I am in receipt of your letter with the resident’s complaint dated April 24, 2017. I am working with our corporate office in order to write a formal response to your correspondence. However, I can advance that there is new management since July at Mission Hills (Greystar),
and the entire staff is new since then as well, and we are unable to comment on anything that occurred prior to our company’s taking over the site’s management obligations. Allegations surrounding my employee’s actions have been grossly misrepresented as there were other witnesses (employees and residents) who witnessed the events with Ms*** Unfortunately due to privacy laws I am unable to disclose their names outside of any official investigation proceedings at this time Ms***’s boyfriend also came in to inquire what had happened on the day of her visit and interaction with Ms***, following issuance of the lease violation (under paragraph of the TAA Lease Contract) and he stated to my Leasing Professional, *** ***, amongst other things, that he had advised her to “calm her temper” since they had had similar issues with the previous apartment community they lived in prior to Mission Hills, and that is one of the issues they are having in their personal relationship, her impulsive temperament Additionally, the apartment in question (#1136) had been leased to a new tenant since 4/1/2017, which by Ms***’s own admission, she attempted to cancel her notice on or around 4/12/2017, which would have been impossible to do by the office at that time. We are contractually covered under the TAA Lease Contract to support our decision to not accept a cancellation of notice. Hopefully this helps shed some light on this matter as I continue to work on a formal response for your organization

The delivery team tried many times with many voice mails left for the customers for more then a month to try and deliver this tv. the customer had not responded to them oncethey finally did and wanted a return thinking this was a tv purchased from another companywe can not loose $

Hello Ms. [redacted],As previously stated by the community, there was no wrongful billing assessed to unit #[redacted], and aside from the prospective tenant cancellation, Mission Hills have contracted companies and vendors, outside of our staff that have witnessed the smoke damage (from tobacco use, not cooking or as otherwise suggested in your response) to the unit was indeed serious and substantial. I fear that your opinion, will not be properly substantiated by the actual evidence of the damage to your apartment the community possess, but you are respectfully entitled to your position, however, we demand that you cease to continue to make false accusations with regards to our business practices, unless you have something more than your opinion and hearsay statements. With regards to other matters concerning the community's reputation, some of which are unfortunately often times misplaced (out of context), exaggerated and/or speculative, if I may add, is indeed irrelevant to the issue at hand concerning the damages caused to your last occupied apartment at the site. Mission Hills understands your legal right to complaint with the Attorney General, but typically, as with any complaints filed with any government and/or regulative organizations, have to be investigated by default, it does not imply guilt by default. Therefore, we will be prepared to show any of the referenced organizations any needed documentation in order to show the transparency of our processes. Mission Hills is committed to providing excellent customer service and is focused in maintaining as well as improving the community to the best of our abilities, but this process includes holding residents accountable for their legal obligations to properly maintain the leased premises, during and after their residency with us.Thank you in advance for your time and understanding in this matter. [redacted] The [redacted] vacated apartment #[redacted] back in February 2017. The unit was preleased to the next scheduled tenant within a week’s time, upon receipt of the unit, the smell of smoke and yellow nicotine on everything around the apartment was overwhelming and since our usual turnaround (5-7 days) time to make an apartment ready for the next tenant was not sufficient to get the issues handled accordingly in this unit, that new prospective tenant ended up cancelling their application with us. Furthermore, it took several attempts to get the heavy smoke smell out and replacing all light fixtures, blinds and ceiling fans. We also had to replace the carpet/pad, seal the subfloor, and repaint the unit and seal the walls while doing so, but the smell was still not eradicated. We have resorted to smoke remediation treatment as a last resort and hope that will eradicate the issue enough for the next tenant. Please note this unit has indeed been unable to be re-leased since February. We have supporting documentation as well as documented photographs to show the condition of the unit at move out and I do not feel that any of the charges were unlawful and/or inadequate based on the terms of the [redacted] signed lease contract. The same thing applies to the water billing, for which we have contracted legal assistance to respond to the PUC as the [redacted] have also filed a separate claim with them. While we continue to research the Conservice claims involving the utility company and meter information, I do not feel that Mission Hills acted in bad faith or unfairly in the final deposit accounting process as it refers to this tenant. Should a legal dispute arise as a result of this matter, the situation should be addressed to include our retained legal counsel on the matter, [redacted], out of Austin, TX. I hope this helps shed some light with regards to this matter, and show that we processed this final accounts, just like we process any other one, on the basis of factual documentation and careful inspection of the units as assessed by the professionals who completed it as well as the lease contract the past tenants had agreed and signed to. I am rejecting this response because: This response will be addressed in sections. Section 1: You said the smell of smoke and yellow nicotine on everything around the apartment was overwhelming and a perspective tenant canceled with you. We have professionals who were in the apartment and no such things occurred. The apartment was spotless. The smell of smoke was not present as we have witnesses to this as well. The perspective tenants did not need to sniff the apartment they just needed to read your reviews,check the crime level in your complex,look at all of the dirty corridors ( I believe you can see those on yelp) look at your billing practices in reviews, to understand what your business is all about. This statement just another lie. We have professional documentation and pictures of everything. The perspective tenant canceled, you made money there too, as you charge for your application. I would like to see the receipts for your refund to them. Apt # [redacted] was rented to us 3 years ago, any unit is considered a MAKE READY UNIT AFTER ONE YEAR as per professionals. If you do not want smoke of any kind in your units you should state that in your lease, you make your pet policy and your fee upon fee upon another fee VERY CLEAR as your policy why would you leave out NO SMOKING for 3 YEARS and then try to steal deposits. This should be very clear to anyone renting from you, have it signed accordingly by the tenants. You do not. Bait and switch is what you do. No BBQ in the kitchen it makes smoke, no smoking in units should be made very clear to people before the move in not 3 years latter. The proof is in our professional documentation and our very many many pictures of unit #[redacted] as by our witnesses who just happened to be none smokers. You want sniffers coming into tenants apartments without notice, next time you should think about getting a warrant, this is still America and we do have rights. Sniffing is not maintenance. I will need to see your professional sniffers credentials as well.Section 2: You said you had to replace light fixtures,blinds,and ceiling fans to eradicate the smoke smell. They were sanitized and professionally cleaned, no possible way there was any Oder of any kind.Please note you cant rent any units no less this one. Maybe its the dirty diapers full of poop that are constantly in the parking lot and corridors. Or maybe its the gang activity, you think? No you don't.Section 3: You said based on your supporting documentation as well as documented photos? What exactly is a documented photo you either have photos or you don't, non the less to show the condition of unit [redacted] at move out and you do not feel any charges we unlawful or inadequate based on our signed lease. Where in our signed leased does it say no smoking? Show me the clause, it is non existent. Bait and switch again, everything in that unit was better then we found it when we left including painting. The paint your maintenance provided was full of mold and we were told to use it but we didn't, painting with moldy paint is another practice you like to do. Talk about allergies mold all over the walls thats what is yellow your moldy paint. Photos of that too. You should have used the pictures I have of the unit [redacted] at move out to rent it out, it is truly clean and beautiful. Carpets were professionally cleaned and deodorized by a professional carpet company.Section 4:You say the same thing applies to the water bill for which you have contacted legal assistance to respond to PUC as the [redacted] family has filed a separate claim with them and that you do not feel like any wrong doing has or had happened. First of all the [redacted] family did NOT file any such docuemt or claim with the PUC. The Attorney Generals office of Texas did we did not so another lie. Now They did send me a letter that they feel like you should be investigated. Your retained law firm should address the state of texas as they are the ones filing the claim not the [redacted] family. No water bill of any kind was unpaid to conserve or mission hills apartments. I have receipts and proof of this as well. So dont try to say we owe you 500 or 600 dollars..lie again. Section 5: Maybe you should tell your maintenance team not to smoke in the corridors of the building any more as well. Maybe your professional sniffers could address this as well. Their smoke gets in the vents and you should replace the whole building very carefully and do a careful inspection have the building assessed by professionals as they smoke in there everyday all of the time. Guess only certain people can smoke there, but tear the building down because it smells like smoke to perspective tenants, got to replace everything...its what you are trying to do to us...[redacted] needs to be addressed as well. Not a word about any of that in your response nope not one word. Gee I wonder why that is you say you care so much. Its ok to make fun of people with a disability just don't smoke of course you are not told that until you leave so you can REPLACE EVERYTHING. Don't forget to do your due diligence and tear the building down cause it smells like smoke from your employees smoking in the corridors....weed too did I mention that called cops for that too. SAPD said there is high drug use at your apartments. Go figure. Thank You in advance for your time and attention to this matter.
