Merrick's lock box vendor receives the mail from the Post Office times a day every day except Christmas day. Payments are posted on the day they are received. As stated in the reply the Dallas Texas post office has experienced delays in delivery of the mail. Merrick does follow the law and take the responsibility of posting payments to its accounts seriously. The reply pointed to many other ways to make payments to avoid the delay with the post office. MsLoonan can use one of those methods or she can send her payment days or more before the due date

A review of the account was conducted. According to Merrick’s records there have been two credit bureau disputes alleging that the account was not opened by Ms***. Merrick investigated the disputes and concluded that that account is not fraudulent and was in fact opened by Ms
***The account was opened in August and was used for the purchase of goods and services. As stated above it appears that this account belongs to Ms*** and the credit reporting sent is accurate and will not be removed or changed. If Ms*** has some documents or proof to the contrary Merrick will re-investigate once that information has been provided I have enclosed a copy of the application, letters sent and statements reviewed for this response

The account which has been owned by Merrick since it was originated is currently being reported as a charge off. The account was charged off July 2010. The reporting of the account status to the credit reporting agencies is correct as is required by the Fair Credit Reporting Act. Merrick will not change of delete that reporting to do so would be a violation of the Act. Enclosed are copies of statements reviewed on the account

MsP*** applied for a secured Visa credit card account on May 28, 2015. At the time of the application MsP*** sent a $deposit for the account. On June 16, a refund check was sent to the address on the application. The check has not been cashed and Merrick
will reissue the check. In reviewing the application it appears that the full address was not included on the application.
MsP*** should receive the refund check in the next 7-days. I have attached a copy of the application received so that you can see the discrepancy with the address. If MsP*** has not received the refund check by August 8th she can contact us at *** and ask for the accounting department to check on the refund status

Mr*** opened an account with Merrick in July and has used the account for the purchase of goods and services. In April when he made his payment the minimum payment due was $***The payment received was for $***This was $short of the minimum payment dueThis is what
caused the late fee of $that was assessed to the account.I have requested that fee to be waived as a courtesy; Mr*** will see this adjustment on the June statement for the accountA fee waive does not reduce the minimum payment due in the month the fees were waived but that waiver does reduce the following month’s minimum payment dueMr*** will need to make the full minimum payment due as shown his May account statement and then the June minimum payment due will be less due to the fee waiver. No late payments have been reported to the credit reporting agencies

the pending account closure on October 2, 2017. Merrick will not re-open Mr***’ accountThe cardholder agreement between Mr*** and Merrick allows either party to close the account at any time, and allows Merrick to do so for any reason without prior noticeMerrick reported the account as “closed by credit grantor”, which is the correct reporting on the account

guaranteeOn that day Merrick provided a provisional credit to Mr***’s account, began an investigation of the claim, and began the process for submitting a charge back to the merchant for $Mr*** contacted the dispute department on September and October regarding the status of the disputed transactionThe Merrick representative explained that the investigation was ongoing and that he would be notified of the outcome When a merchant has a no refund policy it is difficult for the Bank to successfully charge back such a purchase. Once the investigation has been completed, Mr*** will receive notice of the final outcome of the investigation. If the merchant accepts the charge back a permanent credit will be issued to the account. If the merchant refuses the charge back the amount in question will be re-billed to Mr***’s account

Merrick will apologize if the representative was less than professional in the interaction with MsS***. However, the issue remains that it was MsS*** bank who rejected the requested payment and MsS*** is the only one who can remedy this issue
