Customers click to submit their order.
[redacted] submitted her order and agreed to the terms and
conditions. Please see attached. [redacted] received her first shipment of food on January 19,
2017. On February 9, 2017, [redacted]
requested a delay on her second shipment of food. On
April 8, 2017, [redacted] received an email to make any changes to her
order. She received an order
confirmation on April 11, 2017, followed by a shipment confirmation April 12,
2017.[redacted] contacted our customer call center on April 12,
2017, at 10:14 a.m., to cancel her auto-delivery program. Unfortunately, [redacted] shipment was
already in progress. Please see attached
FedEx log. [redacted] received her
second shipment of food on 4/13/2017. As noted on the attached and in accordance with our
cancellation and return policy, due to the perishable nature of our food, our
food is not returnable or refundable. We wish [redacted] continued success with her weight loss

I am rejecting this response because my payment had not been withdrawn from my account on 10/12 when I emailed in. Interestingly enough I emailed back on 10/17 after receiving confirmation the order shipped and my account was cancelled via email within hours for that 2nd correspondance. Why would the account be cancelled that time via email, and not the first time via email. If it is against the terms and services to cancel via email then why would it have been cancelled several days later with the same request? The confirmation number for that was [redacted]. I also did not have a saved payment method on file according to the website which gave me a false sense of comfort in knowing I would not be charged. I specifically looked this up on 10/11 when I emailed in. To me, this shows there was not a saved method to give authorization to charge.Nonetheless, I was charged and am disputing this. Had this been taken care of on 10/11 the shipment would not have even went out.

Two days a week are considered “practice” days, whereby customers practice the principles of the South Beach Diet and may try our easy recipes with additional servings of lean protein, healthy fats and non-starchy vegetables, or dine out following our guides. Customers receive four program weeks of meals each month, consisting of 20 breakfast items, 20 lunches, and 20 dinners. Sixty frozen meals will take up substantial freezer space. Shipments are done once every four weeks due to the costs involved in shipping frozen foods. Our company incurs all of the shipping costs at no expense to our customers. I am rejecting this response because the South Beach Diet company did not live up to their promise. They states that I would "Lose weight eating delicious, fully prepared meals you’ll
love. Feel nourished, healthy and satisfied."The items I received did not look like the items pictured on the website. They were not edible. Also, since my initial complaint, I received an email from South Beach diet about the second delivery I was forced to make. The email stated that I had to make selection changes to my second shipment because the food items I chose were "low inventory." There are very few items to choose from in the first place an now I could not get the ones I could actually eat, but still I had to pay $199. I have cancelled the program, but I don't think it is fair that I am made to pay for the items that I could not eat or ones that were offered to me and then changed. I would like reimbursement for the cost of the food.Thank you

Once again they are NOT showing my actual order but a generic cut and paste from their web site. This is exactly the misinformation that this company is about. They are trying to redirect your attention away from the actual dispute which is the cancellation fee.

US). With the auto-delivery program, customers are automatically
charged and shipped their South Beach Diet plan once every four weeks unless
they cancel. If a customer cancels prior
to accepting their second consecutive order, customers authorize us to charge
their debit card or credit card on file a $125 chargeback fee. This fee is a portion of the discount
received on their first shipment. All calls are recorded for quality assurance and training
purposes. We were able to retrieve and
review [redacted] call with customer service.
We were able to confirm that [redacted] was made fully aware of our
cancellation policy and charge back fee. The South Beach Diet program is a portion-controlled,
reduced-calorie comprehensive weight loss program. As with any other weight loss program, South
Beach Diet recommends that customers consult their physician before beginning
the South Beach Diet program, as changing diet or exercise, or losing weight,
may affect some medical conditions and medications.Due to the perishable nature of our products, returns and
