I am rejecting this response because I did not receive a definite response.  I was not downgraded until the 2 clients.  As for the not encouraging reviews, I disagree.  I have been two businesses recently that asked for yelp reviews and advertised with yelp. I also use square as my processor and they have an email I can send my customers encouraging yelp reviews.

This has been an ongoing issue and we requested tracking information to see why the checks have not been getting to the PO box. There's always tracking information or ways to get it. They simply refuse to give it to us. Why? 
These checks (multiple) were also supposed to be expedited to get here by week's end. Waiting another week for checks that should've been sent months ago is unacceptable. They didn't even mention or apologize for the poor customer service we have received. This is the worst company I have ever had the displeasure of doing business with.

[redacted], It is still incorrect. You are the second representative to "correct" the listing. This shows me the non existent ability of Yelp to maintain helpful information on business profiles. To my understanding it is public information but if it will harm or prevent business that we would get otherwise Yelp should be required to take it down. If I am looking for a business class Sharepoint system that I'm going to spend 500K+ on and I see this type of business on Yelp, I'm absolutely not going to use that company because obviously if they have to be on Yelp to be successful they aren't good at what they do. It sounds as though you are again asking that your business listing be removed, but as previously stated, we don't remove business listing information. Yelp is allowed to publish business names and publicly available information about businesses under the well-established fair use doctrine, as well as First Amendment principles. Generally speaking, this means that we can display business names and trademarks "for purposes of comparison, criticism, point of reference, or any other such purpose." See New Kids on the Block v. New America Pub., Inc., 971 F.2d 302, 306 (9th Cir. 1992).

To clarify, you signed up for an advertising program with $35 monthly fixed costs plus an ad click budget of $275, for a monthly maximum of $310. The monthly fixed costs were for your enhanced profile, which included features such as competitor ad removal and a photo slideshow. Your monthly cost per click budget cap was set at $275, which means you were only charged when someone clicked on your ad and you agreed to pay up to $275 a month for those ad clicks. If you did not reach your monthly budget cap, you would only be charged for the ad clicks you received. However, if you did reach your monthly budget cap, we no longer delivered ads for your business for the remainder of the month so that you wouldn't have to pay more than you agreed to.We also want to clarify that ad clicks and Customer Leads are separate entities of information.An ad click is when a person clicks on your business's Yelp ad. When a user is searching on Yelp for a business in a certain area, we do our best to provide that user with a Yelp Ad applicable to their search. Yelp Ads appear above the natural search results, as well as on your competitors' business pages. The Yelp Ad is differentiated from the natural search results by am orange border, and has the notation "Ad" in next to the business name. Clicking on your ad impression will take the user to your business page on Yelp, and you are being charged when someone clicks on your ad. You can view a breakdown the number of ad clicks you received by logging in to your Business Account at [redacted] and clicking on the "Yelp Ads" tab.Once a user is on your business page (regardless of whether they found it through an ad impression or through another means, such as our natural search results), additional actions they take while on your page may appear in the Customer Leads and Activity Feed sections of your Business Account. The tactics used by Yelp to harass and pressure busy business owners with multiple daily phone calls to trap them into accepting and falling victims for false advertising promises and claims is completely unacceptable. Yelp knows that business owners don't have the time to read all the small prints in a contract, and they rely on sales people to sell as many ads as possible, and in return make false promises and claims to get the business owner to agree on a trial contract. Yes, the sales girl did say there will be a fixed cost of $125, but promised that it should not exceed $200 if there was any clicks on the ads. But, when I find out that the clicks on the ads were costing almost $5 per click, that's when I decided to cancel the ads. Additionally, no video was produced and no enhancements were made to the ads. I also paid Yelp $525, the amount I was billed the first time. But, it seems that Yelp uses not only harassment tactics to trap business owners into false advertising contracts, but try their best to drain the financial resources of small business.    Sincerely,[redacted]

It's important to note that the software applies the same analysis to everyone, and that it affects both positive and negative reviews. Please also understand that the recommendation software is automated: we cannot manually override the software to recommend or not recommend a review. We assume you are referring to the reviews by [redacted] P and [redacted] S, as you've recently flagged these reviews. As you my recall from the messages you've received from the Yelp Support team, the reviews have been evaluated and left up, as they were not found to be in violation of our guidelines. You claim that these reviews are false; however, Yelp does not take sides in factual disputes. Rather, if a review appears to reflect the personal experience and opinions of the reviewer, it is our policy to allow the user to stand by his/her review.

Finally, you requested a refund. Our records indicate that you were signed up for a cost per click (CPC) advertising campaign from February 15, 2012 to February 19, 2012 and that you were signed up for an impressions-based advertising program from September 6, 2012 to October 31, 2013. When advertising, you are either electing to pay every time a user clicks on your ad impression (when doing a cost per click program), or you are paying for the delivery of a certain number of targeted ad impressions (when doing an impressions-based program). You claim that "yelp has charged us over 4200 dollars in advertisement fee which it did not deliver on any of the promises that were made," but advertising services were delivered in accordance with the terms you agreed to, so we will not be able to offer you a refund. can only stand by our previous statements. Yelp's recommendation software is an automated algorithm that attempts to weed out less reliable reviews while showcasing more reliable ones. This means that when reviews are posted to your listing, not all of them will make the cut. We acknowledge that even some legitimate reviews will not be recommended, but we still believe that the software as a whole makes our site more trustworthy and useful to consumers.
As indicated in our prior response, the recommendation software is automated to help avoid the potential for human bias inherent in individual decision-making: we cannot reverse the software's decisions, either to suppress an active review or to restore one that isn't recommended. But once again, the system is not static reviews may come and go as the recommendation software picks up new information.
While we understand your concerns, we want to make sure you are clear that federal law bars lawsuits against websites like Yelp for the decisions they make about which reviews to post or remove. Just CLOSE my business on your website and don't tell me you cannot because you can put me back in Close status, and in 6 months my business will disappear off your page. That is what one of YOUR managers told me, so just do it. The staff at Yelp does not know what they are doing because one moment my business shows as Closed, then when I go back to look a few days later, it's open again. This inconsistency shows you the level of incompetence your staff really has with the business, and I want nothing to do with Yelp because they are unprofessional and unethical. It is understood that Yelp as a business cannot distinguish between a false competitor or ex employee review. That is unfortunate and has caused lots of grief for hard working business owners. However, false information being posted on a business yelp page violates TOS and Content Guidelines. We have NEVER been contacted by Yelp regarding the "[redacted] G" review. [redacted] G makes multiple false statements regarding our Ventnor location while she writes her review referring to our Northfield location. A yelp user with an ax to grind has posted information that will ensure that we will lose revenue. Posting that a "Juice Bar" does not produce "Fresh Juice" when we do in fact produce "Fresh Juice" is not within the terms of service and is a violation. We are a Juice Bar. For a person to post that we do not produce fresh juice at our Ventnor store is absurd and is sure to hurt our bottom line. We create jobs and have employees who depend on us to feed their families. Why has this review not been removed or at the very least, moved to the appropriate page? We have a yelp page for our Northfield store which is a "grab and go" location. We are requesting your help in removing this review based on its multiple violations or at the least, moving it to the appropriate store. Our Ventnor store is a FULL SERVICE location an should not be represented as otherwise. We will lose business when people wrongly accuse of not producing the product we advertise. You yourself can see that we advertise "Fresh Juice" and we obviously have produced such based on the other reviews we have. Why can someone now go on and state that our Ventnor store does not produce fresh juice? Why did we even claim the Northfield business if Yelp is going to just allow anyone to post false and inappropriate information on our Ventnor store? I previously had a reviewer write a review for our Northfield store that ended up on our Ventnor Yelp page. Yelp agreed to remove this review because they admitted that the review was for the wrong store. This prompted us to claim the Northfield page. Additionally, per Yelps guidelines, reviews should be based off of a "personal experience". The reviewer herself, "[redacted] G" states that she is not reviewing the business based off of "personal experience". I urge Yelp to please review [redacted] G's review for the wrong store and to please either delete it due to the violations I listed above or to please at least move it to the appropriate store so that our mother store, Ventnor, is not harmed by this review which states false information. We have already received multiple phone calls asking us if we make juice on site due to the false information in this review. Please help us rectify this situation and bring it to a close.
