I am rejecting this response because:grass4sale has had zero correspondence. They have made no effort to
clean up the oil that Has stained my driveway. I have pressure washed the driveway and the stains will not go away. Grass4sale has not made any effort to clean up the street in front of the house either. This response is unacceptable and grass4sale can do better than that. Please reread the initial
post and come up with a better answer than the one provided.
Regards,
[redacted]
It should be noted that all fluid spilt was on the street, not the customer's private property. Grass4sale.com requested any charges, beyond a bag of kitty litter, to clean up the very minor spill from the city. Nothing has yet been...
received.
While all of the story below has been discussed with the driver, he cannot confirm any of the tickets or blown tires that the customer speaks about. While tickets, blown tires, and many other mechanical issues happen when working in transportation, they are dealt with swiftly to move to the next delivery as quickly as possible.
The installation team was running behind for the job at [redacted] and to avoid any issues, the driver was assigned to fill in until the team freed up. No sooner did the driver (who had been installing and driving for Grass4sale for 3 years) begin the work than the customer began installing his own pallets.
No dates are guaranteed. While unwelcome, delays are a part of doing business with a live, natural product such as grass which dictates when it will be harvested. When there are delays in harvesting the product, there will then be delays in transportation, delivery and ultimately installation. We regret having these barriers but do the best job possible to notify customers of their involvement.
A good timetable to observe when installing sod is no more than 24 hours on the pallet before installation. No timeframe is ever guaranteed, but since Grass4sale.com (the seller, grower, shipper, installer and product expert) supervises each project, none is needed.
Grass4sale installers do not install sod that is beyond the ability to recuperate from the shock of transplantation. Instead, Grass4sale.com install teams are trained to contact the foreman or the office if more grass is needed.
Cancellation is not an option once the grass has been harvested. As per the company Terms and Conditions, all changes and cancellations must occur prior to the 48 hours before delivery. Since he placed his own order, agreement to these Terms was given through checking a box before payment information was taken. In addition, no alterations to company documents or terms are acceptable. No instructions were on file for this delivery or installation.
Starter fertilizer purchased as part of the order was installed by the install team free of charge before watering and rolling the area.

I am rejecting this response because:
What is set out below is incorrect. As you can see from the email attached, I requested that only the 20-30 pieces of dead grass be replaced. I never demanded a refund. I advised them that since I paid for installation, that I insisted on replacement. They offered for me to come to "another delivery site" and obtain the grass and install it myself otherwise a delivery charge would be applicable. That is unacceptable. I paid to have it delivered to my house. I paid to have it installed. A small portion of the grass was dead. This company has refused to do anything reasonable in order to resolved this. After first offering a resolution, they failed to return two separate phone calls, which is what caused the initiation of this action.
Additionally, I did return their warranty form before I filed this claim.

Mr. [redacted] was told several times through email and phone, that Grass4sale.com would gladly honor his claim for warranty replacement of his grass. What the warranty does not cover is the removal of the nonviable, or the installation of the new grass. [redacted] demanded that Grass4sale.com...
refund all of the price of the grass and services, return the grass and harvest another order for him, none of which are within the Terms and Conditions of the order.
On May 9, 2014, at 6:51 PM, [redacted] sent the warranty claim form to [redacted]. Instead of sending the completed form as requested, Mr. [redacted] sent another email on the 12th again demanding the replacement and installation, though the warranty had not been claimed, but was already approved.

Whoever told you this needs to re-think their position. Your installer installed the grass improperly. I paid you guys to have the grass installed properly. It is only 20 or 30 pieces.
I expect that you will arrange not only for the extra pieces to be delivered, but installed at no charge. If this is not going to happen in the next week, please advise as I will need to seek my remedies via the Texas Deceptive Trade Practices Act.
Respectfully,

Grass4sale.com agreed to waive the waiting period for Mr. [redacted], in the interest of satisfying the customer, and send the replacement grass as soon as the form was received. Mr. [redacted] to date has not filed a warranty replacement claim.
On May 13th, [redacted] sent the following email which has his intentions to slander Grass4sale.com in the first paragraph:
Lawsuit is being filed this afternoon. I also hired a team to make postings on Annie's list and Facebook, etc. about my bad experience. It is going to be a lot more expensive than the cost to come out and replace the few dead pieces, but it is your choice.
I ordered 4 pallets of grass and was promised delivery in mid March. Here it is early May and I just hung up with Valerie. After reading many reviews, she has to hate her job because all she must do is take calls from very upset and frustrated customers. She didn't have an answer on when I would get a delivery because the farm hasn't called her back yet. We did have some rain in the past few weeks but I will attest the communication from this company is atrocious and unreliable to say the least. Buyer beware! Not a good company to do business with.

I am rejecting this response because:
The...
order was not complete Both [redacted] and [redacted] made that clear, [redacted] on the phone and [redacted] in writing [redacted] made clear the order would be cancelled, the sod picked up, and that I would be given a refund for the fraudulent charge. Despite repeated requests that they follow up, both in writing and by phone, nothing happened. The grass was not picked up and no refund given. I was charged not only for the grass, but for installation, which they did not do, vegetation removal, which they did not do, and fertilizer, which they did not deliver. I have the email where [redacted] clearly stated that the order was not complete and where [redacted] makes clear the sod would be picked up, order cancelled and that I would be priced with a refund.
it's obvious why this company has an "F" rating with you
