          To Whom It May Concern:I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] states that he requested cancellation of his account in August 2016, and that Vivint has continued to bill him for service and has now sent his account to collections. Mr. [redacted] desires cancellation of his Agreement with Vivint and removal of his account from collections. At this time, Vivint agrees to remove Mr. [redacted]’s account from collections and cancel his System Purchase and Services Agreement (“Agreement”). Vivint’s records show that Mr. [redacted] signed an Agreement on May 29, 2010, in which he agreed that service would continue year to year after the initial term of forty-two (42) months, unless cancelled in writing no later than 30 days before the next renewal term (Vivint Purchase and Services Agreement, Section 2.4).  Mr. [redacted] contacted Vivint on July 6, 2016 to ask about cancelling his account, and Vivint advised him of the required written notice.  However, Vivint never received a written notice of cancellation from Mr. [redacted].  As such, his account remained active and was transferred to an outside collections agency after 120 days of non-payment.Despite this information, Vivint agrees to the above resolution.  Mr. [redacted] has no further obligation to Vivint.If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: (801) 765-5759, attention Department 160 – Legal. 2010        Date of Addendum: October 15, 2013 To Whom It May Concern: I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] states that she has been a customer of Vivint for 4-6 years and has requested cancellation of her service but continues to receive calls from Vivint. Ms. [redacted] desires cancellation of her Agreement and for Vivint to stop calling her.At this time, Vivint will cancel Ms. [redacted]’s Agreement without penalty, effective immediately.Vivint’s records show that on July 30, 2010, Ms. [redacted] signed a Purchase and Services Agreement with Vivint, with an initial term of forty-two (42) months.  As such, the initial term of the agreement would have lapsed on January 30, 2014.  However, Vivint spoke with Ms. [redacted] regarding her alarm service on October 15, 2013.  Ms. [redacted] represented that she was interested in extending the term of her Agreement in exchange for additional window sensors at no cost and keeping her low monthly service fee.  Based upon this representation, Vivint offered a forty-two (42) month extension to which Ms. [redacted] agreed.  Indeed, Vivint read the following statement, after which Ms. [redacted] responded affirmatively:You understand that this call is being recorded, and you agree to extend the term of your agreement forty-two months from today.  No other provisions of your agreement have been changed and this amendment constitutes the new agreement between you and Vivint. Ms. [redacted] sent Vivint a written notice of cancellation on July 26, 2016; however, she was still in the extended term of her Agreement and as such cancellation was not warranted.  Despite the fact that the extended term ends in April 2017, Vivint agrees to the above resolution.  Ms. [redacted] has no further obligation to Vivint.If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: (801) 765-5759, attention Department 160 – Legal.             Vivint Account #: [redacted]              Date of Agreement: May 30, 2017                                                   To Whom It May Concern:   I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond.   In his complaint, Mr. [redacted] explains that he has experienced difficulty with the system. Mr. [redacted] further explains that it was not disclosed to him that he would need internet for the system to fully function. Mr. [redacted] requests that Vivint cancel his account.   At this time, cancellation without penalty is not warranted.      Under section 12 of the System Purchase and Service Agreement, it states:   Some device features may require an internet connection and/ or smart phone technology and any charges for same will be your sole expense and responsibility.   Therefore, it was explicitly disclosed to Mr. [redacted] that he would be required to provide internet connection if he obtained any equipment that required a connection.   In regards to the difficulty that Mr. [redacted] explains in his complaint, in August of 2016, Mr. [redacted] contacted Vivint because he was unable to see clips from his doorbell camera. In response to Mr. [redacted]’s concerns, Vivint sent a technician to his home. Vivint did not receive any further communication from Mr. [redacted] regarding any technical issues with his system.   Nearly one year later, on May 31, 2017, Mr. [redacted] contacted Vivint in an effort to cancel his account because he does not want to pay for the system and because he does not use the system very often. In response to Mr. [redacted]’s concerns, Vivint offered him the takeover option and also to send out a technician to inspect his system. Mr. [redacted] declined these offers.   Vivint’s records also indicate that prior to the installation of any equipment, Mr. [redacted] signed a System Purchase and Services Agreement.  Every customer must sign this document, and if a customer does not, Vivint will not install any equipment in the customer’s home.  The purpose of the Agreement is to verify certain information, ensure that the customer understands Vivint’s offer, and confirm the terms and conditions. Our records show that Mr. [redacted] signed the Agreement on May 30, 2016.   Upon signing the Agreement, Mr. [redacted] represented that he understood and agreed to the initial term of sixty (60) months.  He also represented that he would pay a monthly monitoring fee of $80.99 each month during that term. 2016 To Whom It May Concern: I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] states that he attempted to cancel his account, but was informed he was still under an Agreement. Mr. [redacted] does not recall extending his Agreement with Vivint.  He desires cancellation of his agreement without penalty. A representative from Vivint has recently attempted to contact Mr. [redacted] in an effort to resolve these concerns. At this time, Vivint is willing to waive the extension of Mr. [redacted]’s Agreement and cancel his account.  Vivint’s records show that on May 26, 2012, Mr. [redacted] signed a Purchase and Services Agreement with Vivint, with an initial term of forty-two (42) months. Vivint spoke with Mr. [redacted] regarding his alarm service on January 27, 2016. Mr. [redacted] represented that he was interested in extending the term of his agreement in exchange for a lower monthly rate.  Based upon this representation, Vivint offered a thirty-six (36) month extension to which Mr. [redacted] agreed. Mr. [redacted] further states that he has continued to be billed by Vivint despite the new homeowner taking over the remainder of his Vivint account. Concern:I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint Mr. [redacted] states that he received relocation orders from the Department of State instructing him to move out side of the United States but Vivint has refused to cancel his System Purchase and Services Agreement (“Agreement”). Mr. [redacted] desires his Agreement cancelled without penalty. Vivint agrees to waive the $99 move fee and install a new alarm system in his new home. Should Mr. [redacted] desire to take advantage of this offer he may contact Vivint’s Move department at 1 800.216.5232. In a further effort to assist Mr. [redacted], Vivint agrees to waive any past due balance that has accumulated on his account. Vivint’s records indicate that Mr. [redacted] entered into his Agreement on April 20, 2015. By signing his Agreement Mr. [redacted] agreed to pay a service fee of $64.99 plus any applicable taxes each month during a term length of sixty (60) months. Vivint will cancel an Agreement for relocation orders if the customer is relocated to an area that is not serviceable by Vivint or has moved onto a military base that does not allow a security system to be installed. Vivint has reviewed Mr. [redacted]’s relocation orders and it was determined that Mr. [redacted] has moved into an area that is serviceable by Vivint. As such, cancellation without penalty is not warranted. reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. A Vivint representative recently attempted to contact Ms. [redacted] via email in an effort to resolve her concerns.In his complaint, Ms. [redacted] explains that she was never told that she would not have to pay the $99.00 activation fee. Ms. [redacted] also states that she was not told that the contract length was for forty-two (42) months. Ms. [redacted] requests a refund of all monies paid to Vivint and cancelation of the contract.Vivint’s records indicate that prior to the installation of any equipment, Ms. [redacted] completed a recorded telephonic Pre-Installation Survey with Vivint’s Account Creation department.  Every customer must complete this Pre-Installation Survey, and if a customer does not pass the survey, Vivint will not enter into an agreement with the customer and will not install any equipment in the customer’s home.  The purpose of the survey is to verify certain information, ensure that the customer understands Vivint’s offer, and confirm the terms and conditions of the Agreement. Our records show that Ms. [redacted] completed the required Pre-Installation Survey on July 26, 2016.During the recorded Pre-Installation Survey, Ms. [redacted] represented that she understood and agreed to the initial term of forty-two (42) months.  She also represented that she would pay an activation fee of $99.00 and a monthly monitoring fee of $44.99 plus any applicable taxes each month during that term. Further, Ms. [redacted] represented that these terms were clearly outlined on the Agreement and that Vivint’s representative did not make any promises or commitments which were not written on the Agreement.  Vivint relied on Ms. [redacted]’s representations to ensure that she understood his commitments to Vivint as outlined in the Agreement. Because of these facts refunding the monies paid is not warranted. In an effort to assist Ms. [redacted], Vivint has put a $99 credit on Ms. [redacted]’s account to go toward her monthly payments to cover the activation fee. Vivint cannot guarantee the credit inquiry will be removed from Mr. [redacted]’s report by November 1, 2015. The camera’s sensitivity settings can be changed on the main security panel. I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me based on my conversation with Madison an account manager from Vivint.  The conversation with Madison yesterday was very satisfactory based on the process to finalize the cancellation.   I am however concerned because I've had similar discussions with Vivint and they didn't follow through.  I'll be fully satisfied when the process is completed in early January based on Madison's promise.1. Madison promised to send me cancellation confirmation -- Completed.2. Madison promised to schedule an appointment for pickup of equipment -- Appointment schedule confirmed and technician to pick up equipment Friday 12-18-15 @ 8pm - 9pm.3. Madison promised to fully refund all the money taking out of my account in 7 - 10 business days -- Expected completion is early January because of holidays.

I am rejecting this response because: I will take the 5 extra point and the install fee waved. I want a smoke/carbon detector installed and a glass break. It needs to be on any Friday or Saturday starting next week. I am going to purchase the rest of the item and install so I feel safe for my wife. I also want the legal department to come up with some training for the moves department on what all you get if you take nothing. And the sales department if you move within a year you have to temove everything and take it with you. This has been the biggest problem for. The word go getting lied to from a customer service company.
