email regarding Mr. [redacted] and
appreciate the opportunity to respond. 
 
We have reviewed the circumstances with Mr. [redacted] Michelin
tires.  Our records indicate that we were
initially contacted by Mr. [redacted] on 07/19/2017 concerning alleged wet traction
concerns with his Primacy [redacted] tires fitted on his 2015 Toyota Avalon. Mr. [redacted]
was advised of the 6 year warranty coverage and that wet traction was not a
warrantable condition. However, we did advise him that we would review for any
possible assistance if an authorized Michelin retailer provided inspection
results of the suspect tires to us. We provided information on 7 authorized
dealers he could visit during that contact. 
 
On 08/22/2017 we received the required inspection results from Holly at
[redacted] Toyota. We noticed at this point with projected mileage Mr. [redacted]’s
would most likely fall short. Being as wet traction is not covered under our
warranty guidelines we offered a 33% credit on Michelin replacement tires based
on the projected mileage in an attempt to resolve Mr. [redacted]’s
concerns. Holly, the representative at [redacted] Toyota is currently awaiting
approval from Mr. [redacted] to replace his tires on this basis. Mr. [redacted]
will have 14 days to accept the offer.

complaints. Based on the tire inspection information provided by [redacted], the tires on the consumer’s van had irregular wear which is not covered by the Michelin limited warranty.  However, we provided a 25% credit toward the purchase of replacement tires as a goodwill gesture. We feel we have tried in good faith to assist the consumer above and beyond the warranty.  We are sorry but free tire replacement is not an option in this circumstance. Regarding this complaint, I responded saying the company’s offered settlement was acceptable. When can I expect them to remunerate the funds for the proposed resolution of this complaint? As of March 8 I have not received any communications or the promised reimbursement regarding this complaint. Thank you much for looking into this and responding to my question. J[redacted]

We
received your letter regarding Mr. [redacted]'s complaint.
 
We reviewed Mr. [redacted]'s
case. One tire suffered a road hazard. Road Hazards are not covered by the
limited warranty but we offered a 60% discount as goodwill due to the low
mileage and being worn down only 2/32nds of the original tread.
 
Unfortunately the tire model was
discontinued, so we offered to replace all four tires on a pro rata basis as
goodwill. We offered Mr. [redacted]'s a 60% reimbursement of the cost of the tires.
 
Mr. [redacted] was under the impression
that we would reimburse 100% of the cost of the tires. We explained that the
replacement is done on a pro rata basis. In other words, Mr. [redacted] was
responsible for paying the wear and tear of the tires, besides the
mounting and balancing of the tires and the cost of any other service
charges and applicable taxes.
 
In order to assist Mr. [redacted] a
little more, we adjusted 1 tire at a 60% reimbursement, and the
remaining three tires at a 90% reimbursement. Mr. [redacted] paid
$1,264.00 for his new replacement tires. We reimbursed in total $1,056.40
 
We had initially sent Mr. [redacted] a
check for $754.00 that represented a 60% reimbursement of all four tires.
We have now requested a second check for $302.40 to complement $1,056.40
(1 tire at 60% reimbursement and 3 tires at a 90% reimbursement).
 
Mr. [redacted] was notified of the above
and he replied thanking us for revising the reimbursement and inquiring if we
could overnight the check.

We received your second email regarding Mr. [redacted] and
appreciate the opportunity to respond. 
 
We would like to reiterate that a 33% credit towards
Michelin replacement tires has been authorized by Michelin for Mr. [redacted].
This offer was originally made on 8/22/17 and to be held open for 14 days
after. We will extend this an additional 14 days (expires 9/19/17) in light of
any confusions. We spoke to Holly at [redacted] Toyota and she is aware of the
offer made and willing to process the warranty claim accordingly for Mr.
[redacted].
 
If confusions, concerns or frustrations persist we would like to
extend a second option for Mr. [redacted]. We are willing to reimburse Mr.
[redacted]
the offered 33% credit if he simply purchases the replacement Michelin tires up
front. This would be a direct reimbursement to Mr. [redacted] and the credit would
be on the tire cost alone. Mr. [redacted] can fax a copy of his invoice to
1-864-[redacted] in order for us to review, document, calculate the appropriate
reimbursement amount and request a check to be sent.

We have confirmed with the consumer and dealer that our goodwill offer has been increased to a 45% discount with the purchase of 4 new Michelin or [redacted] tires.  The consumer states he is happy with this offer.
