The customer has indicated the business has not reached out to set this up or return his calls for a replacement of his carport.
We have the customer scheduled to put the mobile home anchors in on Friday 12/2/16.

The business did come out but because they did not come out at a scheduled time the customer was not able to have the issues addressed correctly. The defects are not being fixed and at this time a senior manger needs to schedule an appointment with the customer and replace the car port because at this time the issue have not been fixed. The customer purchased a car port and was not provided a working product.
In response to further clarification, it is standard practice in the metal building industry for the customers to obtain
their permit. A property owner in ANY state is able to apply for and obtain a permit for work to be done on their
property. It is also the property owners responsibility to check on covenants, restrictions, and home owners association
rules. The customer is also responsible for checking with Ms Utility to make sure any underground lines and obstacles
are clearly marked. As clearly stated on the signed order form, the customer is the contractor.
Because we sell buildings up and down the east coast, it would be impossible to obtain a permit for each customer.
In New Jersey, according to Uniform Construction Code, for us to have obtained a permit, we would have needed an
affidavit from the owner that would grant us authorization, and empower us to pull the permit. Once issued, the permit
becomes property of the homeowner, regardless who initially pulled the permit. A property owner can do his or her own
work as long as a contractor is involved for plumbing, electrical, HVAC, lead hazard abatement or demolition. So, if the
customer is the contractor, and applies for the permit, they would be able to install a carport. We would be a
sub-contractor for that customer.
As far as the building being blown over, it is our opinion that if it weren’t for the customer altering the building, it would still be standing, whether or
not the mobile home anchors were installed. Because the building was altered, any certification would have been void. The customer at no time called
in to inquire about adding to the building, or to see if there would by any adverse effects for doing so. Since the customer did pay for the anchors that
they did not receive, we are refunding the purchase price for them.

RE: [redacted]
Newmart Builders Inc is a manufacturer of steel buildings. The [redacted] carport division in ** actually installed the building in question. During the time of the building collapse [redacted] and the entire East Coast experienced extreme snow and ice accumulation. As stated on the order form signed by [redacted] [redacted] on April 18, 2013; We are not responsible for Acts of God (such as flooding, wind, ice, snow, hail, lightning, earthquakes). It is also stated that heavier snow loads are available upon request. This option was not chosen and the customer elected to purchase the standard building.
We are sympathetic to the property loss. We have offered and we will provide the proper insurance quote upon request.
Sincerely;
