While we certainly acknowledge that the loss of computer data which caused the initial delay was not Mr [redacted] 's fault, we have been attempting for many months now to move forward with this project We have made every attempt to rectify the problem and have made Mr [redacted] a generous offer of compensation for the inconvenience It is our desire and intention to fulfill the terms of this contract and produce a finished book for Mr [redacted]
I amrejecting the business response because it needs further clarificationsThefollowing wordage would be acceptable: We fully acknowledge that Mr [redacted] retains all rights to his copyrightedmanuscript; and Dorrance Publishing and it’s employees (including [redacted] ) havenot and never will, use or distribute Mr [redacted] s manuscript in an unauthorizedway The manuscript never left Dorrance Publishing and no one fromoutside of Dorrance has read, reviewed, or copied Mr***’s manuscript Mr [redacted] is indeed our employee Themanuscript was never "missing" as Mr [redacted] states We providedour standard statement of confidentiality and when Mr [redacted] was not satisfiedwith that, we revised it to his liking.We apologize that we were not able to respond to Mr [redacted] as quickly as hewould have liked, but this short delay in communication in no way indicatesthat Dorrance has violated Mr [redacted] ***'s copyright or performed inappropriatelyin any way.Regards, [redacted] ***
We are sorry that this author no longer wants to proceed with the signed contract We did already inform him that we would agree to end the contract and refund his moneyHowever, there is some processing time involved with this The manuscript was sent back on January 12th and the refund check will be issued by the end of this weekWe are certainly not a fraud and we successfully publish books for hundreds of authors each year While we regret that he does not want to proceed with his publication, we are in the process of terminating the contract and refunding his money
Mr [redacted] has been contacted by our Senior Publishing Services Consultant [redacted] *** She has provided him with a Statement of Confidentiality signed by our company president, and assure him that Mr [redacted] and Ms [redacted] are indeed employees of Dorrance Publishing We certainly would not share or distribute any manuscript which is submitted to us.We consider this complaint to be resolved, as we have complied with the desired resolution requested by Mr [redacted] in his complaint and we continue to be in contact with him regarding the possible publication of his manuscript.Sincerely, [redacted] Author Services Director
Our Author Services Manager spoke with Ms [redacted] yesterday and discussed the exact order of the the pagesWe will be providing her with new page proofs for her review and approval reflecting this reordering
We are very sorry to hear that Ms*** has been unhappy with her publishing experience However, we have acted in accordance with the contract, and therefore, no refund is due.Our contract with Ms*** states: "RoseDog shall send to the Author or his/her duly authorized representative a
statement of the number of qualifying sales that result in earnings and remit the Author's payments from the sale of the Work on January and July of each year via electronic funds transfer in U.SfundsStatement of qualifying sales shall be based on all sales made and paid for as of the previous October and April respectively to allow for proper accountingIf no sales qualify for earnings, then a statement will not be issued."As you can see, the earnings statements are clearly to be issued twice yearly, not quarterly as Ms*** has stated Further, it specifically states that we will not issue a statement if there are no qualifying sales/earnings In Ms***'s case, there have been no sales to report.We understand that Ms*** is disappointed in the lack of sales, but we do not and cannot guarantee any number of sales This is stated specifically in Section XIII of the contract "No Sales Guarantee: The Author understands that RoseDog has not guaranteed, nor intends to guarantee, the sale of any specific number of copies of the Work."Ms***' contract included a "limited and specified promotion for the the purpose of attempting to gain some recognition for the Work." We have performed the services detailed in the promotion section of the contractWe have developed this promotion plan based on our years of publishing experience, as what we believe has the best potential to gain some exposure for an unknown author But we cannot predict or control how the marketplace will respond to any particular book.Again, we are sorry that Ms*** has been disappointed in the sales performance of her book, but we have performed the services which she purchased from us and we have not breached the contract

*** ***Thanks so much to the Revdex.com I did hear from Dorrance Publishing Coand they have agreed to reprint my book I have had a contract with them since May with many excuses for not reprinting the book I am concerned that the reprint might still be putt off, so I want to keep in touch with the wonderful Revdex.com until I have the reprint books in my possession as they have promised Thank You so much for your help.*** ***
Following up on this matter, these issues have been addressed and resolved directly with Ms*** Please let us know if she has additional questions for you, but we believe this will close the matter

The last step in the process before we can print Ms***'s book was to send her final "proofs" of the front and back covers of her book These were sent to her on January 8th, so they would have crossed with this correspondenceOnce Ms*** verifies that those covers are correct, we

We are sorry to hear that Mr*** was not satisfied with our "Writing Coach" servicesThe fee for these services is based on the number of hours of work required of the writing coach, not the number of manuscript pages We do our best to estimate what would best suit each author's
needs Unfortunately, it seems that Mr***'s manuscript required much more work than we originally thought, and the original writing coach hours he had purchased were only able to cover a portion of his manuscriptUpon hearing from MrStrickland, we did offer him an additional free hours of coaching, which he declined.As we are not able to meet Mr***'s needs, we will agree to refund the fee he has paid for our services We will be directly sending him paperwork acknowledging termination of our agreementWe wish him the best in finding a more suitable editor for his project
I apologize that it has taken us extra time to respond to this. We have the author in our records by the name of *** ***, so it took some time for us to identify her from this complaint from *** ***.This contract was signed in and the original projected due date was July
However, due to the large amount of revisions submitted by the author, in addition to payment issues, it has taken significantly longerThe author agreed to make specific monthly payments and at times we have had to put the project on hold because these were not met.We are nearly ready to print the book at this time. The interior pages of the book were approved by the author in July and those are ready to goWe are still working on finalizing the back cover of the book to the author's satisfaction. As she mentioned, she did speak with Ashley in August about this and we then made revisions. The most recent version of the cover was sent to the author for review on September 20th. Once we have her final approval on the cover, we can prepare the book for printing. This process takes 2-weeks from when all materials are approved. We apologize if Ms*** was under the impression that it would be only 2-weeks from the time of the conversation in August.We do not believe a refund is warranted as we are working to provide the service for which we were contracted. Per Ms***'s contract with us for the publication of her book, earnings are to be paid each January 31st and July 31st, for any qualifying sales up through the previous October 31st and April 30th, respectively As Ms***'s book was first printed in January 2016, the first time she was
eligible to receive earnings was July 2016.Our records show that Ms*** accrued earnings in the amount of $(for books purchased by a distributor and books ordered directly by an individual) If Ms*** did not receive this payment/statement for some reason, we would be happy to reissue this to her.The statement that we have not called her for many months is not correctHer representative most recently spoke with her on July 15th, and we also placed several calls to her throughout the month of June.Please let us know if we can be of further assistance
We are sorry to hear that Ms*** is unhappy with the status of her book It is untrue that there has been no progressWe are working on the cover design and interior pages and have been in contact with her throughout this process We should have "page proofs" of the interior pages
(which show exactly how the finished book will appear) for her review and approval within the next few days. Regarding the cover design, we are stalled with this because we have been waiting for a response from Ms*** regarding clarification of her requested correctionsWe have prompted her for this information a few times We certainly are not taking credit for any of her artwork. Ms*** may terminate the contract if she does not wish to move forward, however, per the terms of the agreement no refund would be made We are working to produce the book and perform the services which she purchased
Ms***'s contract with us was terminated in April 2015, at her request At that time, ***/Dorrance ceased to be the publisher of this book -- we no longer print any copies of the book or fulfill any ordersHowever, as the book was previously published, there may still be
information about the book available online.We have followed up with *** and *** *** now lists the book as "out of print." *** *** *** has removed the listing.Since this complaint was submitted, we have also been contacted directly by Ms*** and have discussed this matter with her We have assured her that her contract with us is indeed terminated and we have not fulfilled any orders for the book since that time.Please let us know if there are additional questions

Dorrance publishing's companies statement is not all fact nor truthful, when I was first notified about there being a problem was when I asked about the ETA of my receiving the allotted books by contract agreement a month after I had paid my last four payments of my processing fee, and only them MsTina K*** contact me and acknowledge that there was a problem, and that they would have to recreate my book the *** ** *** *** * *** *** and I asked why would you have to recreate the book when it had been finalized in I was then asked to mail or fax the cover sheet print that I had and back which I was informed by MsTina K*** that they could not use the original cover agreed upon that I had drawn the concept, that the graphic designer was no longer with Dorrance, and that they would have the cover redone which I was given a copy that I acknowledged had nothing to do with the title of my bookif they dont have the entire book as written and approved by me than they are incapable of completing my manuscript as I desired and had agreed uponIf the book wasnt completed and they dont have the final print than I see no real reason for my manuscript and monies being kept for a service they did not provide

Complaint # ***3-18-15 I rejected the business's complaint, but I did not understand where to explain the reason for my rejectionPlease accept the following as the reason for the rejection: Dorrance's response states "Mr *** and Ms *** are employees of Dorrance Publishing. My concern was whether or not *** *** and *** *** are employees of Dorrance Publishing, so Dorrance failed to respond to the appropriate concerns.In addition, to date, Dorrance has failed to provide an explanation as to why no one at Dorrance contacted me after the manuscript was receivedThis was requested directly through *** *** of Dorrance. My concern: During the time period Feb 19, 2015-March 4, 2015, whereabouts of the manuscript was unknown and no one at Dorrance responded to my communications regarding the whereabouts of the manuscriptFor example: *** *** failed to reply to two usps letters mailed to her; *** *** and *** *** failed to respond to multiple e-mails; and Dorrance failed to reply to multiple telephone messages that I left on Dorrance's voice mail. Without additional information and clarifications from Dorrance, the Statement of Confidentiality is not entirely meaningful. *** ***
