Complaint: [redacted] I am rejecting this response because: Notice was never sent to me or receivedGM Financial has refused to provide proof of notice being sent on 12/18/This noitice was allegedly sent prior to any enhancements made on the GM Financial system which have absolutely nothing to do with me or negates GM Financial of their legal responsibility of providing said notice even after GM Financial called me on 12/BEFORE their subsequent system shut down and was told by me that notice had NEVER arrivedAnd that conversation was recorded and authorized for being? recorded by GM Financial rep [redacted] ***I will be contacting the Illinois States Attorney Office as well as a private lawyer because no notice was sent in accordance to Illinois Repossession LawAnd GM Financial has refused to provide a tracking number of the notice or any other documentation to provide the whereabouts of the notice ssupposedly sent on 12/18/The system shutdown is the companies issue not mineGM Financial should have had other alternative measures put in place to handle any issues that were to arise during the shutdown which concluded on 1/8/and not 1/5/as they stated in their notices to their customers.? Revdex.com: I have reviewed the response made by the business in reference to complaint ID 11518553, and have determined that this does not resolve my dispute Please enter your reason(s) for rejecting the business response belowThe response from GM Financial is dissatisfying and unnerving to say the leastI know that I was behind two months and as I stated I was contacted by a representative that discussed several options with me, one of them was a deferment that she stated I was eligible forI told her that I was getting married and before I take a deferment I wanted to try to pay for the two months with my expected wedding giftsGM FINANCIAL's rep TOLD ME to TAKE MY TIMEShe NEVER told me that I had a certain date or amount of timeIn fact she told me that I could wait until after my wedding and honeymoon and then call you guys......again with no date givenMy wedding was already fully paid for and was unemployed (I lost my job in March and had to depend on my family to give me money until I could get a job or some means of additional incomeSo why would I outright deny a deferment.??? I certainly did NOTWe discussed it and I was given the option to wait until after the weddingNo one in their right mind would deny a way to keep their vehicle and risk having their vehicle repossessedTo add to that, she made erroneous notes on my file, she did not put any notes stating that she informed me of any dates and put in a "NOT TO CALL NOTE" in my file, which I was informed of AFTER my vehicle was told by a rep who was giving me the info on where my car was towed toSO not only did you make a decision to repossess my vehicle but didn't even notify me of such all due to your repI find your response to be insulting and shows that you will risk customers and their livelihood before admitting any wrong doing on your behalfCommon sense would show that no one would purposely not make contact or any effort to keep their vehicle if they had the information that YOU statedYour inability to see the miscommunication and error on your side that led to this repossession is disgustingI get that your company needs to protect its interest but not at the expense of your customerThis would have all been avoided if that do not call note wasn't on my fileif I was informed I would still have my vehicle and GM Financial would not have to go through the paperwork involved with a repossessionNot to mention that a repossession doesn't look good from a financial business perspective on your end either It was an error that could have been avoided and the response that was given was not acceptableI am still planning on seeing legal advice on the errors made by your rep because I'm sure putting an unauthorized note like that in my file without my knowledge or consent has some illegality to it especially since it resulted in a repossession that has a significant negative and long lasting effect on my creditI feel horrible and I will never refer anyone to your business and I will tell anyone who asks how you take advantage of people who are struggling and make surprise attacks by repossessing their property with no prior notificationAs I stated, I will contact an attorney at some point Regards, [redacted] ***

The reasons I was paying after due due date was because my payday was after the due date and because every time I called or answered your courtesy calls about my payment before I was told "well, its not actually late until so in so date" And as long as you promise to pay before this date we wont charge a late fee and we wont ding your credit Not one time before was I ever advised or notified that this interest was being added every day I payed after the due date You deceived me by telling me its fine as long as I got that payment in before the grace periodAnd of course you tell people that, you want them to make arrangements to pay after the due dateYOU MAKE MORE MONEY THAT WAY!! I believe you withheld that information on purpose, you know most average customers like myself don't know about these daily interest charges, most are concerned with keeping their credit in good standings and having no late charges like myselfTo me being told " Its really not late till this date means its really not lateAnd the reason I had to defer payments and have my due date changed was due to changing jobs and I did everything in my power to work with GM Financial to make sure my loan got payed during my transition Finally in early one of your officers with a heart contacted me and asked if I was aware that I had interest charges accruing and worked out a payment plan where I made several increased amount payments until I was ahead to the point of paying before my due dateFrom that point forward EVERY payment was made approx weeks earlyThe whole second half of the loanHad I known about your daily interest accrual prior to this I would have done the same from the beginningBut I believe you withheld that information intentionally and have probably done that with many other customersWhy else would you have a department created and devoted to working with customers to make arrangements to pay off these unknown interest charges that were screwed out of them the same way I think they call this deceitful practice Loan SharkingI believe a judge would see it the same way

Your loan matured on November 9, 2013, at which time the remaining balance of $1,became due in fullPlease understand that this is a simple interest contract, meaning that interest accrues daily in the unpaid portion of the Amount FinancedOn the maturity date of your account, the late fee balance owed was $An additional late fee assessed for the final installment due date in the amount of $on November 20, 2013, bringing the total late fee balance owed to $? GM Financial received partial payments on December 12, 2013, January 14, 2014, and January 31, These payments paid the outstanding Amount Financed and Finance Charge balances and paid $towards your late fee balanceA notice regarding the maturity of the account was mailed on November 9, and notices regarding the late fee balance were mailed on February 14, and April 17, All notices were mailed to your address of record.? Our records of your account also reflect that on January 14, 2014, you contacted GM Financial and set up two payments in the amount of $each dated for January 14, and January 31, During this conversation you were advised that a late fee balance would still be owed after the application of these two payments; and that once all balances have been paid, the title would then be releasedOur records further reflect that telephone communication was not attempted regarding this balance as both parties to the contract unauthorized communication at the telephone numbers on file via MyAccount online.? GM Financial is stating that vital recovery should answer questions however GM Financial is reporting the account statusThe reporting of this account as derogatory is incorrect and vital recovery agreed to remove this account upon paymentThis account was paid as per the settlement yet the remove of the account was not completed by GM FinancialI also plan to submit a complaint for Vital Recovery as they need to address their actions as wellGM is responsible for the account status and needs to update the account per the agreed terms with Vital Recover
