I have a letter from an attorney stating that the fence was put up illegallyHe reviewed our plot and the covenants and restrictions that were in place during the time of purchase and you are incorrectThe fence is illegal and you should take it downI have tried to discuss this with your company and provide you the letter from the attorney but I continue to get ignored and brushed offIf you don't take the fence down off of my property then you should at least reimburse me for the fence that I paid over dollars to put up while being told that you were going to build a bridge instead of a fenceNo - the school board and the State of Alabama did not deny the fenceOur community is attending the school board meeting the month to get the approvalDR Horton continues to blame the school board and the state when neither have denied anything

The warranty representative has met with the homeowner and a service repair date is scheduled for February 17th

I have reviewed the response made by the business in reference to complaint ID *** and have determined that this does not resolve my dispute.Dented and damaged garage door panels not repaired as sub contractor was no show multiple times and now, after months, still continues to not have replacement panels, two required.Landscaped areas now have all plants dead, and flooding continues over top of front patio, now damaging structure of house.Rear patio concrete has multiple cracks and covered with rusty nail stains as the builder never removed debris from build site and inside home.Driveway drain tube area has multiple large cracks and chunks of concrete falling off driveway.I work from home, no travel last two months, and comments from builder continue to be untruthful All new home buyers need to avoid Emerald or DR Horton built homes, very poor build quality and very untruthful, as observed in their response I have attached several pictures.

I am rejecting this response because:First, I would have expected a phone call from *** This house is a a brand new house. One of the major issues identified at least days before moving in was to fix both of the guest shower/bath combos. During inspection, the home inspector pointed out that the bath/shower units were not installed properly and could result in water damage. I confirmed this with the manufacturer through phone conversations and pictures. *** ** had the plumbers come to the house to take a look. They claimed that that is the and typical way that these units are installed. According to the manufacturer, the gaps in the wall sections were 2-times larger than what their warranty and install spec allowed. *** called the plumber back and he adjusted the section, but still they were too far apart. There was lots of back and forth between ***, the plumber and the manufacturer. I was told it would all be fixed within the first week of moving in. 3- 3 1/months later, the manufacturer sent reps, the plumber and plumber supervisor, and *** met at the house. The manufacturer confirmed that it was an improper install. The wall came down, it was put together properly, then drywall and paint. This was way out of hand and I felt that DR Horton should have fixed my new home instead of arguing with the plumber over who was going to pay for the fix. Other issues that I have had include, hardwood floor issues, that resulted in a repair where the worked ruined the carpet downstairs which had to be replaced.The insulation for the A/C lines was not done properly. The work was scheduled. The drywall people came to take the a wall down in a bedroom downstairs and upstairs. These guys did not have a clue how to fix this and what to do, nor did they have the right materials. Between *** and myself, we fixed it according to the suggestions from the A/C guy.Then I had a roof leak in the Garage. The siding guy found were it was leaking. And the roofer and siding guy were to be there at the same time. There was a miscommunication and this could not happen. The siding guy told me how the roofer should fix it properly, but the siding guy would not be able to come back to put the siding on, but said the roofer should know how to do it. The roofer came, and was not going to take the time to fix the roof according to the way the siding guy said it should be fixed, and he was overlapping the flashing in the wrong direction. *** came and set the roofer straight. He was upset that *** nor I would accept the fix he was going to make. It was hot. He finally fixed everything the right way, but could not figure out how to put the siding back. I had to put it back for him.So back to this current fix1/weeks after moving in, our master shower started to leak. Since we did not have the other bathrooms fixed yetit would be another weeks before they were fixed, we had to result in taking a bath in the master bath tub. That was the only way at the time to get clean. Ridiculous! I fought and fought to try to get this taken care of. When the work was done on the other bathrooms, I was told that the shower would be scheduled in a couple weeks. About every week I checked with *** about it. and finally a couple months after they fixed the other bathrooms, when *** told me the hold up was figuring out who was going to pay for it, I opened a case on Revdex.com. Someone called to schedule the work a couple days later. I should not have come to that. Then when the work started I was told it would be completed during that week. Delays and more delays and we are into week 2, and looking to complete everything at the start of week I do believe that once finished the shower will be in proper working order. The drywall people are here now, and cannot communicate with me at all. *** told them what to do, and they did not do it. I had to show them how to do what was requested, and I called *** upset because these guys cannot communicate and they are not doing things properly I have not felt like I have a "complete" house stillabout living here more than months. And the fact that it has taken so long for DR Horton to fix some things that were known months before hand is unacceptable to me. The contract I signed saying DR Horton would repair items in a timely manner is not happening. For all of these reasons this is why I am requesting a warranty to be extended 5-months..from the time it should expire and the time it has taken DR Horton to fix these issues while leaving their customer and family without a full working house!This is unacceptable for customer service. Do you realize the amount of time I have had to take off of working to support all of this and all of the frustrations and inconvenience behind not having a complete "new" house. All of my issues are fully documented with pics, texts, etc. When I tell someone the experience that we have had they cannot believe this is a new house and that the builder is treating us in this way.I have requested contact info from *** for ***, still waiting to receive it.*** ***

In reference to the above complaint, there have been modifications made to the rear yard of this home after closing, which are causing the drainage issues. These modifications were not made by DR Horton. I have searched our records and do not find any requests for service for the
caulking, sheetrock or any other items on the home. Should the homeowner be able to provide any documentation showing the timely requests for the mentioned repairs, we will be glad to schedule an assessment by one of our team members At this time, any remaining warranty is through RWC and we refer the homeowner to that warranty Thank you, *** ***

Claiming a rider mower from a lawn service "caused damage" to the swales on the sides of the house and is responsible for drainage issues is a disgenious response, as this is a standard response issued by DR Horton against multiple homeowners in this developmentMore important, my back yard -- WHICH WAS NOT ADDRESSED AT ALL -- also showed unacceptable significant pooling of water which was due to poor grading (which has nothing to do with rider mowers.) Twice DR Horton had surveyors come out to mark my property with orange paint, and twice no further action was ever undertakenI have kept correspondence from *** *** which acknowledges such a problem, and he promises that I just need to be patient, but "I am on the list" to have it rectifiedHis last statement to me was in this month, May -- of 2015! Please show me how I can forward these emails to youFinally, I filed through DR Horton Home Warranty Protocol my concerns about poor property drainage within the first year of my residenceDue to problems with their grading contractor, they responded, theough *** *** that this was going "to takeWhile to fix." Please see our responses below to *** ***, the customer who filed complaint # *** He reached out to one of our onsite representatives the day before he filed the complaint and was sent an email promptly by our closing coordinator explaining that the delay was the result of
a personnel change in our office, apologizing and reassuring him that his refund was already being processed and would be mailed asap I followed up with him once we received the complaint to make sure he received the message from our closing coordinator the day before regarding the return of his check and apologizing again for the error. His refund was already being processed prior to his complaint, but in order to expedite the solution the check was fed-ex’ed to him and should have arrived at his home today

I am rejecting the business response because the business has not reach to me to let me know when and how they are planning on resolving the landscaping/sidewalk issueThe business mentioned that they are hoping to have the issue resolved by March 1, but I haven't heard anything backI understand there has been unpredictable weather but as a courtesy I should be informed as to what their intentions are in order to resolve the issue
On February I send an email to Mrs*** *** letting her know that since I haven't heard anything back in regards to the issueI had a professional company take a look at the work that was performed & also to have them provide me with their professional opinion
I choose that company because they are subject experts in the matter, have great ratings and they guarantee their work
After their review, I was informed that the workers who performed the work did a terrible job causing as mentioned previously (February 2016) more problemsThey mentioned that the workers who performed the job were inexpert as they made several mistakes to include routing the cutter line in the wrong direction causing flooding in areas that didn’t have that issue, they inserted just one small 4” cutch pan which is not big enough to keep the area dry, they did not re-grade the swell, among other issues
The company provided me with a proposal estimate which I had provided to D.RHorton on FebruaryI was told by the company that they had giving me a discount since they had worked with D.RHorton on other jobsThey also said that D.RHorton can contact them at any time if they have questions or concernsI have attached a copy of the Proposal Estimate provided to D.RHorton along with more photos of the issue

As per the attached, The *** have already obtained legal consul pertaining to the same issue Some background on this is that I had previously meet with these homeowners over the same issue in October 2013. As per my inspection at that time, the floor tile was installed within
industry standards for flooring guidelines as applicable for Of recent, apparently they had visited our new home community across the street from their residence and obtained information that the procedures for tile floor applications have evolved since and of course now have a perception that theirs was installed incorrectly. Regards, the response from *** is not accurate as *** has been my point of contact and has been contacted several times via telephone and EmailsI did not remove the carpet, the carpet in the living room was previously removed by the framers on a previous attempt to fix the soft spots which as of today 04/04/are not yet fixedOn their visit last Thursday 3/*** told me he would not replace the floor as it was not damaged, the day before while chasing my puppy the floor boards started breaking and I reached out to *** and everyone involvedThe framers came in and on ***'s request replaced only the spot that I had almost gone through, the pieces removed shows the board been completely rooted and delaminating and are been kept food future referenceThis only shows the unethical behavior practiced by the builder and mean while the boards are starting to break apart while my family's safety is at risk nowThere has been several other professional opinions on the current subfloors including an architect/ engineer firm and contractors how have stated the floor is delaminating and requires replacement, *** stated while at home that he was an licensed engineer and general contractor, The meeting on March and I was originally scheduled to inspect the subflooring on the other rooms as stated on the emails, however they have not yet e they have not yet inspected those other rooms to make an assessment of the subflooring, I continuously keep expressing the need of bringing a carpet person I saw I was not sure whether I was goingto install laminate flooring or notI have contacted my flooring Company canceled my order and requested the laminate gets picked up at this point

Please enter your reason(s) for rejecting the business response below.Mr*** response is half true They did return my deposit money However, D.RHorton did not negotiate They made a low ball offer for resolution which I reluctantly accepted I signed the contract addendum that they gave me to sign days later I found out they were not performing on the resolution's requirements AND that they had not even verified that addendum with a signature.Instead they attempted to coerce me into signing a subsequent addendum stating that I had "incorrectly believed" the home was an Emerald home at the time of purchase This was completely untrue, and I refused to sign D.RHorton then canceled the resolution addendum They operated in bad faith from day one.I retained counsel only to ask DRH to go to the dispute resolution avenues outlined in their contract I wanted a formal negotiation, face to face, which is what their contract stipulates is required Had that failed then I would have sought mediation They refused and simply backed out of the contract.I asked that D.RHorton perform on the original sales contract and build the home I contracted for To that end there was no good faith negotiation with DRH.I have attached my complete accounting of the debacle which I had to write for the attorneys earlier A link to the documentation and photos is below.***Thank you

I am rejecting this response because:The technician I escorted out had installed the drain gasket upside down which was why it continued to leakThe new plumber seems to have it fixed properlyI feel I should be compensated for the time I have had to miss work due to their plumbers mistakesThey have also asked me to lie to the manufacturer and not mention that the shower has been pulled outOnly time will tell if my shower is 100% fixedIt may take weeks for a leak to show up again
