5/19/16.  While investigating cr [redacted], we confirmed that an order was placed for a Ms. [redacted] for a Budget Savers 30-day trial membership on 1/15/16.  Membership materials were sent to Ms. [redacted] for review and confirmed as delivered by the United States Postal Service OneCode Confirm® service.  We have canceled this membership. Ms. [redacted] enrolled in Budget Savers during a customer service call on 1/15/16.  Ms. [redacted] was offered and remains eligible for up to $100 in cash back gas rebates for enrolling in Budget Savers.  As detailed in the membership materials, as well as detailed on the sales call, to claim the up to $100 in cash back gas rebates, the customer is required to send in the appropriate quarterly rebate request form, along with a receipt for a gas purchase made during the same time period.  The customer is eligible to receive $25 cash back for each quarter, totaling up to $100.  The request form for this offer can be accessed online, as well as obtained by calling our customer service number.  On 4/14/16, 4/29/16 and again on 5/16/16, all prior to your correspondence, Ms. [redacted] was mailed the selection form giving her the opportunity to request the rebate forms be mailed to her at her home address.  By doing so, we believed we has satisfied Ms. [redacted]; however, rather than waiting for and returning the form to us, she contacted your office.  Under separate cover, we have mailed Ms. [redacted] the selection form via the U.S. Postal Service.  If Ms. [redacted] would kindly complete and return the form to us according to the terms and conditions of the offer, we will make sure she receives that to which she is entitled. Sempris prides itself on providing outstanding customer service and fair resolution to all customer inquiries.  This membership was canceled on 1/25/16 and because Ms. [redacted] canceled during the trial offer period, her card account will not be charged again in the future.   We trust our good faith actions bring this matter to a satisfactory resolution. Sincerely,  David [redacted]Director of Call Center Management and Consumer AffairsSempris, LLC [redacted]

rejecting this response because:Because what they're doing is not right I have been sick and do not check my emails on a regular basic. I don't always understand the charges because I find it hard to understand them due to problems with vascular dementia or maybe I would have notice them earlier. But why would I be looking for someone to go into my account without my permission they are using some else's name to charge my account. I've had 3 strokes but I will not allowed these people to do this to me. They are liars that try to cheat the elderly and I have right. I will be contacting the Attorney General for assistance also.

inquiry dated 6/25/15. While investigating cr 1137135566, we confirmed that an order was placed for a Ms. [redacted] for a Budget Source 30-day trial membership on 5/19/15. Membership materials were sent to Ms. [redacted] at her current address for review and confirmed as delivered by the United States Postal Service OneCode Confirm(r) service. This trial membership is no longer active.
Our customers are eligible to redeem a welcome gift when they enroll in Budget Source, as well as take advantage of the membership benefits as long as they stay active during the trial offer period. Our records indicate that Ms. [redacted] is not a customer. Our customers are required to pay a trial fee in order to be eligible for benefits in Budget Source. Because Ms. [redacted]'s credit card had insufficient funds in order to charge the $1.95 trial fee, she was never actually enrolled. Even so, our records show that Ms. [redacted] received a $25 Shell gift card for attempting to enroll in Budget Source and received a $5 gas rebate check, a benefit for active members, even though Ms. [redacted] was not eligible for them, an error we should not have made but one that was clearly in Ms. [redacted]'s favor. Furthermore, because we do not want to cause further concern for Ms. [redacted], we are not going to require that she send back the gifts we did send her in error, and hope she enjoys them with our compliments.
In her letter to you, Ms. [redacted] is demanding to obtain further benefits, none of which she is entitled to. We refuse to honor this demand. As well, we have flagged Ms. [redacted]'s information so as to ensure she can never be a customer of ours in the future to save her from any issues with us again.

After the 14-day trial period had ended, Mr. [redacted] then began to be billed at $29.95 per month as detailed in the membership materials, as well as detailed on the sales call.
Mr. [redacted] enrolled in Budget Savers during a customer service call he received after purchasing the Water Jet. After reviewing the file associated with Mr. [redacted]'s order for our service, he provided his electronic signature, as well as the full 16-digits of the Visa card to be debited for his purchase and authorized charges to be placed to this card for his Budget Savers membership. During the sales presentation for Budget Savers, Mr. [redacted] unambiguously consents to enrollment after all material terms and conditions of the membership offer had been disclosed.

This membership was canceled on 1/29/16 per Mr. [redacted]'s request and will not be billed again in the future. On 2/5/16, prior to our receipt of your correspondence, we mailed Mr. [redacted] a cancellation confirmation for Budget Savers, which provided Mr. [redacted] the opportunity to request a full refund. By doing so, we believed we had satisfied Mr. [redacted]; however, rather than returning the form to us, he contacted your office.
As Mr. [redacted] states in his complaint sent to your office, we have been putting our charge and phone number on his credit card statement for 49 months. We feel that it would be more than fair to immediately refund his account $599.00 (20 months) for the Budget Savers membership even though Mr. [redacted] consented to enrollment. Please know that is refund is a courtesy in order to address his request for any type of reimbursment. Individual banks, though, post credits with varying timeliness. Mr. [redacted] should, therefore, direct any questions regarding the posting of his refund and its timing to his financial institution.

I am rejecting this response because:
First off I canceled this order the same day it was made. I received zero information...

about the product like the company is claiming and the company name on my card doesn't match the company answering the complaint. I was never sent any materials about the product or the product itself. I called this company the very next day after ordering to cancel the order the reason I didn't even recognize who was charging me was B.C.the name on the invoice wasn't the same and when I called they offered no information. This same company has run this scam on numerous people after looking them up where they say they are sending you a vacuum but never send anything but charge your card every month. They NEVER send product or proof of payment or any sort of documents and if your lucky you catch it the first time. Their statement is full of lies in order to sound like a legitimate business when it is anything but

This represents a refund of $224.55, which is the total amount paid to date for the Value Plus membership. Please recognize that Sempris has refunded this order in full. While Value plus claims I agreed to their membership... I distinctly remember telling them a number of times I was not interested (I purchased something from an infomercial). I also do not remember receiving anything form them but if I did I assumed it was junk mail as I had said a number of times I was not interested.
Before contacting the Revdex.com I contacted Sempris regarding charges on my credit card. The guy Paul who answered was rude and said they could only refund one month, I would have to fill out a form and mail it in (no electronic or email). When Paul sent out the "form" it was actually a letter telling me I am out of luck in getting a refund. So that is when I filed a complaint with my credit card company (they have had many about this company) and complaint with you. To date Sempris has only refunded 3 months worth of these fraudulent charges. I accept their response as long as all 9 months are refunded.

inquiry dated 4/10/17.  While investigating cr [redacted], we confirmed that an order was placed for a Ms. [redacted] for a Value Plus 30-day trial membership on 7/30/12.  Membership materials were sent to Ms. [redacted] for review.  After the 30-day trial period had ended, Ms. [redacted] then began to be billed at $24.95 per month as detailed in the membership materials, as well as detailed on the sales call.   Sempris relies on third parties to sell its programs to consumers.  We hold these distribution partners to the highest standards, and our contracts with them require that all material terms and conditions of all membership trial offers be fully disclosed to the customer during the sales presentation.  In conjunction with applicable laws, copies of these sales verifications are required to be maintained for two years.  Because this sale took place more than 57 months ago, our distribution partner is working to restore the sales verification for their archives.   Sempris prides itself on providing outstanding customer service and fair resolution to all customer inquiries.  This membership was canceled on 4/7/17 per Ms. [redacted]’s request and will not be billed again in the future.  As part of our routine refund process, on 4/21/17, we mailed Ms. [redacted] a refund request form in response to her request for further review. Mr. [redacted], Ms. [redacted] is patently wrong regarding her opportunity to claim the gift card she is entitled to.
