The Member's first request to cancel was sent 9/via mailAll cancellations require a day notice to cancel, making the 9/charges due to cancelThe Member spoke to corporate office representative regarding the cancellation and was informed she must pay $to process cancellation (There were all charges within the last days) Member never came in to make payment, which is why she is receiving calls regarding the past due balance

Hello,We show only [redacted] called the club on 7/30 andrequested to cancel. At that time, our staff informed her of the cancellation policy and the 30 daynotice. The Member refused to pay the last month’s dues as stated in the cancellationpolicy. If the member submits a certified letter by 8/31... to have her membership cancelled,we will waive the 30 day notice. Or, make an appointment prior to 8/31with the manager, M-F 9a-6p, to cancel in person.

Hello,The collections agency has already been contacted to remove the balance by Fitness Evolution as of 2weeks ago.Since this was a paid in full membership, and cancellation was not requested within days, the member will not receive a refundThe collection issue, however, has been taken care of

[To assist us in bringing this matter to a close, you must give us a reason why you are rejecting the responseIf no reason is received your complaint will be closed as Answered] Complaint: [redacted] I am rejecting this response because:Nobody is disputing the fact that there is a buyout fee nor has that ever been an issueThe issue is that Fitness Evolution says one thing and then does another and that's a proven fact with my scenario and countless others as I've read countless other similar complaintsFurthermore, we were told verbally via phone conversation at approximately 11:on 6/14/17, by manager Wes, that there are no refunds for any unused portionYes, the $is a benefit from my employer.Wes changed his tone after this complaint was filed and presumably after Fitness Evolutiom received itAs stated above, he stated that no refund would be provided in June when attempting to resolve this matter without the support of the Revdex.com and at the time of the cancellation and buyoutThen, on 7/11/17, there was no question when we presented Wes and Fitness Evolution regarding the request of refundIt was only at the point of filing this complaint with the Revdex.com that the representative and manager of this business decided and even thought to cooperate in-regards to the request of a refundIt makes me wonder how many customers has this business kept money they weren't entitled to.Furthermore, when looking at your itemization of payments/fees, there is a $returned item fee that I see Fitness Evolution has deducted from available credit which further reduced the balanceThis is inaccurate, as once again, Fitness Evolution attempted to inaccurately charge my credit card when there was still a positive balance on my account with Fitness EvolutionTo fully resolve this, the amount refunded to my employer will need to be $as the additional $fee is a result of their negligence to ensure their systems are properly billing and deducting charges from the appropriate accounts for each and every customer's membershipI'm not quite sure why there is a handwritten not on the itemization for disputing it with the credit card companyThat $charge isn't a charge that shows on my personal accountThat is a fee that Fitness Evolution isn't entitled to as they continue to incorrectly bill, even after brining this issue to their attention on June 14, If this can't be resolved through the platform of the Better Business Burea complaint, the Maryland Attorney General's Office - Consumer Protection division will be the next step in ensuring Fitness Evolution is operating in an ethical manner and not allowing themselves to profit and benefit from their own negligence Regards, [redacted]

I am rejecting this response because: I have not gotten paid yet, I am owed for six months

We do not offer day trials to members The membership agreement that was signed was for a month to month membership The only termination request we have for you is in February There will not be a refund issued

I am rejecting this response because: Hello,Thanks for your prompt reply, please check your Camera Recordings at the GYM I stop by every months and asked for freezing my accountI even talked to the representative at the Front Desk about the charge she said that they had a glitch on their system as some other people also complained the same.Please check your Video recording for Proof

The collection agency has been notified about the payment made in club to settle the account We have reviewed your concerns and addressed them with club management

Regarding the recent response, if the member is able to provide proof of medical leave, we will be able to remove the balance from collectionsIf not, the balance is valid, as there were attempts to contact her regarding the balance on her account prior to it being sent to collections.Thank you

The member was notified by the club and warned verbally, more than once, that the motion cage is for personal training use onlyThere are plaques by the motion cage and it is roped off with a sign that says "for PT use only"The staff felt that the member was discourteous regarding the matterThe membership contract states that the Club may cancel Members membership at any time for breach of the club's rules

We do not show we ever received a request to freeze the accounts so the accounts remained active There will not be a refund issued What I'm able to do is terminate the memberships moving forward Please note if the payment is returned for any reason included but not limited to charge backs, insufficient funds, etcthe account will be referred to collections

At this time the members is only paying for a basic membershipThe club does have group ex classes, tanning and hydro massage availableThe member can cancel her membership, if she would likeWe do not show that she has ever made an attempt to do so
