Dear Ms. [redacted], This letter is in response to the complaint # [redacted] by [redacted]. By way of background, Defenders, Inc.  DBA Protect Your Home is an Indiana corporation that specializes in selling residential alarm systems. We have been an ADT authorized dealer since 1998 that sells and installs ADT monitored security systems. Once the security system is installed, the contract is then purchased, billed, serviced and maintained by ADT.   After reviewing the account I show Mr. [redacted] called in on flyer he recently received on June 22, 2016. The flyer he received the 15 pre-wired/7 wireless Sensor Package Offer for $27.99 for the life of their contract (do not include QSP), PLUS a $100 visa gift card for signing up with Protect Your Home AND a second key fob.  We show our sales representative did customize his package by offering his package by offering a $458.00 equipment credit. We do show Mr. [redacted] did upgrade the promotion to $52.00 pulse package and the additional $340.40 he did pay for additional equipment for shock sensors which were upgrade as well as added. The equipment credit that our sales representative offered Mr. [redacted] was utilized for smoke and glass break protection. I have attached the contract and the schedule of protection that reflects what he was charged. In effort to resolve the complaint we are going to request refund of the addtional equipment he has paid for equipment.  I have also requesting the immediate fulfillment for the initial VISA that he was offered at the time of sales. Unfortunately we are not able to honor the request to be released of contractual. Ms. [redacted], This letter is in response to the complaint # [redacted] by [redacted]. By way of background, Defenders, Inc.  DBA Protect Your Home is an Indiana corporation that specializes in selling residential alarm systems. We have been an ADT authorized dealer since 1998 that sells and installs ADT monitored security systems. Once the security system is installed, the contract is then purchased, billed, serviced and maintained by ADT.   In summary, Mr. [redacted] would like his rate adjusted to $48.99 versus the $52.99 that he is currently paying for his ADT monitored burglar alarm system with the Pulse Solution Services feature.   Mr. [redacted] entered into a contract with Protect Your Home on August 24, 2016 with a rate of $52.99. This rate includes cellular backup and Pulse Tier 1. This allows Mr. [redacted] to arm and disarm his system from any location as well as set up text alerts. Without Pulse Tier 1, his rate would be $48.99. There is about a $4 difference to utilize this feature. The activation charge of $149 for the Pulse Tier 1 was waived by the technician, so Mr. [redacted] paid $0 for that activation. In order to have his rate reduced to $48.99, he would need to schedule a service to have the Pulse feature removed and a contract redone for the lowered rate.   A resolution was accepted by Mr. [redacted]. He was offered to keep the Pulse Tier 1 feature and have the difference in rate reimbursed to him in the form of $200 in Visa gift cards. With this offer, his rate will continue to be charged at $52.99. In return, he will receive his $200 Visa in the mail within two weeks as well as keep the Pulse feature.   I apologize if Mr. [redacted] experienced any troubles with the process.   Dear Ms. Richardson, This letter is in response to the complaint # 11444741 by NGAN Nguyen. By way of background, Defenders, Inc.  DBA Protect Your Home is an Indiana corporation that specializes in selling residential alarm systems. We have been an ADT authorized dealer since 1998 that sells and installs ADT monitored security systems. Once the security system is installed, the contract is then purchased, billed, serviced and maintained by ADT. After reviewing the account I show Mr. Nguyen called into inquire on service on January 30, 2016 due to recent flyer he received as well as break in he had. I show the promotion he called in on included 15 hardwired sensors or 7 wireless sensors in the base package. Our installer did come out the following day to install the security system. I show Mr. Nguyen did agree to purchase additional equipment in the amount of $468.66 and I show he signed off on the credit card authorization form as well which I am attaching. In regards to the permit I show Mr. Nguyen permit has been applied for and he was contacted by our permits team to advise when his local municipality submits the permit to our company we than send him a copy of the permit on May 13,2016. Unfortunately at this time we are not able to honor his request to be released form the contract since he did sign and acknowledge a 36 month agreement. Please review the contract attached.                   Dear Ms. [redacted], This letter is in response to the complaint # [redacted] by [redacted]. By way of background, Defenders, Inc.  DBA Protect Your Home is an Indiana corporation that specializes in selling residential alarm systems. We have been an ADT authorized dealer since 1998 that sells and installs ADT monitored security systems. Once the security system is installed, the contract is then purchased, billed, serviced and maintained by ADT.   In summary, Ms. [redacted] states that she has had multiple alarm events and ADT never dispatched the police after she had a system installed in December of 2016. She states that she wanted to have the system relocated to a different address, but was advised she would be required to sign a new contract. She said that her account has not been sent to collections because Protect Your Home did not send her a bill. Ideally, she would like the equipment removed and have the balance waived.   Ms. [redacted]’s account has been sent to a third party collections agency [redacted] for non-payment. She was made aware on January 24, 2017 that her account was at risk at being sent to outside collections if she did not catch up her bill. She refused to pay, so her account was sent to collections on February 10, 2017.   She initially contacted Protect Your Home for an ADT alarm system on December 8, 2015. The alarm was installed on December 11, 2015. A contract was executed for 36 months at $52.99 a month. Her account became delinquent in August of 2016. She made a payment in November, but her account fell delinquent again in December. A payment was not received, so the account went to outside collections.   Ms. [redacted] states that she did not receive a bill at her listed PO Box. I verified the address and found that the mailing address was incorrect. Although this may have caused her to not receive the mailed delinquent notices, she was still contacted about the past due balance. She was aware of her account status before it was sent to collections.   I investigated her concerns about the alarm events. ADT verified that the police was dispatched on June 2, 2016 and July 19, 2016. ADT has no control if the Police come or not. That is something she would need to contact her local Police Department about.   In regards to her request to relocate the service, Protect Your Home requires a new 36 month contract. There is no way around this. A new contract is required for every new installation including movers.   At this time, a release from contract is denied. The equipment will remain in her possession and she will need to contact the outside collections agency to resolve the balance. Once the security system is installed, the contract is then purchased, billed, serviced and maintained by ADT.   After reviewing the account I show Ms. [redacted] contacted us to compare our prices with [redacted] cable on May 6th. The package she called in on included 3 sensors, motion, and key fob. We additionally offered $229.00 equipment credit and offered $250.00 VISAs to assist with the installation. The customer inquired on cameras and our sales agent did advised her that she would need to speak to our installer in regards to all the fees. Our sales agent did advised Ms. [redacted] of the $299.00 activation fee for cameras on same day. We do reflect on our sales call Ms. [redacted] was played the terms and conditions of the contract which advises:   ADT Pulse Interactive Solutions Services, which help you manage your home environment and family lifestyle, requires the purchase and/or activation of an ADT alarm system with monitored burglary service and a compatible computer, cell phone or PDA with Internet and email access. These ADT Pulse Interactive Solutions Services do not cover the operation or maintenance of any household equipment/systems that are connected to the ADT Pulse Interactive Solutions Services/Equipment. All ADT Pulse Interactive Solutions Services are not available with the various levels of ADT Pulse Interactive Solutions Services. All ADT Pulse Interactive Solutions Services may not be available in all geographic areas. You may be required to pay additional charges to purchase equipment required to utilize the ADT Pulse Interactive Solutions Services features you desire. Up to $499 customer installation charge. Burglary, Fire, Carbon Monoxide and Medical Alert monitoring requires purchase and/or activation of an ADT security system with monitored Burglary, Fire, Carbon Monoxide and Medical Alert devices. Fire, Carbon Monoxide and Medical Alert services are an additional charge.   We do reflect Ms. [redacted] was installed May 10,2016 she upgraded her package to pulse level 1 which the monthly monitoring fees are $52.99 which I have attached for her records and shows she only paid $10.84 for additional equipment. Ms. [redacted] did call in requesting for exterior cameras to be installed. Our escalation department did offer a $100.00 VISA due to account holder requesting a full refund for equipment. Ms. [redacted] was also offered an $75.00 VISA for the inconvenience.   Our escalations representative did receive an complaint on July 21,2016 where the customer requested to cancel due to cameras.  Our records reflect that Ms. [redacted] did speak to our escalations representative regarding cameras and our agent advised her she would have to pay $299.00 activation. We did reach out to branch manager in regards to camera request and he advised us who offered the customer 2 cameras at no cost.  The tech stated he advised the customer of the activation fee of $299.  The customer stated that if I could not waive the activation fee they requested to be released from her contractual agreement. Our agent advised they would be responsible for the termination cost of the contract due Ms. [redacted] never signed up for cameras on the account.   Unfortunately we are not able to honor her request to be released from the contract.  Our records reflect 3 $100.00 were mailed off as well as $50 and $75.00. The sales representatives was able toreduce it to $99.00 plus local sales tax, Ms. [redacted] did provide her cardinformation for payment for the basic package. After reviewing the account Ms. [redacted] was played the terms andconditions which does mention “You may berequired to pay additional charges to purchase equipment required to utilizethe ADT Pulse Interactive Solutions Services features you desire. Up to $499customer installation charge.” I do show thecustomer did call in on July 1 wanting to not proceed with the installation duethe additional fees for the activation of the camera package. We did submit therefund on July 2 and it shows it was paid out on July 12. Unfortunately, wecannot guarantee the processing time for her financial institution to reflectthe refund in her account. Dear Ms. [redacted], This letter is in response to the complaint # [redacted] by [redacted]. By way of background, Defenders, Inc dba Protect Your Home is an Indiana corporation that specializes in selling residential alarm systems. We have been an ADT authorized dealer since 1998 that sells and installs ADT monitored security systems. Once the security system is installed, the contract is then purchased, billed, serviced and maintained by ADT. In summary, Mr. [redacted] would like refunded for the services he paid for and did not receive. He paid his monitoring in advance but found out he was not being monitored for a year. Protect Your Home took a balance of contract payment in the amount of $1007.64 on November 9, 2015. The representative who took the payment processed it as a contract termination charge “balance of contract” versus a paid in full “balance of contract”. The payment was authorized but both parties were under different impressions as to what the payment was for. Protect Your Home recognizes the miscommunication and does no find that the Mr. [redacted] is at fault. Protect Your Home has agreed to refund Mr. [redacted] all funds which amounts to $1453.55 and cover his attorney fees of $150. A payment condition form was sent to the attorney’s office to review and have Mr. [redacted] sign. Upon receipt of the required documents, the payments will be processed. We have reviewed Mr.[redacted]'s complaint pertaining to the recurring service issues. We offered a service appointment on December 1, 2014. By way of background, Defender Security Company DBA Protect YourHome is an Indiana corporation that specializes in selling residential alarmsystems. We have been an ADT authorized dealer since 1998 that sells andinstalls ADT monitored security systems. Once the security system is installed,the contract is then purchased, billed, serviced and maintained by ADT.  I have researched this accountand found that the customer did indeed give his checking account informationover the phone to our sales agent.  Ihave listened to the sales call and the agent asked for permission to run Mr.[redacted]’s credit using his date of birth, our agent then stated that theinstall fee would be higher because Mr. [redacted] didn’t qualify for the $99install, the rate would be $399.00.  Thesales agent then put Mr. [redacted] on a brief hold and came back and said he couldapply a $200.00 discount and bring the rate down to $199, then when Mr. [redacted]received the $100 visa gift card his install would be the $99.00.  Mr. [redacted] asked if he needed to take thefunds now, our sales agent replied yes, Mr. [redacted] said I need to look for mywallet, then gave checking account instead. Mr. [redacted] gave his routing and checking account number on the phonewith the agent knowing he was going to be charged for the $212.93. At this time I have requestedthat his refund be expedited, however; it can take up to 15 business days forthe refund to take place since it was done by checking account (ACH).   Since Mr. [redacted] gave permission by givinghis routing and account number for the charge, Protect Your Home will not berefunding any overdraft fees. We apologize for anyinconvenience he has experienced. is in response to the Complaint 3 [redacted]. By way of background, Defenders INC.  DBA Protect Your Home is an Indiana Corporation that specializes in selling residential alarm systems. We have been an ADT authorized dealer since 1998 that sells and installs ADT monitored security systems. Once the security system is installed, the contract is then purchased, billed, serviced and maintained by ADT. Summation of Complaint: Owner of complaint does not “agree” with the length of contract. Acknowledgement of Resolution: In regards to Complaint #[redacted], we have carefully reviewed the matter and bring forth the following recommendations. Owner of complaint under “express consent,” voluntarily provided contract signature. Their voluntary actions bind them to a “financial” duty relative to length of contract. Owner of complaint was provided access to the terms and conditions of the 36 month contract.  Failing to comply within contract’s three day opt-out period, contract holds as irrevocable (w/limited relief) and enforceable. Client alleges there is an issue with the system, per our notes, client has not scheduled a service appointment.
