Over $1500 was lost to these crooks. They are nasty people. They are thieves!

SCAMMERS and Thieves
I have been a victim of fraud by a company claiming they are Wyndham Resorts.  I have attached a court summary of a lawsuit against the same people who also infringed upon Delta's marketing. Apparently this company has a long history of fraud.
https://consumerist.com/consumermediallc.files.wordpress.com/2017/04/amendedflet... />
I have copied the key wrongdoings set forth in the document which mimics what is being done to Wyndham. Overview of Defendants’ Wrongful Acts 1.This lawsuit presents a textbook case of intentional trademark infringement by a well organized and entrenched ring of intellectual property pirates. As part of a fraudulent scheme to sell “vacation packages,” Defendants have illegally and in bad faith misappropriated Delta’s protected name and marks, specifically the venerable DELTA, WIDGET LOGO, and SKYTEAM names/marks (collectively, the “Delta Marks”). 2.Specifically, Defendants have created, distributed, and are otherwise using and/or profiting from marketing facsimiles (“faxes”) that bear the Delta Marks and expressly purport to have been sent by Delta and/or with Delta’s approval and authorization. These fraudulentpromotional faxes, which falsely appear to have been sent on behalf of Delta, offer a variety ofpromotional vacation packages for sale by Defendants. 3.By trading upon the goodwill, fame, and credibility inherent in Delta’s name and the DELTA Mark, among others, Defendants attempt to lure responding recipients into purchasingexpensive vacation “packages” which, upon information and belief, are essentially worthless. 4.Every Defendant has both actual and constructive knowledge of the infringing, fraudulent, and illegal nature of the wrongful acts committed and carried out by themselves, by the other Defendants, and by other related third parties.Case 6:15-cv-02079-GAP-TBS Document 83 Filed 04/21/16 Page 2 of 30 PageID 5393 5.Delta has not authorized any Defendant to use – in any way – the Delta name or the DELTA Marks. Delta is in no way affiliated with any Defendant. Delta has not agreed to sponsor or participate in any manner in any promotion or giveaway by, through, or in relation to any Defendant. 6.Defendants’ illegal acts have caused and are causing irreparable harm to Delta. 7.Delta now brings this action to prevent the further misappropriation of its name, marks, and intellectual property by Defendants; to cause Defendants to cease and desist from furtherdefrauding the American public; and to recover damages arising from Defendants’ willful and bad-faith actions and other wrongful acts.   There are three key people who are scamming via a fax to public offices and their employees offering vacation packages at Wyndham. Carrie Spitalieri -e address at the same time as Carrie. My trip was canceled, they said it was over booked. I asked for a refund and was told NO. Because I wouldn't expect a trip elsewhere.
10 before I was to leave, I contacted them because they were supposed to contact me and didn't. That's when I was told I wasn't going to be able to go on the trip of my choice. I was told to choose another destination preferably México. I specifically told them México was out of the question and that I wanted a refund. I was told to call back in about 10 days when I did I was told no refund. They said I had over a year to choose another destination. I originally choose Jamaica. I was told I wasn't going to get my choice so choose something else. They said Jamaica was very popular and I wasn't going to get my choice. I'm a senior citizen I feel like a have been scammed. I've paid money for a trip and I don't have any say in this matter. I have repeatedly emailed and called asking for a refund. No one will contact me or email me back. I'm just getting over having COVID-19. If I can't go to Jamaica I want a refund, this was going to be my retirement trip. I think since I paid my money I should be able to go where I want it should be my choice. After telling me to choose another destination I was told I was going to incur more charges. I don't know why because my trip is paid in full envelope the airfare. We paid almost $1,200.

Desired Outcome

I would like a refund. COVID-19 is running rampant right now and getting worse. I've already been sick. I don't want to travel.

Wynpoints Resort Rentals Response • Jul 20, 2020

No refund will be issued as this is a non refundable transaction customer will also be placed on the problem customer list and will only be allowed to travel to select resorts thank you.

Customer Response • Jul 22, 2020

(The consumer indicated he/she DID NOT accept the response from the business.)
I was not treated fairly. I think they already knew that I wasn't
going to be able to go to Jamaica. The only reason I booked
this trip was to go to Jamaica. I asked for a later date and was told I wasn't going to get to because it was a very popular destination. This is bad business false advertising their flyer clearly stated their destinations and Jamaica was one of them. Since they're not keeping their end of our deal. They didn't even contact me to tell me the trip was overbooked 15 days prior to my trip. My bags were packed, I called because I had not heard from them. Only to be told my trip was more or less canceled. I was done wrong and left with no choice, therefore I want a refund. Why wasn't I contacted when the overbooking occurred? They wasted no time taking my money for a trip they knew I wasn't going to get. Since I can't have what I paid for please I want my money back! You guys still haven't contacted me to try to resolve anything! Very Bad Business!

I no longer want to do business with this company. The way I was treated is totally wrong!

The stay was very nice and very accomadating. Many resorts to choose from. Our family enjoyed our stay.

They have my money but I have not received my plane tickets or reservation from the hotel.
I paid for a vacation. I can't get anyone to help me get what I purchased. 4 plane tickets and 5 days 4 nights at the Hilton Village in Hawaii. Or I want my money back.

Desired Outcome

My plane tickets and hotel reservation. Or my money back..

Wynpoints Resort Rentals Response • Jan 15, 2020

All over booking clauses are up front information. No refund will be issued thank you.

I was giving a flyer to go on this vacation from my job. They never sent me any info on the vacation I paid for.
I was supposed to go to Turks and Caicos on August 22, 2019. I've reached out to the vacation rental and they told me if the resort didn't call me they're probably over booked which I thought was very unprofessional and they offered me to go to Cancun if I pay $800 dollars extra.

Desired Outcome

All I want is my $697 dollars that I paid for my anniversary vacation. I've called them and tried to resolve this matter professionally and they weren't responsive to a refund

Hello,
All our terms and conditions are upfront information regarding over bookings and cancelled reservations. All customers are responsible for any upgrades, add on, resort fees or NQ fees that may be applied. No refund will be issued and at this time the customer my only travel to select resorts only.

I requested a refund the same day I purchased tickets. They also charged me twice. t's been well over 30 business days and have not gotten refunded.
On Nov. 8th I called a sales rep and purchased two tickets for an all inclusive trip along with a free bonus trip. My transaction ID is 10725632. The echeck amount was $396. The same day I called back and asked for a refund. They said they will process a refund and I got a confirmation in my email. I was told it would take up to 30 business days to get refunded.

On Nov. 13th the company took two checks from me. The first check is #19725632 and the second is #10725631. I did not authorize them to take the second check. I called and they said it was their mistake and that they were going to try to reach out expedite both of my refunds and cover my NSF charge of $30. They said to expedite it would be about 5-7 business days.

I then called a few days later to check if it was processed and they said their system was down until the following Wednesday. I then called back on Wednesday and they said they would check on it for me. I was put on hold for about 15 minutes and then they ended the call. I called again 6 times after and got sent to voicemail.

The company now still owes me $792 and it has been 7 1/2 weeks since they said they would refund me. I am very upset. I followed all of their instructions and still no refund. I had to request my bank for a loan so that I could get my account out of the negatives and am still trying to pay it back.

Desired Outcome

To be refunded both of my checks totalling to $792, like they said they would.

Customer purchased 2 vacations on our no refundable promotion. No refund will be issued and customer has 2 years to reschedule her vacation. At this time the customer can only travel to select resorts that will still accept her reservations.

Customer Response • Jan 15, 2020

(The consumer indicated he/she DID NOT accept the response from the business.)
In the contract I signed, it said I have up to 15 days for a full refund. I requested the refund, the SAME day I bought the ONE vacation. They said they were going to refund me and they still charged me for TWO vacations when I only asked for one. I need my refund.

Wynpoints Resort Rentals Response • Jan 20, 2020

Hello,
The contract also says all deposits are non refundable. This customer contract also says this was a deposit. Thank you and no refund will be issued.

My vacation package was never reserved and plane tickets were never received from company after money was paid to them. No refunds have been received.
I originally heard about this company through an invoice that was sent to my mom's job. She showed it to me and it seemed interesting and a great deal at the time. I was still suspicious so I went to there website and looked around at the deals. I called the number listed on the invoice. The representative was friendly and gave me what I thought were all the details I needed to know. Everything seemed legit at this time so I paid $407 for trip protection on 6/21/2018(deal credible for 2 years, no blackout dates, and guaranteed trip security). Some months passed before I was ready to book a vacation, which was for my HONEYMOON. My husband and I decided on Ocho Rios, Jamaica for our destination. I called to make the reservations and I was on hold for 30 minutes on 3/12/2019. I had sent a few emails prior to booking and can the same number again to make sure everything still matched. My emails were answered very slowly, but they were answered. At this point customer service was not as great as previous times. At this call I booked the reservation and flights and gratuities/booking fees. At this point I thought everything was a done deal and that the reservations were actually reserved with the resort and airline. I had all my receipts sent to my email. I was told that I would receive our plane tickets and a courtesy call from the resort to discuss details about my trip a month before it was set. The time finally came to receive the plane tickets and call on 6/28/2019 but.. NOTHING. I waited a few more days just in case it was delayed.. still nothing. I emailed and got the run-around about when I should receive everything and but no direct answers. I called several times and was constantly put on hold. I called at least 3 or 4 times out of the week and sent emails. Every time I was put on hold for at least an hour, the longest time being 2.5 hours. On these calls, the customer representative was very impatient and rude, never answering my questions directly. At this point, two weeks had passed and we still had received no tickets or a phone call. I finally took it upon myself to call the resort directly. I did this and came to find out that there was NO reservation booked at all in my name! I immediately called the travel company back with this information. An hour after waiting on hold, the representative came on. I told him the resort had no reservation booked for me. He finally did his job and checked just to realize they never reserved to vacation in the first place. He proceeded to tell me that "it was not my fault, but that it's not our fault (the company's) either". I was beyond heated! He went on to talk about their terms and conditions and how there was never a guarantee that I would get my vacation. He also stated that I was told this upfront but it was NEVER told to me or else I wouldn't have gave them my money!!I tried reserving the same resort again, but all there rooms were booked.I also tried switching the reservation to Mexico, but that was problematic and didn't work out so we canceled it. No resolution came to me getting my money back. I tried speaking with a manager over the phone, but it sounded like the same guy I talked to all the other times. I tried emailing someone in corporate, but they only sent me a copy of terms and conditions stating everything they told me in that last phone call when the bomb was dropped on me on 7/8/2019. And it appeared as if the terms were sent from a different website instead of the original I had known. Three months later and I still have received no money back. My intentions were to pursue a lawsuit, but with college, work, and being a newly wed I haven't had time to dedicate to it and I feel like nothing would come of it because of all of the information they threw in my face about terms and conditions. I at least wanted to write a review to help someone else and expose them. DO NOT trust this company!!

Desired Outcome

The company states the terms and conditions that were stated to me after this issue happened were upfront and told to me during one of my calls, but they actually weren't. Even though I did agree to listen to options on a different vacation package after I was not able to reserve a room with the original resort, I feel like I am owed a complete refund.

Wynpoints Resort Rentals Response • Oct 10, 2019

All company terms and conditions are upfront information. All customer have the option to cancel for a full refund if they do not approve for any reason.

Customer Response • Oct 10, 2019

(The consumer indicated he/she DID NOT accept the response from the business.)
This still does not address the fact that you all never even reached out to the resort to book my reservation in the first place. I had to literally call the resort myself to check the reservation. Isn't that your job as a travel agency actually contact the resort and book vacations? Where did my all my hard earned money go? Where is the money that was supposed to go towards plane tickets? Do you have no shame in not even offering a way for me to get MY MONEY back after you all dropped the ball?
This isn't right at all.

Wynpoints Resort Rentals Response • Sep 18, 2019

We hope you enjoy your vacation!

the company sold me a vacation package in March and do not fulfill the promises upon departure date
To whom it may concern:

This complaint is intended to seek justice. On or about March 12, 2013 I
reached out to the above said company to book a vacation for my family.
Initially I was told that it is a promotional rate and that I have to reserve a
spot by submitting a payment via PayPall. Payment in the amount of $396 was
authorized on March 12th, 2019. Then I was told to make a payment in full
within 48 hr and my husband authorized $1,344 in full via PayPall the next day.

The resort send me few documents via email to sign and initial. There were
clearly 2 page pdf contract with a choice of our destination and terms and
agreement, that I clearly read before signing. The original destination and
resort was Blue Bay Esmiralda, Cancun, Mexico for the party of three with
selected travel dates 8/13 to 8/18 purchasing additional night, as promotional
rate only included 4 night stand.

I was then told that closer to my traveling dates, about 30 days prior I will
receive final written confirmation and welcome package from the resort. Upon
patiently waiting and not receiving any promised information, I started to call
the company and this is where all of this threats started. I was connected to
three different representatives all on recorded lines, where I clearly learned
that it was a big scam. Not that they have not delivered the promises, also
last minute changed our destination blaming on the resort policies that they do
not want what the rated me "scandal customer", the resort wants $150.00 per
night in addition that we already paid in full back in March. I was very upset
and asked representative Joseph to connect me with his Manager. I was placed on
hold for 45 minutes, and upon returning to the line, he stated that they do not
want to speak to me anymore, that they need my spouse information and that they
will be talking to him only. My spouse is traveling for work and not able to
handle this issue. I warned the company that I will use social networking
resources as a blogger to spread the word out there about this company.

I've placed a dispute with PaylPall and started to received emails from the
company on several occasions requesting to withdraw the text of complaints,
also attaching me the proof of their won dispute cases and now giving me a
chance to resolve a final law suit holding against me in the amount of $25,000
for a bridge of the contract. The company is now willing to keep my originally
paid $1740 and settle a case for a 10% of damage that my truth as a customer
who has been scammed, negatively will impact on their overall reputation.

I am acting only to make sure that customers like myself would never be
involved with such business that false advertise, do not deliver promises and
proceeding further in legal matters to collect money that hard working people
earn. Please, advice what other actions I may take in order to proceed further.

Regards,

Isabella

I have purchased 2 tickets for travel to Miami, FL resort for total $594.00
Corporate travel pros keep sending a fax advertise paper to my job at *** showing that it comes from HR dept. so on 5/17/19, I called their office at 888-*** and spoke to James, who told me this was last day for promotion and that, I should buy tickets today to get promotion price of $148/person. So I Purchase 2 tickets for my boyfriend and I. James stated that, they do not take credit card, so I agreed to pay via zelle tru my bank *** on 5/17/19 for total $396.00. Then Rep James stated once I decided where I want to go, I can call later on to pay for resort fees of $99/person, which I did on 5/21 for 2 people total amount $198.00. Then he sent me a docusign document for me to sign via email(***@***.com, which I sign online and sent back. I do have copies on my phone if needed. Then agent James informed me 24hr prior to my travel dates which were friday July 5th, 2019, I would get a welcome phone call from the Miami resort Windham hotels. Reservation confirmation number (***). I never got such phone call, so I called the hotel on july 4th and they said they have no such reservation under my name and is not aware of corporate travel as well. I then proceed to call corporate travel, and customer rep told me he cannot help me, office closed, he is only taking new reservation, I should call next day, and finally when I explained to him, my trip is next day july 5th, and they have no hotel reservation for me, he said I can try email customer service and see if they answer. I did email customer service and explained situation, someone answered me very late in day and said they overbooked with the hotel and will try to find me something else. So around 730pm in the evening to say they going to try to book a different resort Wyndham Palm Aire in Pompano beach, fl. So I never got any final answer from them. Reluctantly, I travel on 7/5 and hope for the best because I had already paid for my nonrefundable airlines tickets. So when we landed, I tried calling corporate travel and got a rep who was very rude, telling me this is America and I should have read fine prints that said, hotel sometimes overbooked. Rep could not understand why I was upset, he kept telling me he is going to find me another resort which was 2hrs away from where I had made plans to be with friends and family. So prior to finalizing new resort reservation while sitting at the airport, very tired, cell phone keep dying, and moving around with luggage trying to find charging outlets, this rep wanted me to say to him on the phone that, I was satisfied with the service. I said how can I say to you on the phone-- which was probably being recorded, that I was satisfied with the new resort when I did not even get there to see it or even look at it online. I had never heard of this resort before. So I even put my boyfriend on the phone, and rep kept telling both of us same thing, that it was policy of his company and he would not make reservation if I did not say I was satisfied. I had no confirmation, no receipt and had no way that, when I get there they would not say the same thing to me like the first reservation. So Rep told us, it was we said we were satisfied with service or he would give us our full money back. So I agreed to get my money back. So I had to pay out of my pocket again to pay for new hotel reservation which was not easy since it was the holiday weekend. So while on vacation, I tried calling my bank to see if they could help me get refund from them, bank stated because transaction was done via zelle, they could not help me. I had to file complaint with company itself. Upon return home, I called company one last time, after what seems like hrs of fighting on phone with James again, he told me that, he has to put complaint to his company to see if they would approve it and I should get a check via mail within 15days, to this day I never got anything in mail.

Desired Outcome

I want a full refund for full amount of $594.00 dollars credited to my account via ***, I do not want a fake check from them either. This company need to be held liable for what they are doing to people as I have read other complaints for same. People work hard for their money. I have made my work aware to cancel their incoming fax as it is all fraud. Please help.

Customer Response • Sep 09, 2019

Yes, this agency deserved less than a star, because they have stolen my hard earned money as well. My husband and I had booked a vacation to miami resort since may 2019 for travel dates in july 5th 2019. We booked our vacation with James who later on turn out to be quite rude and talking to us like we are illiterate by telling us that, the small prints do say that resort can overbooked. Day before our trip we never got a call welcoming us to resort per James, so we were scheduled to travel the next day. So, when tried to reach someone, I call not get anyone, customer service via email only--and they rep tried to tell me they overbooked and will try to get me another resort. I never heard from them until I flew on july 5th to miami, and had to call them from the airport after we landed quite exhausted. This james character kept telling me that, he was the one on the phone with me the day before trying to find me another resort. Even though, I told him I only emailed with someone as no one was picking up phone, he kept insisting that we did speak on the phone, guess one of us has dementia, and I am sure it was not me. James was quite rude, did not apologize for their mistake, and had the nerve to ask my husband and I to agree on the phone that, we were satisfied
with the pretend resort he was about to book for us, without having seen it. So when we refused to do that, he rudely told us then we forfeit our package and we will get reimbursed. So of course, we told him that, we wanted to get our money back. So we had to pay our own money to book another hotel stay, by calling around all over the place during a holiday weekend. This company deserved to be shut down, I have already acquired a lawyer to pursue the matter, I have placed a complaint with Revdex.com, and many more. I am a well educated healthcare professional, as well as my husband. From reading all these reviews, this is not the first time this agency has done that, so they need to stop so others do not fall prey for what they are doing. As of today, we still did not get any refund. By any means necessary, we want our money back. My name is NERLA, and I do want you people to know who you are dealing with. My lawyer will be in touch.

We hope you enjoy your vacation!

I purchased a vacation plan, paid additional for an upgrade, and arrived to no reservation - property had been sold.
I was told I could use it at a different time. I asked for a refund but was told there are no refunds given.
I called a couple weeks prior to my trip and was told nothing about vouchers etc.
I have been going back and forth about a refund or at least a partial refund for the upgrade (since the property has been sold) I continue to be given the extra small print that there are no refunds issues.
I have also been told I can sell it, but who wants to sell a vacation package where I go the shaft as well?

Desired Outcome

I would at least like the $400 I paid for the upgrade since the property has been sold. However, I really would like a full refund since I can't even access the web page to find a new destination etc.

(The consumer indicated he/she DID NOT accept the response from the business.)
I do not accept the response from the business because, I was guaranteed that I would have two rooms available for my nieces wedding August 3rd through 10th. When it was time to confirm my reservation, I was told by the hotel that there was no reservation in my name for that time frame. At that point the vendor tried to tell me that my reservation was on a stand by basis. Who would book a room foe a particular event, only to be told that its on a stand by basis and that I can use my voucher at another location. I Do NOT want to go to another location, and if they could not honor my request as guaranteed then they should in good faith refund me my money. I had to find alternative means for my nieces wedding due to their negligence and dishonesty. They should not be allowed to get away with such dishonesty. The Revdex.com should not allow them to continue to dupe honest, hard working people. They are fraudulent.

The guy said he will send s email that night with verification about the trip but we never received anything. We been trying to call the for the last few days and they keep giving us the run around and having on hold until they close telling us to email them. Long story short we eended up finally talking to them. They told us that itllthe vacation was over booked and we wanted able to go to jaimiaca. We was in shock due to the fact our trip is aug 1-5

Desired Outcome

I just want me and my sister money back because we have spent a lot and this place to be shut damn so kno one else would get scammed.

Hello,
Our over Booking/Cancelled reservation clause is upfront information. We did everything to assist this customer and even offered the customer a refund request after she was no longer eligible for a refund request. We explain this process could take 15 days to be review and approved. This customer continued to act unprofessional speak down to our reps and make countless threats. We will no longer assist any customer who refuses to allow us to assist them. This customer has 2 years to use the package under the terms and conditions of the purchase. At this time the customer has been listed as a problem customer and is only eligible to travel to select resort only.

(The consumer indicated he/she DID NOT accept the response from the business.)
That is a lie me and my sister was really nice about it until we got a rep that kept giving us the run around and being rude and trying to change are suppose to be vacation to a whole another location. Then every time we tried to give them a chance it was something like " you can't go here because it's late notice". How isnanything late notice when we paid for everything in ADVANCE so if that was the case what did this so called company use our MONEY for?? You guys tried to change our vacation date to a whole another time and location . We have job we did this in advance for a reason we can't just go whenever. They are making it seem like they are a corporation but I highly think they are they are not professional they had no sympathy for canceling our whole trip and trying to make it seem like it was our fault when countless times when called and they kept delaying are calls and giving us a run around.

No refund will be issued at this time. The customer has 2 years to use the package under the terms and conditions of the purchase no exceptions. Customer may only travel to select resorts only.

services contracted and paid in advance are NOT deliverable and no reasonable resolution is available and company refuses to elevate to management-
It is interesting how responsive you are when I am requesting a refund on services not delivered, nor can they be apparently be delivered -

I will escalate my concerns and request for refund on services undeliverable and marketed inappropriately.

Again, I am requesting a response from management, which I have been continually denied. I expect to receive the airline refund as indicated on or about 7/23 to my home address via certified check.

There are more issues with your services and company than the overbooking issues -
As has been explained on the phone w/James and in several attempted e-mails -

Please proceed with refunds for airfare - $599 paid w/Zelle 6/11 and confirmed by James to be refunded
Refund of transfer fees $158 also paid w/Zelle 6/11 that are not being used as airfare was canceled and no transfers necessary
And canceled and non-rescheduable (due to your limitations and lack of prompt response prior to 15 days) resort fee of $468

TOTAL to be refunded $1,253

Once again - I have attempted to contact you directly and I have been placed on hold for extended periods of time, told you were closed for system/computer updates, etc.

As indicated in previous e***s w/out resolution - I expressed that I was legally married separated for over 2 years and pending divorce - that is what I told you and what I expressed to Resort - I replied honestly - you must have indicated something different and thus putting me , again at risk for losing my travel arrangements - I

acceptance of responsibility for inaccurately represented products and services, resulting in my inability to utilize contracted services, even after many many attempts to work with company and attempt resolution through several options, ALL of which required compromise on my part without assistance from Company. Company has refused to respond timely, until recently when I requested a full refund - AND company has continually refused to expedite to management level

Wynpoints Resort Rentals Response • Jun 28, 2019

Hello,
This customer has only paid for 5 days and 4 night and requesting to check in on the Aug 28th. This would put the check out date at Sep 1st as we have submitted the vacation for. Our company has done everything to assist this customer with the reservation request. This customer reservation has been cancelled at this time due to breach of contract. This customer is no longer eligible to travel to the resort of choice as they do not accept problem customers per the contract. At this time the customer must re book the vacation and can only travel to select resorts that will still expect the reservation thank you.

Customer Response • Jun 30, 2019

(The consumer indicated he/she DID NOT accept the response from the business.)
They are not being honest nor are they telling the truth. The dates they assigned to me was not the dates I l chose. Also I never had solid reservation or a destination. I contacted them on numerous times without any success. Once I contacted Revdex.com, then I got a response from them. The memo that they sent out clearly stated $148 per person including tax with no hidden fees. I have a party of 3 and I paid a total of $993.00. I received a text from them on Friday June 28,2019 stating that I breached my contract by contacting Revdex.com. They are the ones who breached the contract by altering my signature in different areas of the contact. They also stated that Revdex.com can not make them do anything, that they are not accredited with you all or care to keep you all happy in anyway. Thanks and look forward to hearing from Revdex.com again.

Wynpoints Resort Rentals Response • Jul 01, 2019
