Dear ***, This is in response to the complaint filed by [redacted] *** Per Ms***’s request, I was able to review her account history Our records do not indicate that we received a call requesting forbearance in February of We do show that a call was received on March 12, 2015, in which forbearance was requested While this forbearance backdated to remove the delinquency on the account, it does not remove any previously reported delinquencies from the customer’s credit report A review of the account has determined that the day negative credit reporting for February is an accurate reporting and is unable to be removed An Income Based Repayment (IBR) application was received on March 3, This application as rejected on March 11, as ACS was unable to determines Ms***’s pay frequency On March 17, ACS received a new application for IBR This was approved and applied to her account on March 29, MsZeter is currently on IBR with monthly payments of $ Should you have any further questions or concerns, please contact our offices Monday through Friday from 8:AM to 11:PM EST by calling ###-###-#### Sincerely, Sarah S***

This in is response to complaint ID [redacted] filed by [redacted] *** Mr***’s letter did indicate that he was disputing negative credit reporting however; in order to accurately respond to a credit dispute, ACS would need to know exactly what derogatory information is being disputed Without this information, ACS is unable to provide any type of verification or reason for the reporting Mr***’s account became past due days as of December 2009, which reflects as the first date of delinquency Credit reporting began when the account became days delinquent in January This account was negatively credit reported every days thereafter, until the account entered default in December of ACS has verified that Mr***’s information was transmitted to the credit bureaus correctly, and does accurately reflect the status of the account at that time We are only able to transmit the correct information to the credit bureaus, and have no impact on when that information falls off of Mr***’s credit report Please note that the first date of delinquency is indicated as the first date which lead to Mr***’s current status Should you have any further questions or concerns, please contact our offices Monday through Friday from 8:AM to 11:PM EST by calling ###-###-#### Sincerely, Sarah S***

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below.The fact still remains that ACS does not disclose on their automated system, nor on their website that forbearances requested in the amount of months is not available for my loan lenderWhen I requested to place my loans into forbearance for months through their automated system I gives you an option to choos 1-monthsI chose and the system says " Your request was successfully submittedAbout days later I received and email stating "You forbearance was applied" Nowhere in that email does it state that my forbearance wasn't issued for the months I requestedI don't care what communication was sent via USPS mail because I don't receive mail at the address listed on my account, which is why I signed up for electronic notificationsIt is ACS responsibility to inform their customers what their lender limitations are when applying via phone and automated systemSince neither of those features are updated to protect their customer, it leaves the customer in the dark pertaining to the true status of their requested month forbearanceThe late payments that were accumulated on my account was the fault of ACSIf I applied for a month forbearance and received my electronic email that I signed up for stating "Your forbearance has been applied " it is safe to conclude that my forbearance is for the month just as I put into their automated systemACS needs to take responsibility for their mess up and correct their mistake by deleting all of those late payment that they reporting on my credit file Regards, [redacted] ***

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below I continue to receive calls and emails insisting I am now 90-days late on my current amount due, which is not trueI received a call from [redacted] She could not pin down the exact date of the so-called "delinquency" and said she would send me a copy of my payment history and would also review it and get back to meThat was 24-hrs ago, I havent heard from herI have already supplied ACS with a copy of my payment history from my bank as well as their own website which shows payments are current and on time [redacted] tried to tell me that a delinquency started during a date in that was not even visible to me on their user portal on their websiteI have asked to be supplied with proof of delinquency, and all I get is verbal run-aroundI received another email today saying I was delinquent from DecemberAs you can see from the attachment December was not delinquent In the past if there WERE legitimate missed payments, they were made up which should have brought my account to current every timeHowever, according to ACS, it was NOTThese continued practices are unethical, unfair, and coersive with continued threats of adverse credit reportingand mounting late fees, and harassing phone calls, and evasive run-around treatmentsFurthermore, payment history shows that I have paid $17,Only $of that has gone toward the principal of the loan$has gone toward interest, $in late feesHow is this fair, or even possible? " When a deferment is approved and applied, you are responsible for the interest that accrues on the unsubsidized portion of your loanWhen in forbearance, you are responsible for interest that accrues on the entire loan, regardless of the loan typeThese terms and conditions were set forth in your promissory note, and agreed to by you upon signature of this document" This was NEVER told to me , they NEVER stated anywhere in documents , nor over the phone that this was the case , not how many more years they were adding to my loan They just want more money from borrowers so of course they would tell them this .""ACS has contracted with your lender, College Loan Corporation in order to service these loans, and we are unable to transfer servicing" Since when is this my lender then you told me less than a month ago some business in Boston called American Student Assistance was my lender ? You can't even keep your story straight , no wonder you have so many law suits against you. ACS is also unable to change this loan to a Direct Loan, as you would need to initiate consolidation with Direct Loans to determine if you would qualify" This is completely , you CAN , you simply refuse to becuase that would mean less money I give you in the long runYou just want all my interest . " ACS encrypts e-mails which contain account specific information for your security and protectionACS does use a 3rd party encryption service, and is therefore unable to provide support for the serviceIf you are unable to access the encrypted e-mails after reading the FAQs provided, you may e-mail *** for additional assistance" This is also false becuase I HAVE emails that were sent directly to my email address on file with you and I would be happy to forward them to you . They also did not address the class action lawsuitThey have refused to provide this information to Revdex.com directlyI want the public to see my complaint on the Revdex.com website.

I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear belowI would like to reiterate that my ACS student loan payment was made on March 30th, and was more of the due amount (please the attachment provided). Accordingly, my payment was schedule for March 31st. Therefore, I have asked ACS to credit my account for the late payment; given my student loan payment was made in advance of the due dateI have also filed formal complaints with Attorney Generals in several states, and brought this to the attention of the New York Times and U.SJustice Centers, for further review, and investigation, particularly, given that ACS specifically double-burdens student loan borrowers, who must make a payment days before the schedule due date, holding onto and profiting from borrowers’ income longer, and affecting lives and families nationwide
