I am rejecting this response because:Apparently, Vivint is having some serious issues either telling the truth, or knowing what they are doing. I spoke with Nick B[redacted] at Vivint on 5/2/20017 and he assured me IN WRITING  that all modifications to the agreement have been cancelled. There is no camera order, no forfeited deposit, and most importantly, no contract extension. Once Vivint replies to this , and verifies this information, I will close this case. I attached the email from Vivint in PDF format, and it can be forwarded upon request to verify its original source. It is truly a shame that a company this large, in such a serious line of business, has deceptive and in my opinion, fraudulent people like the two that have responded here.

I am rejecting this response because:I stated that I was mislead when I could cancel my account without penalty. When asked if I could cancel my account if I was unsatisfaied the rep told me I could. He never mentioned I had 3 days to do it. I called six days later under the impression I could cancel without any fees because I asked the rep at the time of set up could I call within a week to cancel if I wasn't satisfied. When I called to cancel they would not close the account unless I paid the full amount. I paid the account months later be I didn't want it on my credit report and I got tired of arguing with vivints very rude customer services reps I have attempted to talk to supervisors and cancel this contract as well as have someone come remove the system and no action has been taken by Vivint. I stop paying because I was advised by my lawyer to no longer make payments and we will just file a motion.

requested the cancellation for the account, but Vivint has failed to follow
through on the request. Mr. [redacted] desires the cancellation of the account
without penalty.Vivint’s
records indicate that prior to the installation of any equipment; Mr. [redacted] completed
a telephonic Pre-Installation Survey with Vivint’s Account Creation
department.  Every customer must complete
this Pre-Installation Survey, and if a customer does not pass the survey,
Vivint will not enter into an agreement with the customer and will not install
any equipment in the customer’s home. 
The purpose of the survey is to verify certain information, ensure that
the customer understands Vivint’s offer, and confirm the terms and conditions
of the Agreement. Our records show that Mr. [redacted] completed the required
Pre-Installation Survey on June 5, 2014. During
the recorded Pre-Installation Survey, Mr. [redacted] represented that he understood
and agreed to the initial term of sixty (60) months.  He also represented that he would pay a monthly
monitoring fee of $[redacted] each month during that term. Further, Mr. [redacted] represented
that these terms were clearly outlined on the Agreement and that Vivint’s
representative did not make any promises or commitments which were not written
on the Agreement. Vivint relied on Mr. [redacted]’s representations to ensure that
he understood his commitments to Vivint as outlined in the Agreement.     Mr.
[redacted] notified Vivint of his move on January 26, 2015. Vivint informed him of
his options to either move the system or find a third party to take over the
agreement. Vivint did not receive a decision on either option, and as such Mr. [redacted]
is still responsible for the Agreement. Cancellation of Mr. [redacted]’s account without
penalty is not warranted at this time. Should Mr. [redacted] wish to cancel his Vivint agreement prematurely, he may pay off the remaining
balance on his account – currently $[redacted], however Vivint will take 25% off
the payoff amount, bringing it to $[redacted]. If Mr. [redacted] wishes
to take advantage of this offer, I would advise him to contact Vivint’s
Customer Loyalty department at ###-###-####. If

            Vivint Account #: [redacted]              Date of Agreement: April 26, 2016                                                   To Whom It May Concern:   I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond.   In her complaint, Ms. [redacted] explains that she was unaware of the term length of her System Purchases and Services Agreement (“Agreement”). Ms. [redacted] further explains that she has experienced technical difficulty with her motion sensor. Vivint’s records show that Mr. [redacted] signed a System Purchase and Services Agreement (“Agreement”) on July 6, 2015, but there is no signature for Ms. [redacted] on the original Agreement.  As a spouse, Ms. [redacted] was listed as an account holder. [redacted]  I still do not agree with the decision. I was misled into this agreement by a fast talking salesman (Steve B[redacted]) and during the phone survey, everytime the person asked a question that I wasn't sure of or asked them to repeat, Steve would speak up and say this is just standard questions and then tell me how I should answer them. How is this a fair survey or how can you believe anything from anyone if their sales people can say and promise things verbally, tell you how to answer the questions, use scare tactics to get you to try the product, etc. The bottom line comes down to I feel I was pushed into this with promises that were not kept, scare tactics, etc, and the item still DOES NOT WORK. I am paying for something that hasn't worked since the 3rd week in March, no one seems to want to resolve that problem but they sure have no problem taking money out of my account. They want me to pay for the next 40 months on an item that doesn't work. How is this good business practice? How can a company do what Vivint is doing - taking money out of my account, let their sales people make promises verbally that they don't honor, didn't take no for an answer the 1st few times I told him I didn't think I could afford  it because my roommate/ boyfriend died the night before and I wasn't sure what my finances were going to be like with all the medical bills, funeral, etc and then they don't even stand by their product? Money has been taken out of my account for March, April, May and June (4 months now) but the system has only worked for 3 weeks. Where are my rights as a consumer? How am I suppose to be fine with paying for something that doesn't work and doesn't get fixed? in response to the third business clause, that was never pointed out to me. I don't know if it was really a person at Vivint the survey was done with on the loud speaker of Steve's phone while he was sitting right there and telling me how I should answer the questions because they were standard ones they had to ask. I think Vivint should think about training their sales people as to what is allowed and maybe they should replace Steve B[redacted] because he is making all kinds of verbal promises but when it comes down to the wire, he can't remember saying them and says he would have wrote them down if he did and the customer gets screwed over in the end. Where are my rights?Where is my 30 day free trial he promised? Where is my $50.00 gift card he promised? Where are the signs for my yard he promised? Where is the "Stand by our Product" he promised? Am I going to get any free months for the time the system hasn't worked? I feel I am paying for an inferior product and I wouldn't even have been home except for the fact that my boyfriend died the night before and there was no way I could go to work that day.if this is the way Vivint practices selling their product, I don't see how they can remain in business.

 June 17, 2016 To Whom It May Concern: I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] states that she is receiving collection notices regarding a Vivint account for someone named [redacted], but she does not know [redacted] and does not have a Vivint account or system.  Ms. [redacted] desires her name removed from this account and from any collection action.  At this time, Vivint agrees to remove Ms. [redacted]’s name from the account in question and to remove her name from any collection attempts.Vivint has a signature for Ms. [redacted] on a System Purchase and Services Agreement (“Agreement”) for her neighbor, and Ms. [redacted]’s phone number is listed on the neighbor’s account.  Ms. [redacted] contacted Vivint to dispute her signature on the Agreement, and Vivint requested documentation of Ms. [redacted]’s actual signature in order to proceed in reviewing the forgery claim. I agree with vivint to remove their equipment from my home and our contract to be cancelled. I would like for vivint to leave a number with a valid voice mailbox so that I can reach them if I miss their call to make an appointment. Also, I would like for vivint to actually keep the appointment that they make with me to remove the equipment. I do not want to be stood up again. information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] state that he experienced technical concerns with his system that were not resolved in a timely matter by Vivint. Mr. [redacted] further states he believes the sales representative mislead him about his agreement. Mr. [redacted] desires the cancellation of the account and the wavier of any past due amount. A representative of Vivint has recently attempted to contact Mr. [redacted] in an effort to resolve his concerns. At this time, Vivint is willing to cancel Mr. [redacted] account and waive the current past due amount.  Vivint’s records show that Mr. [redacted] signed a Purchase and Services Agreement upon installation of his Vivint system, in which he represented that he understood and agreed to the initial term of forty-eight (48) months. He also represented that he would pay a monthly monitoring fee of $[redacted] each month, plus applicable taxes, during that term. Vivint has included a copy of Mr. [redacted]’s Agreement with Vivint with his response. Mr. [redacted] had a three day right of rescission, at which he could request the cancellation of his account without penalty. Vivint did not receive a request the cancellation of his account until after the three day had expired. Vivint’s records show that anytime a concern with their system was report. Vivint either assisted Mr. [redacted] over the phone or scheduled an appointment with a Vivint service technician to resolve his concerns. However, Vivint did receive Mr. [redacted]’s equipment in the mail in September 2015.Despite the above information, in resolution to this matter, Mr. [redacted] has no further obligation to Vivint, and his account will be removed from collections. I am rejecting this response because there is no current legal contract between Vivint and me.  Vivint broke their contract by drafting my account without providing me with the monitoring services for which they drafted my account.  This is illegal.  It is also illegal to misrepresent information and products, coerce a customer via the  use of false information and deception, intentionally create duress for a customer by using deceptive sales practices, etc.  .  Vivint DID NOT try to provide me with any monitoring sevice BEFORE automatically drafting my account in November 2015.    The 12/4/15 appointment was offered as an alternative to the 11/17/15 appointment which was cancelled by VIVINT.  In addition, the 12/4/15 appointment offer was made BEFORE Vivint disclosed to me that I would be required to pay the $99 installation fee again, which is when I asked to speak to a supervisor, was then refused, and later hung up on.  Vivint's decision to terminate our phone conversation insinuates there was to be no 12/4/15 appointment.  Again, Vivint took money from my bank account illegally as they were not providing me with the monitoring services which are required in order to legally draft my account with my permission per their contract.  With all that said, there is no burden on me.  Vivint is soley responsible for the violation ot the contract and therefore retains all liablitliy.
Vivint is responsible for breaking our contract and therefore legally must cease and desist any and all future communications with me, no matter what the form of communication.  I demand and fully expect Vivint to comply with this cease and desist.

As such, Mr. [redacted] requests cancellation of his account without paying the contractual buyout fees.Vivint mantians its stance that cancellation without paying the contractual buyout fees is not warranted.A representative from Vivint has again attempted to contact Mr. [redacted] via the email he provided in his complaint, in an effort to resolve his concerns. Vivint apoligises for any issues Mr. [redacted] experienced with the billing service. Vivint does conciter this issue resolved due to the fact that Mr. [redacted]’s account was removed from automatic payment and put on direct invoice.  Mr. [redacted] is now able to make his monthly payments how and when he chooses. Further Vivint’s website Vivint.com is secure and accesabule. If Mr. [redacted] is having issues loging on to his account he may contact Vivint’s Customer Care and they will be able to assist him access his account information. Vivint is also gratefull for Mr. [redacted]’s feedback regarding Vivint’s billing and customer service. Mr. [redacted]’s feedback has been given to the proper management to better Vivint’s ervice. If Mr. [redacted] wishies to cancel his account early he may call into Vivint’s Customer Loyelty Departmet and they can assit him with that.      To Whom It May Concern: I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] states that he is having equipment complications with his doorbell camera and a Space Monkey device. He desires his equipment repaired so that it is fully functional.  Vivint Inc. (“Vivint”)’s records show that Mr. [redacted]’s System Purchase and Servics Agreement (“Agreement”) did not include Space Monkey Service nor services for a doorbell camera. In order to assist Mr. [redacted], these services have been added on to Mr. [redacted]’s account at no additional monthly charge. A representative from Vivint has recently attempted to contact Mr. [redacted], in an effort to resolve his concerns. To further assist Mr. [redacted], I would recommend reaching out to the representative that has attempted to contact him or our Customer Care department at ###-###-#### to schedule a technician to ensure that these products are working.
