In her complaint, Ms*** alleges that she has had equipment complications, and that Vivint has attempted to troubleshoot with no resolution Ms*** further alleges she is being charged for a system that she claims has not been fully operating for the past months Ms*** desires a termination of the Agreement without early termination fees Vivint’s records indicate that Ms*** had notified Vivint of this concern and that Vivint sent a Field Service Professional for a visit a visit on November 06, who resolved the issueMs*** placed a call on December 02, with camera complications but was not home at the time to properly troubleshoot and stated she would call backRecords reflect that Vivint was not made aware of any further camera issues until April 08, when Ms*** called in once moreA second Field Service Professional was dispatched and resolved the issue on April 10, 2015. the information provided by Ms*** and appreciate the opportunity to respond. In her complaint, Ms*** alleges that she has had complications with the automatic draft of her payments to Vivint, and that Vivint has sometimes waited three (3) or more months to take a payment Ms*** alleges that she has not had good experiences when speaking with Vivint’s customer service representatives, and she desires cancellation of her agreement without penalty Vivint’s records indicate that a representative has recently contacted Ms*** in an effort to resolve her concerns In an effort to avoid further complications with Ms***’s bank account, Vivint has removed her from automatic payments Ms*** will receive an invoice in the mail each month, and may make monthly payments at her convenience To further assist Ms***, Vivint has applied a two (2) month credit to her billing account.Ms*** signed a Purchase and Services Agreement and also participated in a telephonic Pre-Installation Survey upon installation of her Vivint system, in which she represented that she understood and agreed to the initial term of forty-two (42) months She also represented that she would pay a monthly monitoring fee of $*** each month, plus applicable taxes, during that term Cancellation of the Agreement without penalty is not warranted at this time.If you have further questions or concerns regarding this response, please respond to either our mailing address: North West, Provo, Utah 84604, or fax number: *** *** attention Department - LegalSincerely, *** ***

I am rejecting this response because: In the response from Vivint they mention I will be receiving a check in the mail for $in 7-business days However, I also had to pay $in addition to the $ I need to be reimbursed for the total amount The contract was voided because of complete incompetence and follow through on behalf of Vivint In addition, I have recently been in contact with Vivint's home repair/claims They have started the process, but I have yet to know what they will coverThe contract was voided as a fault of Vivint not mine They will need to make sure all repairs are paid for and completed There are several large holes in my doors, wall, and a missing doorbell I will need full compensation and my house will need to be returned to original pre-install conditions Even if Vivint has to paint my kitchen to match after large hole is repaired and possibly replace both damaged doors

I have reviewed the response made by the business in reference to complaint ID ***, and find that this resolution is satisfactory to meA more satisfactory resolution would have been a refund to my brotherAlthough the company discontinued the account, the predatory door to door peddler cost my brother over $which he could ill affordHe is cognitively impaired, and lives at poverty level independently only through the beneficence of family members Josh M***, the door to door peddler, should have recognized this in talking with my brother, who is easily influencedThe letter I wrote to the company in May received no response, making it necessary to file a complaint. This company may offer a valuable product - but anyone who would invest in a home security system from a door to door peddler is making a huge mistakeSales pressure should never be a part of this financial investmentI would give this company an F for the peddling of its product and initial non-responsiveness to my complaint I attached a copy of the contract,and you will see that the number of months he supposedly committed to is in very tiny print hidden in the middle If one wants a home security system, one should look at all options, read reviews then call the company of choice.

Revdex.com:After receiving a call from Vivint on Wednesday, February 1,2017 at 6:pm from (801) 229-7818 we never discussed a final outcome of moving forwardThe woman discussed about all the problems that I encountered with their service and were willing to cancel my service at no costI stated to the woman that I was driving and we briefly talked about cancelling my service and to schedule a date for equipment pick upI also stated that I have questions about repairs and replacing items that were removed for installation. We agreed that she would call the following day Thursday, February 2,2017 around 11:am so we could resume our conversation in reference to removing and replacing as well to a set a date upon agreementThat said I am still waiting on the follow up call from Vivint

Just to end up the contract without any type of penalties or charges

I am rejecting this response because:The contract was NOT clearly explained to me as you previously claimYou were not sitting at my kitchen table when the representative over promised and under deliveredI was verbally told by the salesman that if we no longer owned the residence that we would not be subjected to the terms of this contractHe reassured that Viviant "deals with that all the time" and was very easy to work withIt is becoming painfully obvious that this is not the case. Furthermore, do you record you calls? If so, I would strongly encourage you to review the call on April 28thWhen I called in to cancel the contract I was informed that the sales representative gave me incorrect information and I was not able to cancel itI clearly stated that I sold the home and was moving outThey gave me the options of deferment, installing it in a new residence or finding someone to take over the accountNot ONE (of the three people I spoke with) told me that I needed to have the equipment removed from the house or incure a fee to have new equipment installed in another homeThe first I am hearing of this is through your response to my complaintYour technical department actually instructed me on how to disable it so it wouldn't workWhy did no one mention that I needed to take the equipment? As I stated many times, I no longer own this home and dont have access to itThis is just another example of what a dishonest company Vivint isTrying to squeeze extra fees and surcharges out wherever you can. The people that purchased my home said that you offered them a rate that was much higher than the $*** you are citingThey also complained of the horrible customer service they experienced while attempting to do the transferThe were experiencing exactly what I have been going through the past three months dealing with VivintI can't be held responsible for your poor customer service, long hold times and inconsistency of information. We also found out during the inspection that our fire alarm was not working properly due to the "sensors" your technician installAbout an hour after the system was installed it started loudly beeping telling me the fire alarm was not communicating correctlyI called the technician who said he was too far away to come back and would send someone elseAnother man arrived and "fixed" the fire alarm within about two minutesA few weeks later I receieved our letter from Vivint confirming the installation of our features we noticed that the fire alarm was not checkedI promptly called in and expressed my concerns that it had been disabledI explained that prior to the installation our smoke detector was very sensitive, however once your system was installed it would not go offWe even attempted to make it go off several times and it wouldn'tI wanted someone to take a look at it because I believed it was installed incorrectly and I was concerned about the safety of my homeShe said that they could sent a technician out but I would be charged for thatWhen I questioned why I would be charged when you installed it incorrectly causing a major safety concernShe said that was the policy and would not budge on the fee for the technicianPlease check your records, you'll find evidence of my multiple calls in concerning this as well. Based on your poor customer service, faulty equipment and overall dishonest sales tactics I am willing to offer you $1,to dissolve this contract immediatelyI feel this is more than generous offer and I just want to put this issue to restIf not I will continue to fight thisYour company has made so many errors that I don't think it will be difficult to prove your incompetency as a home security company.

I am rejecting this response because:The appliance adapter that does not work was never tested only the alarm system itselfHad I known before hand the contract was months I would have never agreed to itEven trying to remove the appliance adapter that doesn't get used because it doesn't work is a fee and a waste of money monthlyYour records should indicate that it has never been in useBeing a busy person I am away from home often and don't have time to sit home all day waiting on someone to come byI can send the device back to you guys and you can remove the charge from my account without the fee that I was lied to aboutThe only useful thing about this whole system is being able to adjust my temp while awayDropping a monthly charge by $is unacceptable and a slap in the face and still does not resolve my issue

To Whom it may concern,I have read and acknowledged Vivint INC. responseVivint did sent out a Technician to resolve the problem on October 30th, Which we hope to be resolvedDue our prior experience with Vivint we would like to give Vivint a day trial to see if they product is truly working properlyIf we will have any further issues within days, we will take Vivint suggestion and cancel the Agreement without any penaltyAnd Vivint can come and remove they equipment from our home.
