I am rejecting this response because: Merrick never credited my account for $I have talked to several managers in the dispute deptKatie and SherrodI sent in a fax that was for a receipt for merchandise I returned on January 10, and also Nov29, I was told that they denied my claim because they assumed these credits was from the original dispute filedWhen it was for a separate transaction and it is not relatedIf a credit was posted why can't Merrick produced proof as I didI can upload the receipts but I am unable to do so from my home PCMerrick has record but I will upload it when I get to a location with a scanner as I don't have one readily available nowPlease ask MERRICK to provide the proof of the credit and not assumed credits for items I returnedPLEASE HELP!!! This as went on long enoughEven their employees say that their is miscommunication between the departments and they are not looking at the evidence that I so graciously presented them.

Merrick's response regarding this issue is correct. Merrick will not remove or modify the credit reporting on this account as it is correct and accurate. The returned payments were the reason for the charge off and that has not changed

I am rejecting this response because: No resolution was offered by the company!
The letter sent to me was week after the closure of the account and me calling times to get an answer as to how I can use a card one day and it be marked as a charge off days laterI called in several times asking for an explanation only to be transferred to a collection company each timeAlthough there were payments that were returned,they were not in sequence, and that is over the life of the account historyThere are more than likely 50+ payments that cleared as I always kept the account in good standing and I even tried to explain that the payment being returned the last time was because of unauthorized withdrawals to my checking accountFurthermore, you can not go from "Paid as agreed' to "charge off collection" in dayYou are violating the FCRA by doing soIt would be one thing if you marked it as past due or even pays days late, which would be the next step to take on a collectionAs a business owner I deal with a collection company on a weekly basis for our accounts that customers owe us money on and I am well versed in the FCRA lawsYour company is violating collection laws with your actions. With that being said, I would like the charge off removed from my credit reports and when this is done, I will pay what I owe and move on from this experienceShould the negative publishing on my credit reports from your company not be removed within the next days from today's date, then I will simply file a case in small claims court for the credit line and the filing fee'sYour company will have to send a representative to defend the action which will cost a lot more than simply removing a negative rating that is unjustly put on my credit reportsOr your company can ignore the filing and I will receive a judgement for the amount and seek to collect in every manner allowable by lawI hope that this can be resolved amicably and we can part ways.

Mr*** opened an account with Merrick in February 2013. Mr***’s account has had a zero balance and there has been no activity for a year or more. Merrick’s decision to close the account was based upon the inactivity of the account and no other reasonThe cardholder
agreement between Mr*** and Merrick allows either party to close the account at any time. Merrick will not reopen Mr***’s account
A review of Ms***’s account was conducted. This review included listening to the calls Ms*** made to Merrick on July 15, regarding the balance of her account. The associates on the three calls reviewed all explained to Ms*** that the balance of the account showing on
the online cardholder website was correct. The balance on that day was $9.00. Ms*** had attempted to do a transaction for $to her church and that transaction was declined. All of the representatives explained this process to her during the calls reviewed Ms*** was advised that Merrick accounts do not allow over draft for any amount. The representatives explained to her the process for the posting of pending transactions on the account including payments. I did not find any indication in the calls reviewed that the representatives were not informative and helpful with the information on how the account works
A review of the account opened by Mr*** was conducted. On February 17, Mr*** made a payment of $1,which was in excess of the balance reflected on the statement dated January 26, 2016. However, charges made by Mr*** between the January and February statement,
plus interest, left a balance of $owing on the account in February As Mr*** mentions in his complaint, he has scheduled automated recurring payments to be made to his account at MerrickThe recurring payment schedule authorized by Mr*** was to pay the statement balance and this is what occurred in March (the February balance of $was made on March 20, 2016, as shown on the March statement), and in April when the payment for $173.62, which was the balance shown on the March statement, was made on April 20, The April 20, payment of $was subsequently dishonored by Mr***’s bank as being unauthorized, which is shown as an “adjustment” on the April statement Mr*** received email reminders of the scheduled recurring payments and an email confirming the payment was made for the amount he had previously scheduled as recurring. Copies of those emails are attached. Mr*** discontinued the recurring payment schedule on April 25, 2016, after the April 20, payment had been processedIt is Merrick’s policy to close accounts where the account owner indicates that payments received by Merrick have not been authorizedThe cardholder agreement explains that Merrick can close accounts at any time for any reason or no reason Mr*** indicates in his complaint that he had paid the balance in full but there is still a balance on the account as shown on the statement dated June 24, This balance has not been paid as of the date of this response I have attached copies of the statements reviewed for this response and the emails referred to above
goods and services. A review of calls between Merrick’s customer service representatives and Mr*** were reviewed. On April 27, Mr*** contacted customer service and requested assistance with the available balance on the account. Mr*** explained that he
needed some of the credit line to be available so that he could purchase some necessary itemsThe customer service representative indicated during the call that she could waive the purchase interest on the most recent statement and that would allow $of the credit line to be available in 2-business days Mr*** contacted Merrick again on May and twice on May regarding the request he had made on April because the amount that the customer service representative had indicated would be available was not showing on his account. During the calls with Mr*** on May 5, both the customer service representative and the supervisor who spoke to him indicated that the original representative had made an error in indicating that she could waive the interest for the account owing on the statement. The second call with the supervisor and Mr*** was not handled in a professional manner Merrick apologizes to Mr*** for the issue surrounding this request and for the manner in which the supervisor handled the call on May 5. Merrick has issued the credit to his account in the amount of the promised interest waiver of $25.47. In addition Merrick has given a courtesy credit to the account of $50.00. Mr*** should see these credits to the account in the next few days

Mr*** opened an account with Merrick in February and has used the account for the purchase of goods and services. The due date on the account is the 27th of each month. The last payment for the account were reviewed. One payment was made on line and posted
that same dateThe other payments were sent via the US Postal service. of those payments were posted within days of the date the check was dated. The other one dated April 19, took longer than that. It was posted to the account on the 4th of May. It is unclear why that payment took so long to post to the account. Mr*** has received late fee waivers in the past monthsIt is Merrick’s policy to post payments as of the day they are received. Payments are posted each day until 5pm ET if received via US mailOn line payment are posted as of the date they are received until 11pm ET. According to the USPS mail from Florida to Texas can take 3-days to be delivered. Merrick will not waive any additional late fees or waive interest on the account

I am rejecting this response because:Their statement is as per their own employeeThey give CA residents days notification prior to shutting down the accountMy credit score was vastly affected by the closure of my account, in which they take no responsibility forAs for the agreement, I find it funny that they stand behind a document that not one of their constituents readIf so, they would not be closing accountsThis is unresolved because they have no way to rectify this in their eyesThey should reinstate the account and allow me to use the cardRedirect the reporting agency that the account has been reinstated and remove all remarksIt can be done They just refuse to do it I am a customer who does not/did not want to close the accountI find it unprecedented that they refuse to reopen an existing account in good standingBut I guess, to this company, an account in good standing is one that continuously secures high interest rates, and excessive revolving debtThis is unacceptable.

Mr*** opened an account with Merrick in January and has used the account for the purchase of goods and services. The terms of the account and the application of payments were disclosed to him at the time the account was opened. Interest on the balance of the account is charged
each month based upon the average daily balance of the accountThe interest amount is part of the minimum payment due each month as shown in the cardholder agreement, section 5, “How Interest is calculated”. If Mr*** makes more than the minimum payment due each month the available credit is increased after the interest owing that month is deducted from the payment. I will use the January payment Mr*** made as an example: Balance before payment application = $ Payment received of $ Interest charged for this cycle = $ Late fee charged for prior month = $ Balance after payment application = $ Available credit after the payment = $ Mr*** can always make larger payments to reduce the amount owing on the account at any time. Also, if Mr*** is having difficulty making payments on the account Merrick has several payment plans that can help temporarily. He can contact customer service at 800-253-to find out what those options are and choose one that fits his financial situation. Merrick apologizes that Mr*** did not received the type customer service he felt he deservedWe will address this call with the supervisor and provide additional training as needed

I am rejecting this response because: Apparently Merrick Bank sold this account to a third party, in that case Merrick bank must remove their trade line because they do NOT own this alleged account no more. If there is one account and two entities are claiming it, that would be double reporting which is clear violation of the FCRAMerrick bank indicates if they remove the trade line it would be clear violation of the FCRA but they are already in clear violation of the FCRA because they are reporting and verifying something that does not belong to them anymoreI reject their response and I believe consumer complaints about their experience with Merrick Bank is clear indication of the record of this BankMerrick Bank is abusive and their activities in many areas are illegalIn the attached documents they have failed to provide any statement that shows charged off date and subsequent outcomesThank you for your assistance

I am rejecting this response because: I ACCEPT the waiver of Fees I was given, including the latest one in November However, Merrick Bank needs to accept responsibility for NOT FOLLOWING THE LAW, if the law states they must post as soon as they receive the paymentThat is not happening OR they are DELIBERATELY not collecting from their P.OBox payments in a timely manner to allow for processing and positing to my account as well as others, before the due dateI checked complaints about Merrick and I was not the only one who was having issue with them NOT positing payments, including those made other than snail mail, to accounts in a timely mannerDallas, which is where the Post Office Box is we mail payments too, was not the epicenter of Hurricane HarveyThat's number oneNumber two, of the months these fees were posted, after I mailed the payment and days prior to due date, OCCURRED BEFORE any hurricane hit Texas!! I sent this last payment for the November statement in full and mailed it on November 14, some days prior to due dateI HAVE CANCELLED this credit card and will have one more payment to pay due December 28, I will make another complaint if the December Bill contains a late fee and interest fees!!

A review of the account was conducted. According to Merrick’s records there have been two credit bureau disputes alleging that the account was not opened by Ms***. Merrick investigated the disputes and sent Ms*** a statement of fraud to return to Merrick. Merrick never received the statement of fraud back nor any other information from Ms***Therefore, Merrick concluded that that account is not fraudulent and was in fact opened by Ms***The account was opened in August and was used for the purchase of goods and services As stated above it appears that this account belongs to Ms***The credit reporting related to this account is accurate and will not be removed or changed. If Ms*** has documents or proof that this account was fraudulently opened, the Bank will re-investigate her claim once that information has been provided I have enclosed a copy of the application, letters sent and statements reviewed for this response
