? Thank you for the additional correspondence sent to the Revdex.comI have reviewed your concerns and would like to provide the following information.? On January 10, 2010, you entered into a Retail Installment Contract and Security Agreement (“Contract”) with Rapid Motor, LLC
for the purchase of the Dodge DurangoGM Financial employees were not present at Rapid Motor, LLC (“Dealer”) during the signing of the contract and GM Financial was not an original contracting party in any agreements between the two partiesThe contract was subsequently assigned to GM Financial.? You promised to pay the amount financed of $18,and a finance charge of $15,which resulted in a total of payments of $33,527.52, if all payments are made on the contracted date they are dueIt is important to understand that this Contract is a “simple interest” contract, meaning that interest is accrued daily on the unpaid portion of the amount financed, as indicated on page one of your Contract under “Promise to Pay and Payment Terms”By signing the contract, you agreed to abide by these terms, including paying the principal amount plus finance charges accruing on the unpaid balance at the rate of 22.50% in installments of $? A review of your account activity and payment history reflects that additional interest accrued over the life of the loan due to payments being made after the scheduled due date, two due date changes, and deferments that were processed at your requestThroughout the time your account has been active; deferments were processed for the months of June and July of 2010, September and October of 2010, December of 2012, and January of Because of the due date changes and deferments processed at your request, the maturity date of the account moved to August 15, On page two of your Contract under “General Terms”, it is also explained that the actual amount you will pay may be more or less depending on your payment record.? The deferment agreements were e-mailed to *** on October 27, 2010, December 31, 2010, and December 3, Our records reflect that the agreements were signed electronically on the following dates with the following acknowledgement numbers:October 27, with an? acknowledgement number of 800152? January 5, with? an acknowledgement number of 518068December 4, with an acknowledgement number of 279426? Within this agreement you were advised that interest will continue to accrue during the month(s) deferred on the unpaid balance of the contract at the rate specified in the contract and any deferment fee collected may not be sufficient to pay this accrued interest, and that this would result in a final higher payment due at the end of your contract on the new maturity date.? On August 15, 2015, one year prior to the maturity date of your contract, the Simple Interest Maturity Notice was mailed to all parties to the Contract at their last known addressThis notice advised you of the balance of your account as of the date of the notice and that based on your payment amount and the balance of your account, it was anticipated that your final payment due at maturity will be more than your regular monthly payment amountInterest accrual was again explained within this notice.? GM Financial is unable to honor your request to refund an amount of $3,or release the title to the vehicleFinance Charges are being assessed as per your Contract and within the maximum amounts permitted for this sale by state or federal law.? I understand I am to pay my monthly payment - I have never missed a payment or had NSF fees but when I attempted to change my financial information on your website it charged my old financial institution and my current.? I want the $in fees back.? The point of autopay is to set it and forget it - so for months I have been paying and now my bill is down to and on statements there was errors on my excise tax.? On January 2, 2018, GM Financial received an application for credit submitted at *** *** You have indicated that you are disputing the inquiry as unauthorized; and as a result, GM Financial has requested that the appropriate credit reporting agencies remove the GM Financial inquiry from your credit report In the event that the credit bureau reporting agencies are unable to delete the inquiry, we have asked that at a minimum they convert the hard inquiry to a soft inquiry Please be advised that it can take the credit reporting agencies four to six weeks to update your credit report

I am rejecting this response because:? ? ? This "resolution" was organized by me after my 10th phone call to GM FinancialA very nice young lady FINALLY assisted me with getting the check reissued after a phone call on March 7th.? While I ultimately got the return of the money I asked for this "solution" only addresses a small portion of my complaint.? What was not addressed is the fact that I had to wait full days after this company received an excess in pay to get my money returned to me.? In addition, the most important factor, is how many times I had to call in and how many HOURS I spent on the phone just to get a resolution.? The people who talked to me or claimed would send an email because there was "nothing that could be done" will continue to be able to treat other customers this way.? In addition, even AFTER a complaint to the Revdex.com nothing was done to assist my problem other than "looking into my account".? The first check was supposed to be mailed to me at the beginning of February and I'm receiving it March 12th.? This company and it's representatives should be ashamed of themselves to treat customers this wayI will NEVER do business with this company again and will continue to write public reviews warning others to do the same.? I have nothing more to say here in regards to this matter.?

I am rejecting this response because the point still remains that I requested arbitration and was waiting on a date$was still unethical and the repossession was still a power move on GM Financial part? Forcing me to pay without the right to arbitrationAnd for them to still be able to cause unfair credit reporting should be against the lawAt the end of the contract they received more than fair value and I received the titleI am requesting that they be removed.?
