Re: Plan XXXXXXXX
Dear Ms***,
Regarding the service request for the air conditioner and the cash settlement; I have reviewed the file that indicates two different Independent Network Service Providers
diagnosed that the existing 3-ton air conditioner is approximately years old, and failed as the result of being undersized for the square footage of the homeBoth companies recommend a 4-ton system
However, based on the age of the equipment, and strictly as a matter of goodwill, Old Republic Home Protection agreed to provide Mr*** a cash settlement of $2,390.50, which represents our cost to replace the existing 3-ton condenser and air handler
According to the file, the checks totaling $2,were mailed to Mr*** on August 12,
Please note that if the repair had been covered by the Plan, the terms and conditions do not cover to upgrade a system
Please refer to page of the Plan that states:
"General LimitationsThis Plan does not cover:
ASystem or appliance repairs, replacements or upgrades required as a result of:
A malfunction due to lack of capacity of the existing system or appliance
General Exclusions:
BExcept where noted, we do not pay for upgrades "
If Mr*** has any additional information he believes should be considered, please advise him to provide it to me for review
Sincerely,

(The consumer indicated he/she DID NOT accept the response from the business.)
It wasn't the size of the air conditioner unit that made the compressor go outThe second technician that came out hook the fan motor up the wrong way and that's essentially what made the compressor go outThe $2,was a payoff to keep me quiet, it wasn't a good faith checkBecause it first they weren't going to do anything for me until I stated that the technician that came out second hook the fan motor up the wrong wayOld Republic technician is responsible for my ac unit going outEven though they sent me a check for the balance of $2,390, I have never cash the check because on the pay stub it states that when check is cashed that it relinquishes Old Republic from any liabilitiesI completely believe that old republic and their technicians are responsible for the compressor going out in my a/CThey hired the technician he hook the fan motor up the wrong way that made my compressor go out in my a/C, and now they don't want to take care of the problemI would like for them to pay for the new air conditioner so we can solve this problem because if nothing is done here further legal actions will be takenSincerely *** S,***
Final Business Response /* (4000, 9, 2015/09/24) */
Dear Ms***,
Regarding the failure of the compressor; please advise Mr*** that I have been advised by Service Providers that mis-wiring a fan motor will not cause the failure of the compressor located inside the condenser
We have provided Mr*** a cash settlement of $2,representing what our cost would be to replace his 3-ton air conditioner in accordance with the terms and conditions of the PlanPlease refer Mr*** to page of the Plan that states:
"We reserve the right to provide CASH IN LIEU of repair or replacement in the amount of our
actual costPayment will be provided based on our negotiated rates with our Service Provider
and/or Supplier network, which *** be less than retail."
Again, we apologize that the terms and conditions of the Plan do not cover the cost to upgrade his air conditioning system, as stated on page of the Plan under Limitations of Liability

Dear Ms***,
Regarding the service request for the heat pump, and payment of the Trade Call Fee; I have reviewed the file that indicated on November 14, 2015, Ms*** requested service for
her heat pump not operating properlyOld Republic Home Protection (ORHP) dispatched Pride Home Repair, and their technician diagnosed that the heat pump had no mechanical malfunction, and required cleaning
Please refer to page of the Plan that states:
"GENERAL LIMITATIONSTHIS PLAN DOES NOT COVER:
BRoutine maintenance or cleaning."
With regard to payment of the Trade Call Fee; please refer to page of the Plan that states:
"You are responsible to pay a TRADE (SERVICE) CALL FEE (TCF) when the Service
Provider arrives at your homeThe TCF (or the actual cost of service, whichever is less)
is due for each dispatched service request by trade (plumbing, electrical, appliance,
heating/air conditioning, etc.)Service work is guaranteed for daysThe TCF is due
whether service is covered or deniedEssentially, when we incur a cost of service, you
are responsible for a TCF."
Please extend our apologies to Ms*** that the terms and conditions of the Plan did not provide coverage in this situationWhile the intent of ORHP is to provide as much coverage as possible, the Plan is not all inclusive and there are limitations which are standard in the home warranty industry
If Ms*** has any further needs for service, please advise her to contact us at XXX-XXX-XXXX for assistance

I did not request service for a heat pumpI explained to the lady on the phone that smoke or steam was coming up from my unit and asked if that was coveredThe lady said it was.She put in whatever request it wasThe repairman said "I hate to tell you but this is completely normalIt is in defrost mode"The lady who answered the call should be educated enough to know that that was a process before scheduling an appointmentThey seem to have people answering the phones that have no knowledge of what they are doingPerhaps if they are going to have someone answering calls and making appointments they should actually have knowledge of heating and air, plumbing, or whatever the nature of the call might be.They just send someone so they get a trade fee for nothingI have since ripped the policy up and will not ever use this service againI have no knowledge of heating and air but do expect the people who work for this company and answers their phones to have knowledge so that I can be helped not ripped off
Final Business Response /* (4000, 9, 2015/11/20) */
Ms***,
Please advise Ms*** our Customer Service Department representatives are not technicians and are not trained to diagnose repairs on the phone when a Plan Holder calls to place a service requestOld Republic Home Protection (ORHP) relies on the diagnosis from an Independent Network Service Provide to determine coverage
That said, I understand Ms*** frustration having to pay the Trade Call Fee (TCF), and as a gesture of goodwill, ORHP will refund the TCF for this service requestMs*** should receive the check within days
Please inform Ms*** that in the future when she places a request for service, the TCF will need to be paid whether the service is covered or denied

Obviously your company has no care as to what the letter statesI had the work doneIt cost me far too much for an air conditioner to be installedOld republic was to be responsible for the cost of the unit, and the laborI was charged for ridiculous charges at outrageous ratesI was not allowed to have quotes from other companiesthey made me use this companythey spent less then hours to install this unitmy portion was $after I worked with the technician and did all of the labor to remove the unitas well as I put a new pad down for the new unitI also leveled itOld republic pays the technician $to do the workno matter what the cost really is. The tech must then charge ridiculous rates for "mods" to the systemThis is the only way he can afford to work for old republicI was charged $for duct work modificationThis was Pieces of duct work that were about 20" in lengththen zap screwed to the units and taped upit took them possibly minI would think that to install a new unit the labor to make the unit work is labornot "mods" This is just Old republics way to not pay what they are supposed to payThey do not care about their customersand after many many many calls to them I was not even given good serviceI contacted the Revdex.com and sorry is their only responseIf your Sorry pay the bill that you should have

Dear *** ***,
As referenced in our previous response; the coverage decision was based on the information noted on the invoice from the Out-Of-Network Contractor (OONC) that indicated that the replacement of the compressor was a viable option to repair the air conditionerIn addition, after we received and reviewed the invoice on August 19, 2016, *** *** was given the option to allow us to dispatch a network Service Provider to provide an estimate for the repair, or she could move forward with using the OONC and we would reimbursed her our cost for the compressor replacementAccording to the file, she chose to use the OONC, and was advised we would process reimbursement based on our cost for the compressor replacement

Initial Consumer Rebuttal /* (3000, 8, 2016/03/22) */
(The consumer indicated he/she DID NOT accept the response from the business.)
Old Republic was negligent in its hiring of contractorsIf Old Republic had taken the time to properly interview and screen its contractors, contractors would not have come to my home without the proper equipment to test for Carbon Monoxide
For the record, if it was for ME testing for Carbon Monoxide detector, the Carbon Monoxide would NEVER have been discoveredSince each contractor did not have Carbon Monoxide equipment, neither of them tested for it
Again, Old Republic is negligent in it hiring of contractorsIf I did not have carbon monoxide equipment, my family would have been further exposed to Carbon Monoxide
Old Republic must be held accountable for hiring negligent contractors
I provide the following information to *** *** via email on Tuesday, March, 22, 2016, via email
Mr***,
My wife and I understand your defense that you cannot be held accountable for "negligence" of the work or lack of work by your contractors, I believe you are missing the point we are trying to make
We are making the point that Old Republic was negligent in its HIRING of contractorsTwo (2) contractors you sent to my home were not equipped with ANY carbon monoxide equipmentDue to you hiring contractors who did not have sufficient equipment, my family was exposed to carbon monoxide for a longer period than neededSending contractors within a week period who both did not have proper equipment shows a pattern that Old Republic was negligent in its hiring of contractors
For the record, I am the one who found the carbon monoxide leak with MY carbon monoxide detectorIf not for my diligence and quick thinking, we would not have been able to find the carbon monoxide leak
My wife and I are willing to drop both complaints if we can come to some form of addition financial compensationDue to our previous letter, and the aforementioned information, a $credit does not merit enough of a "gesture of goodwill."
If you want to arrange a phone call, please let me know
Thanks and I look forward to hearing from you

As stated before, my wife and I are making the point Old Republic was negligent in its HIRING of contractorsTwo (2) contractors sent to my home were not equipped with ANY carbon monoxide equipment
Due to Old Republic hiring contractors who did not have sufficient equipment, my family was exposed to carbon monoxide for a longer period than neededSending contractors within a week period who both did not have proper equipment shows a pattern that Old Republic was negligent in its HIRING of contractors
For the record, I am the one who found the carbon monoxide leak with MY carbon monoxide detectorIf not for my diligence and quick thinking, we would not have been able to find the carbon monoxide leakIf I had not found the leak, no service on our heater would have been done
Old Republic's offer of a "gesture of goodwill" for $is insulting and does not show they want to take any responsibility for their hiring practices
Old Republic's defense that they cannot be held liable for a contractor's negligent in service provided does not apply to our complaintAs stated previously, we are talking about negligent hiring practices by Old Republic
