We ALWAYS put our homeowner members, our clients, first, above all else. Pursuant to [redacted] wishes, we have cancelled [redacted] registration in our program, and as a result, as Philip desires, we will not be paying [redacted] $300 to $10,000 (for which [redacted] would have paid $0).
We did speak with [redacted]financial advisor' who file this complaint. She was quite rude when we spoke with her. Why she would advise her client to not accept $2,000 for which he would pay us $0 does not sound like very good financial advice. Also, it would be inappropriate for us to not accept senior citizens into our wonderful program for homeowners when they desire to be a member of our program for smart homeowners, as this 'financial advisor' suggested. Were we to ever do so, then we'd get complaints about excluding senior citizens from our program.

Our program for homeowners benefits both homeowners, as well as real estate agents and brokers who put their clients first. We and our network Cooperating Brokers always put the needs and interests of our clients first. We provide homeowners between $300 and $10,000 in member rewards (amount...

Homeowners pay us $0 to join our program, $0 to be a member, $0 if they sell their home whenever they choose to sell their home using any cooperating broker they choose, $0 if they never sell their home. No homeowner has ever been asked to pay us one penny. No homeowner has ever paid us one penny. WE PAY HOMEOWNERS MONEY. THEY DO NOT PAY US ONE PENNY. IT IS IMPOSSIBLE THAT WE COULD BE A SCAM. We provide hard working real estate brokers and agents with home buyers and home sellers. And when we do, we are paid a reasonable industry standard broker to broker referral fee upon the closing of the transactions. Our network consists of more than 1,000 contracted Cooperating Brokerages across the USA, with more than 5,000 participating offices with more than 250,000 licensed real estate agents. The [redacted]s’ complaint misrepresents the facts, and within their complaint they contradict themselves, saying: “I am happy to refund the initial upfront payment of $200 they made” ($200 that Exceed paid to the [redacted]s). Then, two sentences later, they say “Exceed has voided this contract by not sending any payments as specified on their site”. Which is it? Obviously, as the [redacted]s know, they did receive their first $200 payment, pursuant to the terms of their agreement with Exceed, which they cashed or deposited into their bank account, as evidenced by our bank records, or why else would they be offering to “refund the initial upfront payment of $200” we paid to them? The [redacted]s e-signed the homeowner agreement to which they are a party, and they have always had access to the agreement before and after they joined the program. The [redacted]s were provided three business days to cancel their agreement with us, which is clearly communicated to all of our members multiple times IN BOLD CAPS. Additionally, upon registration, we provide all members a completed cancellation notice for them to mail to us. We also accept cancellations by email within that three-business day period. The [redacted]s joined the program 2/9/15. They cashed their first $200 reward check 4/7/16, and are welcome to cash their second $200 reward check. Of interest, Mr. [redacted] just left a phone message for us, in which he claims he never signed our agreement, which may suggest that his wife forged his signature? However, when looking at our bank records, they BOTH signed the first $200 check we sent to them when they cashed or deposited our check into their account (further ratifying their agreement with us). The [redacted]s violate the law by stating our service is a scam, which is impossible. To the contrary, we value our relationships with our homeowner members. Sadly, from time to time we come across a real estate agent who puts themselves above the needs of their clients, which is what seems may have occurred in this case. Based on what we have been told, it seems the agent involved in this case thinks they own their past clients (even though there was no agreement between them regarding the future sale of their home) and that it is proper to take money out of the clients’ pockets and put it in the agent’s pocket. The [redacted]s’ home, if they sell it soon as seems to be their desire, will sell for approximately $440,000, according to independent 3rd party estimate of the value of their home. If the commission they pay for the sale of their home is as sometimes occurs on Long Island 5%, the sell side commission would typically be 2.5%, in this case, $11,000… of which the agent would typically receive an amount in the range of $8,800. So, if we were to be paid our contracted referral fee, using the preceding figures as the basis for the example, the agent would instead receive a commission of $5,720, which it seems in this case has made the agent angry, due to the agent thinking they own the client, and the agent would rather put an extra $3,080 in their pocket (in the agent’s pocket), while depriving the client, the [redacted]s, of the $1,000 we pay to the [redacted]s. The question is, who is looking out for the [redacted]s’ best interest here? Exceed, who pays them $1,000 for which they pay $0, or the agent who it seems is more concerned with making $8,800 instead of $5,720, another $3,080, for helping the [redacted]s to sell their home? Obviously, Exceed is putting the [redacted]s’ best interest first. It seems that the [redacted]s have been misinformed by whoever they claim to have spoken to at [redacted], out of ignorance or making false statements. This is out of character compared to most of our interactions with [redacted] brokers, agents and management over the past near ten years. We value our long-term relationship with many [redacted] franchisees and company owned [redacted] regions, brokers, and agents throughout the USA. Assuming the [redacted]s sell their property through [redacted], as they desire, or with the help of any other contracted broker that is a part of Exceed’s network, and they retract their false libelous complaint and make no further false or libelous statements about Exceed, they will have no liability to Exceed, or responsibility for making payment to Exceed of any amount arising out of the sale of their property. Following their closing with any broker in Exceed’s network, Exceed will send them the balance of the $1,000 member benefits. We were provided May 4, 2017 a written acknowledgement of [redacted]’s acceptance of the referral. It would be a shame for the [redacted]s to incur legal fees unnecessarily should they continue to libel us or otherwise cause us any additional harm beyond the harm they have already caused us. Mr. and Mrs. [redacted], we pay you $1,000, $200 of which you’ve already received and signed for… you have paid us nothing… you are arguing with the wrong party! In conclusion, the agreement the [redacted]s entered into with Exceed LLC (“Exceed”) remains in effect and has not been cancelled. Please note that in accordance with the terms of the agreement, it may only be modified in writing with our acceptance. Exceed has not agreed to, and will not agree to, any modification. We remain willing to continue to provide any assistance desired to support the sale of the [redacted]s’ home, with whichever of our Cooperating Brokers they choose, pursuant to their agreement with us. We look forward to providing them the balance of their $1,000 member rewards immediately following the sale of their home! Thank you.

The independent marketer Mr. [redacted] wife spoke with was barred from marketing our program soon after he spoke with her, due to our discovering situations similar to what she experienced. We have asked Mr. [redacted] to please write void on...
the check and mail it back to us, and we apologized for any inconvenience this may have caused them.

I first question a company that deals with an "independent contractor marketer employed by a third party marketer (not by us)"whatever that means!I understand the concept, though I certainly doubt the voracity of the individuals behind this company, with them just sending checks to peoples houses and seemingly to expect NOTHING in return but using one of THEIR cooperating brokers. I don't know, it seems a little fishy to me. I have always been told if it seems too good to be true, THAT'S BECAUSE IT IS!!! As for the name of the company, they should maybe consider another name such as the NAIVE HOMEOWNERS PROGRAM. I say this because I certainly consider myself a SMART HOMEOWNER, one smart enough to not conduct business with a company that has independent contractors employed by third party marketers that work out of a supermarket!!!!!In conclusion:

To insinuate that I am not an intelligent person, they named their program after it's members, Smart Homeowners. I find it funny that they keep bashing realtors and brokers, as well as myself, instead of simply complying with my request. The fact that [redacted] corporate office, has never heard of them is funny. instead of just dropping this, they result to insults and defamation. This shows the true nature of the company and the fact that they never did address the apparent fraud that had been committed. I will continue to elevate this to my attorney general's office to stop these horrible people from trying to scam anyone else. They have sent me a letter and email stating that they have cancelled "the contract/agreement". I will accept that but I do wish for an apology for the offensiveness of their reply to you.

Among our more than 1,000 contracted cooperating brokers are 70% of the 100 largest brokerages in the United States (almost all of the other 30% are in states in which we are not active). We give our members cash benefits to spend on whatever they want to buy themselves, on average years before they sell their home! And they can keep it even if they never sell their home! When the home sells in the future, the cooperating broker pays us an industry standard referral fee. We ALWAYS put our homeowner members, our clients, first, above all else.
