I am rejecting this response because: I did not like the service or food and called South Beach ###-###-#### to cancel orderWhen I first ordered/discuss diet plans on the phone I was offered several discounts to purchaseI said ok after several offersI was directed to go online by customer service agent to place order which I did while on phoneThe Company is tricking people to go online and has unethically practices by sending callers to their website when calling in to place a diet plan orderThis company lies and has unethically practicesI did not authorize them for this and they know itAll of the people need to know these gimmicks, IE Then if you cancel order they for any reason, they tried to charge you for unauthorized amountsSouth Beach deliberately sends all customers that call South Beach on ###-###-#### so to trap and mislead them into this type of incident which is under handed and unethicalRegards,

the electronic transaction for credit card authorization was attempted as noted
below:On October 2, 2017, *** *** received an email notice to
make changes to her second auto-delivery shipment of food. On October 11, 2017, *** *** received an
email that her second auto-delivery shipment could not be processed as the
credit card authorization failed as result of a Payment tech problem. On October 11, 2017, we also received an
email to cancel, for which South Beach Diet replied, on October 12, 2017, to
call in to cancel your auto-delivery program.
As previously provided, we ask that our customers contact us
by phone to cancel so that we may i) understand the reason for cancellation;
ii) learn if there is anything we need to do to improve our program; and iii)
find if we may assist with the continuation of a customer’s weight loss

I am rejecting this response because South Beach diet.com has not yet adequately acknowledged the aspects of my complaintMy points are not being acknowledged and addressed to my satisfactionOnce again, I have two major points
Devious nature of website: I do not dispute that their billing information appears somewhereMy argument is that it is deliberately placed in a way that it is very easy to miss, and many people do miss it
*Select Your options Screen: In very small print, it reads "auto-Delivery" about halfway down the screenHowever, you must to click on it in order to learn about the cancellation feeThis is NOT conspicuous
*Submit My Order screen: The paragraph about auto delivery and the cancellation fee is again in very small print - AND you must scroll down the page in order to see it (which you can't tell from their screenshot)My argument again is that this information is deliberately placed in such a way that South Beach counts on the fact that many customers will miss itWhy isn't this important paragraph higher on the page - maybe ABOVE the submit button - and in larger font? Customers easily get on the hook for $if they are not satisfied with the product--which leads me to my second point
As I indicated in my last response, I was not satisfied with the productDoes South Beach take any responsibility for sending me many bars that are stale? I should get a refundPlease see my last response about the food, because my points are largely being ignored
At a minimum, I would like South Beach to refund me the $People do not like to feel ripped-off, and that is exactly what South Beach has made me feel--along with many othersI am again including the numerous customer complaints taken directly off of Facebook, word-for-word

in my office on April 24, 2017.On January 15, 2017, [redacted] purchased the South Beach Diet®
auto-delivery program at www.southbeachdiet.com.  [redacted] received his first shipment of
food on...

February 2, 2017.   On February
20, 2017, [redacted] received an email to make changes to his order.  This same date, [redacted] delayed his auto-delivery
program from February 24, 2017 to April 21, 2017.Thereafter, [redacted] received an email request to make
changes to his second order on April 17, 2017, followed by an order
confirmation on April 20, 2017.  [redacted] received a shipment notification on April 21, 2017, and his order was
delivered on April 22, 2017.   On April
23, 2017, [redacted] contacted our customer call center to cancel his
auto-delivery program.[redacted] has expressed his dismay at the alleged number of
failed attempts to contact our customer service call center.   Although all attempts are made to have
adequate coverage in our customer call center, there are peak hours whereby our
customers may experience a longer waiting period.  All calls are answered in the order for which
they are received.We apologize for any confusion caused.  Please be advised that a customer service
representative has been in contact with [redacted].  [redacted] has been issued a refund for this
second shipment of food in the amount of $324.00.  [redacted] should see the credit applied to
his account within 5-7 business days.We wish [redacted] continued success with his weight loss

food on January 15, 2018.  On this day,

auto-delivery shipment of food from January 30, 2018 to February 6, 2018.  [redacted] again contacted our customer
call center on January 22, 2018 to cancel her auto-delivery program.Since all calls are recorded for quality assurance and
training purposes, [redacted]’s cancellation was reviewed.  It was noted that during this call, [redacted] mentioned that some of her food items did not appear to be frozen.  Our customer service representative offered
to send replacement items, but [redacted] declined.  As provided on the attached and in accordance with our terms
and conditions, if a customer cancels prior to paying for a second consecutive
order, customers authorize us to charge the $125 debit card or credit card on
file for the $125 chargeback fee, which

I am rejecting this response because:SBD advertised the program for 9.89 a day, which comes to a total of 276.00 that is the advertised price as If I did not click off I was offered a 50.00 coupon to receive an additional 50.00 off the 276.00 advertised price, when I called, SBD answer to me was “Well we already gave you 45% off” I said “What do you mean” their answer was “Well its really worth over 500.00 so you got a discount already” It was such scam, they offered me 50.00 they should take 50.00 off their advertised price not come back after the fact and say “Oh well its really worth over 500.00” that is so ridicules. They are false advertising, and leading people to believe if they give it a try they will take the 50.00 off at check out. That never happened.It’s the same thing as me walking into a store with a coupon, and then that store telling me “Well it was already marked down so although we said we would give you this much off we are not going to honor it anymore” It’s wrong and its principle. How dare they do that to me. (There products are NOT worth nowhere near what they claim, I would know)   [redacted] [redacted]

I am rejecting this response because:They failed to put in the letter that I went online on April 11 and delayed the auto ship and received a successful confirmation email. The next day I received an email that my order was shipped after I received a successful confirmation email that it was delayed. If it was not successful or outside of certain guidelines then I should have received An error message or some kind of notification.

As previously provided, [redacted]’s auto-delivery program was cancelled on August 24, 2017.  [redacted] will receive no further shipments of food. The South Beach Diet® is a flexible, easy-to-follow plan which provides five days of fully prepared fresh-frozen and ready-to-go meals each week.  Two days a week are considered “practice” days, whereby customers practice the principles of the South Beach Diet, and may try our recipes with additional servings of lean protein, healthy fats and non-starchy vegetables.  Since weight loss varies with individuals, including starting weight and adherence to the program, we do not guarantee weight loss results.  We guarantee satisfaction for any reason.  In response to [redacted]’s dissatisfaction that the food does not appear as pictured on its containers, please be advised that South Beach Diet® products are cooked according to package directions and subsequently photographed from the box contents.  The pictures are not super imposed.  We make every effort to provide a true representation of each product enclosed in each box.  When shooting the product, there are several samples of the same dish that are prepared and photographed.
