end to verify that we did. Might I add we were never late or behind on rent. Then they said we owed them money for replacing the fridge, which totaled around $980. There was never a fridge in this house to begin with and we showed them our proof of purchasing one when we moved in. They sent us a revised bill totaling now around $540 for "general cleaning". Might I add we cleaned this house from top to bottom when we moved out and had the carpets professionally clean. This is not our first bout with renting, so we know what to expect. We are VERY clean people, so it was not a hard task. The e-mail they sent me stated they had to clean the fireplace which we never used, the top of the kitchen cabinets, and drawers which is how they came up with the "$350" general cleaning fee. That is ridiculous and essentially taking money from people. That is what the $1,100 deposit it supposed to cover. When we moved in we also had a leak from the AC that created a constant drip at our front door that grew rust and mold. They NEVER bothered to come fix it after making multiple calls and work orders. The maintenance man came out one day when it was raining and TEXT us saying "it is the rain that is causing this." What an incompetent response and a lazy excuse to not do your job. This company changed names THREE times while we were renting from them and I guarantee it was to avoid lawsuits and the bad reputation they are making for themselves. After going back and forth with them about the money we supposedly owe for them cleaning the house and not being able to cover "general cleaning fees" with our deposit money, I told them I was hiring a lawyer for their incompetent practices. There is a reason they are not Revdex.com accredited and a reason why they have disgruntled renters. There are numerous red flags with this company. I advise future renters to stay far from them, however, they are likely to change their name within the next few months. This company does not care about its tenants, just their money. Their company is not what it stands for. All communication was through e-mail or text. That alone is enough. Stay away from Progress Residential and the many names it will change to.

consistent with Progress Residential’s high standards.  During this review, we interviewed our leasing team and thoroughly examined all communications between the Progress Team and Ms. [redacted]. Our assessment is as follows: Timeline of events: We show the reimbursement check was sent out to Ms [redacted] on 1/8/2016.  USPS attempted to deliver the check multiple times unsuccessfully, the last delivery date was 1/19/2016.  A notice was left by USPS at that time as no authorized recipient was available to take the delivery and requesting re-delivery.  If the item was unclaimed by 2/3/2016, USPS would return to sender. Unfortunately the only address we had at that time was the address listed in California.  Progress Residential has since put a stop payment on the check and reissued on 2/9/2016.  The check will be resent to Ms. [redacted] at that address listed in this complaint.  Progress Residential will also reach out to Ms.[redacted] to determine who she spoke to regarding the status of this check as outlined in her complaint. We regret that Ms. [redacted]’s experience was not viewed as the red carpet experience that Progress is known for.  Based upon our investigation, the check has been stopped, reissued, and sent over night to the resident at the address requested.   We do apologize for any confusion or inconvenience.  We would appreciate Ms. [redacted] removing her complaint due to the findings of this investigation and all charges being reimbursed.

The Property manager has been in contact with me.Rent Payments I have not yet completed discussions with people in the office regarding the rent payments. AC VentsThe vent issues began before the June visit, however, someone came today to measure for new covers. I hope that takes care of this issue.Pest ControlMy husband himself did put traps and such down in the attic as well as the garage. I understand that pest removal is tenants responsibility, we just wanted the property manager to attend to the entry points that the pests were obviously using to get into the home. A Pest Control company came yesterday and put down more traps. Leaks/Water spots from roofSomeone was here this afternoon. Checked it all out and said the roof itself wasn't leaking but that some pipes had been compromised most likely by animals in and around the attic allowing moisture to get in. He said he caulked and it should fix the issue. Essentially the property management team has been helping to get the issues taken care of, however, they aren't all finished yet.

Where do I start, me and my husband is a military family who moved to Texas from Virginia and found this company. I was so happy about the price and service they offered. We signed lease 7/1/16 and moved in after military brought us 7/10/16 and I had problems the day I walked through the door. I first got locked in the house and my husband had to take door apart. I called made a report and never heard from them, let me back up to when I first walked in and all my lights where on and a/c was on 65 I ask them why would they do that especially if I'm responsible for charges and they told me they didn't know who left it on. Not once did anyone ask about helping with the bill. I then tried to cook dinner to find out my stove didn't work it was shot and the dishwasher leaked water. I called them and got the run around for 2 wks till they sent someone out just to tell me it was not working and he couldn't help. I ask what should I do he said I should hear from the office another week went by and still no call it's now 4wks past 5 wks in my house and no working appliances. I hate that we are dealing with this especially in a new home and all the hard work my husband does to serve this country he has to come home to all these issues. I just need people to know so they don't have to experience the pain we are going through right now. I still haven't heard from anyone and still getting the run around and no help with the usage they used or anything off the rent after not having working appliances. DONT send yourself through this. I now have to find a lawyer and call the military to help us with these issues.

Progress Residential is a money- greed driven company that will try to swindle you every chance they get. They will send emails and ask for a response but it is a black hole of communication. You can never reach them. Joshua M** ( TN) has horrific manners and is rude even in email format. I cannot wait until our lease is up so we can move just to get away from this rental company. Customer Service should be your #1 concern- the ludicrous amount we pay in rent warrants a response in regards to serious questions/concerns.

a window leak (non-emergency). A technician was sent out to determine the scope of work and time needed to make repairs. Progress Residential has since been in contact with the resident and a repair date of August, 22 has been set.
