We are in receipt of your complaint regarding...

[redacted] Please be advised that Domains By Proxy (“DBP”) provides a private registration service that allows its customers hold domain names without listing their contact information in the public [redacted] database. Since DBP is listed as the registrant of the domain name, it may appear that DBP operates or has an interest in the domain name or website. That is not the case; DBP is not a domain name registrar and is not involved in the registration process. Our customer retains all control over and management of their domain names.
Our records show that the customer registered the domain name on the evening of February 19th and the domain name was activated early morning on February 20th.
Questions regarding the availability of this domain name must be sent to the registrant. You may contact the registrant at the email address listed on the public [redacted] database: [redacted]

It appears that Ms. [redacted] has been misinformed, as we (Domains By Proxy) and [redacted] are different companies. [redacted] is an affiliate of ours and offers our private registration service to their customers. Also, all sales and billing of our private registration service are handled by [redacted].

That said, all we can recommend is that Ms. [redacted] contact [redacted]'s Billing Department at [redacted] for assistance with her refund request, as [redacted] is where Ms. [redacted] purchased our private registration service and [redacted] is who has the ability to offer a refund.

Please let us know if we can be of further assistance.

We are in receipt of your complaint from Ms. [redacted]. Please be advised that Domains By Proxy (“DBP”) provides a private registration service that allows customers of our affiliate registrars to register domain names without listing their contact information in the public WHOIS database....

Since DBP is listed as the registrant of the domain name, it may appear that DBP operates or has an interest in the domain name or website. That is not the case; DBP is neither a domain name registrar, nor a hosting provider and has no control over website content. However, we do have a process in place for individuals to file a claim against domain names utilizing our private registration service and we recommend that Ms. [redacted] file a claim against [redacted] so we can investigate the issue. Ms. [redacted] can file a claim via the online form, accessible by clicking the File A Claim button on the homepage of DomainsByProxy.com. Once we receive Mr. [redacted]'s claim we will investigate the issue and respond to her with options to possibly resolve the issue and/or provide any recommendations that she can pursue to resolve the issue.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

these are the same company, why do I have to contact a separate division?  They should be able to resolve it completely & not pass the buck?
