T-Mobile records reflect that on March 29, 2012, Ms*** activated the her T-Mobile account. In addition, Ms*** was subscribed to T-Mobile’s Simple Choice Value Talk, Text and Data rate plan for $per month with mobile number ending 8282. Also, the account had an unlimited data and gigabytes (“GB”) hotspot feature for $per month, the JUMP! (Insurance and Warranty) feature for $per month, and our Name ID feature for $per month. On March 27, 2015, Ms*** qualified for and took advantage of our Equipment Installment Plan (“EIP”) with the purchase of one Samsung Galaxy Note handset. Ms*** remitted a down payment totaling $and agreed to monthly installments of $ T-Mobile records confirm that on September 3, 2015, the account was suspended for non-payment. Following, on September 27, 2015, the account was cancelled due to non-payment. Please note that any time an account carries a past due balance, it is subject to suspension and/or cancelation. When the account was canceled, the remaining EIP balance of $was accelerated and posted to the final billing statement dated October 10, 2015. It is T-Mobile's position that the remaining EIP balance is valid and owed. A breakdown of Ms***’ last four billing statements is as follows: The billing statement dated August 10, 2015, had a balance of $which included past due charges of $for the prior billing statement dated July 10, 2015, monthly recurring charges, features, EIP charge, late fees, applicable taxes and fees billed from July 10, 2015, through August 9, 2015. T-Mobile provided Ms*** multiple notices that the account was in a past due status. These notices were provided in the monthly invoice, through text messages, calls from our Financial Care team requesting payment. Please be advised that as payment was not remitted for the final balance of $988.34, on November 7, 2015, the account was assigned to AmSher, a third-party collection agency, for the collection of the outstanding balance. It is important to mention that the account was transferred to multiple third-party collection agencies attempting to collect the balance. On May 22, 2017, while the account was assigned to Diversified Consultants Inc., an additional third-party collection agency, Ms*** remitted payment of $through Diversified Consultants Inc. Following, on July 24, 2017, after the account was assigned to Receivables Performance Mgmt., Ms*** remitted payment of $through Receivables Performance Mgmt.
