I am in receipt of the complaint initiated by the above-mentioned consumer and appreciate the opportunity to respond.
Priceline offers a variety travel service options, including rental car reservations that permit cancelations.
When selecting a reservation, the consumer is provided with the...

cancel/change policy associated with each reservation.
In this case, the consumer selected a reservation that provided greater savings and less flexibility.
Our records indicate that the consumer contacted Priceline on December 10th requesting to make changes to her reservation. Upon review of the consumer’s selected reservation, the representative informed the consumer that she selected a non-refundable, non-changeable Name Your Own Price reservation. The customer then advised that she called [redacted] and the representative advised that they are fine with changes to the reservation, however; the consumer must contact Priceline for assistance.
The Priceline representative informed the consumer that the rental partner referred her to our company because she booked a restricted Name Your Own Price reservation, and our contractual agreement with our rental partner prevents us from changing the reservation.
Attached hereto is a copy of the consumer’s initialed contract page authorizing the non-refundable, non-changeable terms and conditions of the selected reservation.

I am rejecting this response because they have not offered to refund the difference in the price of the room. Priceline.com ripped me off!The bottom line is this, on Wednesday the 23rd of November 2016, I paid in full for a 2 night stay at the [redacted] in [redacted] at a rate of $115 per night. On Friday November 25th, Priceline.com listed the exact same hotel rooms for only $89 per night. I called that night to request a price-match to which they not only refused, but insultingly offered to cancel the reservation for a penalty of the entire purchase price.Priceline.com has pathetic customer service and are alarmingly deceptive, unapologetic, and have made no effort to resolve this issue in good faith.

that might support a more favorable conclusion.  
The consumer states:



“ I entered the bidding
feature of priceline so that I can search for a car that I can afford.”

desired for the car rental and I believe I also entered my visa credit card
number, not aware that they were going to bill me right away.”

According to the consumer, after purchasing a Name Your Own Price rental car reservation, he also purchased a rental

stating that he was unaware that he would be billed for his Priceline purchase, and did not agree to the Priceline purchase.

The originally proposed $20 compensation already sounded like adding insult to injury to us, and they're doing it again. covered balcony with outdoor seating. She also advised that the room with views
of the Intra-coastal waterway with Juliette balcony is on their Harbor View
rooms, which is on the other tower and is not what you are booked for. Please
feel free to reconfirm this directly with the hotel.

I am rejecting this response because: Not refunding my money for a service that I did not use because I was refused is patently unfair and customer "unfriendly" regardless of policy/procedure. I really don't know if keeping my money is legally acceptable but to me and on behalf of all customers, it is morally unacceptable and based on this situation, it is unfair. I am requesting a full Refund of the amount paid for products or services because they were not delivered!

I have received the consumer’s additional comments. As you requested, I have again reviewed this matter to see if we overlooked anything that might support a more favorable conclusion. Unfortunately, there is nothing we can add to what has already been stated in our previous correspondence.  Upon hotel room check-in/out the hotel representative provided the consumer with the lower negotiated room rate established between priceline.com and the hotel, which is not available to the public.  Priceline.com is a travel agent and as such, makes hotel room rates available on behalf of the hotels. Just like every other business, we receive reduced rates because we sell in large volume, and if you compare our rates, you will find them to be very competitive. We strive to offer customers the best alternatives for saving money while at the same time maintaining profitability. I apologize if the consumer is disappointed with the difference in rates; however, Priceline will not be able to offer a refund for the difference in rates.
