I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.
Regards,
[redacted] P.S. It it Very Hard to make payments! Plus they charge $14-99 for every monthy payments!
Five Star Bank prides itself in building strong and enduring relationships with our customers by providing excellent service and
delivering valued products. Your letter to
the Revdex.com has been referred to me for a response. I would like
to take this opportunity to clarify the...
recent events. Five Star Bank attempted to contact you on
several occasions throughout December of 2017, due to a payment that was returned for
insufficient funds on 12/13/2017. At the time Five Star Bank received notice
that your payment was returned, your loan was past due for November and
December. On 12/21/17, we assigned the
matter to our repossession agent, as it is Five Star Bank's practice to
assign a vehicle for repossession when the customer is two payments past due unless other arrangements have been made. Here too, our agent made several attempts to contact you without success. On 12/26/17, we did receive a payment which satisfied the November installment; however, the loan remained past due. Due to the delinquent status, the repossession action
continued. When the agents could not reach you, or locate our collateral after
30 days, Five Star Bank filed a claim with our insurance carrier, at which time, the insurance carrier takes over the claim. Once a matter is referred
to our insurance carrier, resolution can only be settled in one of two ways: surrender of the vehicle, or full payment of the loan balance. Five Star Bank is consistent
in this practice and our practice for resolution was explained to you in your
conversation with our collector on 2/5/2018. In that conversation, you indicated that you were going to your bank on 2/6/2019 to attempt to secure a loan to pay off Five Star Bank. Please advise us of your intention to
either immediately surrender the vehicle or remit payment for the balance in
full. In the interim, our insurance
carrier will continue their efforts.

Five Star Bank proceeded to send the same statement as the previous one I obtained from the bank. Without explanation of "fees and charges" They will itemize these charges and give explanation of why there is a principal of $405.00 left when the loan was paid on time. Thank you [redacted]

Your letter to the Revdex.com
has been referred to me for a response. I would like to take this opportunity to
provide you with a brief history and a summary of events. Your loan was originated on 8/16/2013 and...
the history indicates a number of delinquencies as follows: 1-29 days past due 14 times; 30-59days past due 5 times; and 60-89 days past due 2 times. As a result
of delinquency, a repossession occurred on 7/5/17. At that time, you reinstated
payments and redeemed the vehicle. Notes on the loan reveal that we attempted
to contact you on numerous occasions without success and the last telephone
conversation with you occurred on 10/5/2017. Subsequent
delinquency occurred, and the vehicle was again repossessed on 12/7/2017. It is our consistent practice to adhere to
all of the terms and conditions as set forth in our New York State contract. I will refer you to the enclosed copy of the contract which you executed
on 8/ 6/2013. The Security Agreement which can be found on the back
of the contract, clearly states our rights in cases of default. The repossession agent representing our bank in this matter is keenly aware of requirements with regard to the recovery of
vehicles and has experience in Vermont repossessions. The plates were
surrendered and a police report was completed as required. In reviewing the condition report that was forwarded to our bank, the repossession did not cause any apparent damage to the vehicle. As indicated in our "Notice of Our Plan
to Sell Property, Notice of Right
to Reinstate and Right to Redeem" letter, dated 12/8/2017, you were advised the name of the
repossession agent, and of your right to claim any personal property. In
addition, you were advised of the amounts necessary to redeem your
vehicle. Please note that the letter
indicates the bank intends to sell the vehicle at the expiration of 15 days from the date of the notice is the
vehicle is not redeemed. In conclusion,
your interactions with staff has been reviewed to ensure they have occurred in accordance with policies, procedures and standards. If you have any further questions in this matter, please contact me
directly. Sincerely, Mary D. Vice President and Collection Manager
I've attached the authorization for release of information above with the bank statement.

Your letter to the Revdex.com has
been referred to me for a response. To
explain the course of events mentioned
in your letter, I'd like to provide
you with a summary. On December 13, 2017 , a payment in the amount of $485.56 was posted to your
account which...
satisfied your
payment due on November 14, 2017. On December 28, 2017, we received a request to reverse an electronic payment in the amount of $485.56
that had been previously made on August 28, 2017 . The request indicated that this was an unauthorized transaction. In
response to the request, we reversed the payment on January 4, 2019. This reversal set your due date back to November . At that time, and as a result of
the reversal , the account became
past due and owing for the November and December payments. After several
attempted phone calls to you proved unsuccessful, the delinquency resulted in the repossession of your
vehicle on January 12, 2018. Through research conducted by our payment
servicer and the Treasury, we learned
that [redacted] Bank did not credit your checking account because their automated
system denied your dispute request . [redacted] Bank has since admitted that the issue was on
their end. To resolve the matter, [redacted] Bank will
process a manual credit to Five Star Bank and upon receipt, Five Star Bank will
mail you a check in the amount of $485.56. As of this date, Five Star Bank is
awaiting receipt of the funds from [redacted] Bank. I trust this will serve to explain that Five Star Bank was not the cause of the issue and that we
immediately responded to your complaint with research conducted with our
servicer, the Treasury, and [redacted] Bank. Unfortunately, the issue did result in a legitimate
delinquency and the repossession of your vehicle. Your account has been noted
to reflect the situation and it is our hope that this is a satisfactory resolution. Since you have redeemed your vehicle and
reinstated the account, it is important to remind you that to prevent future
delinquency the January 2018 payment has not yet been received. In conclusion, your interactions
with staff has been reviewed to ensure they have occurred in accordance with
policies, procedures and standards. If
you have any further questions in
this matter, please contact me directly. Sincerely, Ellen V. Vice Prescient and Operations Manager
