I am in receipt of and have reviewed the above referenced follow up complaint filed by Ms. [redacted] against Receivables Performance Management, LLC (RPM). RPM is a licensed third party collection agency operating in all fifty states and the District of Columbia. Ms. [redacted] rejected RPM’s initial response for these reasons: RPM stated the last contact with Ms. [redacted] was August 6, 2016; the credit bureau told her RPM last reported this as an active collection in March, 2016; RPM promised to resubmit the deletion to the credit bureau; and RPM is blocking her calls into our office. After a review of our records I offer the following response on behalf of RPM:
My apologies for stating the last contact was August 6, 2016, it was on April 6, 2016. This was a typo and my error. RPM doesn’t know who Ms. [redacted] spoke with or at which credit bureau she is referring to so RPM can’t comment about that. However this account was recalled by our client over seven months ago so there would be no recent reporting to the credit bureau. However RPM did resubmit a deletion to the three major credit bureaus. Under the Fair Credit Reporting Act (FCRA) Ms. [redacted] can contact the credit bureau directly and dispute any reporting in her file. RPM is not blocking Ms. [redacted]’s telephone number into our inbound call department.

I am in receipt of and have reviewed the above...
referenced complaint filed by Ms. [redacted] against Receivables Performance Management, LLC (RPM). RPM is a licensed third party collection agency operating in all fifty states and the District of Columbia. Ms. [redacted] is disputing this debt and requesting validation. She further states that she sent a letter of dispute to RPM on February 15, 2016 after receiving the dunning letter from RPM. Ms. [redacted] also alleges that RPM violated the Fair Debt Collection Practices Act (FDCPA) by not responding to that dispute letter; then reporting the debt to the credit bureau. After a review of our records I offer the following response on behalf of RPM:
RPM researched its business records and can’t find a letter of dispute being received in February, 2016. RPM’s first notice of a dispute was upon receipt of the complaint from your office. RPM immediately ceased collection activity, coded the account as a dispute and contacted our client for validation. When that validation is received, RPM will forward it to Ms. [redacted] for her review. Regarding the credit bureau reporting, RPM does not report anything to the credit bureau for this client. RPM disagrees with Ms. [redacted]’s allegation that RPM violated the FDCPA.

I am in receipt of and have reviewed Ms. [redacted] rejection of RPM’s initial response. Using the account numbers Ms. [redacted] provided in her rejection notice RPM was able to locate the account at issue. DIRECTV listed the account in the name of “[redacted] BAIL” hence entering only Ms. [redacted] name would not locate the account.
After review, RPM’s business records confirm that a payment in the amount of $115.00 posted to settle the account on July 23, 2016. RPM’s business records also indicate that a letter confirming the account settlement was emailed to Ms. [redacted] on August 5th and again on August 8th by a member of RPM’s Escalations Department.
After review of Ms. [redacted] interaction with our representatives, Ms. [redacted] confirmed the email address that the letter was sent to: [redacted]@hotmail.com.
Attached for Ms. [redacted] records is another copy of the August 8th settlement letter.

Receivables Performance Management, LLC (RPM). RPM is a licensed third party collection agency operating in all fifty states and the District of Columbia. Ms. [redacted] is alleging that RPM is continuing to attempt collections even though this account is closed. In addition RPM has never removed the negative credit rating from the three major credit bureaus. After a review of our records I offer the following response on behalf of RPM:
RPM received this account from our client T-Mobile USA on February 12, 2013. Time Warner Cable on March 25, 2013. RPM was unable to collect any monies and the account was recalled by our client on August 26, 2015. Two days later Ms. [redacted] called our office to dispute the debt. As part of our recall process, RPM sent a deletion notice to the three major credit bureaus on August 26, 2015 and on September 1, 2015. Ms. [redacted] last contacted RPM on August 6, 2016 stating RPM had just reported this debt to the credit bureaus. Since RPM has not represented our client in this matter for over 7 months, we don’t know the status. Ms. [redacted] can contact our client directly or check with the credit bureau to obtain a copy of her report and ascertain what is in her file.

I am rejecting this response because:
At no time did I request a refund of the fee that was charged. The fee was not disclosed to me prior to being charged. I contacted the company directly many times to attempt to resolve the matter. Most recently when I call and identify myself they hang up on me. That is why I made the complaint with the Revdex.com. My contention is that it was a fraudulent charge and the remaining balance should be waived due to their unscrupulous business practices.

Cincinnati B[redacted]., Ms. [redacted] states that RPM has reported a debt to her credit history despite not having a contract with her. She states that she has not been provided adequate proof of the debt and wants the matter removed from her credit history. After review of our records and contacting our client I offer the following response on behalf of RPM: Cincinnati B[redacted] placed Ms. [redacted]’ account in our office for collection in May 2015. RPM has no record of contact with Ms. [redacted] until receiving a letter from her that was deemed a frivolous dispute because there was not enough information to determine what exactly Ms. [redacted] was disputing or requesting. A letter explaining this was sent back to Ms. [redacted]. RPM is a data furnisher to the credit reporting agencies on behalf of Cincinnati B[redacted], so while Ms. [redacted] may not have a business relationship with RPM, she had one with our client. Upon receipt of this complaint, RPM contacted Cincinnati Bell who advised that their notes indicate the account was activated on 2/18/2014. On 5/13/2014 Ms. [redacted] called Cincinnati B[redacted] asking why her service was interrupted. She was advised at that it was shut off due to non-payment. Cincinnati B[redacted] provided the attached account statement as validation of the debt. It is Cincinnati Bell’s position that the balance is owed. In the meantime, RPM has requested removal of the account trade-line from Ms. [redacted]’ credit history. After review of the invoice provided by Cincinnati Bell, Ms. [redacted] is welcome to contact our office to make arrangements to resolve the obligation. I am rejecting this response because: I am able to provide all emails, records, and receipts from T-Mobile. The return confirmation number from T-Mobile was [redacted]. I can provide more information as needed by forwarding emails and receipts. I want this removed from my credit report, it shouldn't be there in the first place as I never started service with T-Mobile.

Performance Management, LLC (RPM). RPM is a licensed third party collection agency operating in all fifty states and the District of Columbia. Ms. [redacted] is complaining she paid her Time Warner Cable debt directly to the client with the promise that RPM would delete this negative report on her credit bureau file. She alleges that RPM removed the rating from one of the three major credit bureaus, but not the other two. After a review of our records I offer the following response on behalf of RPM:
RPM was advised, by our client Time Warner Cable, of a payment made directly to them on August 31, 2015. RPM subsequently notified the three major credit bureaus that this account was not Paid in Full (PIF). Ms. [redacted] has called RPM several times (September 22, September 28, and October 13, 2015) stating that she paid the debt based on Time Warner Cable’s promise to have the credit bureau report deleted. On December 30, 2015, Ms. [redacted] called RPM with a Time Warner Cable representative on the line and RPM was instructed to send a Paid in Full letter. That was done on January 7, 2016. RPM has not received any instructions from our client to change or remove the PIF rating, which is correct, from our credit bureau reporting.

that he signed no contract with RPM and is not liable for a debt due to DIRECTV. He requests the matter be removed from his credit history. After review of our records and contacting our client I offer the following response on behalf of RPM: DIRECTV placed Mr. [redacted]’s account in our office for collection on April 3, 2017. On April 5, 2017, RPM sent Mr. [redacted] a notice identifying the debt, creditor, and his rights under the Fair Debt Collection Practices Act (FDCPA). On May 25, 2017 RPM received a fax from Mr. [redacted] disputing the account, however there was not enough information in the correspondence to determine what was being disputed. RPM sent Mr. [redacted] a notice the following day requesting further details of his dispute. Upon receipt of this complaint the account was recalled by DIRECTV. RPM is no longer handling the matter. RPM has requested removal of the account trade-line as a result of the account recall. did not agree to pay a convenience fee associated with making payment over the phone. He requests that the convenience fee be refunded. After review of our file I offer following response on behalf of RPM:RPM is a third-party collection agency working on behalf of DIRECTV and other creditors. DIRECTV listed Mr. [redacted]’s account with RPM for collection on May 2, 2017. It appears that on August 7th Mr. [redacted] reached an agreement to settle the account and made his first payment. A second payment is scheduled to run on September 12th to complete the settlement.RPM is unable to determine if the convenience fee was disclosed to Mr. [redacted]. As a result we are refunding the convenience fee that was charged. RPM will send Mr. [redacted] a check in that amount. RPM will also cancel the second payment set for September 12th to avoid a second convenience fee from being added. RPM IS WILLING TO STILL HONOR THE SETTLEMENT AGREEMENT, HOWEVER MR. of Columbia. Mr. [redacted] states that he never received a validation notice from RPM and disputes a debt RPM attempted to collect on behalf of [redacted]. He requests RPM cease further attempts to contact him and remove the account from his credit history. After review of our file and contacting out client, I offer the following response on behalf of RPM. [redacted] placed Mr. [redacted]’s account with RPM for collection on November 5, 2017. On November 9, 2017, RPM sent Mr. [redacted] a notice identifying the debt, creditor, and his rights under the Fair Debt Collection Practices Act (FDCPA) to the address listed in the complaint. RPM did not receive a response to this notice and have no record of it being returned undeliverable. RPM’s first contact with Mr. [redacted] occurred January 24, 2018 where he offered to pay the debt in exchange for removal from his credit history. Upon receipt of the complaint, RPM contacted [redacted] who provided the following response and account statements: “[redacted] regrets any concerns that Mr. [redacted] has regarding the balance on his account. [redacted] records confirm that Mr. [redacted] activated service with [redacted] on December 27, 2015, and was subscribed to the Simple Choice rate plan for $80.00 plus applicable taxes for his mobile numbers ending in 1267 and 7595. [redacted] records confirm that the December 28, 2015, billing statement was provided and reflected a balance of $91.37. This balance included new charges for services from December 28, 2015, through January 27, 2016. As Mr. [redacted] did not remit payment the balance was forwarded to the following billing statement. Records confirm that Mr. [redacted] canceled his account on January 26, 2016, when he ported his mobile numbers to another service provider. Mr. [redacted]’s billing cycle ran from the 28th of one month to the 27th of the following month. Pursuant to [redacted] policy, customers may be billed through the end of their current billing cycle if they cancel their service mid-cycle. Accordingly, Mr. [redacted] was billed through January 27, 2016. Mr. [redacted]’s final billing statement dated January 28, 2016, was provided which reflected a balance of $91.53. This balance included the past due balance of $91.37 and new charges for taxes totaling $0.16. Please note that payment was not received for the balance due. Since the account remained unpaid, Mr. [redacted]’s account was referred to a third-party collection agency for the collection of the past due balance. As stated in our Terms and Conditions, accounts that are referred to a third-party collection agency may be charged a one-time collection fee. The amount of a collection fee is determined by the amount of the past due balance. Accordingly, a one-time collection fee in the amount of $22.88 was charged to Mr. [redacted]’s account, which left a revised final balance in the amount of $114.41. Based on the above findings, it is [redacted]’s position that the balance on Mr. [redacted]’s account is valid and owed. Between the dates of April 27, 2016, and November 7, 2017, Mr. [redacted]’s account was referred to several different third-party collection agencies, and currently resides with Receivables Performance Mgmt. who can be contacted at 1-866-367-1875. Mr. [redacted] was contacted on February 6, 2018, at which time [redacted] agreed to issue a credit to the account in the amount of $114.41, leaving a revised balance of zero. [redacted] has requested the removal of Mr. [redacted]’s account from third-party collections and instructed the collection agency to delete any negative information reported to the credit bureaus relating to this account. Please note that it may take up to 90 days for the credit report to be updated. Finally, [redacted] has notified Receivables Performance Mgmt. to cease and desist all collection efforts against Mr. [redacted].” RPM has requested removal of the account trade-line pursuant to [redacted]’s request and have closed our file. Time Warner Cable account number XXX13306 was listed with RPM for third party collection services on October 2, 2013. The account was recalled from our office on April 6, 2015 after a payment in the amount of $252.21 was made directly to Time Warner Cable on or about February 2, 2015. RPM updated the account trade-line accordingly to reflect the ‘paid in full’ status. In the event Time Warner Cable directs RPM to remove the account trade-line from Ms. [redacted]’s credit history we will certainly comply. However please be advised that RPM no longer has a business relationship with Time Warner Cable and thus are unable to contact them regarding this complaint. Absent direction from Time Warner Cable, RPM must adhere to our duty to furnish accurate information to the credit reporting agencies. RPM has advised DIRECTV that the account was previously settled. DIRECTV will likely recall the account from the current collection agency the account trade-line will be removed from Ms. [redacted]’s credit history.

the District of Columbia. Mr. [redacted] is requesting a debt owed to Sprint from 2011 be removed from his credit history. Additionally, he claims Sprint advised that they were unaware of the debt. After review of our records I offer the following response on behalf of RPM: Sprint placed Mr. [redacted]’ account in our office for collection in May 2011. RPM’s business records reflect that the account was satisfied by Mr. [redacted] in September 2011. The account trade-line was updated at that time to reflect that the account balance was paid in full. RPM is required under Federal law to report complete and accurate information to the credit reporting agencies. We are currently reporting the account as ‘paid in full’ which we believe to be the correct status. RPM advised Sprint of the complaint. Sprint responded with the following: “Sprint’s policy is to have our Outside Collection Agencies report any unpaid debt to the 3 major credit bureaus: If and when an account is paid in full, the bureau reporting will be changed to show the debt as a charge off that was paid in full. Sprint as a matter of policy does not remove the bureau reporting for paid debt as this would violate our agreement with the agencies and the credit bureaus. RPM is a licensed third party collection agency operating in all fifty states and the District of Columbia. Ms. [redacted] is disputing this debt and alleges that RPM is calling her 5 times a day, seven days a week. After a review of our records I offer the following response on behalf of RPM:
RPM received this file from our client DirecTV on May 16, 2016. RPM mailed the initial dunning letter on May 17, 2016, advising Ms. [redacted] of the creditor, amount owed and her rights under the Fair Debt Collection Practices Act (FDCPA) to the address of [redacted] Bartow, FL 33830. RPM’s client provided the telephone number (863) 445-0075 as a good number to reach Ms. [redacted]. Between June 1, 2016 and July 18, 2018, RPM made seven telephone attempts. Once notified of the complaint, RPM ceased collection attempts, coded the account as a dispute and contacted our client for validation. That validation has been received and attached with this response. If Ms. [redacted] wishes to contact RPM to discuss this debt further, she can call our escalations department at (888)838-5123.
