LoanMe, Inc., (“LoanMe”) is in receipt of our customer’s above-referenced complaint, and we welcome this opportunity to respond to help clarify and resolve the matter Please allow this to serve as our formal responseLoanMe’s records indicate that our customer agreed to an unsecured consumer installment loan on December 19, 2015, which was subsequently funded on December 21, in the amount of $2,minus a $pre-paid finance charge/origination fee A review of LoanMe’s records show that phone calls made to our customer in the month of May were professional attempts to secure a payment our customer had prearranged but failed to payIt is important to note that LoanMe originated and owns this loan, and hence would not be considered a “debt collector” for it under the Fair Debt Collection Practices Act (“FDCPA”) Nonetheless, calls LoanMe places to delinquent customers adhere to the FDCPA, and are never intended to be anything other than a professional effort to collect a debt While LoanMe has attempted to contact our customer to secure a payment arrangement, many of those calls went unansweredOur objective was to have a meaningful conversation to assist our customer in bringing her loan currentIf our customer interpreted any of the conversations between us to be less than professional, we would like to sincerely apologize as that was not our intent As of the date of this response our customer’s loan is past due for both the May and June payments Upon receipt of this complaint, we have ceased all phone calls to our customer and to our customer’s place of employment, and we have taken additional steps to ensure that only communication in writing takes place regarding matters pertaining to her loanWe thank you for this opportunity to respond, and hope that we have helped to clarify the matter for our customer If our customer has additional questions or concerns, she may contact LoanMe directly at [redacted]

LoanMe, Inc(“LoanMe”) is in receipt of the above reference complaint and we welcome this opportunity to respond to help clarify and resolve the matter Please allow this to serve as our formal response Our records indicate that our customer obtained an unsecured consumer installment loan October 9, 2015, which included the funded amount of $3,minus a $origination feeOur customer made multiple payments toward her loan, but then fell delinquent for the payment due on October 1, On or about October 21, 2016, we received authorization for LoanMe to discuss the customer’s loan with a company called Settle Our DebtLoanMe made contact with Settle Our Debt At this point our customer was seriously delinquent, and past due for both her October and November payments As a result of the delinquent status of the loan, and based on our customer’s financial hardship situation, LoanMe made a special arrangement agreeing to receive an amount that is substantially less then what is contractually obligated by the customerThis was done to assist our customer, even though LoanMe was under no obligation to offer the settlement Under the special arrangement our customer needed to make consecutive payments of $This would have significantly reduced the $monthly payments due under her contract, as well as the number of months payments would have needed to be paid toward the loanIf the conditions of the settlement were not fulfilled, then the settlement would be cancelled and the terms of the original loan agreement would be enforcedA payment was not received in January 2017, and as a result, the settlement agreement was considered cancelled and void At that point multiple payments under the terms of our customer’s contract were past due, and as a result the account was charged off on March 31, Again while under no obligation to do so, in an additional attempt to assist our customer, LoanMe then agreed to reinstate the settlement arrangementThis requires that the scheduled (reduced) settlement payments be made on or before the dates requiredPer the settlement arrangement, if paid as required, LoanMe will report the account as “Settled” to the credit reporting agency and forgive the remaining amount of the debt, but only once the conditions of the settlement arrangements are fulfilled completely LoanMe reports to the credit reporting agency (Experian) on a rolling 30-day period, and as a result, the customer’s account would be viewable on an Experian credit reportLoanMe does not report to other credit reporting agencies It is the policy of LoanMe to ensure that all information provided to the credit-reporting agency is accurate and free of errors, and LoanMe has been reporting the customer’s account accurately based on the status of the loan contactIt is also the policy of LoanMe to promptly respond to any inquiries regarding the accuracy of credit reporting promptly and in accordance with the Fair Credit Reporting Act (“FCRA”)

LoanMe was provided my contact, and personal information by a Utah firm named LendioLoanMe accessed by credit report on Equifax without my permissionThis was a soft, and hard pull without my authorization I was contacted by individuals by the name of: Jermane [redacted] and Naisha [redacted] by both telephone and emailThese individuals claim to be employees of LoanMe I did return a few employees think that this was a lender for Small BusinessInstead, after reading hundreds of negative reviews, LoanMe is a Predatory Lender located in the State of California charging small business customers, and consumers loan rates of 300-500% When Naisha [redacted] contacted me she did not disclose that I was being recordedCalifornia is a two-party State and both the party recording, and myself must agree to being recordedNaisha never closed this warning Instead she had all of my personal information and asked to run my creditAt that point I DID NOT GIVE MY AUTHORIZATION I immedi
LoanMe, Inc(“LoanMe”) is in receipt of our consumer’s follcomplaint, and we welcome the opportunity to help further clarify the matterPlease allow this to serve as our response The customer is raising points that were already addressed in our initial responseIf our customer has new facts or additional information that was not considered in our initial response, LoanMe would be happy to review such informationAs LoanMe previously stated in our last response, we have reviewed the complaint as well as our own records, including telephone conversations that took place between the customer and LoanMe representatives, all of which are recordedBased on our research of the recorded calls we have determined that a conversation concerning credit card payments did not take place prior to the customer obtaining her loanDuring a call on January 17, at approximately 10:a.m., our customer provided her information and submitted an application for creditThere was no discussion regarding credit card payments that took place during the callAt the end of the call the loan agent explained to the customer that she would receive a call the following day to review the Promissory Note and Disclosure Statement (“Note”)The next call took place January 18, at approximately 8:a.mto review the Note with our customerDuring the call we informed our customer of the interest rate, Annual Percentage Rate (“APR”), payments, the total Finance Charge, and the payment amount and scheduled due datesOur customer agreed to the terms, and indicated that she did not have any questions or concernsDuring this call there was no discussion regarding credit card paymentsOn January 21, 2016, at approximately 4:p.m., after the loan was funded, we conducted a “welcome call” with our customer, during which we again discussed the terms of her loan and payment due datesOur customer indicated she understood, and that she did not have any questions or concerns at that timeAt no time during her application for the loan, prior to funding, or immediately after receiving the funds was there a discussion about credit card payments as stated in our customer’s complaintThe terms of the loan have remained the same, contrary to the statements by our customerNowhere in the Note that our customer signed did it indicate that payments could be made via a credit card during the life of the loanFurthermore, the Note included our customer’s election to have the monthly payments debited from her bank account via ACH drafts each monthBy signing the note, our customer certified that she understood and agreed to be bound by its termsUnfortunately, LoanMe can no longer process credit card payments directlyHowever, in our previous response we explained that she could potentially still use her credit card to pay her loanIf our customer wishes, we suggest that she contact her credit card company directly to discuss the possibility of using a convenience check or cash advanceAdditionally, LoanMe offers various payment options that our customer may still utilize, including [redacted] which may accept payment via credit card online and at many of its locationsIf our customer is interested in pursuing this, she is encouraged to contact [redacted] directly to research this optionUpon a complete review of the complaint and our records of the matter, we found that LoanMe has been forthright in our business practicesIf our customer has additional questions or concerns, she may contact LoanMe directly at [redacted] In closing, we would like to thank you for this opportunity to respond, and hope that we have helped to clarify the matter regarding the statements made in our customer’s complaintLoanMe
LoanMe, Inc(“LoanMe”) is in receipt of the above reference complaint and we welcome this opportunity to respond to help clarify and resolve the matter Please allow this to serve as our formal response Our records indicate that our customer obtained an unsecured consumer installment loan October 9, 2015, which included the funded amount of $3,minus a $origination feeOur customer made multiple payments toward her loan, but then fell delinquent for the payment due on October 1, On or about October 21, 2016, we received authorization for LoanMe to discuss the customer’s loan with a company called Settle Our DebtLoanMe made contact with Settle Our Debt At this point our customer was seriously delinquent, and past due for both her October and November payments As a result of the delinquent status of the loan, and based on our customer’s financial hardship situation, LoanMe made a special arrangement agreeing to receive an amount that is substantially less then what is contractually obligated by the customerThis was done to assist our customer, even though LoanMe was under no obligation to offer the settlement Under the special arrangement our customer needed to make consecutive payments of $This would have significantly reduced the $monthly payments due under her contract, as well as the number of months payments would have needed to be paid toward the loanIf the conditions of the settlement were not fulfilled, then the settlement would be cancelled and the terms of the original loan agreement would be enforcedA payment was not received in January 2017, and as a result, the settlement agreement was considered cancelled and void At that point multiple payments under the terms of our customer’s contract were past due, and as a result the account was charged off on March 31, Again while under no obligation to do so, in an additional attempt to assist our customer, LoanMe then agreed to reinstate the settlement arrangementThis requires that the scheduled (reduced) settlement payments be made on or before the dates requiredPer the settlement arrangement, if paid as required, LoanMe will report the account as “Settled” to the credit reporting agency and forgive the remaining amount of the debt, but only once the conditions of the settlement arrangements are fulfilled completely LoanMe reports to the credit reporting agency (Experian) on a rolling 30-day period, and as a result, the customer’s account would be viewable on an Experian credit reportLoanMe does not report to other credit reporting agencies It is the policy of LoanMe to ensure that all information provided to the credit-reporting agency is accurate and free of errors, and LoanMe has been reporting the customer’s account accurately based on the status of the loan contactIt is also the policy of LoanMe to promptly respond to any inquiries regarding the accuracy of credit reporting promptly and in accordance with the Fair Credit Reporting Act (“FCRA”)

LoanMe, Inc(“LoanMe”) has investigated the Customer’s complaint and has found that it acted properly at all timesThe Customer entered into an unsecured consumer installment loan with LoanMe on May 4, 2015, in the amount of $10,This amount includes the loan amount of $10,net the Prepaid Finance Charge/Origination Fee of $The Note clearly notes at the top in the TILA disclosures an Annual Percentage Rate of 99.75% and a Total Finance Charge of $71,These disclosures were made in accordance with the requirements of the Truth in Lending ActIt is important to note that the Note contains a provision that allows a borrower to prepay their loan, in part or in full, at any time without penaltyWhen the Customer entered into the loan agreement with LoanMe, the Customer was directed to read the Note in its entiretyAfter the Customer had reviewed the Note he electronically signed or initialed the Note in multiple locationsThe fourth of the signatures represents and confirms that the Customer had read and understood the terms and conditions of the Note As part of our business practice LoanMe records when and where the borrower signs the NoteAccording to our records, the Customer signed the Note on May 1, 2015, via electronic signatureThis Note, in its original format, is an electronic document fully compliant with the Electronic Signatures in Global and National Commerce Act (E-SIGN) and other applicable laws and regulations LoanMe also emailed a copy of the Note on May 4, 2015, to the Customer at the email address provided by himIn addition, after funding, LoanMe called the Customer on May 4, 2015, where a representative went over the terms of the loan with him, including the interest and repayment scheduleThe Customer did not raise any concerns about the terms or repayment of the loan at that timePlease be advised, on July 25, 2015, the Customer contacted LoanMe and requested assistance on his accountThe customer requested to have his interest rate reduced, LoanMe confirmed that all of the terms of the loan were prominently disclosed to the customer before the loan funded and that the customer had expressly agreed to those terms Nonetheless, strictly as a courtesy, LoanMe will reduce the Customers interest rate to 45% and offer him a one month deferment The Customers new monthly payment will commence on October 1, and the new payment amount will be $Please have the Customer contact LoanMe at [redacted] to discuss payment arrangements

LoanMe, Inc(“LoanMe”) is in receipt of the above reference complaint, and we welcome this opportunity to respond to help clarify and resolve the matterPlease allow this to serve as our formal response Our records indicate that the customer agreed to an unsecured consumer installment loan on June 15, 2016, which included the funded amount of $5,minus a $origination fee Based on our research of the complaint, we confirmed that our customer contacted LoanMe to advise that she had an “unexpected hardship,” and as a result was overextended While under no obligation to do so, LoanMe offered our customer relief in the form of a special assistance forbearance arrangement in an attempt to assist This meant that LoanMe would accept half-payments from our customer for three months (due on May 1st, June 1st, and July 1st, 2017) The terms of the forbearance were that the scheduled half-payments had to be made by the scheduled due dates, and if the half-payments were made as scheduled, LoanMe would forgive the unpaid portion of those three paymentsIf the special assistance arrangement was not kept however, it would be cancelled and the payments due under the terms of her Note would apply While our customer made the forbearance payment due in May, she failed to make the forbearance payment due on June 1st, which cancelled the forbearance arrangement On July 6, 2017, our customer requested further assistanceAt this point our customer’s account was delinquent for the full payment due on June 1, under her original contractAs a result, at that point she was more than days late on her account Our customer incorrectly states that LoanMe inaccurately reported her account delinquent Our records indicate that in July LoanMe accurately reported the thirty day (30) delinquency to her credit report, because we did not receive her payment due on June 1, Our agent and a supervisor explained to our customer via telephone, that her June payment was being reported as days late in July, which is in fact accurateOur customer disagreed, and stated she would file a complaint LoanMe reports to the credit-reporting agency ( [redacted] ) on a rolling 30-day period It is the policy of LoanMe to ensure that all information provided to the credit reporting agencies is accurate and free of errorsIt is also the policy of LoanMe to respond promptly to any inquiries regarding the accuracy of credit reporting promptly and in accordance with the Fair Credit Reporting Act (“FCRA”) In reviewing the account, we have determined that the 30-day delinquency was reported accurately to the appropriate credit-reporting agency Additionally, LoanMe offered our customer a settlement arrangement on her loanBy extending an offer to settle, LoanMe agreed to receive an amount that is substantially less then what is contractually obligated by the customerThis was done in a further attempt to assist our customer, even though LoanMe was under no obligation to offer the settlement arrangement Under the settlement arrangement, the customer agreed to make a lump sum payment of $5,to settle on the loan Per the settlement arrangement, if paid as required, LoanMe would report the account as “Settled” to the credit-reporting agency and forgive the remaining amount of debt Our records indicate that our customer honored the settlement agreement, and the status of the loan is now “Settled in Full” We are in the process of reporting the updated status to the credit reporting agency, which should soon reflect on our customer’s credit report In closing, we would like to thank you for this opportunity to respond, and hope that we have helped to clarify the matter for her If our customer has additional questions or concerns, she may contact LoanMe directly at [redacted]
