This process provides customers with multiple opportunities to review the details of their order. Once customers select the tickets they are interested in for a production of "Tool," they continue to the Login page which displays a detailed order summary on the right side. After the customer enters an email address to create an account, they then navigate to the Checkout page, which features an even more in-depth order summary that displays the number and prices of their tickets, delivery and service fees, and the total charge of $2,060.08 highlighted in bold text. At this point, our customers are presented with the message “I agree to the Vivid Seats terms and conditions,” and a check box that must be selected in order to continue with checkout. Our sales policies, including our “all sales are final” policy, are disclosed throughout the purchase process and displayed at checkout with the message “All sales are final. All prices are listed in US Dollars (USD).” Directly above the Place Order button, our customer’s order total was reiterated with the bold statement: “By clicking ‘Place Order,’ your credit card will be charged $2,060.08.” Our customer then proceeded to select Place Order at which time their order was submitted.As a secondary marketplace, Vivid Seats is not affiliated with any artist or venue and does not generate tickets as a primary box office; rather, we act as an intermediary between fans and ticket holders. The prices of tickets on our site are set by the individual ticket sellers, not Vivid Seats, in accordance with their assessments of a range of market factors such as customer demand. This fact is stated at the top of every ticket listing page clarifying, “Prices set by sellers, may be over face-value.” Because our customers are purchasing tickets owned and listed by individual resellers, we must ensure that our policies are fair to both parties. This means that we are unable to offer refunds and must adhere to an “all sales are final” policy—a standard throughout the industry.Prior to receiving this claim we have thoroughly discussed this matter with our customer. Vivid Seats facilitates thousands of successful transactions each day with satisfied customers who are fully aware of their checkout total. We regret Ms. [redacted]'s frustration but we are confident in the transparency and fairness of our checkout process.
When a customer selects tickets to purchase on our site, there is a drop down menu next to the ticket price where customers can select the quantity of tickets for the desired event. Once the customer has selected tickets, our checkout process provides multiple opportunities to review the details of an order, including a Login page displaying a detailed order summary. Once the customer enters an email address to create an account, s/he is then taken to the Checkout page, which features an even more in-depth order summary that displays the individual ticket costs, individual delivery and service fees, and the total charge in red lettering. This summary is provided prior to placing the order.
As a secondary marketplace, Vivid Seats is not directly affiliated with any artist or venue and does not generate tickets as a primary box office; rather, we act as an intermediary between fans and ticket holders. The prices of tickets on our site are set by the individual ticket sellers, not Vivid Seats, in accordance with their assessments of changing market factors such as customer demand. This means that ticket prices can fluctuate at any time, and as a result, sellers are notified as soon as an order is placed. This practice is clearly disclosed throughout our website and the order process. In addition, the fact that customers are purchasing tickets listed by individual resellers, we must ensure our policies are fair to both parties. This means that we are unable to offer refunds and must enforce an "all sales are final" policya standard throughout the industry.
This policy is described in detail in our Sales Terms and Conditions (www.vividseats.com/terms.html) and during checkout, where the following message is displayed directly above a box that customers must check to authorize the purchase: "To complete your order, you must agree to the Vivid Seats sales terms and conditions and confirm that you are aware that you may be paying above face value for your tickets. All prices in US Dollars. All sales are final." These messages would have been clearly visible to Ms. [redacted] before she submitted any payment information and finalized her order.
Since customer satisfaction is the most important to us, Vivid Seats has reached out to Ms. [redacted] and both parties have found an amicable resolution. We consider this matter resolved. Thank you for your response; I am satisfied with my refund. However, for the record, Vivid Seats' description of the check out process is not accurate particularly if you go through [redacted]. I have the screen shots to prove it.
First of all, yes, there is a drop-down box to select a number of tickets...but there are SEVERAL drop-down boxes listed vertically with a quantity listed and a price next to it. No where does it say "per unit" or "per ticket" so your average person would assume the cost is for the total number of tickets listed.
Secondly, if you go through [redacted] rather than just using a credit card, the [redacted] screens do not show you a sub-total until the very last screen, where it's in small black print just above the submit button. Only after submitting do you see the sub total in obvious larger red letters. I would strongly encourage Vivid Seats to contact Pay Pal and have them change how the buying information is presented on their screens.
Based on these two notations alone, it is VERY easy for a buyer to think he or she is purchasing tickets at one price, only to find out after the fact that it is a very different price. I would strongly encourage Vivid Seats to put the words "per ticket" next to those drop-down boxes to be clear about what you are selling and at what price. As I stated in my complaint, the venue was selling tickets for $30/ticket. Vivid Seats had one quantity option (among many) where it said the following:
3 tickets $182
If the venue is selling them at $30, it is natural to assume that Vivid Seats is selling 3 tickets for $182, making them about $60/ticket, or double the price. This would be pricey, but something I could afford. Instead, Vivid Seats was actually selling the tickets at SIX times the price, and it was NOT clear anywhere in the buying process until the very end. It should be up front and obvious what the sub-total is, otherwise it comes across as deceptive.
Again, I am satisfied with my refund, though it would have been nice to have this refund after the phone call I made to Vivid Seats 30 seconds after I realized just how much those tickets were, but instead was told by Vivid Seats that my only option was to re-sell on their website.

These terms, which are clearly visible on our website, state: "Vivid Seats agrees to use its best efforts to procure and to deliver, prior to the date of the event, the tickets described. Vivid Seats also reserves the right to replace tickets with comparable or upgraded tickets if originally ordered tickets are no longer available. Definitions of 'comparable' and 'upgraded' are made at the reasonable discretion of Vivid Seats." This upgrade policy is reiterated in our 100% Buyer Guarantee and FAQ page.Vivid Seats is not directly affiliated with any artist or venue; as a secondary marketplace, we act as an intermediary between fans and a vast network of ticket resellers. This means that tickets purchased on our site are subject to change and not guaranteed to be part of a specific section, and Vivid Seats is not made aware of such arrangements ahead of time. The change that was ultimately applied to Ms. Rimel’s order moved her from row 38 to row 16, which moved her closer to the action and was therefore considered to be an upgrade.In the scope of customer satisfaction, Vivid Seats has reached out to Ms. Rimel, and both parties have found an amicable resolution. We consider this matter resolved—and we hope that Ms. [redacted] will consider Vivid Seats for her future event ticket needs. When Mr. [redacted] selected the tickets he was interested in they clearly stated the price per ticket, not the total as Mr. [redacted] indicated. He continued to the Login page which displayed a detailed order summary on the right side. After Mr. [redacted] entered an email address to create an account, he then navigated to the Checkout page, which featured an even more in-depth order summary that displays the number and prices of his tickets, delivery and service fees, and the total charge of $574.44 highlighted in bold, red text. This information was displayed prior to Mr. [redacted] entering any payment information. At this point, Mr. [redacted] was also presented with the message “I agree to the Vivid Seats terms and conditions,” and a check box that needed to be selected in order to continue with checkout. Directly below this Mr. [redacted]’s order total was shown once again with the message, “By clicking ‘Place Order,’ your credit card will be charged $574.44.” Our sales policies, including our “all sales are final” policy, are disclosed throughout the purchase process and displayed at checkout with the message “All sales are final. Our network includes hundreds of professional ticket resellers who list their inventory on multiple websites and set their own prices according to their assessments of the market climate, which means the availability and prices of any tickets are subject to change at all times. Because of this, all orders are considered requests until confirmed by the seller.This process is explained in our Sales Terms (http://www.vividseats.com/terms.html): "If a buyer finds desirable tickets, buyer places an offer to purchase the tickets by placing an order. ... However, placing an order does not complete the sale. Rather, the order will be subject to acceptance ... by the respective seller. At that point, your credit or debit card ... will be charged and Vivid Seats' consumer protection measures take effect."  Once the seller confirms the order, the purchase is considered complete and protected by our 100% Buyer Guarantee.Mr. [redacted]' order was never confirmed by the seller. This happened because the requested tickets were no longer available and Mr. [redacted]' credit card was never charged. Vivid Seats is often able to help the buyer find comparable tickets to the same event and in the same price range, however, our agents were unable to find suitable tickets to fulfill his order. We informed Mr. [redacted] of these circumstances and offered to assist him in finding alternate tickets, which he declined. As a result, Mr. [redacted]' order was cancelled and we consider this matter closed. We encourage Mr. [redacted] to contact us for his ticket buying needs in the future.

This process provides customers with multiple opportunities to review the details of an order. When Ms. [redacted] viewed the tickets she was interested in, she was displayed with the event details, the ticket listing information, as well as a drop down box for her to adjust the quantity selected. Ms. [redacted] then selected the listing she was interested in and continued to the Login page which displayed a detailed order summary on the right side. Provided in this order summary was another opportunity for Ms. [redacted] to alter the amount of tickets selected. After the customer entered an email address to create an account, she then navigated to the Checkout page, which featured an even more in-depth order summary that displays the number and prices of their tickets, delivery and service fees, and the total charge of $2,414.70 highlighted in bold text prior to entering any payment information. This breakdown provided Ms. [redacted] with a final opportunity to adjust the quantity selected, at this time; the quantity selected was five, not one. Ms. [redacted] was then presented with the message “To complete your order, you must agree to the Vivid Seats sales terms and conditions and confirm that you are aware that you may be paying above face value for your tickets. All prices in US Dollars. All sales are final.” At this time, Ms. [redacted] was required to select a check box stating, “I agree to the Vivid Seats terms and conditions,” in order to continue with checkout. Our sales policies, including our “all sales are final” policy, are disclosed throughout the purchase process and displayed at checkout with the message “All sales are final. Customers purchasing tickets and fan sellers listing tickets are two completely separate transactions. Additionally, by purchasing tickets on our site you must agree to the Vivid Seats sales terms and conditions; when listing tickets on our site, fan sellers are required to agree to Seller terms and conditions. Ms. [redacted] was presented with these seller terms prior to listing her tickets. These terms clearly state, “Sellers typically receive payments issued to their registered Paypal accounts not more than fourteen (14) business days after delivery to buyer.” In terms of the service fees, the conditions also state, “Seller's proceeds are calculated based on the amount of the listing price set by Seller minus any fees charged by Vivid Seats.”As Ms. [redacted] agreed to the sales terms and conditions as well as the Seller terms and conditions, which include the delivery of tickets once a sale is confirmed, Vivid Seats has fully adhered to all terms and conditions which Ms. [redacted] agreed to. We have thoroughly addressed this matter with Ms. [redacted] prior to receiving this claim. He then placed his order and agreed to the sales terms presented to him. Because our customers are purchasing tickets owned and listed by individual resellers, we must ensure that our policies are fair to both parties. This means that we are unable to offer refunds and must adhere to an “all sales are final” policy—a standard throughout the industry. In relation to Mr. [redacted]’s request to resell his tickets, we encourage him to use the desktop version of our site when attempting to list tickets if he is having any trouble using the application for this purpose. However, it should be noted that Vivid Seats conducted a thorough investigation regarding this claim and concluded that Mr. [redacted]'s tickets were in fact authentic for admittance to his event. Additionally, we offered a one-time courtesy resolution in the interest of customer service. We are pleased to have reached an amicable resolution; at this time, we consider this matter resolved. These tickets were delivered to the email address on file for our customer to download, print, and bring to their event the following day. Our customer proceeded to download their valid tickets on 8/30/17 at 11:24 AM CST.As our customer received the exact tickets which were selected prior to their event, we have fully adhered to our sales terms and consider this matter closed. Although Ms. [redacted] continues to press forward with this matter, we are not able to offer refunds once a sale has been completed and must enforce the “all sales are final” policy which was explained clearly in bold text and agreed to by the customer prior to purchase. Our checkout process allows each customer several opportunities to view all details of an order, including the Estimated Ship Date, prior to purchase. In Ms. [redacted]’s case, the Estimated Ship Date of 11/14/2016 was stated. Due to the nature of our business as a secondary marketplace, Vivid Seats does not own or generate any tickets and therefore does not set or control delivery date. Rather, the Estimated Ship Date is set by the individual seller of the tickets and is dependent upon the primary issuer of the tickets, with which Vivid Seats has no affiliation. This information was clearly presented to Ms. [redacted] before she submitted her order. Ms. [redacted] placed her order on 10/7 at 8:06 AM Central Time. Immediately the order was confirmed at 8:06 AM Central Time with an email sent on 10/7 at 8:06 AM Central Time. Once an order is confirmed we are unable to offer refunds and must adhere to our “all sales are final” policy that was thoroughly discussed with Ms. [redacted]. Vivid Seats has sufficiently addressed Ms. [redacted]’s concerns in detail and have acted to resolve this matter to the best of our ability. Clint [redacted]   We have shown all the paper work to you showing this dispute you are stating has been resolved , This no longer the issue , We paid the $507.79 for these two tickets & viidseats resold these tickets after we paid , This is  the problem  VividSeats is giving us credit back to our Discover card AMOUT OF $ 478.80 Jun.22, 2017    We were billed $ 507.99 We would like to know why you decided not to refund all that you charged Discover Card and we paid ?  There is a Difference of $29.31  PLEASE EXPLAIN THIS TO US , WE WILL NOT CLOSE THIS COMPLAINT UNTIL YOU PAY WHAT YOU CHARGED AND WE PAID . VIVIDSEATS YOU HAVE MADE THIS INTO A NIGHTMARE FOR US BECAUSE YOU DECIDED TO TO DO THE WRONG , YOU HAVE MADE OUR 27 WEDDING ANNIVERSARY A MEMORY THAT SURE IS NOT A SPECIAL OCCASION  ,THANKS FOR THE MEOMORIES ,   VERY UNHAPPY WITH THIS MESS , PAY US THE $29.31 SO WE CAN CLOSE THIS BAD CHAPTER IN THIS MESS Clint & Bobbie [redacted]    You will never have to deal with us again & like wise for us , Your company VividSeats is nothing to us Except a bad Memory

I said "no", because that mean I'm completely satisfied and that's not true. I'm partially satisfied. They resolved the issued partially. The made a mistake and they only said "I'm sorry for the mistake" and refunded only the service fees.
I'm not completely satisfied, because they made the mistake and we paid the consequences.

Mr. [redacted] was also presented with the message “I agree to the Vivid Seats terms and conditions,” and a check box that needed to be selected in order to continue with checkout. Our sales policies, including our “all sales are final” policy, are disclosed throughout the purchase process and displayed at checkout with the message “All sales are final. All prices are listed in US Dollars (USD).” Prior to placing his order, Mr. [redacted]’s order total was reiterated in bold text directly above the place order button stating, “By clicking ‘Place Order,’ your credit card will be charged $526.91.” Mr. [redacted] then proceeded to place his order.As a secondary marketplace, Vivid Seats is not affiliated with any artist or venue and does not generate tickets as a primary box office; rather, we act as an intermediary between fans and ticket holders. This means that all listings on our site are priced by individual sellers. This also means that the majority of any ticket sold on our site goes directly to the seller. The service fees are in place, in part, to cover operation costs including maintaining a professional website, screening sellers’ listings to ensure authentic tickets, and sustaining an easily accessible customer service department. Due to the nature of our business, our customers are purchasing tickets owned and listed by individual resellers and we must ensure that our policies are fair to both parties. Still very unprofessional! I learned a valuable lesson about this company they sale second hand ticket and try to pass them off as real tickets. Still puzzled as to why the operator told me I shouldnt have mentioned I bought my tickets to will call and instead just printed them and tried them at the door and also no need to lie about this incident I bought tickets again once I was denied entry so my daughter wouldn't be disappointed.
