We apologize for the inconvenience, it is a little odd that after living in the house for almost years you are experiencing this problem Never the less, we will still send out our techs to investigate and correct if there is a problem despite the fact you are out of warranty
We apologize for the inconvenience, and will continue to work on getting this resolved as quick as possible However, due to high winds and heavy rain, this problems was unforeseeable and may of happen by natural acts We are however still here for you after months you've lived in the house and still here to help make it right We'd like that to be permanently on the Revdex.com as well
Again, we are not here to take anyone’s earnest money With our best intension we try to build you the house you selected and customized to your families liking The facts are as you mentioned; Our sales staff was made aware of your concerns only “several weeks” before closing To be exact it was about weeks before closing The landing was framed months prior to this A few inches may have made the landing step slightly different due to the angle of the opening Our position is that this is not a mistake, rather an excuse used by the customer to cancel the contract What was failed to be mentioned is that we offered to install wrought I [redacted] railing, a $upgrade, as a concession to any mis-understanding that may have taken place.We at no time confused your house plan with another, your plan which was an Anaqua and part of our “Pride Series” The Hemlock which is part of our “Enchanted Series” (Not Heritage Series as you mentioned).Our sales staff is not aware of the square footage of the lot, they would not have offered that information The Lot premium that was charge was due to the fact that this lot is larger than the typical lot and in a cul-de-sac.Out of principle we have chosen not to refund back your earnest money As it clearly states in our contract, that once the house commences all earnest money’s are forfeited We take a lot of pride in what we do, and we don’t take much earnest money to hold customers to their side In most cases around 1% of the total sales price As folk will read, yes much easier to refund this customer and avoid getting accused on the Revdex.com site But if you are serious about building your dream home with a builder that has integrity and is honest, we will do our best for you

Complaint: [redacted] I am rejecting this response because:I have been extremely clear as to what I would likeI expect a full refund and to speak with someone from New Leaf Corp.I have left several messages for [redacted] and have yet to receive a call backSeeing as you will not contact me to discuss my concerns I will explain them here.Here is my experience and complaint on what occurred during my build and why I feel I should have all my money refunded.On October 28th @ 2:58pm [redacted] and [redacted] confirm site is ready for inspection via email October 30th @ 12:30pm Site is inspected and the fails due to the foundation caving in due to weather November 8th @ 10:21am [redacted] emails that the foundation is ready for the 2nd inspection November 9th @ 3:21pm Site is inspected by 3rd pary, myself, and [redacted] (New Leaf Superintendent) and failsAll parties agreed that it was not repaired November 9th @ 5: [redacted] sends me a text stating that all repairs have been completed and the site is ready November 10th @ 6am - Site is poured without anyone verifying repairs were made.Here is where we have the disagreementNew Leaf was not able to repair the issues in a weeks time but I'm expected to believe that in hours you were able to contact a crew, get them onsite, complete all the repairs, and pass inspection? I have contacted San Antonio Development Services and have disputed New Leafs inspection approval via engineering letter.City Inspector Rober Cigarroa is currently investigating.I will also be filing suit disputing the contract and seeking return of all earnest money.I have attempted to email, call, and work through the Revdex.com but it is obvious New Leaf has no desire to speak with me.I'm amazed that all it took was email to a salesman to consider our deal void in New Leafs opinion but every other email or call to work towards a resolution means nothing Regards, [redacted]

Complaint: [redacted] I am rejecting this response because: We have never once agreed to close out this issueI was told by both *** and [redacted] that they understood that we were overcharged and [redacted] original response was that he was waiting for the final invoice so that he could refund me the differenceI was later offered less than 1/of what we were overcharged and was told the day before closing that we could accept that or not close on the houseWe had other issues forcing us to close on the house as soon as possible and I stated during that time that would not be accepting the offer but we would still need to close on the houseI've continued to ask about the refund on a regular base but NewLeaf chooses to ignore all requests after someone closes on their home Regards, [redacted]

I am rejecting this response because:Problems haven't been fixed still have broken tiles and other things in home These are on going problems since the beginning that I was verbally agreed that will be fixed by building manager *** at the end of my two year warranty so I wouldn't have to be missing work or free time waiting for them to fix them

Ms***, It's not that we are denying your request, but both these items are a result of lack of or No homeowner maintenance. If you can provide a receipt(s) of how many times the exterior has been painted and caulked, we can further evaluate the problem. Given that we build our
houses with a predominantly brick/masonry exterior, the maintenance cost to paint the fascia and columns should be minimal. As we recommend to all our homeowners, this should be done at a minimum of every other year. Therefore, you being in the house for years, you should have had this performed at least times. Thanks,

***I am rejecting this response because: If the AC were working properly my unit would not run continuously, my electric bills would NOT be almost $for an energ efficient home with an Aunit that works properly I have also requested the reports from the AC company, air leakage, blower door and duct reat and the HVAC Manual J to be sure that the ayat was the proper size for my home The AC company will not send to me and when I call I am sent to a voicemail If my Aworked properly theWVERY time they have come out they would NOT find something else that was wrongIt's been approx 25-times they have been here Always with a different reason as to why the system is not working right We have had the city inspector to our home and he is the one that told us what reports we needed to get to verify what's wrong with our unit I believe that since this is considered a warranty issue and I am the homeowner we are able to request the documents needed to be sure our unit is the propeer size The response that there are sides to every story may be teue, however when we have had several other professionals come into the home and tell us there is something wrong it needs to be addressed Neither of us are satisfied with the workI'm not sure where the company got that idea from
With good faith and intentions, we have built this customer a beautiful, quality, very complicated house and they decide to cancel days before the walk of the house. The upgrade money with is less than 3% of the value of this house will not be enough to offset the carrying cost of this
house. These funds are clearly explained as "non-refundable", for this very reason!
Below are some dates to put things into perspective:Original contract signed : 6/2015Decision to move to a different lot: 10/2015House started construction: 10/2015House walk date: 4/2016 Not sure what happened between the time the contract was signed and months to make the final decision on which lot to build on, but that was not our delay. We try to make sure that the dream home we are going to build is exactly what and where you want it. We have seen the pictures you have during construction and we can assure you that these items are typical during the construction process and have already been addressed as necessary.Again, we are sorry to respectfully deny the request for any refund. However, if you do decide to build with us in the future, we will gladly apply these funds to the purchase of your new Newleaf Home. This will be our final communication on this matter
We are sorry you do not agree but these are also the fact: We clearly have records as well of discussing this with you and let you know that all pricing coming from the builder are finalWe inform both you and and your Realtor prior to closing that if this was going to be a problem, you didn’t have to close on the houseYou at that time both agreed to the pricing and were ok with our final answer and you proceeded to closedWe've let you know in the best way possible that all prices are final. Honestly don't understand why are we now having to renegotiate the price of the house AFTER you have closed and best of all on the Revdex.com website?Newleaf is done responding to this dispute
