Dear Revdex.com Representative: Thank you for sending us the customer's rebuttal. As outlined in our previous response, contrary to the customer’s claim, we sent new agreements to perform a platform change. This way the customer could avoid paying Adelo a $59 Monthly EMV fee and $1,500 Ownership Transfer fee. We remain ready to assist in completing the platform change once the paperwork is returned. If, and when, processing begins we will be able to issue previously discussed credits. We regret the customer’s dissatisfaction, but this rebuttal brings no new information for review. As a result of the above, no grounds exist at this time for early termination of the agreements, or additional refunds to the customer. We request that you close out this complaint. Thank you.

We have reviewed this file and believe all issues raised in the complaint have been resolved.  As an initial matter, we have reviewed the file and found no support for any of the claims raised in the complaint.  A company representative emailed the...

customer the agreements and walked through all important terms and conditions, including rates and fees.  The Merchant Processing Application and Agreement (MPA) signed by the customer includes a detailed two-page Schedule A with an itemized listing of all rates and fees applicable to payment processing.  The MPA also includes a separate equipment lease section that clearly describes the “non-cancellable” equipment lease for $129/month for a term of 48 months.  Additionally, the Merchant Receipt signed by the merchant clearly discloses the fee for early termination of the processing agreement and refers the customer to the company website for the full terms and conditions of the equipment lease, including the cost for default or early termination of the equipment lease.  As such, the equipment lease, all leasing and processing rates and fees, and the cost of early termination of the agreements were all clearly disclosed to the customer in the agreements he signed, and any claim to the contrary is unfounded.
 
That said, our customer service department worked diligently with the customer to try to resolve his concerns.  We offered to make pricing adjustments to the account to reduce the overall cost, but the customer refused our assistance.  We have therefore terminated the customer’s processing agreement/account before expiration of the agreed upon term and waived the agreed upon early termination fee at the customer’s request, but no grounds exist for early termination of the equipment lease, the rights to which are owned by a third party leasing company.
 
As such, we feel that we have addressed and resolved.  Should you need any additional information in order to close this out, please let us know.  Thank you.
