PACE FINANCIAL IS USING A 3RD PARTY SYSTEM THAT
ONLY SHOWS AMOUNTS THEY ENTER FOR YOUR TO PAY AND THEY ARE NOT ENTERING IN LATE FEES UNTIL OVER A YEAR
I CONTACTED THIS UNPROFESSIONAL FINANCE COMPANY BECAUSE I WAS PAYING A CAR NOTE FOR A VEHICLE I HAD FINANCED THROUGH THEM AND IN JANUARY 2017 THEY SHOWED AN EXTRA AMOUNT OWED AFTER THE FULL BILL WAS PAID FOR THAT MONTH. HOWEVER, I HAD PAID ALL OF WHAT SHOWED OWED FOR EACH MONTH AND IT NEVER STATED ANY AMOUNT OTHER THAN 0.00 OWED WHEN I PAID. THIS WAS FOR AN ENTIRE YEAR. I SPEAK WITH THEM AND SOME RUDE LADY WAS ON THE PHONE AND I HAD TO RELEASE THE CALL.

IN FEBRUARY I CONTACTED THEM TO INFORM THEM AGAIN BEFORE PAYING THAT MONTHS BILL. I ASKED THEM TO SEND ME A STATEMENT. THEY SAID THEY DO NOT SEDN OUT STATEMENTS. I INFORMED THE REP ON THE PHONE THE SAME SITUATION AND SHE STATED THAT IT WAS FOR LATE FEE BACKDATED STARTING A YEAR AGO. YET NO ONE HAS NOTIFIED ME OF ANY FEES ASSOCIATED WITH IT NOR HAD THE 3RD PARTY COMPANY,*** THEY USE ON THE WEBSITE WWW.PACEFINANCE.COM ENTERED THE FEES SO THAT I COULD SEE AN EXTRA AMOUNT THAT WOULD PROMPT ME TO CALL BEFORE A YEAR LATER.

I CALLED PAYMENT VISION AND WAS INFORMED THAT THEY HAVE TO MANUALLY ENTER INTO THEIR SYSTEM. MEANING NOT ONLY DID THEY NOT SEND A STATEMENT BUT ALSO THEY DID NOT NOTIFY ME OF ANY LATE FEES AND BY LAW YOU ARE SUPPOSE TO AND YOUR ARE SUPPOSE TO WAY BEFORE A YEAR LATER. THIS COMPANY IS UNCOOPERATIVE IN TAKING THE LATE FEES OFF DUE TO THEIR FAULT. AND THEY DO NOT SEND STATEMENTS AND THEY REFUSE TO SHOW ME THEIR SCREEN WITH PAYMENT VISION WHERE THEY ACTUALLY ENTERED THE FEES BEFORE JANUARY OF 2017. THEY SENT A LETTER AND STATED I NEED TO SHOW THEM SCREENSHOTS OF IT SHOWING O, YET THE *** CAN NOT GIVE ME THE INFORMATION. SO THIS COMPANY IS BASICALLY UNPROFESSIONAL, VIOLATES THE LAW WITH NO REGARD AND BOTTOM LINE THEY ARE NOT GETTING THEIR LATE FEES UNTIL THEY SHOW ME THEY COMPLIED WITH LAW. SHOW ME THE SCREENSHOT THAT YOU ENTERED THE LATE FEES IN THE MONTH INCURRED ON*** OR HAVE*** GIVE IT TO THEM. I WILL SUING THIS COMPANY IF THEY DO NOT SHOW ME THEY ENTERED THESE LATE FEES IN AND COMING BACK A YEAR LATER ONLY AFTER I CALL TO INQUIRE TO FIND OUT I HAVE LATE FEES FROM A YEAR AGO JUST NOW ADDED. TAKE YOUR LATE FEES OFF OR GET SUED. THEY DO NOT SEND STATEMENTS OR EMAIL NOTIFICATION OF BILL STATEMENT, BILL DUE, LATE FEE DUE, ETC OR EVEN NOTATE THE DESCRIPTION OF THE FEES WHEN AN EXTRA AMOUNT DID SHOW UP A YEAR OR EVEN. VERY UNPROFESSIONAL. DO NOT DO BUSINESS WITH THEM.

PLUS THEY CALL ALL YOUR REFERENCES DAYS BEFORE THE BILL IS EVEN DUE WHICH MAKES NO SENSE BECAUSE THAT IS ALSO BREAKING THE LAW BECAUSE THEY ARE CALLING TO COLLECT A DEBT THAT IS NOT EVEN DUE.

Desired Outcome

TAKE THE LATE FEES OFF OR SHOW ME THEIR 3RD PARTY PAYMENT PROCESSORS INFORMATION ON MY ACCOUNT THAT SHOWS THEY ACTUALLY ENTERED THEM IN ON THE *** TO PROVE THEY DID NOT WAIT UNTIL AN ENTIRE YEAR TO ADD THE FEES. AND SYSTEM BEING UPDATED IS NOT AN ANSWER.

Pace Financial Response

Pace Financial, LLC ("Pace") disputes the correctness of Mr.' factual and legal assertions. While it is true that Pace utilizes an online payment vendor, Mr. fails to note that he is in possession of two months' worth of screenshots from that payment vendor wherein his past due balances are reflected. In point of fact, a consumer information file ("CIF") is transmitted at midnight to the third-party payment vendor. That CIF file contains all account information, including payments and assessments of charges (such as, late charges or NSF check fees). Mr.' assertion that charges are somehow manually input into the payment processing vendor's displays or records is wrong.

While it is true that Pace does not send monthly statements, nor is Pace required to do so, as soon as a Pace customer fails to make payment by the contractual due date, Pace attempts to contact the customer to help them think of ways to make payment and likewise confirm that the Contract provides that failure to pay within 10 days of the due date results in a late charge. Pace makes no telephone calls to any customer until they are one day past their contractual due date. Pace only contacts the references listed by a customer when the customer fails to respond to Pace's telephone calls. Pace calls to references are made exclusively in order to confirm Pace customer's contact information is correct or to request contact information or whether the reference can ask the customer to call Pace.

Pace previously provided Mr. with a complete and detailed listing of his various failures to timely fulfill his obligations under the retail installment sales contract ("Contract"). Mr. signed and was given a copy of the Contract and the Contract specifically provides a date by which payments are due and further specifies that a late charge will be assessed against the account if payment is not made within 10 days of the due date. That detailed accounting is the sum and substance of the information that is transmitted to the third-party payment vendor and credit reporting agencies. Because a customer is entitled to understand their account, if a written request is made for validation, it is provided. Pace asked Mr. to provide some support or proof indicating that the payment vendor screen failed to display his late charges, but instead of providing that proof or acknowledging his repeated late payments properly resulted in late charges, Mr. seeks to distract the conversation through threats of legal reprisals and mischaracterization. Pace believes that it acted appropriately with respect to Mr. concerns.

Customer Response

(The consumer indicated he/she DID NOT accept the response from the business.)
This company is a blatan lie. They know well the thrid party vendor they use, *** require them to input the late fee assessed. And if they do not input it there and with no statements, they know VERY well there is no other way of seeing any extra fees. No extra amount showed up that did not total the actual payments x 2 and this would only be when another month rolled over and you were paying outside the date they input the nexts months payment to the third party vendor. Also I never told them I kept screenshots specifically showing anything. I told them I believe I could show them a screenshot with NO extra amount attached to a monthly payment since they claim this was from a year ago when a late fee was assessed. It is not my duty to keep screenshot by any contract. So that point is moot. Also they do call one day before the due date because I have my call log to prove it. If this is needed. I will go into my contact to show they have done this on numerous of occasions and called others. As well this has nothing to do with them calling. That will address in another case if necessary. This is about the blatan unprofrofession alism of inputting data from an account 1 year later and attaching fees on in Jan 2017 instead of upfront. The complaint is on them, so if they are using a third party vendor then please show their screenshot of them inputting the late fee assessed for months they saying I paid after the due date. Also they sent an email stating this and stated they waived my April late fee yet fees arent suppose to occur until after the 10th. I paid on the 4th. So this company is well over stating their mishaps and needs to be marked and flagged as a company not to do business with because they seem to think it is ok to hold late fees out a year and not ask about them even when speaking to the customer. Why did they not notate the account that they told me about the late when they spoke to me. I have no need to prove anything other than to make my complaint and let other customers see this so they be aware to stay away from this company. No April late was waived. They choose not to waive any late fees they entered in after a year ago because they know they are wrong and unprofessional. So show your proof that you entered into your 3rd party payment processor any late fee since Jan 2016 without any fraudalent edit to any screens and I agree to pay all fee per the contract. And also provide where a late fee should have been assessed in April since you are saying you waived it.

This company will likely choose to only response in depth about the later request since they know they can not prove they entered into their payment processor any late fees, at least not until Jan 2017. Totally unprofessional AND if they can not show this then you need be waiving all fees you did not enter before a year later. Im not giving them a dollar until they prove. they will get what I pay every month which is the amount of the bill which I never recieve anyway but im paying it every single month. Yet they decide to wait a year later to input this late fee into their third payment processor. So it sounds like they are trying to throw this on their 3rd party vendor so they have no resposibility to be upheld to the same standard as professional finance companies are. Show their proof that I requested above and I wil pay the fees today. Show proof from your 3rd party vendor that you input late fees into their system. And show where you waived a late that couldnt have been assessed in April since I did not pay past the 10th. And also if you can not show proof you entered it in so I could see the extra amount like on the screenshot for this month taken today (attached) then how is a customer suppose to know when anything occurred in real time accept whenever they input it for the customer to see? see attachment. this is how their screen looks. In the one titled pace 6 you see that unless they input it, their is no way of knowing it is there if it states 0. they are asking me to send screenshots of past things that I can not go back and see because that is their only way of getting out of putting lates fees into a system a year later. Also even when they attached the fees you still dont know what it is because it DOES NOT STATE IT as they said it does (attachemnt title PACE). and look in their email where they contradicted themselves saying they waived the fee for April then state that no fees are assessed unilt after the grace period of the 10th yet I paid on the 4th of April.

IM SURE THIS WILL PROVE MY POINT TO BE AWARE OF THIS COMPANY AND NOT DEAL WITH THEM SINCE IM SURE THEY WILL GET AROUND SHOWING PROOF BY SAYING THE LAWYERS SAID THIS OR THAT OR SAYING THE CONTRACT STATES THIS. THIS IS ABOUT PROFESSIONALISM AND FAULT. OK I PAID LATE BUT YOU ALSO DID NOT SHOW ANY FEES UNTIL A YEAR LATER.

Pace Financial Response

Pace Financial, LLC ("Pace") constantly seeks to improve its processes while assisting customers achieve their goal of debt-free vehicle ownership. However, Mr.' unwillingness to address his concerns without threats or name-calling significantly undermine these goals and the Revdex.com's purpose. His rebuttal correspondence makes plain that he is less interested in understanding and resolving issues than he is in creating a negative (and unsupported and unwarranted) impression about Pace.

As noted in its initial correspondence, Mr. has regularly been past due and has incurred numerous late fees as a result. Pace has no objective indication that the account history data, provided to Mr. and the third-party payment processor, was incorrectly displayed on the third-party payment processor's systems or the Pace website. In response to Mr. concerns, Pace repeatedly tested its website and payment processor's screens in attempt to replicate Mr.' complaint that his past due balances (arising, primarily, from late fees) did not display for some period of time. In every instance, the past due amounts showed on the payment screen, as expected. Pace also made multiple inquiries with its online payment processor.

As indicated in the attached correspondence from the third party payment processing company (contrary to Mr.' assertion), Pace does not manually input account information into the payment system absent extraordinary circumstances and their records do not reflect a manual entry of information as to Mr.. Pace is not attempting to shift the burden of proving whether an error existed in its payment screens, but is rather asking for some objective information that its' automated systems failed to properly display account balances. The screenshots provided by Mr. show that the payment system correctly included his past due balances. Similarly, if Mr. can provide the call logs he claims will show that Pace called before he was one day past due, Pace will meet with offending employees to provide additional training to ensure that Pace's policies are more closely followed. If Pace is wrong, it will correct its errors. However, there is nothing other than Mr.' (apparently mistaken) memory to indicate that Pace made an error with respect to this account.
