I amrejecting the business response because it needs further clarifications. Thefollowing wordage would be acceptable: We fully acknowledge that Mr. [redacted] retains all rights to his copyrightedmanuscript; and Dorrance Publishing and it’s employees (including [redacted]) havenot and never will, use or distribute Mr. [redacted]s manuscript in an unauthorizedway. The manuscript never left Dorrance Publishing and no one fromoutside of Dorrance has read, reviewed, or copied Mr. [redacted]’s manuscript. Mr. [redacted] is indeed our employee. Themanuscript was never "missing" as Mr. [redacted] states. We providedour standard statement of confidentiality and when Mr. [redacted] was not satisfiedwith that, we revised it to his liking. We apologize that we were not able to respond to Mr. [redacted] as quickly as hewould have liked, but this short delay in communication in no way indicatesthat Dorrance has violated Mr[redacted]'s copyright or performed inappropriatelyin any way.Regards,
[redacted]
Mr[redacted] has been contacted by our Senior Publishing Services Consultant [redacted]. She has provided him with a Statement of Confidentiality signed by our company president, and assure him that Mr. [redacted] and Ms. [redacted] are indeed employees of Dorrance Publishing. We certainly would...
not share or distribute any manuscript which is submitted to us.We consider this complaint to be resolved, as we have complied with the desired resolution requested by Mr. [redacted] in his complaint and we continue to be in contact with him regarding the possible publication of his manuscript.Sincerely,[redacted]Author Services Director
[redacted] spoke with [redacted] on Monday, May 11th, and [redacted] indicated that he was still interested in our services. We are sending him a proposal for his review.
I apologize for the late response. We responded directly to the client on February 7th, right after receiving your email and had intended to send you a copy of that response. Here it is:"We received a notification from the Revdex.com that you did not receive you earnings statement. These...
statements were emailed on January 31st. Sometimes, because they are sent in bulk, they can be flagged by spam filters. I have attached a copy for you. Please let us know if you have any questions."We have not had any further reply from the client.
We were surprised to receive this complaint of errors in her finished book, as Ms. [redacted] ([redacted] in our records) has not expressed any dissatisfaction directly with us since receiving her printed book. We go to great lengths to make sure the printed book is exactly how the author...
wishes it to appear. In this case, Ms. Jordan reviewed 6 sets of page proofs before approving the final version. We would not send a book to print without the author's final approval. The materials that she approved for printing were exactly how the final book appeared. However, in the effort to satisfy the author, we will agree to make changes to the printed book at no charge to her. Her author services representative, Michael K[redacted], has already reached out to her to facilitate this process. Sincerely,Jessica S[redacted]Author Services Director
In the first place, just because the correct number of pictures were included, doesn't mean that the RIGHT ones were. In fact, three of the illustrations that I fought so hard to get were left out altogether. Also, the book is supposed to be set up so that there is an illustration followed by text on the facing page. There were two instances where two pictures were on facing pages. If my contact had looked at it more closely, she would have seen these mistakes.I am willing to work with Dorrance to get my book published but all of this back and forth with correction sheets has got to stop. I have cobbled together a copy of what the book should look like from the three separate "final" proofs they sent me. I can send that to them but, other than that, I need assurances that no more of these very obvious mistakes will be made.
Regards,
[redacted]
While we certainly acknowledge that the loss of computer data which caused the initial delay was not Mr[redacted]'s fault, we have been attempting for many months now to move forward with this project. We have made every attempt to rectify the problem and have made Mr. [redacted] a generous offer of compensation for the inconvenience. It is our desire and intention to fulfill the terms of this contract and produce a finished book for Mr. [redacted].
We are sorry to hear that Ms. [redacted] has not been satisfied with our service. I have confirmed that her promotion postcards were mailed to her on May 28th. The other portions of the promotion were completed in April, and she was sent detailed information about them on April 28th....
Our usual promotion schedule is to have these activities completed within 8 weeks of publication. As Ms. [redacted]'s book was first printed on April 17th, we were actually ahead of schedule with her promotion.I have personally reached out to her to let her know she can contact me if she encounters any further issues with communication, but I am hopeful that her publication will move forward smoothly.Sincerely,[redacted]Author Services Director
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.
Regards,
[redacted]
We would be happy to discuss this issue further if she is not satisfied with our response, however, she has not provided any indication of why our response was not adequate or what her further questions may be. We believe we provided the factual information which was requested in the original complaint. If she can provide specific additional questions, we'd be happy to answer them.
We are sorry to hear that Mr. [redacted] feels that he has had a difficult time getting the W-9 form from us. We have both mailed and emailed the form to him multiple times. It was emailed on 10/13/17 and 11/21/17 and also sent through the U.S. Postal Service 10/17/17 and 11/22/17. As Mr. [redacted]...
states that he returned a form, it does sound like at least one of those reached him. We have not yet received the completed form from him, and as his complaint doesn't specify when that was sent we are uncertain whether it is reasonable to expect that may still arrive. We will certainly let Mr. [redacted] know if we do receive it. In the meantime, we'd be happy to put another copy in the mail for him.I am sorry to hear of his difficulties in communication. Our records do show multiple attempts by Mr. K[redacted] to return his calls however he received no answer and no voicemail was set up.
Hello this is [redacted], I have read on my computer that Dorrance publishing was supposed to send a refund back to me a month ago thanks to you guys. However I have received nothing at all.
Mr. [redacted]'s refund is being credited to the Visa card with which original payment was made.
Ms [redacted] signed a publishing contract with us in June 2014. As she mentioned, she had successfully published 2 previous books with our company. We were surprised to receive this complaint from her, as production of her book has been moving along and we have been in communication with...
her.The original due date for her book was January 2015, however, Ms. [redacted] added additional materials to her book after work had begun and her approval of the cover took longer than usual when she did not inform us of a change in address. Her most recent set of page proofs were sent to her on April 23rd. Once we have her approval on these interior pages we can prepare the book for print. We have been acting in accordance with the contract and have every intention of producing a book according to those terms. Her representative here, [redacted], has spoken with her on the phone several times in the past several weeks and has sent her materials as necessary. As stated above, the production of her book is nearing completion. Therefore, we cannot agree to a refund of her publishing fee and strongly deny her accusation that we are a "fraud." We will continue the servicing of her contract and complete the project for which we have been paid.Sincerely,[redacted]Author Services Director

Review: On 01-15-15 this company published my book. I paid them $1000 to publish my book. I have not seen any proceeds from my book. They said they would pay this out in July and January, but I have not received any money from them. They have not called me for many months. When I call them they play games and never receive any answers to my questions.Desired Settlement: I would like the proceeds from my book sent to me.

Response:
Per Ms. [redacted]'s contract with us for the publication of her book, earnings are to be paid each January 31st and July 31st, for any qualifying sales up through the previous October 31st and April 30th, respectively. As Ms. [redacted]'s book was first printed in January 2016, the first time she was eligible to receive earnings was July 2016.Our records show that Ms. [redacted] accrued earnings in the amount of $31.68 (for 12 books purchased by a distributor and 3 books ordered directly by an individual). If Ms. [redacted] did not receive this payment/statement for some reason, we would be happy to reissue this to her.The statement that we have not called her for many months is not correct. Her representative most recently spoke with her on July 15th, and we also placed several calls to her throughout the month of June. Please let us know if we can be of further assistance.
Review: For 2 years no progress has been done on my Vignettes book. I haven't received any proof as DORRANCE promised. Had the staff followed my Dummy - mistakes, repeatitious e mails, sending back & forth pages for corrections will be prevented and save time.
It has been a very stressful months, mentally & emotionally waited for the formatted covers, 129 pages was exasperating. So many ridiculous excuses, the sudden change of size of my book, messing up my back cover design & so many more but the limited space couldn't fully describe my complains. I'm asking for a refund of Joy's fully paid $4,900 .I asked it 4 times & Dorrance doesn't refund because- "the money you have paid goes to the cover designers, editors, to get this far in the production." What cover design? SHAME !
I did not use DORRANCE page designers. I am an art director for 25 yrs. DiID ALL THE LAYOUTS, 129 pages, both Covers. I requested only for copy editing for my [redacted] articles only.Desired Settlement: DORRANCE art dept. can't claim theiir artists did my Vignettes both covers or any art work, layouts done in the book, that's. Plagiarism ! I thank the editors for editing my articles.
Most important is to PLEASE RETURN ALL MATERIALS / VIGNETTES BOOK , BOTH FRONT COVER AND BACK COVERS & ALL COLOR PAGES. AND REFUND OF MY DAUGHTER & GRAND DAUGHTER's HARD EARNED MONEY FOR MY BIRTHDAY GIFT. to fulfill my dream .

Response:
We are sorry to hear that Ms. [redacted] is unhappy with the status of her book. It is untrue that there has been no progress. We are working on the cover design and interior pages and have been in contact with her throughout this process. We should have "page proofs" of the interior pages (which show exactly how the finished book will appear) for her review and approval within the next few days. Regarding the cover design, we are stalled with this because we have been waiting for a response from Ms. [redacted] regarding clarification of her requested corrections. We have prompted her for this information a few times. We certainly are not taking credit for any of her artwork. Ms. [redacted] may terminate the contract if she does not wish to move forward, however, per the terms of the agreement no refund would be made. We are working to produce the book and perform the services which she purchased.
I paid 6,400 up front. It was sent at the same time as I sent my book.
My book was to be done in 6 months. Well a year has pasted and no book?
But I have gotten in return week after week lie after lie after lie. Next step Attorneys, and Newspapers.
To yell it to the entire world. To light a candle and curse them.
To go to their place of business and stand face to face
And dare them to lie to me yet again. To pull down the darkness of the night
And assign each of them a spirit to torment them day and night as they have done and are doing to me.
May sickness and messier follow them all the days of their lives without a God to hear their cries.
This is my curse to them; that nothings will go right for them until they do right by me.
Review: We contracted with Red Lead Press for the publishing of five novels (FIVE NOVELS) of historical fiction. Then Red Lead Press closed its doors. Its parent company Dorrance apparently does not have a method to help us republish those novels. We ask Dorrance to consider helping us or send the five novels to another firm that can make them available for purchase.Desired Settlement: Either re-publish my five novels OR send them to a publisher who can set them up to be republished and available for purchase.

Response:
Mr. [redacted] did sign contracts with us for the publication of his five books through our Red Lead Press imprint. Those contracts were terminated by us in 2013. Per the terms of our agreement, we were only obligated to keep his book active for a minimum of six months, and we went well beyond that time frame for each of the books. There is no "contract dispute" as these contracts were ended several years ago, in accordance with the terms of those agreements. It is true that we no longer publish books under the Red Lead Press imprint, but we do still publish books as Dorrance Publishing. We have no record of Mr. [redacted] requesting a quote to publish through Dorrance. We certainly would be happy to discuss this option with him. Likewise, we have no record of being contacted regarding providing his files to another publisher. If he wishes to publish elsewhere, he is certainly welcome to do so and we can provide him with printing files, upon request.

Response:
I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me. I will contact Dorrance Publishing because I was not aware of that option.
Review: I paid $2,000 for publishing, marketing and promotion services with the Rose Dog Division of Dorrance Publishing. The book was published. Dorrance provided some marketing services but asked for additional fees when these services were already promised in the original contract. All sales and book signings were obtained through my own efforts, not Dorrance's. Dorrance very little, if anything, to advertise or promote my book. There is a clause in the contract which requires Dorrance to report all sales activity, including no sales, on a quarterly basis. Dorrance failed to provide me with any sales reports.Desired Settlement: I would like a full refund of $2,000.

Response:
We are very sorry to hear that Ms. [redacted] has been unhappy with her publishing experience. However, we have acted in accordance with the contract, and therefore, no refund is due.Our contract with Ms. [redacted] states: "RoseDog shall send to the Author or his/her duly authorized representative a statement of the number of qualifying sales that result in earnings and remit the Author's payments from the sale of the Work on January 31 and July 31 of each year via electronic funds transfer in U.S. funds. Statement of qualifying sales shall be based on all sales made and paid for as of the previous October 31 and April 30 respectively to allow for proper accounting. If no sales qualify for earnings, then a statement will not be issued."As you can see, the earnings statements are clearly to be issued twice yearly, not quarterly as Ms. [redacted] has stated. Further, it specifically states that we will not issue a statement if there are no qualifying sales/earnings. In Ms. [redacted]'s case, there have been no sales to report. We understand that Ms. [redacted] is disappointed in the lack of sales, but we do not and cannot guarantee any number of sales. This is stated specifically in Section XIII of the contract "No Sales Guarantee: The Author understands that RoseDog has not guaranteed, nor intends to guarantee, the sale of any specific number of copies of the Work."Ms. [redacted]' contract included a "limited and specified promotion for the the purpose of attempting to gain some recognition for the Work." We have performed the services detailed in the promotion section of the contract. We have developed this promotion plan based on our years of publishing experience, as what we believe has the best potential to gain some exposure for an unknown author. But we cannot predict or control how the marketplace will respond to any particular book.Again, we are sorry that Ms. [redacted] has been disappointed in the sales performance of her book, but we have performed the services which she purchased from us and we have not breached the contract.
