Mr*** registration had already been cancelled by Exceed prior to his contacting us.We did so in conjunction with requiring our national marketer to terminate its contract with the company that had been marketing our program in the state of ***, which we did upon completing an
investigation of similar allegations.The program we provide to homeowner is truly wonderful, and there is no reason ever to fail to accurately describe the program.As a result of what occurred in ***, numerous redundant steps have been implemented to be sure that 100% of homeowners joining our program 100% of the time will know 100% of what there is to know about our simple program.We genuinely appreciate Mr***, and other *** homeowners, who were kind enough to take the time to let us know what occurred.Sincerely,All of us at Exceed
My name is Irwin and I am writing this in regards to a company named Exceed Inc. This is a fraudulent company who preys on older citizens and tries to scam them. They took advantage of my wife Elvira Kaplan. They sent us another check on 4/11/17, which we are still holding. Someone must stop this company from taking advantage of older senior citizens. This is a copy of the letter sent to them on 1/23/17. Please help us! Thank you.
In January of 2014, my wife Elvira Kaplan went shopping in Waldbaums supermarket in Merrick. Upon entering the store she was approached by a man who told her that if she signed an electronic agreement, he would pay her $400 per year for five years. He gave her no details other than she would have to use a cooperating real estate broker. We never received a copy of the agreement. He definitely was going to extort and scam her because she was a senior citizen. I know nothing about this until March of 2016 when I received a check for $400. I immediately reached out to them and all I got was the runaround. Some notes I have found out so far; their agreement states that ALL parties holding title to the property must sign. I never signed anything. On 5/11/16 they sent a letter saying that they sent a copy of a check that had cleared. I never received a copy of the check. If my wife actually cashed a check and they could provide proof, I would gladly return the money. On 5/2/16 they sent a letter stating that they sent a copy of the electronically signed agreement. I never received that either. Enclosed is the check they sent on 3/10/16 uncashed. I would like this phony agreement terminated.

When anyone foolishly suggests we are a scam, we always ask how could this possibly be, but no one ever has the courtesyto reply. This is because it is impossible we could be a scam.

The independent marketer Mr. [redacted] wife spoke with was barred from marketing our program soon after he spoke with her, due to our discovering situations similar to what she experienced. We have asked Mr. [redacted] to please write void on the check and mail it back to us, and we apologized...
for any inconvenience this may have caused them.

The company is a bully and uses underhanded tactics to sign people into a realtor contract. Now, when you call them on it, they get rude and immature trying to act as if we, consumers, are the problem instead of fixing a mistake. As I have read one complaint after another, it has become obvious that they do not intend on changing their practices and only getting people out of these false contracts after contacting the Revdex.com to try to keep a good rating here. I debated simply rejecting their rude cancellation letter but it does meet with my request and shows this insane contract cancelled. I will keep this correspondence as a note as well. The marketer is no longer marketing our program.After similar incidents became known to us, we began using a third party verification company who speaks with every homeowner who signs up for our program, and with the homeowner's permission, in a recorded phone call, verifies the information provided during registration, confirms the homeowner reviewed the agreement, and that the homeowner e-signed to enter into the agreement. We began to do so to eliminate in the future any homeowner ever being able to falsely claim they themselves did not register for our program.Pursuant to his wishes, we have cancelled [redacted] registration in our program, and as a result, as he desires, we will not be paying him $1,000 for which he would have paid $0.Thank you.

Our system automatically emailed [redacted] (i) December 29, 2013 (at the...
email address [redacted] provided during her online registration) confirming she had completed her program registration, and (ii) January 2014 notifying [redacted] that her program registration was accepted.
After we recently received a communication from [redacted], we requested the ICM call her. According to the ICM: (i) He called and spoke with [redacted], she was very friendly, confirmed she regularly shops in the [redacted] in Hamden, and it seems she must have forgotten about registering for the program; (ii) Nonetheless, [redacted] did say she wanted to cancel her membership and return the gift card. Although more than one year past the three business day period provided to mail a cancellation notice, we agreed to cancel [redacted]’s registration and provided our mailing address to return the $100 gift card. Every homeowner who registers to join our program, within the registration completed confirmation email sent to them at the email address they provide during registration, is informed in writing about their three business day right to mail in a cancellation notice, and is provided a completed Notice of Cancellation to print, sign and mail to us via the [redacted].
Homeowners pay $0 to join our program. Homeowners pay $0 to be in our program. If the homeowner never sells their home, or if they sell their home in the future using any Cooperating Broker they choose in our national network, they pay us $0 (our national network comprises more than 1,000 contracted cooperating real estate brokers, with more than 5,000 participating offices, in which are more than 250,000 licensed real estate agents).
