Thank you for the opportunity to respond to this member concern.  Our company owned the Gold's Gym and we did have a Name change only to Max Fitness.   No other terms or conditions changed.  After a full review of this members account we have terminated...

the account with no balance due and we have also voided the 30 day notice.  It is the members responsibility to notify us after thirty days of being billed of any problems with the account.  We advise members to always check their automatic deductions to be sure they are accurate and have been approved each month.  Members must take responsibility for not checking automatic deductions in two years.  In todays world this is very important.   All of our agreements have an automatic renewal clause that tells the member they must advise us in writing within 30 days of wanting to terminate the agreement.  Member stated that a representative told him if he didn't use the facility he would not be charged but that is not what the agreement says. We apologize for any miscommunication between our member and employees.  Its always best to go back and look and see what you signed originally.  The system does not know if the member is active or not.   We have to terminate the billing in order to stop deductions.  I hope this member will be satisfied with this outcome.  Thank you so much.  Customer Service - Max Fitness

I was a member of the Columbus, GA location Max Fitness. I signed up in September 2015. When I spoke with the representative about getting a membership, I told her I wanted the month-to-month contract because I am a college student that will not be traveling 45 miles to Columbus, GA after May 2016. She ensured me that it was on a month to month basis. The representative seemed to be unsure of what she was doing and confused herself multiple times. She was new and had just started at Max Fitness from another gym. I stated multiple times I needed a month-to-month membership. I spoke with a representative in the gym about canceling my membership. They explained that all I needed to do was go online and submit my request and it will cancel my membership after 30 days. I submitted my cancelation request. I then received an email stating that I need to pay and this was well after my 30 day request was up. I called The woman in charge of cancelation and she told me that I was signed up for a one year contract and my request to cancel would not come into effect until September (although they didn't think it was a good idea to notify me of this, instead just charge my account when I was under the impression my request had gone through). I explained to her, as I did the representative that I requested a month to month. She stated she couldn't do anything about it and I am required to pay almost $200 to finish out my one year contract. This is not the first issue I have had with the billing department as I have had a personal training membership with them that I canceled back in December. I had many people explain to me that Max Fitness would do things like this and to not join their gym, which I should have listened to. I have been so disappointed in the facility and even more in the poor management and lack of training in the membership department. On more than one occasion I have had the actual employees complain about the management. There is a wide disconnect between the departments and now I have to suffer by trying to find the money to pay my membership off all because an employee lacked the training and entered me into a one year contract instead of a month-to-month that I requested and stated multiple times. I will make sure that anyone I know that attempts to join Max Fitness is made aware of all issues and disconnects that this company cannot seem to handle.
