I am in receipt of and have reviewed the above referenced complaint filed by Ms. [redacted] against Receivables...
Performance Management, LLC (RPM). RPM is a licensed third party collection agency operating in all fifty states and the District of Columbia. Ms. [redacted] is complaining that RPM called her residence telephone, [redacted] almost every day for nearly a month. Furthermore she never received the initial dunning letter and wants all contacts to cease. After a review of our records I offer the following response on behalf of RPM:
RPM received this file from our client [redacted]. on November 6, 2015. RPM mailed the initial dunning letter to Ms. [redacted], advising her of the creditor, amount owed and her rights under the Fair Debt Collection Practices Act (FDCPA) on November 8, 2015 to the address of [redacted]. RPM does not have the above telephone number in our system; however RPM did make call attempts at another number. At Ms. [redacted]’s request a Do Not Call code has been placed on it. No other calls will be attempted.

the District of Columbia. Ms. [redacted] states that RPM processed a payment before the agreed upon date resulting in an overdraft fee. She requests RPM refund any overdraft fee. After review of our records and contacting our client I offer the following response on behalf of RPM: Windstream placed Ms. [redacted]’s account in our office for collection on May 12, 2017. On July 17, 2017, RPM spoke to Ms. [redacted] who agreed to make full payment on the debt. The payment was processed that same day. After review of a recording of the call, it is clear that the payment was supposed to be processed on July 31, 2017. The representative involved has been reprimanded. The account is now paid in full. RPM will reimburse Ms. [redacted] for any overdraft fees incurred as a result of this error. Ms. [redacted] may email proof of the overdraft fees to [redacted]@receivablesperformance.com and cc myself at [redacted]@receivablesperformance.com. RPM has confirmed that Ms. [redacted] was not contacted prior the account being reported to her credit history. This alone does not prohibit a creditor or data furnisher from providing information to the credit reporting agencies. In an effort to resolve the issue in a manner acceptable to Ms. [redacted], RPM will request the removal of the account trade-line from her credit history to allow her the opportunity to resolve the obligation in the interim.Ms. [redacted] may contact RPM directly at 866-212-7408 to make payment arrangements. Receivables Performance Management, LLC (RPM). RPM is a licensed third party collection agency operating in all fifty states and the District of Columbia. Mr. [redacted] feels he is near the end of his payment plan and was trying to get an updated balance. While calling RPM he felt mistreated: rude representatives who talked over him or just hung up his calls. He feels RPM should discontinue collection efforts on the remaining balance. After a review of our records I offer the following response on behalf of RPM:
RPM negotiated a Settlement in Full (SIF) on this account with Mr. [redacted]. Mr. [redacted] paid four payments, with the last one received on February 21, 2016. RPM has updated the status to SIF and reported that to the three major credit bureaus. RPM apologizes to Mr. [redacted] for any discourtesy or issues he had when calling RPM.

Ms. [redacted] is disputing this debt and making several allegations against RPM: no initial dunning letter; use of abusive and hostile tactics to collect a debt; hanging up when he calls; violations of the California Fair Debt Collection Practices Act; and illegally reporting this debt to the credit bureau. RPM has researched its business records and cannot locate a file for Mr. [redacted]. RPM has searched by his name, address, telephone number and e-mail address. RPM is not saying Mr. [redacted] does or does not have a debt placed here; we just are unable to locate it in order to accurately response to this complaint. After review of our records and contacting our client I offer the following response on behalf of RPM: DIRECTV placed Ms. [redacted]’s account in our office for collection on March 30, 2017. On April 1st RPM sent Ms. [redacted] a notice informing her of the debt, creditor, and her rights under the Fair Debt Collection Practices Act (FDCPA). RPM also attempted to contact Ms. [redacted] by telephone and appear to have spoken to her several times at which point she hung up on our agent. During one such contact she requested no further calls. Accordingly RPM ceased further call attempts. Upon receipt of this complaint, RPM contacted DIRECTV who provided the attached account ledger and cover letter for Ms. [redacted]’s review. At this time, it is DIRECTV’s position that the balance is owed. RPM acts as a data furnisher on behalf of DIRECTV. someone else and demands that they stop. After review of our file I offer the following response on behalf of RPM:
RPM located an account using the telephone number ending [redacted] provided in the complaint. The account is in the name of a consumer who is not Mr. [redacted]. In order to prevent a potential third party disclosure in violation of the Fair Debt Collection Practice Act (FDCPA), RPM is withholding any further information about the consumer responsible for the debt.
The telephone number listed in the complaint (ending [redacted]) was called by RPM attempting to locate the consumer responsible for the debt. Our business records reflect no record of contact with Mr. [redacted]. RPM has added Mr. [redacted]’ telephone number to our permanent ‘do not call’ datab[redacted] preventing future calls should the number be listed on a subsequent account.

and the District of Columbia. Ms. [redacted] states that she signed up for internet service with AT&T however it never functioned properly and was eventually removed. The account was later sent to collections and she is now being contacted by RPM. She requests the matter be removed from collections as well as her credit history. After review of our records I offer the following response on behalf of RPM: AT&T Wireline listed Ms. [redacted]’s account for collection with RPM on February 27, 2017. RPM’s business records reflect a conversation with Ms. [redacted] on April 28th where she stated that she did not owe the balance. RPM’s agent marked the account as disputed and RPM ceased further collection activity. Upon receipt of this complaint, RPM contacted AT&T who advised that a credit had been applied to the balance. The account has been recalled from collections with a $0 balance. RPM has requested removal of the account trade-line from Ms. [redacted]’s credit history. I am in receipt of and have reviewed the above referenced follow up complaint filed by Ms. [redacted] against Receivables Performance Management, LLC (RPM). RPM is a licensed third party collection agency operating in all fifty states and the District of Columbia. Ms. [redacted] rejected RPM initial response since it was a letter addressed to another consumer. After a review of our records I offer the following response on behalf of RPM:
RPM apparently attached the wrong letter when we originally responded to this letter. RPM sincerely apologizes for this error. RPM received this file from our client Sprint on November 30, 2015. RPM mailed the initial dunning letter on December 2, 2015 to Ms. [redacted], advising her of the creditor, amount owed and her rights under the Fair Debt Collection Practices Act (FDCPA) to the address of [redacted]. RPM did begin unsuccessful telephone attempts to contact Ms. [redacted]. All telephone attempts were within the convenient times as authorized by the FDCPA, Section 805 a (1). Upon the receipt of complaint, RPM placed the requested cease and desist on the account.

RPM stands by its prior response. In addition to the notice sent to Mr. [redacted] on March 28th, RPM also sent Mr. [redacted] a settlement offer via ground mail and email on or about July 11th or 12th. No response was received. RPM also attempted to contact Mr. [redacted] by telephone prior to credit reporting and have no record of speaking to him. Attached is verification of the debt in the form of monthly billing statements provided by Sprint. I am in receipt of and have reviewed the above referenced complaint filed by Ms. [redacted] against Receivables Performance Management, LLC (RPM). RPM is a licensed third party collection agency operating in all fifty...
states and the District of Columbia. Ms. [redacted] states that a debt she made arrangements to satisfy was later reported to her credit history. She states that RPM advised it would be removed, however it still remains. After a review of our records I offer the following response on behalf of RPM:
RPM received Ms. [redacted]’s [redacted] account for collection on March 30, 2016. In May of 2016 Ms. [redacted] made arrangements to satisfy the obligation over two payments. The final payment posted to the account on June 3rd. RPM’s business records indicate that the account was first reported to Ms. [redacted]’s credit history on May 15th prior to receipt of any payment. RPM does not credit report an account until approximately 45 days from the date it is listed with us for collection. In order to avoid an account being credit reported an account must be paid in full prior to the reporting date regardless if payment arrangements have been set up- it must actually be paid. This information should have been conveyed to Ms. [redacted].
In light of these circumstances, I agreed to remove the account trade-line from Ms. [redacted]’s credit history as was referenced in the complaint. A request was sent via our automated process. It can take anywhere from 30 to 45 days for the credit reporting agencies to update their system. Because Ms. [redacted] is claiming the trade-line is still present, RPM is submitting a manual request to remove the account trade-line. If the trade-line continues to appear Ms. [redacted] may contact me directly for further assistance.

Mr. [redacted] is now complaining that RPM hasn’t sent any deletion to the credit bureaus nor has it sent him a deletion letter. After a review of our records I offer the following response on behalf of RPM:
RPM sent a deletion notice to the three major credit bureaus using two methods: one was by an electronic means sent by our IT department and a second through the EOSCAR system, AUD# [redacted]. However RPM has no control over how long it takes the credit bureaus to update their records. Regarding the deletion letter, it was sent on December 16, 2015.

RPM did negotiate a settlement in full (SIF) with Mr. [redacted]. The SIF payment was received and it appears that the SIF code never got to our client Dish. RPM has contacted Dish, advised them of the SIF and asked that they recall the account from the other collection agency. RPM apologizes to Mr. [redacted] for any inconvenience.

I am rejecting this response because:I’ve disputed this account with the credit bureau and RPM has responded that the credit bureau (Equifax) the account is valid and accurately reporting which was false information. This account should never been reported to credit bureau; furthermore, I’ve contacted RPM directly and was advised that as long as I continue to dispute this account with credit bureau it will remain on my credit by represetive Maritza. As of today, this account is still on credit report as an adverse account which has adversely affected my credit worthiness. My complaint is this company is not compliant with the fair credit reporting laws. I plan to seek legal action.

I am in receipt of and have reviewed the above referenced complaint filed by Ms. [redacted] against Receivables Performance Management, LLC (RPM). RPM is a licensed third party collection agency operating in all fifty...
states and the District of Columbia. Ms. [redacted] states that she settled a delinquent [redacted] account with RPM in June 2016 however received a notice from another collection agency over the same account. She requests RPM confirm the settlement with the current agency and resolve the matter. After a review of our records and contacting our client I offer the following response on behalf of RPM:
RPM received Ms. [redacted]’s [redacted] account for collection on March 15, 2016. On June 23rd, RPM’s business records indicate that on April 20th a settlement to resolve the account payable in installments was reached. The first three payments were timely received, however Ms. [redacted] requested an extension of the final payment which was granted. The final payment was subsequently posted to the account on June 20th. As a result of changing the arrangement it appears that the account did not close properly in our system due to an agent error. The remaining account balance was later recalled by [redacted] and placed with another collection agency.
Upon receipt of this complaint, RPM advised [redacted] that the account was indeed settled by the payments received by RPM. [redacted] advised they had updated their records to reflect the same and were recalling the account from the subsequent collection agency that sent Ms. [redacted] a notice. The account is settled in full.
