Bad business cars are not worth the money spent not

We purchased a 2015 Kia Soul from this lot on 11/8/19.
The first issue is that the paperwork listed the odometer reading at 94K miles, but when we picked up the vehicle it had 97K miles on it. The appraisal from the bank and approval of the loan was based on a vehicle with a much lower odometer reading. Because I feel we are continually being defrauded, I have reported this as odometer fraud to the state of Texas. I will also report it to my bank if we do not come to a reasonable solution.
Next, within minutes of driving it off the lot, the check engine light came on. We took it to our nearest mechanic shop. The computer readout indicated that the computer had been reset to hide a bad catalytic converter. We spoke to *** (the owner) about the issue. He said he would have it fixed, no charge, if we brought it back in. They had the car for 5 days. When we picked it up on 11/20/19 they said the only issue was a faulty O2 sensor that had been replaced. Today 11/21/19 while driving to the tax office to obtain Disabled Veteran plates, the check engine light went off again. We took it back to the mechanic we deal with and once again it said that there is a faulty catalytic converter. The code was the same. The codes indicated that this is a long standing issue.
I have filed a complaint with TX *** Office of Consumer Fraud protection.
As I told *** when all this started. I want to keep the car, but I expect them to fix these problems. It is bad enough that the business has committed felony odometer fraud and by extension have defrauded a bank to inflate the price, but they have also defrauded a disabled Veteran and continue to waste our time with fabrications.

I purchased my vehicle back on August 28 2019. I have not received my title or tags so I called down to the dealership the week of October 1st and the lady in the office said that they haven’t received them yet but once they do they will call me. I got concerned when my husband received his (purchased from a different dealership) after me. Do I called the DMV and they haven’t received my application for my title and she told me the dealership has 30 days from date of sale to do this. It’s been almost 45 days and nothing. Also I found paperwork that I signed that states (Spot Delivery Agreement) and it says I can return vehicle and get all moneys I have spent (trade-in, down payment and my $500 for taxes and title. At this point I just want my money back if possible because aside from all this I noticed once I got it home that the transmission might have issues.

I went in to buy a car from this establishment February 26, 2019 around 5:00 pm. I initially wanted a Volkswagen but there was an noise issue with that vehicle so I was shown a few others and decided on the 09 Dodge Journey. Being that my credit card would only go through for 2,500 we both agreed that I would return the next day February 27,2019 to pay the remaining balance of 1926.11 and proof of insurance. After retiring home the key fob no longer worked. I tried changing the battery and nothing would work so the next day February 27,2019 I had the vehicle towed back to the lot and requested a refund of the 2,500 I had already paid. I did not want another vehicle nor did I want them to fix that issue I just wanted a refund. I received paper that I would receive a refund and left. Today February 28,2019 I get a notice that my card was declined for 4,426.11 at 12:29 pm which means someone at the establishment was trying to run my card for the amount. I returned their vehicle and was waiting on my final refund of 2,500 dollars so there should not be anyone trying to run my card for any amount. This is unacceptable I was not able to get a clear explaining and currently on hold this company needs to be investigated for fraud immediately

Bonillas Auto Sales Response • Feb 28, 2019

Debit and Credit Cards transactions can take 1-3 business days, transaction made on 02/26/19 for $2,500 has not cleared on our end , so the refund made on 02/27/19 could take 1-3 business days as well, I advised *** about it and told her will contact our merchant provider and give her an update as soon as I got it from the merchant services company.

On Oct. 20, 2018 I spoke to *** about purchasing a vehicle from Bonilla’s Auto Sales specifically a 2015 Chrysler 300 or 2014 Toyota Camry. After speaking with *** in detail about the two cars I decided to purchase the 2014 Toyota Camry via car loan. Since my credit is not the best I chose to finance through one the dealerships company. I signed a contract with *** Financial Services, ***, Sacramento, CA 95899. The initial loan amount through Westlake was $12,771.11 which was $2,921.11 more than the dealership asking price.
Two days later on Mon. Oct. 22, 2018 I received notice late in the evening that Westlake denied the loan I informed on Oct. 20 was final and complete. Later in the week a new contract was drawn up and I was again asked to come sign with Lobal Finance Corporation, ***, Anaheim, CA 92803 but was not given a copy. This Company also denied my loan a couple days later.
When I spoke to *** about the reasons for the denial he told me that my loan was denied because of the fictitious paystubs he suggested would be better than my sub-contractor paystubs I have. The paystubs were printed off his office printer and submitted to Westlake Financial Services by him. The second loan was denied because when employment was verified Lobal Finance Corp. was informed that I am a sub-contractor not an employee for The Renters Club *** TX 78703.
On Nov. 3, 2018 my 2014 Toyota Camry was “ repossessed” after being unable to take off work to bring my sub-contractor paystubs the Bonilla’s Auto Sales on Springdale in time to again re-do another contract. On Fri. Nov. 2, 2018 I spoke to *** twice about whether or not I needed to bring the car back I was told and assured twice that I did not need to return the car things would get settled when I was able to meet in person with him the next day. After a week without a vehicle I went to speak face to face with *** since he was ignoring my call about retrieving my personal property. On Nov. 9, 2018 I went to the dealership to get my belongings and the refunded down payment of $1,500.00 that *** promised me on Nov. 3, 2018. I was then informed that I would not receive my refund and after some debating towing laws and whether or not the car could be financed Homberto Bonilla agreed to refund only $1,200.00 which is the total after the “ repossession fee” of $300.00 but only in the form of trade towards another vehicle of no more than $2,000.00. I then agreed to consider the offer and was shown to two vehicles on the lot one a Chrysler PT Cruiser and the other a Buick Rondevue both vehicle had close to 200,000 miles or more and the battery was dead when he tried to start them, in addition when I opened the Buick there was clear evidence that the vehicle had been broke into more than once. I turned down the offer retrieved my things and decided I would make an effort to purchase the Toyota cash.
As of today I am still in contact with *** trying to get the rest of my personal belongings from the car including: BNIB dremel power tool, insurance documents, 2006 Volvo XC90 title, dash cam and car detail cleaning chemicals.

Tell us why here..On or about 10/20/18 Mr. *** came in and purchased a 2014 Toyota Camry White initially was submitted through Westlake Financial but a couple of days was turned down due to credit history, client was contacted and returned to our office on or about 10/25/18 so we could submit a new contract to Lobel Financial as he had been approved, in the process our Finance Department was notified from this lender that he was not employed by The Renters Club Company but he was a sub contractor at that point Lobel returned that deal to our company, all stips were obtained from Mr. , paystubs were given to *** from him, after getting deal back from Lobel we attempted to contact Mr. several times he didn’t answer or returned our phone calls, vehicle was repossessed on 11/03/18 and after vehicle was picked up then he contacted our office, any items found in vehicles are bagged and stored at our facility after a certain period of time we dispose of them, client came in and picked up items found on vehicle, left and contacted us the following day claiming there were some items missing from his vehicle, we told him how our repossessed vehicles procedure works on items found on vehicles, after a couple of weeks he came back and spoke to the owner wanting to get that same vehicle back, despite of the fraudulent activity he was offered to purchase it cash or get $1,200 worth of credit in one of our vehicles from the inventory available to be financed In House, he refused to get any of the vehicles available. Bonilla’s Auto Sales will not return any money due to the fact that he provided us with fraudulent stipulations
and once we offered options so he will have a vehicle for transportation he refused options given, also we have no authority or obligation with the Insurance Company to refund any money paid to them, he will have to address that directly with the Insurance Company , If any other information is needed feel free to contact us.
