have reviewed the complaint and the customer’s file and have found no support for the customer’s claimsThe customer was sent and signed a Merchant Processing Application and Agreement (MPA) that sets forth all terms and conditions of the agreement, including an itemized list of all credit and debit card processingAdditionally, the customer participated in a recorded verification call with the company’s compliance administrator in which he expressly confirmed his understanding of the primary terms and conditions of the agreement.That said, our customer service department has worked diligently with the customer to resolve their concerns. We offered the customer a refund for the weeks of processing where their rates were not as anticipatedThis was due to a low processing volume we explainedThe customer refused this courtesy refund and opted for cancellationWe as well offered to adjust the account’s overall effective rate for future processing if the volume would remain low, and consist of mostly non-qualified credit cardsAgain, the merchant refused assistance, and opted for cancellationCancellation fees begin at $250, but that is not all-inclusive, these terms are explained within the signed MPA.We are happy to monitor the customer’s account and work with him to make adjustments if they are not satisfied with the service, but no grounds exist at this time for additional refunds to the customer. Thank you for sending us the customer's rebuttal. Despite what is stated in the customer’s rebuttal, there is no evidence that the customer was told there was no early termination fee and the documents signed by the customer clearly disclose the early termination fee. As such, there are no grounds for a refund of the early termination fee.

The customer signed a Merchant Processing Application and Agreement (MPA) that sets forth all terms and conditions of the agreement, including an itemized list of all credit and debit card processing fees as well as the non-cancellable lease for processing equipment for $per month (plus applicable taxes) for a term of months. The customer also confirmed her understanding of and agreement with the primary terms of the agreement on a confirmation call with the company’s compliance administrator
That said, our customer service department has worked diligently with the customer to resolve her concerns. Despite the existence of valid and enforceable agreements, we have agreed to terminate the processing and lease agreements prior to expiration of the agreed upon terms and waive all associated early termination obligationsThe customer will not have any further obligation under these agreements after August 12,

Although this company's response is partially true in that *** initially willingly signed this contract, she did not realize that she does not have legal ability to sign for herself regarding any business matter- since January 1, 2015, I - *** *** own 99% of my company and I do not give anyone else permission to make any business decisions, and I'm providing proof of thisFurthermore , the way this company handles their business and recruits customers is illegal and outrageous: it is illegal to verbally state information on the phone to a prospective client and then con them into signing quickly on a contract that states totally different information! This company hires very slick phone reps that do nothing but lie to their clientsThe rep , Elijah, verbally stated that the monthly service upkeep fee us $109, NOT the leased equipment! He said to her that the equipment is totally free! This is pure fraud! You can see for yourself the horrible negative reviews on Google for this company! I attached a few reviews but I don't have the ability to attach them allYou can look them up on Google and yes - all the five star ratings are fake- they are posted by employees of this company
All I am asking for is to cancel all connection with this company, BOTH the monthly service fee, AND the year lease contact fir the equipmentI am willing to pay a termination fee that's feasible to me but not $that they requested to complete the lease terms!! Please reply back with a resolution as soon as possibleThank you

I am rejecting this response because:the company is charging me a full month (May) service because we made our first transaction on may 21stand a second full month (June) service because they sent out the statement on June 2nd and I called to cancel on that very same daythere for I find it unjust and refused the weeks discount.the main issue with this dispute is the constant lies and tricks that the company playthey wanted a year contract based on the promise that on average if my monthly total on all different types cards is about $60,I will be charged around $plus is the company's monthly charges, and that's it no hidden charges or surprises, that was the agreement.after less than weeks I get charged $and that's on less than half of the $60,if any one reads these charges they can tell they are ripoff and falls charges, we got over different charges worth almost $on transactions. Please take a look at these charges and let me know if they seem reasonable.

We have reviewed the complaint and the customer’s file and found no support for the customer’s claims. The customer signed a Merchant Processing Application and Agreement (MPA) that sets forth all terms and conditions of the agreement, including an itemized list of all credit and debit card processing fees as well as the non-cancellable lease for processing equipment for $per month (plus applicable taxes) for a term of months. The customer is correct that qualified credit and debit card transactions are charged a processing fee of 1% and non-qualified credit and debit card transactions are charged a processing fee of 2.99% per the terms of the MPA, but the MPA also includes a long list of other applicable rates and fees applicable to the program that were clearly disclosed to and signed off on by the customer
That said, our customer service department has worked diligently with the customer to resolve her concerns Despite the existence of valid and enforceable agreements and full disclosure of all rates and fees, our customer service department reduced the customer’s non-qualified transaction rate from 2.99% to 1% - an adjustment that would result in significant savings for the customer. We also agreed to terminate the processing and lease agreements early prior to expiration of the agreed upon terms at no cost and waive the associated early termination fees. However, due to the full disclosures outlined above, no grounds exist for the additional refunds requested by the customer

Thank you for sending us the customer’s follow up response The $monthly fee referenced in the customer’s latest correspondence is for the equipment lease As outlined in our last correspondence, we have already arranged for early termination of this lease at no charge As such, the customer will have no further obligation under that agreement. Also, all refunds requested have been issued to the customer, so there is no further action for us to take to resolve this complaint

I am rejecting this response because:On March 21st United Card Solutions (UCS) offered a resolution that we found acceptableOn April 4th we received an email from UCS indicating that in order for them to do as they had promised, we would need to sign a new contractWhen we questioned the reasoning for this, their response was; “This is purely for our process over here.” United Card Solutions is unwilling to perform as promised under the original contractTherefore they have terminated the original agreement. We are unwilling to sign a new agreement since UCS has clearly demonstrated their unwillingness or inability to ever do what they say they will do. The only resolution at this point in the relationship would be for UCS to communicate to FDS Holdings that the contract has been voided and that UCS and FDS holdings return the monies unlawfully taken from our checking account

Thank you for bringing this complaint to our attention. We have reviewed the complaint and the customer’s file and have not found any support for the customer’s claims. The Merchant Processing Application and Agreement (MPA) signed by the
customer disclosed all terms and conditions of the agreement, including an itemized listing of all applicable processing rates and fees and the 48-month non-cancellable equipment lease for $per month (plus applicable taxes) for a term of months
Even so, our customer service department reduced the customer’s rates in order to bring the overall cost down to the satisfaction of the customer and issued the customer courtesy refunds in an attempt to retain her as a happy customer. We removed various fees from her program, reduced her downgrade surcharge for non-qualified credit card transactions from 2.99% to 1%, and reduced her signature debit card transaction rate to 0%. We also issued the customer a $refund to cover March’s non-qualified credit card transaction fees and a $refund to cover the account setup fee
The customer is still actively using our processing services and equipment to process debit and credit cards. The customer has expressed her satisfaction with the above resolution measures and stated that she was going to contact us after receiving her May merchant statement (received in June) so she can review the adjustments we made and request other adjustments if necessary
