Thank you for bringing this matter to our attention. We appreciate the opportunity to re-address our customer’s concerns.
On April 3, 2010, our customer entered into a Retail Installment Contract when she purchased a 2006 Jeep Commander. Attached, you will find the Retail Installment Contract for your review.
The champ program allows for current customers, with a balance of $4,500.00 or below, to exchange their DriveTime vehicle in for another. The new vehicle requires a new contract and financing.
On May 10, 2014, our customer entered into the new Retail Installment Contract, via the DT Champ Program, when she purchased a 2010 Chrysler 300. Attached, you will find the Retail Installment Contract for your review. Our customer received $4,216.00 credit for the Jeep Commander, applied towards the new loan for the Chrysler 300.
DriveTime agreed to process a two (2) payment deferment, with the exclusion our customer makes one (1) payment, to bring the account current. Additionally as a goodwill gesture, we have agreed to extend our customer the opportunity to return her vehicle in exchange for a comparable vehicle. The original trade-in value of $4,216.00 would be applied towards the new vehicle. The payments would be retained for usage.
On November 11, 2014, we contacted our customer and offered the resolution stated above. To complete the exchange, we require our customer to fill out a new loan application. During the conversation, our customer inquired about parting ways with DriveTime. We advised our customer, while that is an option, she would not be eligible for any refund.
The Jeep Commander was sold for $4,667.00. A total of $4,063.63 was applied to the account to pay off the remainder of the loan for the Jeep Commander. As a part of the DT Champ program, a trade in amount is generated to allow the customer to transfer into the Chrysler 300 with zero down payment. In this instance, we applied a trade in value of $4,216.00 towards the Chrysler 300.
At this time, DriveTime is willing to offer the following resolution:
DriveTime agrees to:
Waive deficiency balance of $19.684.60
Delete trade line from all three (3) major Credit Bureau reporting agencies
Refund to Customer $600.00
Submit an update to all three (3) major Credit Bureau reporting agencies to report DriveTime trade line as Paid in Full for the Jeep Commander.
In exchange, Customers agrees to:
Release possession of vehicle to DriveTime
Our customer will be required to sign a Full Settlement and Release of Claims if they choose to take advantage of this offer. This settlement offer is good until December 5, 2014.

appreciate the opportunity to address our customer’s concerns. On February 9, 2010, before purchasing a vehicle with DriveTime, our customer filed for Chapter 7 bankruptcy. This bankruptcy was discharged on May 12, 2010. On July 1, 2013, our customer entered into a Simple Interest Retail Installment Contract with DriveTime when he purchased a [redacted]. Attached you will find the Simple Interest Retail Installment Contract for your reference. In October 2014, DriveTime temporarily ceased credit reporting to all three major credit bureau agencies. This cease was due to required system enhancements taking place in the manner DriveTime reports to the credit bureaus. We have completed the necessary updates with the three major credit bureaus, and they have uploaded our customers’ account information for public viewing. We understand the importance of building and maintaining a credit score. We also understand the importance of accurately reporting credit activity, and that is why DriveTime has made the effort to complete these system enhancements. After a recent extensive review, we determined that there were serious questions about our ability to report bankruptcy accounts accurately. As a result, we were temporarily unable to report accounts with previously filed bankruptcies, in order to ensure no inaccurate reporting occurred. This change was also required to ensure DriveTime was in compliance with the Fair Credit Reporting Act. At this time, DriveTime has found a resolution to report accurately for accounts that have had a previously discharged bankruptcy. This update should reflect on our customer’s credit reporting within 30-60 days. We will be reinstating these trade lines with [redacted], [redacted], and [redacted].On September 1, 2015, we contacted our customer and came to an amicable resolution. We discussed the above information and advised him to contact us at ###-###-#### with any further questions or concerns. I have been speaking with Jeremy in customer relations, well up til he made this reply on this case then dropped me like a bag of hot potatoes like the rest of this company has done to me. He called me and made me the offer to refund the license fee but didn't want to mail me the check saying he thought it would get lost in the mail. Then said he would call me the next day to apply it to my next payment that is automatically drafted which he did not. He also told me he had to find the title and where it was so he could see if he could stop the process in [redacted]a so we could submit it to [redacted] for [redacted] plates. I guess they still have not found the title cause he said he would call me to let me know that status as well. I am beyond upset at how this company is treating me and handling this. Had they done the title and registration when I bought the car (almost 4 months now) I would not be having this issue. I want my title found NOW and I want the refund I was promised or I will be seeking out an attorney very soon.

Vehicle Lease Contract for your reference. At the time of lease, our customer agreed to make 64 bi-weekly payments of $206.55, beginning February 20, 2015. Additionally, our customer agreed to make four side note bi-weekly payments of $100, beginning February 20, 2015. On March 18, 2015, a payment amount of $100 was reversed due to insufficient funds. On March 26, 2015, we informed our customer of the reversed payment of $100 on his account and stated that there is a zero day grace period with our lease accounts. Our customer informed us he would make the $100 payment on March 27, 2015. On April 1, 2015, the vehicle was recovered for default. Please refer to page 3 of the Cancel Anytime Lease, section 11 Default, Repossession, and Other Remedies. "You fail to pay any periodic payment when due or any other amount you owe under this Lease when we ask you for it… Take (repossess) the Vehicle wherever we find it and enter any property where the Vehicle may be to do so…" Later that day, our customer faxed in running bank statements as he states there was $100 available in his bank account. We informed our customer the insufficient funds reversal was correct and he would need to speak with his financial institution if there is further disputes. We informed our customer he will need to pay the past due amount of $100.55 and the repossession fee of $300 directly to DriveTime within 48 hours if he would like to redeem his vehicle. We also informed our customer an additional amount of $125 would be owed directly to the repossession agent.We have made several unsuccessful attempts to contact our customer to discuss his concerns. On April 14, 2015, we sent a letter via certified mail to our customer’s address on file. The purpose of this letter is to inform our customer of our attempts to reach out to him. We encourage our customer to contact our Customer Relations department at ###-###-####, to discuss his concerns. At this time, we are unable to accommodate our customer’s request. DriveTime would be willing to waive the past due amount of $100.55 if our customer pays the repossession fee of $300 and the additional payment that has come due of $307.10. Our customer has until Monday, April 20, 2015 to redeem his vehicle. As a goodwill gesture, DriveTime has sent our customer a $25 American Express gift card. We absolutely do not accept the response from Drivetime. Mainly due to the inaccuracies stated by the business. The dates are completely wrong and they have only started contacting us as of YESTERDAY April 13th 2015. Any correspondence that has taken place besides the response to our Revdex.com complaint, has been one sided and made by us. The $100.55 payment in question was derived from the March 6th auto scheduled payment.....WE called about it the following week when we received NSF fees on our account. And they had no problem accepting our 3rd payment totaling $305.55 on March 20th 2015. The dates that have been given by the company are inconsistent with my pay dates, which is something that was told to the company when we received the vehicle. Why would you accept further payments from someone who owes from the last payment and not apply it to the outstanding balance?? Also, now they are willing to drop the $100.55 balance when that's ALL we asked for to begin with!!! It took going to this level for them to be reasonable? So that tells me they could truly careless about their customers or their business.....they care more about a bad rating from the Revdex.com, which is sad and disappointing. We have since had to get another vehicle from a different company and incur another Down Payment. In the time we dealt with Drivetime from January 31st to our last payment on March 20th, we have spent a total of over $1800.....in less than a 60 day period!!! Lease or not, that is absurd!! How is this legal, seriously? And all over $100.55!!!!!

On September 27, 2014, our customer entered into a Simple Interest Retail Installment Contract with DriveTime when he purchased a 2006 Jeep Commander. Our customer also opted to purchase a 5 year/50,000 mile Vehicle Service Contract, administered by [redacted]. Attached you will find the Simple Interest Retail Installment Contract and Vehicle Service Contract for your reference.
On October 6, 2014, our customer contacted [redacted] and expressed multiple mechanical concerns with the vehicle. [redacted] advised him to take the vehicle into our in-network repair facility for diagnostic.
That same day, our in-network repair facility filed a claim for a throttle body clean and a fuel system diagnostic. [redacted] advised them that the repairs were covered.
On October 8, 2014, our customer contacted [redacted] and stated that the check engine light and other warning lights had come on in the vehicle. [redacted] advised him to take the vehicle back to our in-network repair facility for diagnostic. No new claims were filed in regards to our customer’s concerns. �...⇄ /> On April 27, 2015, our customer contacted DriveTime and stated that the traction control light is on and the vehicle had shut off while driving. We advised him to take the vehicle into a repair facility for diagnostic.
On May 5, 2015, our customer contacted [redacted] and stated that the vehicle was not starting. [redacted] also advised him to take the vehicle into our in-network repair facility for diagnostic.
On May 7, 2015, a repair facility filed a claim with [redacted] for the repair of starter motor and an electrical diagnostic. The repairs were covered under the terms of the Vehicle Service Contract.

All DriveTime vehicles go through a multipoint inspection process prior to sale. Any failings on the vehicle are addressed, and corrected during this inspection process. Discoloration of the rear bummer is not considered a failing.
We disclose all information we have on the vehicle history by providing the [redacted] Vehicle History Report. We require our customers to sign this report as acknowledgement of the information contained therein.
As previously communicated to our customer, the What You Need to Know about financing a vehicle with DriveTime document disclaims,
"You have received and reviewed your title history report. The [redacted] report is created by a private company not affiliated with DriveTime. [redacted] gets information from government and private businesses. We give this report to you as a courtesy. Use or damage information about the vehicle not listed on the report given to you may appear on reports created by other private businesses (for example, [redacted]) or on an [redacted] report obtained after you purchased the vehicle. You should research the vehicle thoroughly before purchasing and fill out the [redacted] Buyback Protection Registration Form after purchasing."
We also require our customers to sign this document as acknowledgement they have reviewed and understand the information provided.
At this time, we are still unable to accommodate our customer’s request to pay for repairs to his vehicle from a previously undisclosed accident. Our offer remains to provide payment deferments due to out of pocket expenses as a means of assisting our customer. We encourage our customer contact us at [redacted] to complete our offer.

I am rejecting Mr. [redacted]response due to the fax he did acknowledge Drive Time is no longer interested in the lien and it was sold to several different collection agencies Mr. [redacted] onlybknows of one. I have spoken to the current collection agency that has my account but not the title. Mr [redacted] stated its nothing they can do because they are not longer the lien holder, I stated to Mr. [redacted] even though Drive Time Corporate is no longer the lien hold on the vehicle according to DMV records and the title to which is in reference, Drive Time still remains by law the lien holder. All I am asking is that Drive Time remove their name off as the lien holder, I have given my insurance the bill of sale, and the power of attorney on the car.

We advised her a claim for repairs is needed in order to review for assistance. We also advised our customer returning the vehicle without negative impact is not an option. Our customer informed us the airbag light comes on regularly and shuts the radio off. She also stated the rubber around the windshield is peeling but doesn’t leak. Our customer agreed to send in her receipts for what she paid out of pocket for repairs. We advised our customer we would review her receipts along with new issues for possible assistance.On September 18, 2014, we contacted our customer to go over the receipts she sent in, the mileage on the vehicle and the options available for assistance. Our customer’s current mileage is 57,697 miles. Given the current mileage our customer’s limited warranty has expired. We extended an offer to assist with the repairs needed to get the airbag light turned off.On September 22, 2014, our customer contacted us stating she took her vehicle into a repair facility, and new repairs are needed. The total cost of repairs are $4,680.79. After carefully reviewing her account DriveTime agreed to assist with fifty percent of the total cost ($2,340.39). In addition, DriveTime agrees to cover the part needed to repair the airbag light.At this time, our customer is reviewing the offer. Our customer has agreed to give us a call by the end of next week to let us know how she would like to proceed. We appreciate the opportunity to re-address our customer’s concerns At the time of purchase, our customer agreed to make 145 bi-weekly payments of $203.82 and 1 final payment of $203.51, beginning July 12, 2014. Since our customer makes payments on a bi-weekly frequency there are two months that our customer will make three payments. On July 23, 2014, our customer contacted DriveTime and informed us she would like to process a due date change on her account. Due date changes can only be processed one time for the life of the loan. On July 28, 2014, our customer contacted DriveTime and inquired about her due date change. We informed our customer the due date change was in process. Our customer informed us she would make her next payment on August 2, 2014. On August 2, 2014, the due date change was processed on our customer’s account. Because of this due date change, during the month of August our customer was responsible for three bi-weekly payments for a total of $611.46 due. Throughout August of 2014, our customer paid $507.64 toward her account. Between the months of August 2014 and December 2014, our customer accrued a delinquent amount of $179.74 and a $5.00 late fee on her account. For the month of January 2015, our customer was responsible for three bi-weekly payments for a total amount of $611.46. Our customer paid a total of $407.64 towards her account this month. At this time, our customer’s account has accrued a delinquent balance of $531.66 at 33 days past due. This balance includes the two $5.00 late fees that were assessed. Our customer is responsible for payment of the past due balance owed on the account. In order to avoid negative impacts on her credit, we encourage our customer to resolve the past due balance. At this time, DriveTime is offering our customer a three (3) payment deferment on her account, to assist with her past due balance. Thank you for bringing this matter to our attention. We appreciate the opportunity to address our customer’s concerns.
All DriveTime vehicles are thoroughly inspected prior to sale at our DriveTime inspection centers. Parts that fail inspection are replaced. However, if a part is functioning at the time of inspection, there is no need to replace it.
Regarding recalls, at the time of sale DriveTime provides our customers with a printed copy of a recall report from the federal government website www.safercar.gov. Our customer signed an Acknowledgement which states:
“I/we know that DriveTime did not create this report and there may be mistakes or missing information. DriveTime said we should contact a new auto dealer to ask them if there are any safety recalls related to the vehicle. After looking at the recall report and having time to ask questions, I/we chose to sign the purchase or lease agreement and I/we understand that I/we do not have any claims against DriveTime related to any safety recalls.”
The recall report provided to our customer listed an open recall on the steering torque sensor. Attached you will find the Recall Report and the Safercar.gov Recall Report Acknowledgement for your review.
On November 27, 2015, our customer entered into a Conditional Sale Contract and Security Agreement with DriveTime when she purchased a 2008 Ford Escape. Our customer purchased a 5 year/50,000 mile Vehicle Service Contract, administered by Aeverex. On April 1, 2014, we contacted our customer and advised her we have identified the issue with the credit reporting. We offered our customer the option to be released from the contract. She declined our offer. We advised her if she continued to stay in the contract, we would backdate the credit reporting to time of sale. Unfortunately, we cannot provide a timeframe of resolution for this issue. We advised our customer we could provide her with a Credit Rating letter, stating her credit status with DriveTime. The letter is attached for your review. DriveTime reports to all three major credit bureau agencies on a monthly basis. The credit bureau agencies are separate organizations. Therefore, we are unable to guarantee the credit bureaus will update our customer’s account status each month. According to our records, DriveTime is reporting accurately. The insurance loss process took a total of two (2) months. During that timeframe, our customer did not make payments because the vehicle was being processed as a total loss. Due to non-payment during this time, two (2) late payment marks were reported to the credit reporting agencies.
On June 13, 2014, we came to an amicable resolution with our customer. As a goodwill gesture, we are removing the two (2) hits to her credit for late payments during the insurance loss process.
As a goodwill gesture, DriveTime has mailed a $25.00 American Express gift card to our customer.

Retail Installment Contract for your reference.On December 10, 2014, we acquired the tracking information for the title documents submitted by the dealership. It was confirmed the documents were delivered to the Maryland DMV on November 24 at 8:34am. We also had our title department reach out to the Maryland DMV for a status update on the titling for our customer’s vehicle. They gave our titling department a 72-hour turnaround time to provide us with more information.On December 11, 2014, we reached out to our customer to address her titling concerns. We advised our customer that we are working with the Maryland DMV for an update. The customer asked if we could process her registration at the Missouri DMV for that is where she currently resides.On December 17, 2014, the Maryland DMV advised they mailed the title documents back to the dealership in Mechanicsville, Virginia. Thank you for bringing this matter to our attention. We appreciate the opportunity to address our customer’s concerns.
On May 12, 2016, our customer entered into a Simple Interest Retail Installment Contract with DriveTime when he purchased a 2014 Dodge Avenger. Attached you will find a copy of the Contract for your review. The Contract was subsequently assigned to DT Acceptance Corporation, now known as Bridgecrest Acceptance Corporation.
During the contracting process on May 12, 2016, DriveTime required a proof of income from our customer to ensure income was sufficient to maintain loan payments. Our customer provided us with a Proof of Income letter from his employer showing a hire date of April 20, 2016.
Under the terms of the Retail Installment Contract, we notify the customer that we may perform after sale verification of the information provided to us by the customer. On June 22, 2016, DriveTime contacted our customer’s employer as part of the verification process. The employer stated that our customer is not employed with them and has never been employed with their company. Additionally, they informed us that the manager who signed our customer’s Proof of Income letter is no longer employed with them.
On or around June 23, 2016, DriveTime spoke with our customer to inform him of the after sale verification concerns. DriveTime instructed our customer to provide Proof of Income from the employer, such as a paycheck stub. DriveTime made clear to our customer that if he was unable to provide this documentation, then we would need the vehicle returned to the dealership. Our customer stated that he would not provide any additional documentation and also would not return the vehicle.
On July 21, 2016, DriveTime recovered the vehicle.

Being lies to repeatedly by drivetime in mechanicsville ,va. It's now been 13 days since customer relations said they would have an answer and have my plates to me. I want the last 3 months of my payments which equals $1461.00 credit to my account. I am a mitary spouse and cannot get on base thus asking a friend for theist 4 months this has been a huge inconvenience. We have completed the necessary updates with Experian and Equifax, and they have uploaded our customers’ account information for public viewing. We anticipate the enhancements with TransUnion to be completed within 30-60 days.We understand the importance of building and maintaining a credit score. We also understand the importance of accurately reporting credit activity and that is why DriveTime has made the effort to complete these system enhancements.After a recent extensive review, we determined that there were serious questions about the ability to report bankruptcy accounts accurately. As a result, we were temporarily unable to report accounts with previously filed bankruptcies, in order to ensure no inaccurate reporting occurred. This change was also required to ensure DriveTime was in compliance with the Fair Credit Reporting Act.At this time, DriveTime has found a resolution to report accurately for accounts that have had a previously dismissed or discharged bankruptcy. We have submitted for reinstatement our customer’s trade line and this update should reflect on our customer’s credit reporting within 30-60 days.On July 9, 2015, DriveTime’s Customer Relations Department reached out to our customer to advise him of the abovementioned information. Our customer stated the cease in reporting resulted in a higher interest rate on a vehicle he recentlypurchased. In regards to the inconvenience, our customer requested DriveTime to accept return of his vehicle and forgive the remaining balance of loan. We advised our customer that we were resolving the credit reporting concern and waiving his deficiency balance would not be an option if he chose to return his vehicle.On July 10, 2015, we submitted for reinstatement of our customer’s trade line. This update should reflect on our customer’s credit reporting within 30-60 days. At this time, we are unable to accommodate our customer’s request for DriveTime to waive the remaining principal balance of $15,198.87 if the vehicle is returned.We apologize for any confusion or inconvenience this matter may have caused.
