The service contract provides express coverages that are set forth in writing and further subject to the terms and conditions of the...
service contract, all of which are also set forth in writing. The service contract specifically identifies in writing the components that are covered under the service contract. The service contract, in that section entitled EXCLUSIONS (WHAT IS NOT COVERED BY THIS SERVICE CONTRACT) specifically states that components not listed in the coverage section are excluded from coverage. Pursuant to the terms and conditions of the service contract, the Complainant was provided thirty (30) days to review the terms and conditions of the service contract. If the Complainant was not satisfied, for any reason, the Complainant was entitled to cancel the service contract during the 30 day period and receive a full refund of all sums paid. No request to cancel the service contract was made. As the Complainant noted, on or about May 3, 2017 a claim was made for repairs to the covered vehicle's door actuator. The door actuator is not listed as a covered component and was thus properly excluded from coverage. The service contract remains in full force and effect, subject to its terms and conditions.
SunPath is a third party administrator of vehicle service contracts. As noted by the Complainant, SunPath does not engage in the sale of service contracts and does not ever solicit consumers directly. SunPath does not condone or permit any vendors of its products to engage in illegal conduct....

Coverage is at all times subject to additional terms and conditions set forth in the VSC in writing, among them exclusions for mechanical failures that arose prior to coverage becoming effective.On September 20, 2016, a claim for transmission replacement coverage was presented to SunPath. As of the date of the claim, coverage had been in effect for four days.In accordance with the terms and conditions of the VSC, an independent adjuster was dispatched to examine the covered vehicle and evaluate the mechanical breakdown and its cause. The adjuster submitted an extensive written and photographic report to SunPath, the findings of which were relayed to the complainants and their representative. The adjuster concluded that the failure was long term in nature and not sudden and had arisen prior to VSC coverage becoming effective. Accordingly, coverage was denied pursuant to the terns and conditions of the VSC, specifically the aforementioned exclusion. The denial of coverage was reasonable and made in good faith.

At that time, various warning lights (drive trail malfunction and chassis stabilization) were illuminated, the vehicle was emitting noise, sputtering at highway speed, and losing power. The vehicle was inspected by an independent adjuster and subjected to computer testing by [redacted] of [redacted]. It was determined that the vehicle's transfer case had failed, and required replacement. During the computer diagnostic process performed by [redacted] of [redacted], the vehicle's internal computers confirmed multiple failure codes to the transfer box (135) and transfer box fault clutch (255) had previously occurred. The first failure code for the transfer box occurred at 106,563 miles. The first failure code to the transfer box fault clutch occurred at 108,022 miles. The last failure codes occurred at the time of diagnosis. In a** case, the computer analysis clearly and unambiguously established that the failures existed prior to the purchase of the Contract. The Contract does not cover pre-existing conditions, and coverage was properly denied. SunPath has at all times acted in good faith, and in accordance with the terms and conditions of the Contract, none of which has been waived.

The repair facility diagnosed the cause of the rattling and requested replacement of the timing chain to address and correct this problem, which included diminished oil pressure. The timing chain is covered under the Agreement, and coverage in the amount of $1,039.61 was provided to pay for the timing chain replacement. The repairs to the timing chain did not correct the rattling noise or the diminished oil pressure. Additional repairs to replace the vehicle’s oil pump were thereafter requested. An independent inspector was dispatched to examine the vehicle and assist in determining the true cause of failure. The inspector examined the vehicle while the engine was running and confirmed the vehicle’s condition, and indications of long term oil leakage. Additional tear down of the vehicle revealed extensive damage due to lack of lubrication. An inspection report confirming “black baked-on oil sludge” and “varnish” and other conditions as the cause of failure is attached hereto As a result of the damage, the vehicle required engine replacement. The Agreement expressly excludes damage due to lack of lubrication, and additional coverage for the engine replacement was therefore denied. SunPath has at all times acted in good faith, and in accordance with the terms and conditions of the Agreement, none of which has been waived.
The terms and conditions of the Contract have not been amended or modified. In any case our office is strictly bound by the terms and conditions of the Contract and can not provide coverage for the Consumer's vehicle. The previously referenced refund will be issued as set forth in our office's prior response.

The fact that this company has defended and settled lawsuits regarding telemarketing violations indicates that their response is not truthful. It is possible that they have contracted with a telemarketer who is doing this but the previous lawsuits demonstrate that Carpath is aware of this practice and has not put a stop to it.

The agent ([redacted]) sold me a policy for that truck with a fifth wheel in it after our conversation about the fifth wheel camper and having a fifth wheel hitch. The truck was not towing the fifth wheel at the time of breakdown.I feel the agent and company should be held accountable in this instance. The agent sold me the policy knowing I had the fifth wheel on my truck,whether the policy did or did not cover it the agent and the company should be responsible for the transmission repair.
