Vivint Account #: [redacted] Date of Agreement: October 20, 2016 To Whom It May Concern: I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, she explains that she was unaware of Vivint’s 3 day Right of Rescission (“ROR”) period. Therefore, she has attempted to cancel after her ROR period ended; however, she has been unable to cancel her account. Ms. [redacted] requests immediate cancellation of her account. At this time and although not warranted, Vivint has agreed to cancel Ms. [redacted]’s account without penalty. Vivint’s records indicate that prior to the installation of any equipment, Ms. [redacted] completed a telephonic Pre-Installation Survey with Vivint’s Account Creation department. Every customer must complete this Pre-Installation Survey, and if a customer does not pass the survey, Vivint will not enter into an agreement with the customer and will not install any equipment in the customer’s home. The purpose of the survey is to verify certain information, ensure that the customer understands Vivint’s offer, and confirm the terms and conditions of the Agreement. Our records show that Ms. [redacted] completed the required Pre-Installation Survey on October 20, 2016. During the recorded Pre-Installation Survey, Ms. [redacted] represented that she understood and agreed to the initial term of forty-two (42) months. She also represented that she would pay a monthly monitoring fee of $60.99 each month during that term. Further, Ms. [redacted] represented that these terms were clearly outlined on the Agreement and that Vivint’s representative did not make any promises or commitments which were not written on the Agreement. Vivint relied on Mr. Ms. [redacted]’s representations to ensure that she understood her commitments to Vivint as outlined in the Agreement. Despite the information mentioned, Ms. [redacted] has no further obligation to Vivint. Concern: I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In Mr. [redacted]’s complaint he explains that he is divorcing his spouse and as part of the settlement Mr. [redacted]’s spouse will take over the Vivint account, but the account is still in Mr. [redacted]’s name. Mr. [redacted] requests that the account be changed to his spouses name and a refund of all payments after October 2015. A representative from Vivint has recently attempted to contact Mr. [redacted] via email in an effort to resolve his concerns. Vivint’s does not have any records of name changing documentation. In order for Vivint to change the name listed on the account Vivint requires a name addendum signed by each person and a signed name removal form. Once Vivint receives the legal documentation the name on the account can be changed. A refund of all the payments from October 2015 is not warranted. Because, all the payments are outlined in the contract. If Mr. [redacted] has any questions or concerns he can contact the representative who reached out to him directly. Ms. [redacted]’s desired resolution is cancelation of the contract. A representative from Vivint has recently attempted to contact Ms. [redacted] via email in an effort to resolve her concerns. In an effort to help Ms. [redacted] and to resolve this issue. Vivint can cancel the account without any additional charges, if Ms. [redacted] will allow a Vivint technician to come to her home to remove the equipment. In her complaint, Ms. [redacted] explains that she does not recall extending the term of her agreement over the phone with Vivint, and that now she is unable to cancel her agreement. Ms. [redacted] desires cancellation of her agreement without penalty. At this time, Vivint has agreed to cancel Ms. [redacted]’s account without penalty. However, Vivint spoke with Ms. [redacted] regarding her alarm service on December 12, 2016. Ms. [redacted] represented that she was satisfied with Vivint’s services and that she was interested in extending the term of her agreement. In her complaint, Ms. [redacted] alleges that she was not advised of all the fees upon installation of her system, and that she had equipment complications and was charged a fee to have a service visit. Ms. [redacted] is now in collections, and desires cancellation of her agreement without penalty.Vivint’s records show that prior to the installation of any equipment, Ms. [redacted] completed a telephonic Pre-Installation Survey with Vivint’s Account Creation department. Every customer must complete this Pre-Installation Survey, and if a customer does not pass the survey, Vivint will not enter into an agreement with the customer and will not install any equipment in the customer’s home. The purpose of the survey is to verify certain information, ensure that the customer understands Vivint’s offer, and confirm the terms and conditions of the Agreement. Our records show that Ms. [redacted] completed the required Pre-Installation Survey on May 15, 2013. During the recorded Pre-Installation Survey, Ms. [redacted] represented that she understood and agreed to a monthly monitoring fee of $[redacted] each month during the term of her agreement, and a one-time activation fee of $99.00. Further, Ms. [redacted] represented that these terms were clearly outlined on the Agreement and that Vivint’s representative did not make any promises or commitments which were not written on the Agreement. Vivint relied on Ms. [redacted]’s representations to ensure that she understood her commitments to Vivint as outlined in the Agreement. Vivint’s records further show that Ms. [redacted] notified Vivint of equipment complications, and Vivint dispatched a Field Service Professional to her home on January 15, 2014. Vivint has not been notified of any further equipment concerns since that time.Ms. [redacted] stopped making her monthly payments after July 2014. As such, the account was cancelled due to non-payment on December 30, 2014, and was transferred to an outside collections agency. In an effort to assist Ms. [redacted], Vivint is willing to offer her a reduction by 40% of either her reinstatement fee, or the settlement fee to cancel her account. Should Ms. [redacted] wish to reinstate her service, she may pay $[redacted] rather than the $[redacted] owed. Upon reinstatement, Vivint would also be willing to send a Field Service Professional to the home at no cost to Ms. [redacted], to ensure that the equipment functions properly. Should Ms. [redacted] wish to settle and cancel her account with Vivint, she may pay $[redacted] rather than the $[redacted] owed. In the document which Ms. [redacted] provides, it states that her finished contract date is October of 2018; however, Ms. [redacted] previously received an email from a representative at Vivint which states that her contract ends in April of 2019.
